Dear Lyle:
We have reviewed the grading for the property owned by Phillip Otto, 4116 Highwood Road,
and have found that the finished grading does not conform to the previously approved plans.
The previously approved grading plan was submitted in September of 1995. This plan proposed
only minor filling below the 956 contour (see Exhibit 1). Our initial review concluded that the
grading plan was acceptable and would have minimal effects on the storage capacity of the pond
(see attached letter).
The completed grading plan submitted in October of 1996 shows up to a six-foot depth of
additional fill below the 956 contour. Also, it appears that the applicant has filled portions of the
adjoining properties. The increase in fill is distinctly shown near the existing maple tree, which
has up to five feet of fill placed around it (see Exhibit 2).
The north half of this lot is part of a storm water ponding area that provides storage for 3.4 acres
of direct drainage and 16.5 acres of indirect drainage. This ponding area has a history of
flooding problems due to an inadequate pipe outlet between the pond and Lake Minnetonka.
Because it is unknown if this outlet pipe will ever be replaced, it is very important �o maintain
the storage volume of this ponding area. The amount of fill significantly lowers the storage �
capacity of the pond and would increase the potential of flooding the adjacent homes.
To alleviate the potential flooding problem, the fill in the low area below the existing 954
contour must be removed. In addition to the increased fill, it appears that the grading has
extended beyond the property lines. This fill must also be removed unless the adjoining property
owner appiies for a separate grading permit and it is approved by the City.

Landscape and Drainage Issue

Objectives:
Owners: Owners of the property, Phil and Darcy Otto, wish to preserve the greatest
amount of"useable"yard space while not negatively impacting the amount
or ve(ocity of run-off to the adjacent property owners.
City: The City must retain the pre-existing drainage conditions (prior to
construction).
Recit�ils: Prior to the construction, the subject property had been the site of a
ramshackle home which was destroyed by fire years ago. At the time, the
rear of the site was a literal cliff which dropped off with such intensity that
any attempt to control the run-off of water would have been impossible.
During the construction process, the Owners have modified the prior grade
of the property to allow for a gradual slope to the adjacent properties. It is
their belief that they have improved the transition of elevations which would
have the effect of slowing the velcx;ity of run-off. While there has been
some"spill-over" of fill onto the property on the east, this minimal amount
of fill can be easily removed. The placement of a rather small amount of fill
onto the property to the west was done with the consent of the adjacent
property owner, to again improve a significant elevation change between the
properties. For the past year, the City and the Owners have met and spoken
on several occasions attempting to resolve the issues relating to the
proposed grading of the subject pr�perty in order to complete construction
of their(the Owners) home. Last fall it seemed as though a compromise was
reached between the parties which would have allowed for the grading
process to move forward in the spring to complete the project and allow for
the sodding and landscaping of the property to begin. it was the owners
understanding that the installati�n of a trench drain at the lower end of their
drive and some minor alterations of the existing grade would allow them to
finally complete their home and give them a useable yard.
In summary, the Owners are willing to remove fill at the lower end of their yard so that the amount
of water retention is equal to that which existed prior to construction. They request that the City
allow the existing fill on the property to the west to remain which allows for the gradua! flow c�f
water to the rear of the property. They agree that any spill-over to the property to the east will be
removed.
The owners request that the City move quickly so that sodding of the yard can begin as soon as
possible to alleviate any further deterioration of the existing fill which would further add to the
amount of fill in the area of concern as well as give their one year old daughter a place tc�play.

Dear Lyle:
We have reviewed the grading for the property owned by Phillip Otto, 41 16 Highwood Road,
and have found that the finished grading does not conform to the previously approved plans.
The previously approved grading plan was submitted in 5eptember of 1995. This plan proposed
only minor filling below the 956 contour (see Exhibit 1). Our initial review concluded that the
grading plan was acceptable and would have minimal effects on the storage capacity of the pond
(see attached letter).
The completed grading plan submitted in October of 1996 shows up to a six-foot depth of
additional fill below the 956 contour. Also, it appears that the applicant has filled portions of the
adjoining properties. The increase in fill is distinctly stiown near the existing maple tree, which
has up to five feet of fill placed around it (see Exhibit 2).
The north half of this lot is part of a storm water ponding area that provides storage for 3.4 acres
of direct drainage and 16.5 acres of indirect drainage. This ponding area has a history of
flooding problems due to an inadequate pipe outlet between the pond and Lake Minnetonka.
Because it is unknown if this outlet pipe will ever be replaced, it is very important to maintain
the storage volume of this ponding area. The amount of fill significantly lowers the storage '
capacity of the pond and would increase the potential of flooding the adjacent homes.
To alleviate the potential flooding problem, the fill in the low area below the existing 954
contour must be removed. In addition to the increased fill, it appears that the grading has
extended beyond the property lines. This fill must also be removed unless the adjoining property
owner applies for a separate grading permit and it is approved by the City.
