2. The property is located in the LR-1B, Single Famil}� Lakeshore F.esidential
Zoning District, requirin� 1 acre in area and 140' of lot «�idth.
3. The Orono Plannin.g Commission reviewed this application on January 16, 1996
and further reviewed revisions to the application on Apr�' 15, 1996 and
recommended approval of the praposed variances based upon the followin�
findings:
A. The property currently contains a small 600 s.f. house and no garage, yet
the property already exceeds the 25°/o 7�-250' hardcover limtt due to the
eatremel�� small lot area and narrowness of the lot.
B. T'he proposed house and attached two car gara�e «-ill cornprise of 1,492
s.f. of structural footprint on the property, m�eti.:� the 1,500 s.f.
limitation far lot coverage on extremel�� small lots establisl-�.ed in zoning
code Section 10.03, Subdivision 14 (C).
C. 'I�ne proposed house is located less than the normal 30' required setback
fram HiQ'�w�od Roaei in order to rninimize the a?no�int of har�cover
needed for driveway. The proposed 40% hardcover in the 75-2�0' zone
is not dissimilar fram the hardcover percentages on other properties iii
the neighborhood. Furtlier, no hardcover is proposed fo: the 0-75' zone,
and overall hardcover on the property is proposed at 22.9%, within tlie
2>% standard of the DNR.
?J. Tiie west side setback oi 9.5' on:y ncr_urs at � midpoin� corner of the
proposed house, while the majority of the structure «�ill meet the 10' ���est
side setback requirement. Further, the proposed constr�ction ras been
revised such that the setback between the proposed attached garaae and
the detached garage on the neiahboring propem� ezceeds the 10'
r:Zinimum structure-to-structure setback requirement.
F. ihe proposed 8' east side setback, includin� a 10'aJ?' cantile:�er.d se,inent
approximately 6' from the east side lot line, is necessary in order to
maintain a fia_nctional house width for room layout. "fhe hotise iri tot.al

is only 24' in width as proposed. The adjacent house on the property to
the northe�-t averaQes 18' from the lot 1ine, hence the sepa.ration between
the structures will be maintained at approximatel�• 26', greater separation
than might be obtained if all houses in the neighborhood vvere
constructed right up to the required 10' side setbacks.
G. Whi1e the lot at 8,550 s.f. and widin o1 4e-�v' is reiati��ciy sirali
compared to the 1 acre/14�' standards of the LR-1B zone, -other
developed lots in the neighborhood are of similaz size. Further, t.i-�e
property has contained a single family residence for many years and has
remained in single sep�trate ownership.
H. Applicant has provided a grading and drainage plan v��hich ���ill
adequately manage the runoff from the property. Because the
neighborina property to the east has recentl�� been reconstructed, t;1e
opporhzniri exists for an appropriate draina�e«�a� to be dc�eloped a'ton�
the conurion lot line.
4. The �:ity Council has considered tiiis application including the f ndings an�
recorLurieiidations of the Planning Co:nmission, reports by City staff, commer,ts
by the applicants and the effect of the proposed variance on the health, safery
and welfare of the community.
j. The Cit�,� Council finds that the conditions existin� on this propert}� are peculiar
to it and do not ap�ly generally to other property ;n this zonin� district; that
aranting the variance would not a�versely affect traffic conditior,s, light, air nor
pose a fire hazard or other danger to nei�hborin` propem�; would not mereiy
serve as a con��enience to the applicant, but is necessary to alle��iate a
demonstrable hardship or difficult}; is necessar}� to preserve a substantial
property right of the applicant; and would be in keepin� tivith the spirit and
intent of the Zoning Code and Comprehensive Plan of the Cit}�.

CONCLLiSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Mwucipal �oning Code Section 10.24, Subdivision 5 (B), granting lot area
ar.d w-idth variances for construction of a new residence on the property v✓hich is 8,550 s.f. in
area where lot area of 43,560 s.t: is normally requireu and �vnere esisting ioi widtii i� ��' at
the shoreline and 46' at the 75' setback 1?ne where a 140' lot vvidth is normally- required at such
locations; and hereby ��a.nts further variances to Section 10.24, Subdivision 5 (B) to allow the
resider.ce to be located 25' from the front or s�eet right-of-way line where a 30' stFeet or fron:
setback is normally required, and to alluw an east side setback of 6' where a 10' setback is
normal�y required, and to allow a west side setback of 9.5' where a 1 G' setback is normal?y
required; and fi�rtl-�er grants a variance to Sections 10.22, Subdivision 2 and 1 t�.SG, Subdivision
l6 (L) to aliov✓ hardcover ir, the 7�-250' zone of 1,956 s.f. or 40% where oni}� 1,220 s.f. or
25% hardcover is nornially allowed, subject to the follo��ving conditions:

plan a�d construction plans per the survey by Ron Krueger and Associates, Inc.

footprint, or w�hich result in additianal hardcover, will require additional reviev��
by the Cit��.
2. No hardcover shall �e allo��ed in the 0-7�' setbaci: zone. In the 7�-250' zone,
hardcov�r shall be limited to 1,492 s.f. including the house and attached garage,
��1d 45'' s.f. in �.ra,k:�ays and �rive��vay, for a total i:ardcover alio��-ance of 1,9�6
s.f. or 40% of the 4,882 s.f. 7�-2�0' zone. An}� hardcover in addition to tl�a�
noted ��il: require variance approval by the Cit��, and is not likely to be
approved in the future unless concurrent removals of pre-existin� hardco�er
result in no hardcover increase above the 40% allo«�ance.
3. Applicant shall ��ork with neighborin� propem ow�ner to the east and ���ith tne
City to estabiish suitable clrainageways so that the applicant's cc�nstruction has
no negative impact on the neighborhood or adjacent propetiies.

expire �n that date (April 22, 1997).
5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall corL�titute a violation of the zoning cod�, shall autor.iaticall}'
terminate any authority granted 'nerein, dnci snait 'v� �unis'r�a�:e as a
misdemeanor. -
