Re: Construction of Retaining Wall
Dear Mr. Brickley:
It has come to the attention of this department that you have recently constructed a retaining wall
on your property at 4105 Highwood. This letter is to inform you that the City of Orono requires
building permits for retaining wall construction that exceed 4' high. The City also requires
retaining walls over 4' high to be designed by a state licensed structural engineer. Your wall
appears to be severely under designed to support the loads applied to it. It appears to me that
the next heavy rain could cause the fill to become saturated and cause the wall to fail.
Therefore the City must require you to apply for a building permit and submit a design from a
structural engineer to either make this wall work or if that is not possible, a design for a new
wall. A deadline of March 30, 1995 has been established for application submittal. If you have

Re: Construction of Retaining Wall without Building Permit
Dear Mr. Brickley:
On March 15, 1995 this office notified you of the requirement for a building permit for a
retaining wall constructed on your property at 4015 Highwood Road.
As of this date, the matter remains unresolved. Therefore you leave the City no alternative but
to initiate legal action. Action will be withheld until April 27, 1995. If this deadline is not m�t9
the City will issue citations and refer the matter to the City Attorney for further legal action.

Re: Retaining Wall
Dear Mr. Brickley:
On March 15, 1995 this office notified you of the requirement for a building permit for the
construction of a retaining wall on your property at 4105 Highwood. On April 26, 1995 you
submitted a letter to the City stating you would lower the wall to less than 4' to avoid building
I permit and engineering requirements. You stated the work would be completed by June 15,
1995.
As of this date, the work has not been done and a building permit and engineering has not been
submitted. T'herefore you leave the City no alternative but to initiate legal action. Action will
be withheld until July 24, 1995. If the wall is not in compliance at that time, the City will issue
citations and refer the matter to the City Attorney for further legal action. If you have any
