A RESOLUTION RENEWING VARIANCES
TO MUNICIPAL ZONING CODE
SECTI�NS 78-330 78-1288 AND 78-1404
AND REVISING RESOLUTION NO. 3537

WHEREAS, Alonzo B. Seran and Renee N. Seran, busband and wife,
(hereinafter "Owners") are the owners of the property located at 4099 Highwood Road within
the City of Orono (hereinafter "City") and legally described as: Lot 14, Highwood Lake
Minnetonka, Hennepin County, Minnesota(hereinafter "the Property"); and
WHEREAS, the Owners have made application to the City far renewal of a
variance to Municipal Zoning Code Section 78-330 to construct an attached garage nine feet
from the northwesterly property line when a 10 foot setback is required; and
WHEREAS, the Owners have made application to the City for renewal of a
variance to Municipal Zoning Code Section 78-1288 allowing 46.1 percent hardcover in the 75
to 250 foot zone when the normal maximum is 25 percent and 49.3 percent was previously
approved to permit the construction of an attached garage and new driveway; and
WHEREAS, the Owners have made application to the City for renewal of a
variance to Municipal ?oning Code Se�±�nn 7R-14�4 �11���;-;r� i g.a p���P�� s��r+,;ral ccveraQe
when the normal maximum is 15 percent to permit the existing detached garage/shed to be
replaced by an attached barage/entry of the same foundation area; and
WHEREAS, the Owners have made application to the City for renewal of a
variance to Municipal Zoning Code Section 78-330 to construct an attached gara�e with three
defined stories when the maximum is two and a half defined stories; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zonin� and Planning Codes, the Orono City Council
waived the Planning Commission review and held a public hearing on September 14, 2009, at
which times all persons desiring to be heard concerning this application were given the
opportunity to speak thereon.

NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
l. This application was reviewed as Zoning File 09-3427.
2. The Property is located in the LR-1B zoning district, where 1 acre is the minimum
lot area and 140 feet is the minimum lot width. The Property is approximately
0.235 acre in area and 50 feet in width.
3. The Planning Commission reviewed the original application on May 19, 2008 and
on a vote of 5 - 0 recommended approval of the variances, based on the following
findings:
a. An attached garage is a reasonable addition to the property.
b. The new gara�e and parking arrangement will reduce hardcover and be more
compatible with the surrounding area than the existing garage and parking
arrangement.
c. The new arrangement will allow the storm water runoff from Highwood Lane
to be channeled toward the lake alon�the side property lines.
d. The need for the side setback variance results from the side setback variance
that allows the existing house to be 6.4 feet from the side property line.
4. The Plarming Commission carefully reviewed the variance to allow a three story
addition and in addition to the findings noted above recommended approval based
on:
e. The topography of the lot.
f. The need for the garage floor to be above street grade to avoid drainage
problems.
g. The mass of the addition being the same with or without the basement under
the garage.

h. The peak height of the addition being less than 25 feet above the grade of
Highwood Road adjacent to the property.
i. There will be minimal impact on the view from the lake because the addition
is on the road side of the house with the existing house between it and the
lake.
5. The City Council has considered this application including the findings and
recommendation of the Planning Commission in May of 2008, reports by City
staff, comments by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the community.
6. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affect traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicant, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicants;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of t?�e above fin�ings, the �rnr.o City ro�ar:cil her�by grants a
variance to Municipal Zoning Code Section 78-330 to construct an attached garage nine feet
from the northwesterly property line when a 10 foot setback is required; and grants a variance to
Municipal Zoning Code Section 78-1288 allowing 46.1 percent hardcover in the 75 to 250 foot
zone when the normal maximum is 25 percent and 49.3 percent was previously approved to
permit the construction of an attached garage and new driveway; and �rants a variance to
Municipal Zoning Code Section 78-1404 allowing 18.4 percent structural coverage when the
normal maximum is 15 percent to permit the existin� detached �arage/shed to be replaced by an
attached garage/entry of the same foundation area; and grants a variance to Municipal Zoning
Code Section 78-330 to construct an attached garage with three defined stories when the
maximum is two and a half defined stories, subject to the following conditions:
1. Council approval is based on the site and building plans submitted by the Owners
and annotated by City staff, attached to this Resolution as Exhibits A and B. Any
amendments to these plans may require further Planning Commission and City
Council review.

?. Hardcover in the 0-7�' zone shall be limited to 0 s.f. or 0 %. Hardcover in the 75-
250' zone shall be limited to 3096. s.f. or 46.5% per the proposed site plan and
hardcover allowance summary as depicted on Exhibit B. The Owners are advised
that any future requests to increase hardcover or change the nature of
existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concurrent reduction in existing
hardcover. This condition revises the 49.3 % hardcover allowed in the 75 to 250
foot zone by Resolution No. 3537.
3. ADDITIONAL SURVEYS REQUIRED:
a. Per City Code 86-68, a foundation survey is required to be submitted prior
to commencement of framing; and
b. An as-built grading plan verifying compliance with the building permit,
stormwater mana�ement, grading and drainage plans shall be submitted
priar to the issuance of a Certificate of Occupancy for the residence.
4. The Certificate of Occupancy shall not be issued until the Owners have �ranted
the City a drainage easement over the swale along the southwesterly property line
that carries the runoff from Highwood Road.
�. Owners shall not place any plastic or fabric liner material under any landscaping
on the property to ensure their perme�bility as non-har�c�ver surf�ces.
6. Authorities granted by this resolution run with the Property not with the owners,
but are permissive only and must be exercised by obtaining a building permit for
the new garage before September 14, 2010 or the variances will expire on that
date.
7. Once a building permit has been obtained for the new garage the setback
variances granted in zoning file #178 for the existing detached garage are void.
8. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.

9. The undersigned Owners have read, understand and hereby agree to the terms of
this resolution and on behalf of their heirs, successors and assigns, hereby agree to
the recording of this resolution in the chain of title of the Property.
