Defendant was found working without a permit on October 13, 1993. A stop work order was posted and the defendant was required to submit a permit application. On December 20, 1993 a permit application was submitted and on March 1, 1994 a review was completed. The proposed deck was found to be encroaching the average lakeshore setback. A letter was sent to the defendant requiring him to remove the deck or apply for a variance to the zoning code. The deck remained unfuushed until recently when it was finished without approval.
