ROLL CALL
The Orono City Council met on the above-mentioned date with the following members present: Acting
Mayor Aaron Printup, and Council Members Cynthia Bremer, Doug Franchot, and David Rahn.
Representing Staff were City Administrator Jessica Loftus, City Clerk Lin Vee, Finance Director Ron
Olson, Assistant City Administrator of Long-Term Strategic Planning Michael Gaffron, Planning Director
Melanie Curtis, City Engineer/Public Works Director Jesse Struve, City Attorney Soren Mattick, and
Recorder Jackie Young.
Acting Mayor Printup called the meeting to order at 7:00 p.m., followed by the Pledge of Allegiance.

PRESENTATION
4. TOUR DE TONKA, TIM LITFIN
Tim Litfin provided the City Council with an update on the upcoming Tour de Tonka that is scheduled to
take place Saturday, August 4, 2012, and a brief overview of the 2011 bike touring event. In 2011, over
163 communities participated in the event, with the City of Minnetonka having the highest number of
bikers at 303. The event has grown substantially since 2006, with 2,448 bikers having participated in
2011, which is an increase of 300 percent in six years. The riders range from 5 to 82 years of age. To
date the Tour de Tonka has raised over $21,000 for the ICA and has collected $2,923 and 567 pounds of
food in 2011.
This year's event also includes the 4th Annual Miles of Smiles scheduled for July 30th, which allows
young riders aged 3 to 7 to participate in either a two or four-mile option. In 2011, there were 84
participants in this event.

Approximately 387 volunteers have offered to help with this year's event and rest stops are planned at
various locations through the different communities. Litfin noted that a rest stop is located at St. George
Church in Long Lake, who has helped with this event for a number of years. Litfin noted that safety is a
top priority and that a number of motorcyclists will be leading the bikers as well as bringing up the rear.
Printup asked whether the construction work being undertaken on Orono Orchard Road will impact the
bike ride.
Litfin indicated it will have a small impact but that the bikers will only be on Orono Orchard Road for a
brief period of time.
Printup noted the event is scheduled to take place on Saturday, August 4th.
BIG ISLAND PARK REPORT - GABRIEL JABBOUR, CUSTODIAN
Gabriel Jabbour addressed the City Council regarding Big Island. Jabbour noted that Big Island is
probably in the best condition it has ever been in but that the milfoil around Big Island was prolific. The
LMCD was notified of the problem and the LMCD agreed to alter their milfoil harvesting schedule which
allowed the docks to be installed at Big Island. Jabbour requested the City Council thank the LMCD for
their cooperation on that item.
Jabbour reported he and Mayor McMillan, as well as a representative from the Watershed District, went
before the LMCD regarding the possibility of having concession stands on Big Island and Lake
Minnetonka. Jabbour stated it is not in the vision of the City to have such commercial operations on Big
Island. The LMCD was presented with a Power Point presentation on Big Island. Jabbour noted the
foremost guiding principle and goal of Orono’s planning is to protect and preserve Lake Minnetonka, its
water quality, and its recreational assets. This goal continues a commitment established half a century
ago.
In 1991, the LMCD adopted a management plan, with one of the major objectives of that plan to
designate certain areas for different activities. They created a quiet refuge for children to learn, a place to
watch birds and other wildlife, a place to have a picnic, and walking trails. Jabbour noted that Big Island
is not a place to camp overnight or a place to operate motorized vehicles.
Jabbour displayed pictures showing the bluff before and after the improvement work.
Jabbour noted they may need to hire someone to clean the zebra mussels in a couple of years but at the
present time the water is pretty clear.
Printup thanked Gabriel Jabbour for his presentation and the periodic updates he has provided to the
Council.
Jabbour stated the City Council and Staff have an open invitation to visit Big Island with him anytime.
Jabbour noted the LMCD, the Watershed District and Three Rivers Park have passed a cooperative
agreement to rehabitat the bluffs on the other side of the island.

Franchot thanked Gabriel Jabbour for all his hard work and the hundreds of hours he has spent improving
Big Island.
LMCD REPORT - ANDREW McDERMOTT, REPRESENTATIVE

PLANNING COMMISSION COMMENTS - JOHN THIESSE, REPRESENTATIVE
Thiesse stated he had nothing to report but would be available for questions.
PUBLIC COMMENTS
Kahler Nygard, 1386 Rest Point Road, stated he is here as a spokesperson for the group and that they are
here peacefully tonight. Nygard stated there has been a lot going on in the City and that there have been
some stop work orders issued on work at his residence. Nygard stated he does not see why the stop work
orders were issued and under what authority.
Nygard stated he also does not understand why the wind turbine had to be removed in the first place since
it was providing free energy. Nygard stated there are nuclear plants across the country, and if there was
ever a problem, there would be radiation everywhere. Wind turbines do not create any radiation. Nygard
stated he is not sure what jurisdiction the City has been granted to regulate wind turbines and that in his
view there may be some issues with the City overstepping their authority.
Laura Hedland, 1364 Wilderness Run, Eagan, stated Orono has a special spot with Big Island and that she
appreciates the presentation on Big Island. Hedland stated this year was the warmest year ever in the
country and that the Arctic is melting. Hedland stated it is hard to believe that we are similar to the
people who left garbage on Big Island because freedom and responsibility are not easy things to own up
to.
Hedland indicated she knows Jay Nygard personally and that he is a hero. He has spent his own money to
get wind and solar energy to his residence even though it did not make economic sense but that some
things are more important than money. Jay Nygard has been a pioneer in this City but it has been a
struggle. The City has spent tens of thousands of dollars fighting this. The wind turbine may have had a
slight impact on the visual aspects, but the goal of wind energy and trying to find new ways of energy is
commendable.
Hedland encouraged the City Council to become educated on how many people are dying from climate
change and the type of world we are leaving for our grandchildren.
Carrie Plack, 6251 Eagle Lake Drive, Maple Grove, stated in her neighborhood they have a lot of wind
and that she is personally interested in installing a wind turbine because she is interested in saving money
on her electrical bill and in preparing for a power outage.

Plack asked if it is common to have people tear down structures if they do not have a building permit.
Plack stated she is also confused as to why Jay Nygard had to tear it down due to a building permit issue
since the electrical person had told him he did not need one. Plack stated she is interested in how the city
process works and that she wants to make sure she understands all of the facts surrounding the case.
Brian Novak, 1735 Perkins Lane, Maple Plain, stated he has served on the Maple Plain Planning
Commission and that he understands how difficult it is to write codes and regulations that will fit
everyone. Novak indicated he currently works with Minnesota 350, which is about climate change and
trying to get the atmosphere down to 350 parts per million. It currently is at 395 parts per million and
recently they found up in the Arctic that it is up to 400 parts per million. Minnesota 350 has been
conducting a campaign called Connect the Dots. Novak stated tonight they heard about the milfoil
coming out early this year and that he does not feel that was an accident or an accident that the apple
blossoms froze all over Minnesota because they budded out too early.
Novak stated with the great legacy the City of Orono has in supporting the environment, he would ask the
City to go one step further and look at the bigger picture. What is going to solve the problem for all of us
is a lot of little things happening, like Jay Nygard's wind turbine and adopting an overall national policy.
The wind turbine will help limit coal production. Currently there are 27,000 premature deaths in the
United States every year due to lung cancer and lung related diseases. Novak stated hopefully Orono can
step it up a notch and get their renewable energy standards and ordinances enacted now and support the
residents.
Amelia Kroeger, 65 Stubbs Bay Road, stated she is here tonight because she supports wind turbines and
renewable energy and that she is a believer in climate change. Kroeger stated approximately 20 years ago
her husband gave her a windmill for her birthday but that it did not meet the ordinances because it was too
high. Kroeger indicated they have three acres and it would not have impacted the neighbors but that they
followed the ordinances and did not install it.
Kroeger commented sometimes ordinances need to change. This particular wind generator is appropriate
for a residential area. Kroeger stated she understands there will be an ordinance written to deal with this
issue if it hasn't been done already, but that she would ask the City Council to research various websites
that have information both pro and con regarding climate change. Kroeger provided the City Council
with a list of websites.
Jay Nygard, 1386 Rest Point Road, indicated he has lived at that residence for approximately 16 years.
Nygard noted Orono's code is based on the environment and the City's entire code and everything we are
doing is based on the environment. Nygard noted tonight's agenda has two items on the Planning
Department Report that are applications for after-the-fact variances, which is 40 percent of what the City
Council is dealing with tonight.
Nygard indicated he has lived in this community for 47 years of his life and that he attended every grade
of primary school in the building across the street from city hall and also attended nature classes long
before this building was constructed. Nygard indicated he is living his childhood dream here in Orono.
Nygard stated he knows the mayor is a green, conscientious person and that she has attempted to adhere
to that philosophy in the various applications that come before the City. The City of Orono has adopted

ordinances regulating driveway monuments, oversize light poles, and other things it considers may be a
nuisance. The City of Orono has also chosen not to regulate portable hot tubs, bug zappers, and renewal
technology such as solar and wind energy. Nygard stated except for Aaron Printup and David Rahn, no
one here, including City Staff, has taken the time to visit the property and discuss the issues with him.
Nygard noted things have changed in Orono and that there are now mansions in some of the places where
he played as a kid. Nygard stated times change and people change and that everyone has to learn to
adapt. A municipality's job is to guide those changes in a meaningful way and not to punish residents
who have the foresight to bring the most modern piece of equipment there is on the planet to help beautify
their property in an effort to do the right thing.
Nygard noted Long Lake has adopted an ordinance regarding renewal technologies that is somewhat fair
to its citizens. They did it to protect the community and its citizens. Nygard asked if the City of Orono
has done anything similar. Renewal technologies are going to be an integral part of the world going
forward and Orono could be an example and a shining star in helping to integrate those technologies.
Penny Rogers stated she lives directly east of the Nygards on Rest Point Road. Rogers indicated she is
not opposed to green energy by any means but that there is a place and location where it should be
located. The last 18 months have been very difficult and frustrating. She noted their enjoyment of the
lake has been greatly diminished due to the wind turbine being placed on the lot line.
In October of 2010, Mr. Nygard applied for a permit and was denied. He continued on with his project
and continued to violate city rules. In November the City ordered him to cease and desist the activity. He
violated four different ordinances by installing the structure as well as hardcover requirements, which has
not been mentioned tonight. In 2002, when he received a variance from the City, he agreed that their lot
would be considered fully built and that no other increases to structural coverage would be allowed.
Therefore, as a result of their lot being fully built, they were not going to be allowed to build another
structure.
Rogers stated the Nygards placed the wind turbine so close to the property line that for a while the nine
foot blades were shown by survey to trespass over their property line. The blades were approximately 30
feet from their home. They had to view the turbine from every south and west facing window and it was
directly across from their deck. Rogers stated they were not able to enjoy their outside time on their deck.
Rogers stated the effects on them and their home were many. The wind turbine reflected light into their
home in the morning, which was like having a strobe light inside reflected on their walls and glass and
picture windows. In the afternoon they experienced flickering shadows. When it was windy, they would
hear a whirling noise, which was disruptive to them in their home and loud enough to wake them up at
night. The neighbors two doors down could also hear the turbine.
Rogers noted two of Orono's neighboring cities have ordinances regulating wind turbines. Both cities
require that the property owner comply with all setback requirements. Long Lake also requires that any
wind energy system be designed to utilize earth tone colors and textures that are compatible with adjacent
dwellings. Rogers noted this turbine is not compatible. Minnetrista's ordinance requires the property to
be a minimum of ten acres. The Nygard property is less than one-half acre. This turbine would not meet
those code requirements.

Rogers noted that Mr. Nygard has stated in newspaper articles that he is not affecting the health, safety or
welfare of anyone and that there are no ordinances that he is violating, which is far from the truth. He
also admits that his motivation to install the wind generator is not solely driven by an overwhelming
concern for the environment or to conserve reserves. Mr. Nygard said this is also part of his business.
Rogers stated in addition to running a turbine all hours of the day and night, Mr. Nygard has also been
harassing the neighbors in other ways.
Rogers stated the City of Orono is doing the right thing by suing Jay and Kendall Nygard for their illegal
and continuous violations of the City's ordinances. The City cannot make exceptions, nor should they, for
structures that violate its ordinances. Working with the City legally is the right solution. Rogers stated in
her view the placement of the first turbine on the property and now the second turbine on the property
constitutes harassment against them. It is intrusive and it has caused them substantial adverse affects on
their privacy and property value.
Sheridan Nygard, 1386 Rest Point Road, noted there are a lot of people that do support the wind turbine.
There is a wide range of ages that support wind energy. Nygard stated the wind turbine will affect you a
little bit if you live near it but that it does not bother her. Nygard commented her dad does like the wind
turbine and that even if he cannot keep it, she will keep trying to utilize green energy. Nygard noted she
also has some friends here who think it is cool.
Dennis Walsh, 1354 Rest Point Circle, stated everyone is for green technology but that there is a context
and a place. Walsh noted Jay Nygard served on Orono's Planning Commission and also on the City
Council and that he knows there are processes and rules to follow but that he has chosen a different route.
Walsh stated the City has a few choices in dealing with this situation. There is the integrity of the City
from a rural standpoint in how the rules should be followed or a lawlessness of the Wild West where
citizens do whatever they want, whenever they want regardless of the situation with the neighbors or
anything else. Walsh stated that is a problem for the City. There are reasons for codes, and if the City
does not uphold those codes, this situation will exacerbate and the City will not have any laws.
Walsh stated at this point the courts have ruled pretty clearly what is right and what is wrong and that the
property owner needs to comply with the court's ruling. Walsh encouraged everyone to work with the
City to get things implemented the correct way and that the people who do things incorrectly need to be
held accountable.
Walsh noted Jay Nygard talks about doing the right thing but that he keeps putting up more structures that
get red tagged and torn down. Walsh stated he hopes the Nygards do the right thing so the neighbors can
put it behind them and they can have a peaceful neighborhood once again.
Shalen Score, 5797 Colony Lane, stated there is nothing wrong with a wind turbine since it provides free
energy, and if there is a problem with lights, that is what curtains are for.

PUBLIC WORKS DIRECTOR/CITY ENGINEER'S REPORT
Struve reported there are a few projects being undertaken in Orono. Work has begun on Orono Orchard
Road today. The roadway will be milled into a gravel base starting this Thursday. The project will begin
toward the south end by Fox Street and move north, which is a slight change from what was originally
planned. According to the last construction update, access to the golf course will be open all days. The

public may need to access the golf course either from the north or the south depending on the status of the
construction that day but detour signs will be erected directing traffic.
Struve reported that the Hennepin County 19 bridge replacement project over Forest Lake Channel is
scheduled to begin July 17th. There is a link on the City's website that will direct people to Hennepin
County’s website where there should be updates on the project. Orono's Public Works Department is
finishing up cleaning up sanitary sewers on Tonkawa Road.

MAYOR/COUNCIL REPORT
Rahn stated to his knowledge they have updated the signs for the bridge replacement project today.
Printup noted the Children of the Revolution had near record attendance at their event on July 4th at the
Wayzata Depot. The Creative Kids Academy has their grand opening scheduled for this Saturday, July
14th from 1:00 to 4:00 pm. The public open house for Old Highway 12 is scheduled for Thursday, August
9th, from 5:00 to 7:30 p.m. at Lake Community Bank.
CITY ADMINISTRATOR'S REPORT
Loftus noted the LMCD did approve their 2013budget with a 2.6 percent increase. Loftus indicated she
did share with the LMCD the City's desire that there not be an increase given the City's desire to maintain
a zero percent increase in the City's budget. Orono is the second largest contributor to the LMCD at
$58,000 a year.
