A RESOLUTION GRANTING VARIANCES
TO NIUNICIPAL ZONING CODE
SECTION 78-330 SUBDIVISION S AND
SECTION 78-1288 SUBDIVISION A
FILE NO. 04-3066
«'HEREAS, William R. Rouse and Anita M. Rouse, husUand and wife
(hereinafter "the applicants") are the owners of the property located at 4051 Highwood
Road within the City of Orono (hereinafter the"City") and legally described as follows:
Tract A, Re�istered Land Survey No. 14?0, files of Registrar of Titles, Hennepin County,
Miiuiesota(hereinafter tlle "property"); and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Mtuiicipal Zoning Code Section 7�-330 SuUdivision B to allow a
side setUacl� of 9.3' in order to reorient the roofline on the existing detached gara�e; and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-330 Subdivision B to allo�v a
side setbacl� of 4.3' in order to reorient the roofline on the existing home in conjunction
with a partial second story addition; and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-1288 Subdivision A to allo�v
a second story to be constructed over the e�isting llome within 75' of the OHWL.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono,Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#04-3066.
2. The property is located in the LR-1B, One Fainily Lakeshore Residential
Zoning District which requires a minimum lot area of 21,780 s.f. or '/2 acre
and a minimum lot width of 140'.

3. The Plamiing Commission reviewed tl�is application at a puUlic hearing
held on November 15, 2004 and reconunended approval of the side
setback variances based on the following findin�s:
a. The applicants' property has 22,215 s.f. or '/2 acre in area and 90' of
width at the shore aud 95' of width at the 7S' setUacl:.
b. No additional land is availaUle for acquisition by the applicants to
malce the property confornling iu area or width.
c. The applicants are proposing to reorient the rooflines; no additional
living space is proposed within the substandard setUacks.
d. Due to the location of the home any additions or alterations to the west
side of the house and detached garage require variances.
e. There is no available land to purchase to mal<e the e�isting side
setbacics confornling.
f. The applicauts are proposing to remove portions Of I]011COI1f0I111111�
hardcover in conjunction with setUacic variance approvals.
g. Since the l�ome and subsequent addition were originally constnicted
the shoreline l�.as eroded mal:ing the previously confonnin� lalce
setback nonconfoi-ming.
4. The City Council has considered this application including the findings
and reconunendation of the Plaiulin� Cominission, reports by City staff,
comments by the applicants and the puUlic, and the effect of the proposed
variance on the health, safety and welfare of the coirununity.
5. The City Council finds that the conditions existing on this property are •
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to ileighboring
property; would not merely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
presei-��e a substantial property right of the applicants; and would be in

keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORD�R AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereUy
jrauts a variance to Orono Munic.ipal Zoning Code Section 78-330 Subdivision B to
allo�v side setbacics of 9.3' for the detached �arage and 4.3' for the existing home in order
to reorient the rooflines in conjunction with a partial second story additioi�, a variance to
Orono Municipal Zoning Code Section 78-1288 Subdivision A to allow a second story to
Ue constructed over the e�isting home within 75' of the OHWL and hardcover removals,
subject to the following conditions:
1. Council approval is based on the site plan suUmitted Uy the applicants and
aiulotated by City staff, attached to this Resolution as Exhibit A. Aily
amendments to the site plan which are not in confoni�ity with City codes will
require fiu-ther Plaiuiin�Commission and City Council review.
2. Hardcover in the 0-75' zone shall ilot iucrease aUove the level of 12.6%.
. Hardcover in the 75-250' zone shall Ue limited to 4,820 s.f. or 33% per the
proposed plan and hardcover allowance summary as depicted on Exhibit A.
Applicants are advised that any future requests to increase hardcover or change
the nature of existing/approved hardcover shall require City approval, and
increases in hardcover will not likely be approved without concun-ent reduction in
existing hardcover.
3. Applicants shall remove all plastic or faUric liner material fronl the decorative
landscape Ueds on the property to ensure their penneaUility as non-hardcover
surfaces.
4. Required reinovals of stnicture and hardcover shall be completed by the final
inspection.
5. Autl-iorities granted by this resolution nui with the property not with the
applicants, but are pernlissive only and nnist be exercised by obtaining a building
pemiit for the new constniction within one year of the date of Council approval,
or the variance �vill e�pire on that date (DeceuiUer 13, 200�).

6. Violation of or non-compliance with any of the tern�s and conditions of this
resolution shall constitute a violation of the zonin� code, shall automatically
ternlinate any authority granted herein, and shall be punishable as a rnisdemeanor.
7. The undersimied applicants have read, understalld and hereUy a�ee to tl�e tei�l7s
of this resolution and on behalf of the applicants and the applicants' heirs,
successors ancl assi�ns, hereby a�-ee to tl�e recording of' t11is resolution in the
chain of title of the property,
