Bill and Jim,
I appreciate the additional information and I do understand what you are planning on doing once you get to the site.
Essentially what you are proposing is field fitting the steps once you get out there. With this sort of work, I cannot
approve a plan were you will fit it as you go, but it should be looked at prior and have engineered plans submitted with
the application prior to arriving on the site.
Since the City does a lot of road work, I can provide an example from a road project to accurately portray what I expect
for this and all future applications. Your original application included a survey which only showed lines where the steps
were being proposed but did not show how the steps were going to fit into the existing site. This would be very similar
to the first page of my attachment showing where the road is going to be in relation to the existing road.
After my original email,you provided details for how the steps were going to be installed. This is very similar to the
second page of the attachment showing the typical section of a road. Finally, what I still need is how are these steps
going to fit into the existing grade and how are you planning on tying into the existing grade. What I expect is some
cross sections of your proposed steps along the path going down the slope. This is very similar to the third page of my
attachment. You should include a cross section at major places of change. I would say if you include something at each
major landing pad and at least in one location of the steps between these pads.
You should include elevations of the pads and the elevations at the tie in points so I can clearly see what you are

I attached a drawing of a typical step section. Obviousely we will be constructing the landings the same way.
Each step unit will overlap and sit on the lower tread as necessary to achieve desired tread depth. If you agree
with my drawing please forward it to all as I believe this will clear up why I am saying we are not changing the
slope of the hill to acomodate the steps.

I will ask both Mark Gronberg and Jim Smith to get you the details that are needed. But I want to make sure we are all on
the same page as to how these steps and landings are going to be built. Based on the slope of the property going down
to the lake, our intention is to use wall stone directly underneath the 4' steps and landing areas to handle the difference in
elevation from the back of the step to the front of the step, and from side to side. There will be no additional hardcover as
the steps will either be sitting on the prepared ground or the wall stone directly underneath the step. By doing this, we will
not be increasing the hardcover going down to the lake, and will not need any retaining walis outside of the steps or
landing areas.
I hope this explanation makes sense. Based on this, please let me know exactly what will be needed in your office by

Melanie,
I have reviewed the application for the proposed steps at 4051 Highwood Road and have the following comments:
• The submitted survey does not show the impacts to the slope of the hill or what is being proposed for retaining walls.
Because the steps are angled at a diagonal down the slope rather than going straight down, the existing ground will be
approximately 1.5' across the 48" wide steps. If the installer is planning on setting the stairs to follow the existing grade,
this will either require a 1.5' wall on the upslope side, filling on the down slope side, or a combination of both.
More than likely a portion of the steps will be dug into the ground (upslope side)to the extend where the dirt dug out will
be placed on the down slope side to balance it out. This is magnified even more with the 5' wide landing pad on the lower
portions of the proposed stairs which will have a 2' existing ground difference. This will more than likely require a portion
of the down slope side to be filled in or raised (retaining wall) or substantial grading on the upslope side.
I would recommend having the surveyor do cross-sections for the stairs to show how the stairs will be placed /graded to
fit the existing grade and show if there will be any retaining walls installed.
• The proposed work will disturb more than 10 CY of material within the 0-75' zone so a CUP is required.
• The plan does not show erosion control measures on the slope. Also pursuant to City code Sec 79-7 (b)(1) the
applicant will need to submit an escrow in the amount of$2,000 for grading and erosion control.
• A permit from MCWD may be required.

ZONING PERMIT ESCROW AGREEMENT

AGREEMENT made this��day of � , 20� by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Wiliiams and Anita Rouse ("Owners").
Recitals
1. A zoning permit application has been filed for a property located at 4059 Highwood Road the
("Subject Property"), legally described as Tract A, Registered Land Survey No. 1420, Hennepin County
Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$1,300 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering or legal consultant review) or will
incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible
for under a zoning permit application. The escrow will also guarantee reimbursement to the City for all out-of-
pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater
Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financia! security may also be
used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to
public property or infrastructure that is caused by the work (including pfanning, engineering, or legal consuftant
review) associated with permit#2012-00595 if compliance with the approved zoning permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City wifl in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeftame outlined in#3 above, shall issue a Stop Work Order until the Owners pay atl expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligibfe expenses the City has incurred.
5. CLOSING ESCROW. The 8alance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written not�cation is received from the Owners requesting the
funds.
6. CERTlFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject o erty pursuant to Minn. Stat. §§415.01 and 366.012.

Technically, all the aspects of the permit including landscaping and erosion control must be complete before we can
refund the escrow. However, as you know our history working together has been positive. I would like to build on that
rather than tear it down.... Further, I don't think you're going to"run away"without completing the landscaping required.
O Having said that& knowing that you will complete the planting in the spring, if you are able to complete the
requirements to stabilize the disturbed areas for the winter so that erosion is not a concern I can begin the process of
refunding your escrow once the pass-through bill is paid. The review was done this month (November). We won't
receive our official billing invoice from our consultant until mid-December. I inquired this afternoon as to the amount of
your bill and was told it was between $250 and $300.

I will pay the invoice when I receive it. As far as the finalization of my project, Chris' email below says that I need to have
a general planting plan. It says nothing about finalization of anything. I will take the existing plan, and incorporate in
Bolton Menk's recommendations as they were written. That will be my general planting plan. I am not expecting to wait
until Spring to get my escrow refund, and all of the communication up until now has not indicated this. When I pay the
invoice, I should be able to get my escrow refund. Would that be approved at the following Council Meeting? Thank you.

As a result of your call today, I have looked into your file and found the resolution approving the CUP and Variance has
not been signed. Please make arrangements to stop by City Hall between 8 am and 4:30 pm Monday— Friday. The
resolution requires signatures from both property owners. Please bring your driver's license as proof of identification for
your signature to be notarized by City staff. I did stop in and sign last week. Hopefully this is all completed. Yes, we have
this completed. Thank you.
According to the resolution (page 3, item 4—copy attached), a general planting plan must be submitted and approved
prior to the release of the escrow funds. As we discussed, this plan was submitted in May when we originally applied for
permits. My understanding is that this was sent to your landscape expert to determine if it is adequate. Please let me
know. Landscape comments are attached. Please review and make a few of the suggested adjustments.
Lastly, if you recall your permit was issued by us in haste as you were headed out of town. The zoning permit was issued
without our usual notification identifying the requirement for submittal of an as-built survey and hardcover calculations.
We apologize for this.... However, an as-built survey and as-built hardcover calculations are required to be submitted in
order to verify compliance with approved plans and to close out your permit. First of all, this permit was not issued in
haste because I was leaving town. This permit was started back in May. The Council approved everything, and then
when I questioned why the permit was not issued, you informed me that I had not submitted the paperwork. This was not
accurate. We had submitted everything. I have reviewed my permit and there is no requirement for an as-built survey or
as-built hardcover calculations. I have already spent over$2,500 on surveys to put steps in. This project has already
been signed off on final inspection by your office according to the plans and permit. Spending another$1,000 for another
survey after a final inspection has been made makes no sense to me, especially when my permit did not require it.
Perhaps "haste"wasn't a good word to use, but we did process it quickly once we had all of the info we needed
z
for the permit in place. It happened that you were at the airport and your contractor was going to start within the
next days. Christine is correct in that our permitting staff moved the permit along hastily once we authorized it to
be issued. The portion missing was the transfer of our requirement for an as-built survey to the permit form. See
the attached internal review sheet and the permit as issued. The last page of the internal review sheet reflects
the planning department's requirement for an as-built survey. Unfortunately this was not transferred to the
permit to communicate that point to you; and at this point I think it is counterproductive to try to have you
provide it.... no as-built survey will be required.
Once the above requirements/items have been completed and/or submitted, I can continue to process your escrow refund
request. Please let me know if this escrow refund will be granted tomorrow night, or if I need to be in attendance at the
meeting. Thank you. Bill, our consultant just reviewed your landscape plan (comments attached). This bill will be

Both of you are listed on the resolution, so both must come in to sign the document.
I will look through our file for a copy of the planting plan.
We do have a survey from Gronberg &Associates for the proposed project. An as-built survey is a survey
prepared after the project is complete. The surveyor visits the site and shows on a survey the stairs were
constructed in the approved location and the grading was completed in accordance with the approved plan.
The surveyor also prepares the as-built hardcover calculations.
As I mentioned I will continue to review the file for the planting plan. We will be in contact again on Monday.

As a result of your call today, I have looked into your file and found the resolution approving the CUP and Variance has
not been signed. Please make arrangements to stop by City Hall between 8 am and 4:30 pm Monday— Friday. The
resolution requires signatures from both property owners. Please bring your driver's license as proof of identification for
your signature to be notarized by City staff. Is it just me that needs to sign?
According to the resolution (page 3, item 4—copy attached), a general planting plan must be submitted and approved
prior to the release of the escrow funds. There was a plan and design with the plants identified when everything was
submitted. Please let me know if you cannot find this document, or if it was lost or misplaced.
Lastly, if you recall your permit was issued by us in haste as you were headed out of town. The zoning permit was issued
without our usual notification identifying the requirement for submittal of an as-built survey and hardcover calculations.
We apologize for this.... However, an as-built survey and as-built hardcover calculations are required to be submitted in

order to verify compliance with approved plans and to close out your permit. I have no idea what you are talking about
here. Can you tell me exactly what I need to submit? You should have the survey and hard cover calculations from
