Enclosed please find a copy af an RPA which was prepared by Northwest Abstract Company pursuant to the sale of the above referenced property. According to the Torrens c>ffice, the title company has the correct legal description for the CE�rtificate referenced an.d Aruce Molumby is the fee holder. Thc: scenario as described is as follows: �iolumby has been the holder of this certificate since January 24, 1978. A mortg�ge was created on the property on [)ecember 23, 1977, and it is mp understanding that the date of the Warranty Deed from Kolstads was also that date. �iinnesota Title insured the mortgage on the entire parcel. 't'he deed to Molumby along with the mortgage were recorded with no apparent problem. ,_, 1'rte house on the property burned down, it is my understanding that happened in 1989. 3. Subsequently Molumby has sold the property on a Contract for Deed to Mark Larson Wooden Works, Inc., and Phil Otto. That closing was July 26, 1990. �. Purusant to that closing a title opinion was rendered for the purchaser, a copy enclosed, by Francis J. Eggert. When I called to determine delinquent tages, I was told by the County that 4116 Highwood not anlp had the PID cited in the RPA of 07-117-23-44-0032, but also was obligated for 07-117-23-44-0036, with the total tax on the latter amounting to �25.47. At the closing, I sent $1,032.68 to the Hennein County Treasurer for the delinquent and late taxes through and including the first half of 2990, except the smaller piece required full payment because it was under $50.00. 5. Apparently the smaller portion taxes have all been applied to the PID ending in 32, which Dennis is indicating has to be corrected by Judy Gillis who is also being copied with this letter. Dennis i� further stating that I can record the contract after October 15, 1990, providing that the intersecting parcels have had their t�es paid in full. He is sug$esting that Orono can correct the tax description without changing the tag base because the amount of land to correct is small and just "corners". Nhile I am certainly not an attorney and do not feel that I can carry t his matter any further, I have consulted my own counsel and he feels that Molumhy should be allovred ta record his document as it was a District Court Action to establish the legal description of the lands that he is conveying. It is also my understanding that other mortgages have been recorded on adjacent parcels without the same c,�ilamity that Molumby seems to be experiencing. .7e;an, as you can see, all parties are being copied this letter. I would appreciate your reviewing your rec:ords to see if you can shed some light on this without involving a ma jor legal battle and unnecessary expense for all the parties. If as Dennis suspects, the t� valuation would not change for any of the parties, perhaps the City can correct its legal to c-.onform with the legal deacriptions which have apparently been passed as correct for some time. I have no way of knowing whether the ad jacent parcels are Torrens or Abstract, but the 'Porrens process should be straight forward in the establishment of the descriptionR because of the surveys required to establish bcsundary lir�rs for r�wnership. You had further indicated that there was a process required bp the City to ad just lot lines. It appears that all the owners of the ad jacent pieces should bP notified and certainly their lenders. I am not in a position to be able to initiate that process and this letter will probably be the only active involvement that I can take other than to assist with information that I have. Williams : • At your request, I have made an examination of the Registered Property Abstract to the real estate he�einafter described, situated in the County of Heniiepin , State of Minnesota, which Registered Property Abstract contains 6 memorials, 2 exhibits and was certified to June 19 , 1990 at 7 : 00 o ' clock a.m. according to 1 certificates of various abstrac�;�ers , to which Abstract is appended searches to said date for judgrnents, old age assistance liens, federal tax liens , adjudications and certificates as to real estate taxes, current and delinquent. I�Iy examination and this Opinion assumes such Registered Property Abstract and the certificates appended thereto to be complete, true and correc-�. From such examination, I have concluded that, on the date last mentioned, the title to said real estat�� was vested in and owned by Bruce ,T. Molumby, a single person. The titles to all tracts of land i_1 the State of Minnesota are not only subject to those matters which County records and the Registered Property Abstract disclose, ;�ut are also subject to certain matters which do not appear of record a:zd/or which are not disclosed in Registered Property Abstracts and which may cause complete or partial failure of title. Principal among those matters which may not be of record and which are not disclosed by the Registered Property Abstract examined are the following : 1 . Rights , if any, of the parties in possession of said premises other than said owners , such as lessees or contract purchasers . 2 . Mechanics lien rights , if any, for recent improvements upon said premises or property connected therewith. Special assessments , if any, wi�ich may have been levied upon said premises for improvements previously made, or which may soon be levied upon said premises for improveme:zts now made or pending. Inquiry should be made at the office of the Municipal Clerk as to existing or pending assessments . 4 . Physical condition of the premises and the home or other building (s) thereon. For example, the absence of water in a base- ment at this time does not necessarily indicate that there will be none in the future. You should inquire of the owner (s) and/or the realtor (s) as to the existence of any such other problems in the past, and as to their knowledge of the �eneral condition of the premises at present. 5 . Ingress and egress or access to the premises . If the premises are unplatted and/or do not abut a public road, the premises may be accessible to and from a public road only by trespass over the land (s) of others . You should inquire of the owner (s) and/or the realtor (s) as to such matters of access . 6 . Public zoning or building ordinances and regulations which may affect the use of said premises , or which may prohibit the use thereof for certain purposes . 7 . Rights of the public or persons in streets, alleys or visible user easements in, under, over or across said premises ; rights of persons , if any, who are victims of forgery and/or duress; rights of persons who are minors or suffering mental illness ; and rights in favor of adjacent property owners resulting from inaccurate location of boundary lines and/or questions of survey. 8 . The Certificate of Title on which the Registered Property Abstract is based, namely Certificate of Title No. 561268on file in the office of the Kegistrar of Titles in and for Hennepin County, Minnesota, in Vol. 1862 at page56162� ,originally registered on January 24 , 19 78 i��lxxxxxxxx��cx , discloses certain statutory exceptions to which the ownership of the premises is subject, namely: (a) Liens , claims or rights arising or existing under the laws of the Constitution of the United States, which this State cannot require to appear of record. (b) The lien of any tax or special assessment for which the land has not been sold at the date of the Certificate of Title. (c) Any lease for a period not exceeding three years , when there is actual occupation of the premises thereunder. (d) All rights in public highways upon the land. � � � Ms. Martha P. Williams -3- July 17, 1990 (e) Such right of appeal, or right to appear and contest the application as is allowed by Chapter 508 of the Minnesota Statutes . (f) The rights of any person in possession under deed or Contract for Deed from the owner oE the Certificate of Title. Such ownership is also subject to �he following as disclosed by the records and/or the Registered Property Abstract : A) Real estate taxes in the year �988 and prior years have been paid. There are delinquent taxes owed against the premises for the first half of 1990 and for all of 1989 . The 1989 delinquent taxes are in the sum of $613 . 62 . There may bc penalties and interest against said taxes in addition to said sum. ThE 1990 taxes are in the sum of $560. 50 . The first half taxes were due May 15 , 1990 . Since the same were not paid on said date, there is penalty and interest due on same. Therefore, objection is made to the unpaid, but due, taxes. This should be paid on or before your closing in this matter. � B) A Mortgage Deed dated March 31 , 1954 and filed for record on April 5 , 1954 as Document No. 419675 . Said Mortgage runs in favor of White Investment Company, Inc. Said Mortgage is given to secure $9 , 100 . 00 . Said Mortgage was assigned to Federal National Mortgage Association by Document No. 422302. On December 19 , 1977 , by Document No. 1259057 (being filed February 7, 1978) a Partial Release of this Mortgage as given. However, the Mortgage remains against parcels 2 and 3 contained in the legal descripti�n attached hereto. —� C) A Mortgage Deed dated December 23 , 1977 and filed for record on January 24 , 1978 as Document No. 1257�04 runs in favor of Nickels & Smith Company. This Mortgage was give:z to secure $28 , 300 . 00 . Said Mortgage was assigned to �'ederal National Mortgage Association by Document No. 1257405 . This Mortgage remains a second encumbrance against the subject premises . Objection is made to both Mortgages unless same are paid off prior to the date of closing. The undersigned is not able to ascei-tain whether the legal description contained on the abstract is appropriate. In order to do so, the undersigned needs to be provic:ed with: tax statement showing that the parcel numbers mentioned on youz� purchase agreement match with the legal description contained on t=he registered property abstract; and photocopy of survey of the legal descriptions contained on the RPA.
