Representing Staff were City Administrator Jessica Loftus, Finance Director Ron Olson, City Clerk Lin Vee, Assistant Administrator of Long-Term Strategic Planning Mike Gaffron, Planning Coordinator Melanie Curtis, City Attorney Soren Mattick, City Engineer Tom Kellogg, and Recorder Jackie Young. Council Member Cynthia Bremer was absent. Mayor McMillan called the meeting to order at 7:04 o'clock p.m., followed by the Pledge of Allegiance. PLANNING COMMISSION COMMENTS - LIZZ LEVANG, REPRESENTATIVE Levang stated at the August 3rd work session they received a history of the zoning changes that have occurred in Orono over the years from Mike Gaffron. The Planning Commission found it very interesting. The Planning Commission also looked at six land use applications, one of which was the Ryan Companies application for 550 Old Crystal Bay Road, which was placed on tonight's Consent Agenda. JEM Technical will be moving into the building, which will be a good asset for the City. Levang stated she would be available for questions this evening. PUBLIC COMMENTS Ralph Kempf, 3675 Togo Road, noted he has appeared before the City Council on other occasions regarding the last 1,000 feet of sidewalk or trail along the west side of County Road 19 that would connect the Dakota Trail to the Navarre business district and playground. Item #03 - CC Agenda - 09/12/2011 Approval of Council Minutes 08/22/2011 [Page 1 of 14] MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, August 22, 2011 7:00 o'clock p.m. _____________________________________________________________________________________     Page 2 of 14       (PUBLIC COMMENTS, Continued) Kempf stated the last time he addressed the Council he was informed that Orono is not able to use its Park Funds to construct a sidewalk but that they can be allocated for trails. Kempf noted that one of Orono's Park and Open Space and Trail goals is to identify, develop, and oversee a city-wide bike and walking trail plan that provides connections between area parks and open spaces and would function as a transportation corridor. Kempf stated his understanding is that a sidewalk is typically six feet wide and in order to be designated a trail it needs to be eight feet wide. Kellogg indicated that is correct. Kempf stated the photograph on the overhead screen depicts the last section of the Dakota Trail that enters Wayzata. The area to the right is trail and it is eight feet wide. That area, including the curb, is all asphalt. The curb itself bumps out approximately six inches. Kempf indicated he did measure the area, and from the center of the road to the striping is 12 feet, there is another one foot to the curb, another two feet from that point to the striping of the trail, and then eight feet to the edge of the asphalt trail. There is a total of 23 feet from the center of the pavement to the edge of the trail. Kempf stated if he is not mistaken, there should be a 33-foot right-of-way along county roads. Kellogg indicated he did not bring the file with him tonight and that he is not positive of the width of the right-of-way. Gaffron stated to his knowledge it is a total 66-foot right-of-way. The last few feet of the right-of-way consist of the slope. Kempf stated the driving lanes are 12 feet wide and that it is six feet from the striping to the edge of the asphalt. Kellogg indicated that is meant to be a bike lane. Kempf stated if something similar were done in Navarre, there would be another 10 feet to construct a retaining wall before it would encroach on to anyone's property. If the City did that, they would be able to use the Park Fund, which this type of project is what the funds are designed for. Kempf encouraged the City Council to consider this as a possibility and to see whether some of the City’s park funds can be used for that particular purpose. The trail is needed in the City and would help address safety concerns, especially with the increasing amount of traffic between the trail and the business district of Navarre. Kempf commented it is possible that an asphalt trail would also be less costly. McMillan asked whether he is suggesting that the entire length be trail. Kempf stated that is correct. McMillan suggested that making the other section asphalt should also be considered so it matches up. Gaffron indicated he and the City Engineer met with Bo Carlson from Three Rivers Park District and Bob Beyers from Hennepin County Transportation approximately one week ago and that they had this exact same discussion about what is considered a trail and a sidewalk. Gaffron indicated he received the impression from that discussion that the county is not likely to consider funding this project if it is something different than a sidewalk. Bob Beyers is researching some items on this project to see if there is a way to accomplish it utilizing some of their funds. Gaffron stated the City may have a three-way partnership but that it is dependent on whether they would be able to use trail funds to construct a sidewalk. There are also some width issues. Gaffron stated the double strip may be centered in the right-of-way but that there is the possibility that the right-of-way is not centered. Gaffron indicated there will also be a significant amount of vegetation impacted, which will need to be taken into account. Gaffron stated he expects to hear back from Bob Beyers in a couple of weeks. Kellogg noted the City does not have a designated trail for the first block and that the only trail connection there would be, if the City does not do upgrades to the first section, would be from Livingston to the trail, so it would not be a true trail connection from the Navarre parking lot to the trail. Kellogg indicated they did look at a wider trail when the first section was designed. When the original sidewalk was constructed in 2003, it was designed to be a 7-foot wide concrete sidewalk but some obstacles were encountered in terms of improvements that would be required on one corner lot, which then resulted in the sidewalk being narrowed in order to limit the impacts to that property. The first section was never designed at eight feet in order to be considered a trail. Kellogg stated it is also his understanding that the roadway is not centered in the right-of-way. Whether or not there is a full 33 feet from the centerline is questionable. There is a 12-foot traffic lane and a six foot striped bike lane, which brings the distance to 18 feet. Curb and gutter would also need to be installed to preserve the bike lane. That brings it up to 20 feet before you are able to start your sidewalk. Kellogg stated if the road was centered in the right-of-way that would leave 13 feet to work within. Due to the existing slope and trees and close proximity of the houses to the top of the slope, it would make the work very difficult. It would also be necessary to leave three to four feet for a retaining wall. Kellogg commented he is not saying it is impossible but that it would need to be explored further. Kellogg indicated he can bring the cross-sections for that section to the next Council meeting which would show how much right-of-way the City has to work with based on the existing design of a 6-foot wide sidewalk. Franchot asked why the City cannot take back the bike path from the County and create a bike/walk path. Gaffron indicated you would need to convince the County that they should give up that 6-foot existing bike path in order to construct a new trail/bike path. Kellogg asked if Council Member Franchot is talking about taking back the 6-foot bike lane for a block. Franchot stated he has wondered in the past why there is a separate bike lane with no separation from the roadway and then a walking sidewalk when something like this could be constructed that would accomplish both purposes. Gaffron stated they can ask Hennepin County that question. Franchot commented it would be likely that a retaining wall would then not be necessary. Franchot stated if they were starting from scratch, the combined bike path/trail would be a good solution. McMillan commented the trail would have more uses than a sidewalk. Franchot stated it would also provide a separation from the roadway. Kellogg pointed out there is an existing bike lane on both sides of the roadway. Kellogg stated the separation is generally dictated by the posted speed limit on the roadway. The curb is not intended to stop the vehicle from hitting a bicyclist since it would be a surmountable curb. Kempf commented it sounds like the City Council is shopping around for a good engineer, and that during his time on the Planning Commission he discovered how important it is to have a good historical perspective of things. Mike Gaffron’s history of the city is invaluable and prevents the City from not having to recreate the wheel. Kempf stated he hopes the City Council will take that into perspective as it relates to Tom Kellogg and the services he has performed for the City over the years. Kempf stated he knows Tom Kellogg has been here for a number of years and is an important aspect of that historical piece. Kempf stated the City will lose a huge amount of historical information in exchange for someone that might be a little bit cheaper. PROPOSED XCEL ORONO SUBSTATION & 115kV TRANSMISSION LINE - DRAFT COMMENT LETTER Rahn moved, Franchot seconded, to approve the comment letter to Suzanne Steinhauer, State Permit Manager, Energy Facility Permitting, MN Department of Commerce – Office of Energy Security, and to direct Staff to forward it to the Public Utilities Commission. VOTE: Ayes 4, Nays 0. CITY ENGINEER'S REPORT 7. ORONO ORCHARD ROAD AGREEMENT WITH MCES Kellogg stated in June of 2010 Staff began discussions with the Metropolitan Council Engineering Services (MCES) to determine their interest, if any, in being a partner with the City of Orono in the Orono Orchard Road reconstruction project. The Orono Orchard Road project is on the City’s street CIP and is scheduled for 2012 construction. MCES has plans to install a parallel force main down Orono Orchard Road adjacent to their existing force main to provide additional capacity and redundancy but that is not on their schedule for improvements until 2020 or beyond. In our discussions with MCES, they have concluded it made sense to move their project up on their CIP to 2012 to take advantage of the City project and capitalize on the cost savings and efficiencies by partnering with the City. The City will also benefit by partnering with MCES and that current estimates indicate the City will realize a project cost savings of approximately 26 percent or $435,000. Staff has worked through the details and crafted the attached Construction Cooperative Agreement and Attachment No. 2. The Construction Cooperative Agreement defines the terms, conditions, and responsibilities for Orono and MCERS in this joint project. Kellogg noted the City sold bonds in anticipation of this project. At the time the cost estimate for the City portion of the project was $1.7 million. That estimate was reduced by a couple hundred thousand dollars with the hope that the Metropolitan Council will contribute towards the project. If the Council chooses to move forward, it is expected the agreement will be back before the Council between now and November sometime. The next step would be to authorize completion of a feasibility report. Kellogg indicated they will hold a neighborhood meeting to identify any concerns the residents may have. The October, November time frame has been identified for a preliminary survey and preliminary design. The final design would be completed by February 2012 and would be let out for bids in March. The project would be awarded in April of 2010, work would begin in June of 2012, and the project completed in October of 2012. Kellogg noted there is not a lot of leeway in the schedule and that he would ask the Council to decide if this is a project they would like to move forward with. Kellogg also noted that because the Metropolitan Council has moved this project from 2020 to 2012, it is their anticipation it will get built in 2012. If the project is not completed in 2012, Kellogg indicated he is not sure what the ramifications will be. McMillan asked if Kellogg has discussed that issue with the Metropolitan Council. Kellogg indicated he has not since he wanted to discuss it with the City Council first. ORONO ORCHARD ROAD AGREEMENT WITH MCES, Continued) Franchot asked if the general design is to replace the existing road. Kellogg stated the road would be reconstructed as is. The Metropolitan Council project would reinstall their parallel force main on the east side rather than on the west side where it currently is. Franchot asked if the City would be maintaining the same type of road. Kellogg stated it would be the same type of road with some possible improvements to the ditches. Kellogg indicated they do not anticipate the need for any curb and gutter. It would remain a rural section roadway similar to what currently exists. Franchot asked if there would be any elevation changes. Kellogg indicated there may be some minor elevation changes to help facilitate drainage. McMillan asked if there is a bike trail in Orono's Comprehensive Plan for Orono Orchard. Gaffron stated to his knowledge there is not. McMillan commented some of her neighbors have asked about the possibility of a trail along that roadway. Kellogg stated the feasibility study would look at the location of the right-of-ways. From a legal perspective, because the road has existed for a number of years, the City has the right to replace the road in kind, but that if further improvements are done outside the existing roadway and the area designated for snow storage, there may be an issue with the land acquisition. Mattick concurred that land acquisition would like be an issue if the road is not replaced in kind. Mattick indicated that replacement in kind is typically straight forward from a land acquisition standpoint. Kellogg noted if the Council does desire a trail along that roadway; it would impact the schedule due to the need for land acquisition. McMillan commented that the road is not the best for sight lines. Kellogg stated they would look at whether the road qualifies for a 30-mile design speed and that it may be possible some improvements will be required in order for it to meet a 30-mile design speed. Printup asked whether there would be any I&I credits awarded for this project. Kellogg stated because it would be a Metropolitan Council improvement and not a City improvement, it would not be eligible for credit. Generally I&I is nonexistent in a force sewer and is only found in a gravity sewer. Kellogg noted the only city sewer on that roadway serves Mayor McMillan’s property. There is a short length of gravity sewer along that roadway but it is relatively new and they do not anticipate having to replace any of that sewer. ORONO ORCHARD ROAD AGREEMENT WITH MCES, Continued) Rahn stated if the Metropolitan Council is willing to partner with the City on the project; it would make sense to move ahead with the project. Rahn requested Kellogg provide the Council with the cost differences if the City were to do a like, kind, and size reconstruction on Old Crystal Bay Road versus a mill and overlay. Rahn noted they have talked in the past about substandard base in some areas and asked at what distances the soil borings were performed. Kellogg indicated there were five borings performed for the total length of the roadway and that generally they attempt to pick the areas where poor soils are anticipated. Rahn asked whether that cost comparison could be brought back to the Council in two weeks. Kellogg indicated they can prepare a cost estimate for the Council and bring it back to them in two weeks. Kellogg noted Old Crystal Bay Road is a state aid route and that if they are going to use state aid dollars, the road will need to meet some minimum widths. Rahn stated he would like to leave it up to the City Engineer to determine what the bare minimums are. Kellogg asked if he would like the cost estimates for the minimum standards on a mill and overlay project versus the cost estimates to reconstruct the two-way roadway to minimum standards. Rahn stated that is what he is looking for and that his intention is to not spend millions of dollars and replace infrastructure that is in good shape. Rahn stated he would like to see what the difference is between the two. Rahn asked whether the Council could move along with that in conjunction with the Orono Orchard Road project. Kellogg stated the two projects could go along on parallel paths if the City Council makes a decision on how they want to proceed in the very near future. Rahn asked what the next steps would be. Rahn commented the quicker the City does the work on Old Crystal Bay Road, the more the City will benefit from the engineering that has already been done. Kellogg noted a mill and overlay would not require plans and specs and that he could easily update the cost estimate later this year by figuring out the percent of increase in the cost index. If it is a complete reconstruct to minimum standards, he would suggest that the existing report be modifying by adding an option three. The two options already included in the report were a wider roadway with turn lanes and a wider roadway with roundabouts. Kellogg indicated adding a third option to the report would be a fairly simple process. Printup commented in his view that is a good idea for Old Crystal Bay Road. Printup stated partnering up with the Metropolitan Council on Orono Orchard Road is also a good idea. McMillan commented the Council cannot forget about Crystal Bay Road and that she would like to see both roads dealt with next summer. McMillan stated she appreciates the tight time schedule but that she would like to leave ample time to obtain public comment. ORONO ORCHARD ROAD AGREEMENT WITH MCES, Continued) Kellogg noted he has allotted some time to hold a couple of neighborhood meetings but that more could be added. Kellogg noted that the Orono Orchard Road project is going to be more complicated than a standard road project since the process has to be coordinated with the Metropolitan Council and they have their own review process. Rahn asked if they typically see the same contractor bidding on both projects. Kellogg indicated it depends on the size of the project and the size of the contractor. Printup asked if the Metropolitan Council is on board with the Orono Orchard project. Kellogg stated they are. McMillan asked if there is any reason why the Council should not sign the agreement tonight. Kellogg noted the agreement does contain some out clauses for the City and that he would recommend getting it signed tonight since it would be a good indicator to the Metropolitan Council that the City is interested in moving forward. Mattick recommended the Council approve the agreement on the Orono Orchard project tonight. Mattick noted the agreement was sent to the Metropolitan Council a couple of months ago and that he would like to keep the forward momentum going on the project. Kellogg noted the agreement does not assume there will be a trail or land acquisition necessary for a trail. Mattick noted it also does not assume any assessments. Rahn moved, Printup seconded, to approve the Construction Cooperative Agreement and Attachment No. 2, and authorize the preparation of a feasibility report for the Orono Orchard Road/MCES Utility and Street Reconstruction Project. VOTE: Ayes 4, Nays 0. Rahn moved, Printup seconded, to direct the City Engineer prepare cost estimates for Old Crystal Bay Road for like, kind and size replacement, taking into consideration the minimum standards that are required for a mill and overlay versus a reconstruct project. Rahn asked if the Old Crystal Bay Road project would also deal with the I&I issue. Kellogg indicated it would not be included since it would be a separate project. The direction at the last Council meeting was that those plans would be brought back before the Council in November with the possibility that they will go out for bids in January. Rahn stated getting the costs for an overlay and a reconstruct would be a good starting point. McMillan noted the bid for Highway 112 on the sewer repair was approximately $250,000. Kellogg concurred that it is an expensive fix. ORONO ORCHARD ROAD AGREEMENT WITH MCES, Continued) McMillan asked if there is a possibility to use manhole extensions to resolve the I&I problem temporarily. McMillan stated she understands the sewer repair is a long-term fix but that the costs were higher than she anticipated. Kellogg stated one of the issues is the proximity of the City's pipe to Metropolitan Council's force main. Kellogg indicated the City hit it on a previous project due to the Metropolitan Council locating it in the wrong spot and that they do not want to have a similar mishap occur. Kellogg stated replacement of the manholes is the most intrusive part of the project and that is one option he will look into. Kellogg noted that the pipe eventually will need to be replaced and the capacity increased. McMillan commented the City does not know when that area will be developed and that it might be a good option for the short-term. Kellogg noted the Council does not need to make a decision on that project until November. VOTE ON THE ABOVE MOTION: Ayes 4, Nays 0. 8. FOREST LAKE DRIVE STORM SEWER IMPROVEMENTS Kellogg stated on June 13, 2011, the City Council meeting discussed a cost estimate and proposed improvements to help resolve a sedimentation problem in Lake Minnetonka adjacent to the Forest Arms Country Club Homeowner’s Association joint dock. At that meeting the property owner at 4265 Forest Lake Drive spoke of concerns about the integrity of the pipe downstream from the proposed improvements. The cost estimate presented to the Council on June 13, 2011, did not include a cost to replace this pipe. The Council directed Bonestroo to further investigate this pipe to determine its condition. Staff has since televised that pipe and found that it is failing and corroded and needs replacement. Kellogg noted they could only televise the pipe nine feet down due to its poor condition. This existing pipe is located entirely on private property (4265 Forest Alake Drive) and the City does not have an easement for that area. Replacing the pipe in its current location will require removal of bushes and possibly some trees and will negatively impact 4265 Forest Lake Drive. Kellogg indicated he has had discussions with the FACCHA and they are receptive to relocating the pipe on their common lot and providing the City with the necessary drainage and utility easement. Impacts to the FACCHA property will be minimal and the cost to relocate the pipe will be less than replacing it in the current location primarily due to limited impacts and restoration efforts. As noted in a June 13, 2011, memo to Council, Bonestroo has worked with the Public Works staff to further economize this project. In a typical city project of this magnitude plans and specs would be prepared, quotes solicited, and the work on the project inspected. Kellogg indicated they have concluded that some of these steps can be minimized or eliminated if the Public Works Department completes the project and that formal plans and specs will not need to be prepared. Public Works has indicated they are able to do the work, including the additional pipe replacement, and would be able to react to favorable weather conditions quicker than a contractor by the City. The estimated costs assume Public Works staff will complete the project and includes material costs as well as an allowance for labor costs incurred by Public Works staff. Kellogg indicated they are also in discussions with the Minnehaha Creek Watershed District to pursue any cost sharing opportunities. It appears there may be a $2,000 matching grant available from the Minnehaha Creek Watershed District. McMillan asked if the existing pipe would be removed. Kellogg stated the existing pipe would be abandoned in place. Mayor McMillan opened the meeting up for public comments at 7:58 p.m. Jerry LeMire, 4205 Forest Lake Drive, stated the Homeowners Association is agreeing to a 10-foot easement off of the west property line and that the City will be drawing up those documents for them. Kellogg indicated the document has been forwarded to Tom Barrett. Aaron Russ, 915 Forest Arms Lane, indicated he has assumed the presidency of the homeowners association from Tom Barrett. Russ stated he has been informed by Tom Barrett that everything looked good with the documents. Russ indicated he does have a couple of comments regarding the legality of the easement and whether something could be built on it. Kellogg stated generally under the easement they would not allow structures to be built since it would likely compromise the integrity of the pipe. The easement is basically a 10-foot strip along the property line. Two trees would need to be removed up near the roadway. The easement would then follow the lot line and would not encroach any further into the property than 10 feet. The pipe would be 18 inches in diameter. Russ indicated he was looking down the line and whether the encroachment would cause a problem with building if the owners should decide to sell that lot some day. Franchot noted there is a 10-foot side setback anyway and that it is unlikely the City would allow anything to be built in that area. Russ commented he was wondering about the future value of the property give the easement. Kellogg stated generally on new subdivisions there is a 5-foot utility easement on both sides of the property line. In this case it made more sense to have a 10-foot easement on the one property to avoid the removal of some trees. McMillan thanked the residents of the Forest Arm Homeowners Association for allowing the City to relocate the pipe on their property. McMillan commented that relocating the pipe will help prevent a lot of sedimentation from draining directly into the lake. The City would also receive a small benefit in the form of perhaps a pound of phosphorus removal. Franchot asked if this would be paid for out of the Storm Water Fund. Olson stated it would come out of the Storm Water Fund. Franchot moved, Printup seconded, to move forward with the Forest Lake Drive storm sewer improvements, with the Orono Public Works Department providing the labor, and to direct Staff to obtain the necessary easement for the storm water pipe. REQUEST FOR PAYMENT NO. 2 AND FINAL - NORTH FARM ROAD SANITARY SEWER Rahn moved, Franchot seconded, to approve Request for Payment No. 2 and final for the North Farm Road Sewer Project, E.J. Mayers, in the amount of $1,602.12. VOTE: Ayes 4, Nays 0. MAYOR/COUNCIL REPORT Printup noted that approximately one week ago was Long Lake Corn Days, which was a success. McMillan noted the Orono Police Department participated in the parade. McMillan reported she attended the Xcel open house with Mike Gaffron and that Mike Gaffron has done a good job writing up the City's comments regarding the environmental impacts as well as a number of issues that have been raised. There were approximately three or four property owners who were also in attendance. The environmental assessment will be finished in late October and then another open house will be held in Orono to discuss the findings. CITY ADMINISTRATOR'S REPORT *10. ENGINEERING SERVICES - REQUEST FOR PROPOSALS Loftus stated pursuant to the Council direction at the last meeting, a draft engineering services Request for Proposals has been prepared. A list of engineering firms, along with the location of their headquarters, is also attached as requested by Councilmember Printup. A job description for a Public Works Director/City Engineer has also been prepared. McMillan asked how this will be advertised. Loftus indicated it will be placed on the City’s website as well as the website for the League of MN Cities. The Council could also mail it to certain firms if they so choose. Loftus noted she has already been contacted by some firms and that the word typically spreads fairly quickly. Kellogg stated the League website is probably the best spot. Rahn stated in his opinion the RFP looked fine. McMillan stated on Page 3, Letter D, it states, the ideal firm will be a full-service firm. McMillan asked whether that language would limit some of the responses. Franchot commented that the word ideal makes it nonrestrictive. Rahn recommended the Council move forward with the RFP. Printup indicated he is in agreement that the RFP process should move forward. Franchot stated in his view the RFP continues to be an unnecessary exercise and a waste of time. Franchot asked what will happen to the projects that are currently underway if a new engineering firm is retained. Loftus stated there are some options the Council can pursue. Rahn stated his feeling was that if Bonestroo was not successful on the RFP, there would be some options and that it was his belief that Bonestroo would continue to work on those ongoing projects. Mattick stated the Council can elect to utilize Bonestroo to complete those projects or switch to the new firm. Typically it does not make financial sense to switch in the middle of a project. Based on the projects discussed earlier tonight, it would seem reasonable that Bonestroo would complete those projects. That project is almost ready for construction in 2012. Gaffron stated it will also be difficult to switch to a new firm on the Casco Point shoreline restoration project. Rahn asked if the Council would like to address the issue of moving the public works position forward and whether it would be beneficial to move both the RFP and the public works position forward at the same time. Loftus stated the job description is quite lengthy and that she is interested in knowing whether the Council would like to see any changes made to it. McMillan stated the Council should discuss how they want to go about advertising for that position. Rahn stated it will likely go on the League’s website. Loftus stated there is approximately a five to ten thousand dollar difference between a public works director and a public works director/city engineer. Loftus stated typically Staff will do the recruiting and interviewing but that she is not sure what type of involvement this Council would like to have in that process. Loftus suggested the issue could be discussed further in a work session. McMillan concurred that the Council should discuss that process more in depth. Franchot stated in his view the City is doing this backwards and that it would make more sense to have the public works director/city engineer be a part of the RFP process since he is the person that would be interacting with the engineering firm on a regular basis. Loftus stated they will bring back the public works director/engineer position for further discussion at a work session. Printup moved, Rahn seconded, to approve the engineering services Request for Proposals and to direct Staff to place it for advertisement on Orono's website and the League of MN Cities' website. VOTE: Ayes 3, Nays 1, Franchot Opposed. CITY ATTORNEY'S REPORT Mattick reported in the ongoing litigation against the City there was a motion to consolidate the two cases, which has been granted. They do have a conference call with the judge set up. McMillan asked if the City Council wants to be approving the added message therapists each time or whether it can be done administratively.
