Earlier this year the Council requested information on how care facilities were regulated within the city zoning ordinance. The following information is presented for discussion and possible direction. All health and therapy related uses identified in the code are summarized below. “P” notes permitted use, “C” is conditional use in the respective zoning district. Among those listed, the only term defined is “Clinics for human care on an out-patient basis only”. Other care type facilities are not listed, and may require a zoning ordinance amendment to permit them.   USE   RPUD B-1 B-3 B-4 B-5 I-1  Assisted living facility   C            Clinics           P    Clinics for human care on an out-patient basis only     C P P      Massage Therapy     P P        Massage Therapy Centers           P    Medical, dental and optical laboratories             P  Nursing homes, hospitals, rest homes or retirement homes, provided the site shall contain not less than 600 square feet of lot area for each person to be accommodated and no building is located less than 35 feet from the side lot line.         C      Veterinary Clinic           C     The definitions and appropriate zoning could be reviewed to better reflect Council goals. Sex offender housing. Additionally, Councilmember Printup questioned the potential of drafting an ordinance that would establish a minimum separation between the homes of sex offenders and public parks, schools, and other areas where youth may congregate. It has been noted that other communities have passed similar ordinances, including Brooklyn Center, Minnesota Lake, Mahtomedi, Birchwood, and Watertown. Columbia Heights and Hilltop passed one year interim ordinances (moratoriums) late last year. Attached are a number of articles collected over the last several months as this issue has heated up in Minnesota.
