Representing Staff were City Clerk Lin Vee, City Attorney Soren Mattick, Assistant City Administrator of Long-Term Strategic Planning Mike Gaffron, Zoning and Planning Coordinator Melanie Curtis, City Engineer Tom Kellogg, and Recorder Jackie Young. Mayor White called the meeting to order to at 7:00 p.m., followed by the Pledge of Allegiance. CONSENT AGENDA Item Nos. 9 through 11 were added to the Consent Agenda. Item No. 6 was removed from the Consent Agenda. Bremer moved, Murphy seconded, to approve the Consent Agenda as amended. VOTE: Ayes 5, Nays 0. APPROVAL OF MINUTES *2. VOTE: Ayes 5, Nays 0. 6. #09-3405 FRANK MASSERANO III ON BEHALF OF INTERNATIONAL MINISTERIAL FELLOWSHIP, 2477 SHADYWOOD ROAD – VARIANCES AND CONDITIONAL USE PERMIT – RESOLUTION NO. 5880 McMillan noted the required church setback is 50 feet, with the setbacks for office buildings being 35 feet. McMillan asked why the deck could not meet the 35-foot setback. Curtis stated the applicant has reduced the size of the deck from their original proposal. Frank Masserano, Pastor of International Ministerial Fellowship, indicated the available footage is 21 feet and 2 inches across the board in the back due to a handicap ramp that is located on the back of the church. In the City of Fridley, where the church has been located for the past 28 years, they do not count the handicap ramp towards the setback but it is included in Orono’s setback calculation. Masserano noted the deck would be used mainly during funerals. Murphy moved, Franchot seconded, to adopt RESOLUTION NO. 5880, a Resolution Granting Variances to Municipal Zoning Code Sections 78-736 and 78-1288 and An Amendment to Resolution No. 4674 for a Conditional Use Permit Pursuant to Municipal Zoning Code Section 78-734(11). VOTE: Ayes 5, Nays 0. 7. #09-3423 HARVEST MOON NATURAL FOOD CO-OP ON BEHALF OF CLIFFORD OTTEN, 2380 WAYZATA BOULEVARD WEST – PUD AMENDMENT #3 AND VARIANCE Gaffron noted this application was heard at the October 12, 2009 City Council meeting. Council directed staff to draft an amendment to PUD No. 1 to include retail foods as a permitted use and to grant a variance for parking. Gaffron reviewed highlights of the proposed amendment. Item #02 - CC Agenda - 11/23/09 Approval of Council Minutes 11/09/09 [Page 2 of 7] MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, November 9, 2009 7:00 o’clock p.m. Page 3 of 7 (7. #09-3423 HARVEST MOON NATURAL FOOD CO-OP ON BEHALF OF CLIFFORD OTTEN, 2380 WAYZATA BOULEVARD WEST, Continued) Gaffron noted that in conversations earlier today, Mr. Otten indicated he is comfortable with the City undertaking a study at the time they feel there is an issue with the parking or when Willow Drive is redone. Additional conversations were held this afternoon in which Mr. Otten has requested that the last sentence of the Site Access paragraph be eliminated. It currently reads “All costs associated with construction of the portions of any new access within the Property shall be paid for by the Developer.” Mr. Otten has indicated he does not agree to pay such costs if the access change is due to traffic unrelated to his use of his property. Mr. White stated that perhaps the best option is to have the consultant examine this situation at the time it becomes an issue. Bremer stated she has a concern about eliminating the responsibility on the part of Mr. Otten regarding the costs and that she would like it addressed in the agreement in some fashion. Mattick stated that issue was discussed at a staff meeting and that one option was to simply assess the costs to the property. It was Staff’s feeling that the agreement terms regarding the costs should be spelled out in the agreement, which is what has been done. At the time it was originally platted, it was thought that the access may one day become a public road, which is probably not going to be the case. Bremer asked whether there is a benefit to the City for removing that language. Mattick stated there is not an advantage to the City by removing the language. Staff felt the property owner should be liable for the costs as they relate to access into the property. If the City Council feels the costs should be shared, the agreement can be revised. White noted Mr. Otten is not opposed to paying the costs if the change is related to his property, but that he is opposed to paying for construction of the new access if it is required for reasons other than simply access to his property. Mattick stated since the City does not envision this becoming a road, all traffic utilizing that access point would be going into the Otten property. Franchot asked if the costs could be broken down by percent between the City and Ottens if a traffic study is required. Mattick stated it is likely that growth in the area will cause the access point to be changed at some point but that 100 percent of the traffic would be accessing the Otten property since the City does not intend to make the outlot a public road. Murphy stated in his view the City should be careful about having a preconceived solution for a problem that may never occur. Murphy stated given the uncertainties about what may occur with the traffic in the area, there is really not a need to decide at this time that the access should be changed. Mattick noted the traffic study would study how much traffic turns into the Otten property and is not necessarily related to other development in the area. Mattick indicated he is not opposed to removing that language. McMillan asked if the situation does arise where the access needs to be realigned, whether the City can close that access. Mattick stated the City does control the access since they are the road authority and they have the ability to determine what a reasonable access would be. Murphy noted if the amendment is adopted as is, the City will hire a consultant and the recommendations will need to be followed. White stated the City will not be arbitrary about the issue and that if the conditions change at some point in the future, they will sit down with the property owner to arrive at the best solution. Murphy asked whether it would be helpful if the italicized part is left in but add the language that unless the access change is due to traffic that is unrelated to his use of his property. Mattick stated in his opinion that does not change the issue. If there is no through street, the only traffic that will be utilizing the access will be traffic going into Otten’s. Bremer moved, Murphy seconded, to adopt PUD Amendment No. 3 to PUD No. 1 for Harvest Moon Natural Foods Co-Op, an Amendment to Planned Unit Development No. 1 Agreement for East Willow Woods, with the removal of the last sentence of Paragraph 5. CRIME TRENDS AND PREVENTION – HENNEPIN COUNTY ATTORNEY MIKE FREEMAN Mike Freeman addressed the Orono City Council regarding the services provided by Hennepin County as it relates to crime prevention. Individual city prosecutors are assigned to each community and they keep in contact with the local police chief to determine what types of crimes are being committed more often in a particular area. Freeman noted that mortgage fraud has hit a number of neighborhoods, even in the City of Orono. Twenty-nine complaints have been filed in this regard and 19 of them have been tried. Hennepin County is also taking steps to address the truancy problem. Approximately 98 percent of juveniles who are truant tend to go on to commit felonies. Due to early intervention steps taken with children under the age of 12, the truancy rate has gone down and, as a result, so has the crime rate. As it relates to violent crimes, those rates have decreased substantially. Property crimes have also decreased slightly. The violent crime rate is virtually nonexistent within the City and the juvenile crime rate is also very low. Property crime is also lower than it was five to six years ago. White commented the majority of gang members get recruited when they are eight or nine so that by the time they are 11 or 12, they are committing serious crimes. Murphy asked what steps are being taken to address issues relating to the conciliation courts and the substantial number of cases being heard in that court. Freeman stated people have a right to have access to the court system and it should be paid for with tax dollars. People also have a right to access the conciliation courts and that he attempts to make the court system as efficient as possible. Denise Reilly, 3405 High Lane, stated she serves on the Judicial Council, and at the time the court system was facing millions of dollars in cuts, they went through all of their expenditures and put priority marks next to each one of them. Conciliation court did not receive a high priority while public safety was given the top priority. Murphy recommended the volunteer option not be overlooked in addressing some of these issues. McMillan stated in her view the taxpayers would like a stable court system since it is a very important aspect in today’s society. Reilly stated Hennepin County raises more money in fees and fines than it costs to run the court system but that the money goes into the general fund. Bremer stated due to the fact that a small percentage of the population actually utilizes the Hennepin County Court System, she is not surprised that it does not receive a higher priority. MAYOR/COUNCIL REPORT White stated he received a call from a property owner on Bayview Place regarding vehicles parking the wrong way on their street and that the police officer was not very receptive to them. Gaffron noted he will be meeting with Boe Carlson on November 19th. McMillan stated one option is the parking lot near County Road 51 and Brown Road. Bremer stated she used the city parking lot in Navarre on Saturday and it was almost empty, which is also another option. CITY ENGINEER’S REPORT City Engineer Kellogg had nothing to report. CITY ADMINISTRATOR’S REPORT *10. APPOINT CONFLICT COUNCIL Bremer moved, Murphy seconded, to appoint Richard Schieffer as Conflict Counsel and to approve the fee agreement. VOTE: Ayes 5, Nays 0. Northwest Tonka Lions Club Narrows Saloon 3380 Shoreline Drive Bremer moved, Murphy seconded, to adopt RESOLUTION NO. 5884, a Resolution Approving Issuance of a Lawful Gambling Premises Permit for the Northwest Tonka Lions Club to Conduct Lawful Gambling at the Narrows Saloon Located at 3380 Shoreline Drive.
