Representing Staff were Interim City Administrator Jay Kiedrowski, Assistant City Administrator for Long-Term Strategy Mike Gaffron, Planner Evelyn Turner, City Engineer Tom Kellogg, and Recorder Jackie Young. Mayor White called the meeting to order at 7:00 p.m., followed by the Pledge of Allegiance. CONSENT AGENDA Item Nos. 4, 5, 6, 8, and 9 were added to the Consent Agenda. Item No. 7 was removed from the agenda. Murphy moved, Rahn seconded, to approve the Consent Agenda as amended and to remove Item No. 7 from the agenda. VOTE: Ayes 4, Nays 0. APPROVAL OF MINUTES *2. REGULAR CITY COUNCIL MEETING OF AUGUST 11, 2008 Murphy moved, Rahn seconded, to approve the minutes of the August 11, 2008, Orono City Council meeting as submitted. VOTE: Ayes 4, Nays 0. PLANNING COMMISSION COMMENTS – KIM KANG, REPRESENTATIVE None PUBLIC COMMENTS None ZONING ADMINISTRATOR’S REPORT *3. #08-3376 CITY OF ORONO, CORNER OF CASCO POINT ROAD AND FREDERICK STREET – CONDITIONAL USE PERMIT – RESOLUTION NO. 5764 Murphy moved, Rahn seconded, to adopt RESOLUTION NO. 5764, a Resolution Granting a Conditional Use Permit for a Permanently Installed Emergency Generator for a Sewage Lift Station per City Code Section 78-348(5). Item #02 - CC Agenda - 09/08/08 Approval of Council Minutes 08/25/08 [Page 1 of 4] MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, August 25, 2008 7:00 o’clock p.m. ___________________________________________________________________________________ PAGE 2 of 4 MAYOR/COUNCIL REPORT Bremer reported the Orono Police Commission met this week and that the attendees were given some very helpful statistics on drug use in the area, with heroin being the biggest drug on the market currently. Bremer noted the use of methamphetamines has dramatically declined. Murphy stated he received two calls today regarding the Dakota Rail Trail and the intersection of County Road 15 and Orono Orchard Road. The resident indicated he had witnessed a high-speed biker narrowly getting missed by a car taking a right-hand turn. Murphy noted one of the neighboring communities has also expressed similar concerns about this intersection and the trail. In addition, the Wayzata Chief of Police has gone on record stating that they will ticket pedestrians and bikers if they are observed not obeying the traffic signs in that area. Murphy recommended that Police Chief Farniok be apprised of the situation and be asked to contact other cities in the area to see how they are handling this situation and how it can be resolved. Bremer stated that issue was also discussed at the Police Commission meeting and that there have been representatives from Three River Parks that have sat in the area to alert pedestrians and bikers about the need to obey the traffic signs along the trail. Bremer noted Chief Farniok was in attendance at that meeting and is aware of the situation. Rahn stated in his view an electronic radar speed limit sign would be a great addition at that intersection and would help to slow traffic. Bremer commented it is also a line of sight issue. CITY ENGINEER’S REPORT Kellogg had nothing to report. CITY ADMINISTRATOR’S REPORT Mayor White noted this is the last official time that Interim City Administrator Jay Kiedrowski would be attending an Orono City Council meeting. Murphy, Bremer, and Rahn commended Kiedrowski on the outstanding job that he has performed over the past few months. Kiedrowski thanked the Orono City Council for allowing him the opportunity to work in Orono and commended the city staff for their excellent assistance. Kiedrowski noted Staff held their second leadership workshop earlier today. VOTE: Ayes 4, Nays 0. *5. APPROVAL OF CITY ADMINISTRATOR AGREEMENT Murphy moved, Rahn seconded, to approve the contract agreement as negotiated with William Wells, city administrator candidate. VOTE: Ayes 4, Nays 0. *6. REQUEST FOR PAYMENT NO. 1, 2008 OVERLAY PROJECT Murphy moved, Rahn seconded, to approve Request for Payment No. 1 for the 2008 Overlay Project to Astech Surface Technologies in the amount of $358,191.68. VOTE: Ayes 4, Nays 0. 7. REQUEST FOR PAYMENT NO. 1, 2008 SEAL COAT PROJECT Murphy moved, Rahn seconded, to remove Request for Payment No. 1 for the 2008 Seal Coat Project to Pearson Brothers, Inc., in the amount of $94,076.60, from tonight’s agenda. VOTE: Ayes 4, Nays 0. *8. CASCO POINT PROJECT – ACCEPT SOILS INVESTIGATION QUOTE Murphy moved, Rahn seconded, to accept the quote of Braun Intertec in the amount of $8,800.00 for soils investigation, to be charged to the Pavement Management Program account (435-48956), and authorize the work to be commenced. VOTE: Ayes 4, Nays 0. CITY ATTORNEY’S REPORT Mattick had nothing to report. *9. LICENSES & PERMITS CLUB FIREARM USE PERMIT 1.
