Steve,
Any changes made to an approved building permit plan and/or survey should receive pre-approval from the City before
commencing with the changes. In some instances, additional permits may be required.
In this case,the survey submitted dated 8-30-13 shows retaining walls south of the patio which were not on the
approved permit survey. As I discussed with the landscaper,John Bauman today, retaining or landscape walls not
shown on approved plans require new permits. Retaining or landscape walls under four feet require a zoning permit,
copy of the application attached. Retaining or landscape walls four feet or over require a building permit. Attached is
our information sheet on Landscape Walls and Retaining Walls.
Please have the survey reflect the top and bottom elevations for each retaining wall. Tiered walls are considered one
wall unless they are separated by twice the height of the higher wall. Separation is measured from the back of the lower
wall to the face of the upper wall. As I explained to Mr. Bauman, if the walls do not meet the separation we will require
the walls be certified by a professional engineer.
Also, please note,the property owners will not be allowed to move in (occupy) the home until the as-built survey has
been submitted and approved and we issue a certificate of occupancy.

Scott,
Thank you for the landscaping drawings and the original site plan. Unfortunately your proposed landscaping plan will
need to be resubmitted and potentially require going back to the council for approval. As we discussed on site (June 11),
you were inquiring about removing some lilac bushes close to the property line with the City's right-of-way. It wasn't
completely clear if the lilac bushes further up the hill were located on City property or not. Finally you had some
questions related to the unofficial pathway located on the City property.
As we discussed you were going to have your surveyor add the lilac locations and the pathway on either the survey or
the landscaping plan to show if the bushes were indeed on your land or not. Then I could review the survey or
landscape plan and tell you if they could be removed or not. We also discussed, if they were on the City property,we
would need to go to the City council for authorization where they would either grant the removal or deny it.
The issue I see now is your landscaping plan is vastly different than what was approved with your building permit. There
are retaining walls up to the property line (required to be 5' off the line),there are additional walls which were not
approved,there is a proposed steps coming off the patio which impact a proposed drainage swale, and these steps will
be counted as hardcover. I don't recall for certain, but I think you may be at the 25%hardcover limit from what was
approved with your variance. If that is the case,you would not be allowed to add these steps without going back to the
council for approval (another variance request).
In terms of placing some sod in the area which is currently failing down by the lake,that would be ok, but the removal of
the lilacs and a good portion of your landscaping plan was not approved with your building permit. You may want to talk
with Melanie about the process you would have to go through for your proposed landscaping plan if it is going to be
different than what was approved with the building permit.

Good Morning,
This morning City Engineer Jesse Struve performed a follow-up site visit to the property. Based on the modifications the
tiered walls are now able to be approved. The survey must shown top and bottom of wall elevations on the as-built
survey.
When Mr. Struve was on site he took picture (copy attached) of steps and a retaining wall on the east side of the
property, adjacent to the new patio, neither of which are shown on the survey dated 8-30-13. Melanie Curtis believes
the steps to be the same steps discussed by Scott Musgjerd on August 29th. Mr. Musgjerd was instructed that the steps
must be entirely removed and the area restored or the hardcover must be shown and accounted for on the hardcover
calculation sheet. The retaining wall, if remaining, and landscape area must be shown on the as-built survey. Note, if
the landscaping rock is underlain with plastic, it is considered hardcover and must also be included in the hardcover
calculation.
We will consider issuance of a temporary certificate of occupancy upon receipt of an additional escrow deposit of
$7,500 for a total of$10,000. It will be refunded when all outstanding issues are addressed and resolved.
