ORONO CITY COUNCIL WORK SESSION

Present: Mayor Lili McMillan, Council Members Doug Franchot and Aaron Printup; representing Staff
were City Administrator Jessica Loftus, Assistant City Administrator for Long Term Strategy
Mike Gaffron, Finance Director Ron Olson, City Clerk Lin Vee, Public Works Director/City
Engineer Jesse Struve and City Attorney Soren Mattick.
Council interviewed Christopher McGrann to fill vacancies on the Planning Commission as a regular or
alternate Planning Commission Member and reviewed the interviews that were held with Tom Frahm
and Bruce Lemke at the May 14, 2012 Council work session.
Council discussed the list of interested representatives to the Project Advisory Committee (PAC) for the
CSAH 112 (old Highway 12) Turnback Committee. Loftus will submit a list of residents and
representatives of Orono businesses to Jim Grube at Hennepin County, which includes Juan Cristiani,
Gary Wilson, Richard Wysocki, Stuart Ackman, Cheryl Klinkhammer, Justin McCoy and Jeanne Mabusth.
Sturve provided background information regarding a curb complaint at 1386 Rest Point Road. Council
and staff agreed to support the recommendation of the Public Works Director/City Engineer as stated in
his memo dated May 24, 2012. A written response will be provided to the complainant.
Gaffron outlined the rationale and basis for park dedication fees that were established in 2001. Based
on Council discussion of potential parkland acquisitions and improvements, the “Park System Analysis
for Establishing Park Fee” will be updated as of 2012. Council agreed to continue with the current
method for determining park dedication fees as defined in the Park Dedication ordinance.
Council briefly discussed the current process of the Local Board of Appeal and Equalization vs. the Open
Book Meeting which is held by the county assessor’s office. It was the consensus of the Council to
continue with the Local Board of Appeal and Equalization process. Prior to the 2013 Local Board, at
least one Council Member who will be in attendance at the meeting will be required to attend training.
There were no comments regarding Information Update items.

The Orono City Council met on the above-mentioned date with the following members present: Mayor
Lili Tod McMillan, and Council Members Cindy Bremer, Doug Franchot, and Aaron Printup.
Representing Staff were City Administrator Jessica Loftus, City Clerk Lin Vee, Finance Director Ron
Olson, Assistant City Administrator of Long-Term Strategic Planning Michael Gaffron, City
Engineer/Public Works Director Jesse Struve, City Attorney Soren Mattick, and Recorder Jackie Young.
Mayor McMillan called the meeting to order at 7:02 p.m., followed by the Pledge of Allegiance.

4. 2011 COMPREHENSIVE ANNUAL FINANCIAL REPORT
Dennis Hoogeveen and Michelle Hoffman, Clifton, Larson, Allen, were present.
Hoogeveen noted the firms of Larson, Allen and Clifton, Gunderson have merged as of this year and their
business focus is on governmental entities.
Hoffman stated the audit does provide reasonable but not absolute assurance on the City’s financial
statements. A new accounting policy was adopted in 2011, GASB 54, which affects fund balance
categories and special revenue funds. The significant accounting estimates included in the report include
useful lives of capital assets, valuation of investments, and post-employment benefits. Hoffman noted
that they received the full cooperation of the City’s management team during the audit.
Hoffman noted the City received an unqualified or clean opinion on the financial statements, which is the
highest rating the City can obtain. Two exceptions were noted as it relates to preparation of financial

statements and segregation of duties, which are the same two exceptions noted during last year's audit.
Hoffman indicated those exceptions are common with cities the size of Orono.
As it relates to the Minnesota legal compliance, various areas were tested and there was one exception
noted, and that was a disbursement not paid within 35 days. Hoffman stated to her understanding it
related to a golf course expense.
McMillan asked what is meant by the exception in the preparation of the financial reports.
Hoogeveen indicates it has to do with the fact that Orono has a small staff and relies on auditors to draft
their financial statements. Under the new GSAB regulations, the auditor is required to inform the City
Council that the City is relying on Clifton, Larson, Allen to prepare those financial statements.
Hoffman stated as it concerns the General Fund/Unreserved/Unassigned Fund Balance, the unassigned
amount of expenditures for the year was $3.5 million, which is approximately 54 percent for the year. As
it relates to the General Fund Revenue, all of the revenue streams have remained fairly consistent over the
past five years. Total General Fund Revenues for this year is approximately $5.9 million. As it relates to
the General Fund expenditures, those also have remained fairly stable over the past five years, with the
total expenditures in 2011 being approximately $5.5 million.
Hoffman noted as it relates to the Other Governmental Funds-Fund Balance, different categories have
been created due to the new accounting standard. The unreserved and assigned categories over the past
five years have remained basically the same except for a different title. There was a decrease in 2011 as a
result of the bond payment that was paid off in that year.
Total revenue in 2011 was approximately $1.6 million compared to $1.4 million in 2010. There was an
increase in intergovernmental spending last year and that related to some MSA funding for a bridge
project. The All Other Revenues Category was higher in 2007 and 2008 due to investment income
received by the City.
Hoffman noted the Other Governmental Funds – Expenditures graph shows a higher amount of debt
service in 2011 than in the previous four years due to the $1.6 million bond payment that paid off the
2003 public utilities lease bonds.
The City’s Enterprise Funds consist of the water fund, sewer fund, and storm water fund. A little over $2
million was spent on the Casco Point project in 2009, which is the reason for the decrease in that year.
As it relates to the Enterprise Funds-Operating Income, the water and sewer funds did have operating
losses in 2011. Once you factor in non-operating revenue, those funds would have had a positive change
in net assets.
McMillan asked if non-operating revenue is like connection fees and antenna fees.
Hoffman indicated it is. Hoffman stated in 2007, there were a couple of bigger developments that
generated more trunk fees, which was the reason for the increase in that year.

The Government-wide Financial Data chart shows the City’s cash and investments, expenses, and
expendable net assets. The amount of cash and investments has remained constant from 2010 to 2011. In
2009 there was a decrease in cash due to the Casco Point project.
Hoffman noted the City’s future debt service is projected to decrease over the next five years. The tax
rate comparison was obtained from the League of Minnesota Cities and shows that Orono is at 14.9
percent, which is the lowest among the cities shown on the chart. There are 140 cities contained within
Region 11, and the average tax rate among cities with a population of 5,000 to 9,999 is 38 percent. In
comparison to other cities in the area, Orono is the lowest at 15 percent, with Medina the next lowest at
18 percent.
Hoffman noted there will be two new GASB standards that will become effective in 2013. GASB No. 61,
the Financial Reporting Entity, becomes effective in 2013 and modifies previous requirements for
inclusion of component units, such as the City’s HRA. In addition, GASB No. 62, Codification of
Accounting and Financial Reporting Guidance, goes into effect in 2012, and potentially impacts
accounting policies followed by the proprietary funds.
Hoffman noted the City has received the GFOA Certificate of Achievement for Excellence in Financial
Reporting for 2010. The City also received that award in 2009.
The City Council took no formal action on this item.
5. ANNUAL POLICE REPORT – POLICE CHIEF CORREY FARNIOK
Farniok presented the Orono City Council with the 2011 Orono Police Department Annual Report.
Farniok noted in 2011 Orono had just under 14,000 calls for service, with the majority of those being
traffic stops. The response time analysis shows an average response time of 5.74 minutes on priority calls
and an overall response time for all calls of 7.78 minutes.
The majority of the crimes in the area consist of thefts, followed by burglaries. The Police Department is
seeing a 56 percent increase in property crimes for 2012 and is consistent with the other cities in the area.
Farniok stated part of the reason for the increase is the fact that more individuals are coming out to this
area and committing crimes.
Some of the investigations that involved a fair amount of time on the part of the police department
involved a felony fraud case, a second degree criminal sexual conduct, theft by swindle, felony burglary,
and felony theft/fraud. There were two arson investigations in 2011. Neither of those cases ended in
criminal charges due to the difficulty of proving there was arson, but they did reveal a better way to
investigate suspected arson cases.
The West Metro Drug Task Force seized illegal drugs in 2011 with a street value of $5,121,644.15. In
addition, 12 firearms were seized and 59 search warrants were executed. The Drug Task Force is seeing
more crimes associated with prescription pills. The annual budget for the West Metro Drug Task Force is
$280,486. Forfeited cash received was approximately $132,000 in 2011.
Farniok stated for the first quarter of 2012, they are seeing a rise in general thefts as well as drug activity.
The use of heroin is increasing in the area. The Police Department is also seeing an upward trend in use

of the Dakota Trail by individuals and different organizations that are utilizing the roads and trails for
biking and other events.
Printup asked what the Police Department is seeing as it relates to the increased heroine usage.
Farniok indicated they are seeing heroin usage increasing due to people becoming more addicted to pain
killers and then turning to heroin as a substitute. Farniok stated typically very small quantities are
involved which makes it difficult to capture the dealers and/or users. Heroin is also fairly cheap
compared to other drugs.
McMillan asked how Three Rivers Park feels about the increased demand for the Dakota Trail by the
various organizations.
Farniok stated Three Rivers has left usage of the trail for special events up to the various cities. Orono is
not seeing the impacts that other cities are seeing such as Spring Park and Mound.
The City Council took no formal action on this item.

7. PLANNING COMMISSION APPLICATIONS
Gaffron noted the Planning Commission has one regular vacant position and up to two alternate positions
available at the present time. The City Council has recently interviewed three candidates for the Planning
Commission and Staff is recommending that one be appointed as a regular Planning Commissioner and
the other two as alternates if they are interested.
Franchot moved, Bremer seconded, to appoint Bruce Lemke as regular planning commissioner and
to appoint Chris McGrann as an alternate planning commissioner.

PUBLIC WORKS DIRECTOR/CITY ENGINEER’S REPORT
8. ORONO ORCHARD ROAD PROJECT – BID AWARD
Struve stated at the April 9, 2012, meeting, the City Council was presented with plans and specifications
for the Orono Orchard Road project and gave authorization for bidding the project. Bids were opened on
May 11, 2012. The low bidder is Minger Construction, Inc., in the amount of $2,957,685, which is
approximately 5.8 percent lower than the estimated project cost of $3,139,047 as presented in the
feasibility report.
This is a Cooperative Agreement project with the Metropolitan Council Environmental Services. MCES
has reviewed the bids and are in agreement with the updated, but still estimated, project cost splits. As
per the Cooperative Agreement, the final project costs will be reimbursed based on actual project
numbers. This places MCES’s city project cost participation rate at 24.5 percent.
The total for city road and utility improvements is $936,537. After including the 20 percent for
engineering costs and 5 percent for bonding, the total estimated City contribution is $1,180,037. This is
approximately 3.7 percent lower than the estimated $1,226,000 project costs as presented to the City
Council on April 9, 2012.
McMillan noted that approximately $1 million of the costs for this project is allocated for the sewer
portion of the project, which will be picked up by the Metropolitan Council.
Printup moved, Franchot seconded, to award the bid for the Orono Orchard Road project contract
to Minger Construction, Inc., in the amount of $2,957,685. VOTE: Ayes 4, Nays 0.
9. PUBLIC HEARING – ANNUAL PUBLIC HEARING FOR NPDES PHASE II STORM
WATER PERMIT
Struve noted the City of Orono holds an MS4 (Municipal Separate Storm Sewer System) permit under the
NPDES program for operation of the City’s stormwater drainage system. The NPDES is a national
regulatory program under the jurisdiction of the U.S. Environmental Protection Agency and is
administered at the state level by the Minnesota Pollution Control Agency.
A requirement of the permit is that an annual report be prepared and submitted to the MPCA. Staff has
prepared the report and will submit to the MPCA at the completion of this meeting. One component of
the report is that the City must hold a public meeting. The meeting must provide a summary of the City’s
Storm Water Pollution Prevention Program, the activities of the City for the past calendar year in regards
to the permit requirements, and must afford the opportunity for public input and comment.

(9. PUBLIC HEARING – ANNUAL PUBLIC HEARING FOR NPDES PHASE II STORM
WATER PERMIT, Continued)
Struve stated the goals of the public hearing are to educate interested citizens, meet a requirement of the
permit, and to receive comments from the public on the Storm Water Pollution Prevention Program and to
provide Progress on Best Management Practices.
NPDES stands for National Pollutant Discharge Elimination System. There are six minimum control
measures, and they include: (1) public education and outreach; (2) public participation and involvement;
(3) illicit discharge detection and elimination; (4) construction site storm water runoff control; (5) post-
construction storm water management; and (6) pollution prevention and good housekeeping for municipal
operations.
The local and global impacts of storm water discharge include a decline in aquatic biodiversity, habitat
loss, increased flooding, aesthetics, human health, and drinking water quality decline. Typical pollutant
sources include residents dumping pollutants into waterways or runoff from yards.
2011 MCM Achievements include public education through articles in the City’s spring and fall
newsletters, stormwater information on website, grass and leaf disposal program, construction debris
collection, and erosion control inspections. There were 126 total inspections conducted in 2011, with two
stop work orders being issued and 12 notice of violation orders.

MAYOR/COUNCIL REPORT
Printup thanked the participants in the Memorial Day Service at Union Cemetery.
McMillan noted on May 4th she attended a program at the Orono Schools dedicating the new nature center
that was approved on April 9th by the City Council. The school will be able to use the outdoor classroom
for their summer program. McMillan commented it is a wonderful addition to the school and provides
the students with opportunities to explore nature.
Franchot commented the new senior living center appears to be a very well done project and will not
negatively impact the Luce Line, which was one of the concerns of the City Council.
McMillan noted there will be a ribbon cutting ceremony on June 7th for the facility.

CITY ADMINISTRATOR’S REPORT
10. FUND BALANCE DISCUSSION
Olson reported as of December 31, 2011, the unassigned fund balance was $3,523,859, which represents a
balance of 60.9 percent of the General Fund operating budget. A fund balance of 50 percent would be
$2,892,815, which is $631,044 less than the current balance.
The fund balance increased by approximately $250,000 during fiscal year ending December 31, 2011.
Olson noted one of the major contributing factors was building permits exceeding expectations for 2011,
which were the highest since 2005. The other major portion of that increase was money that was not
expended for the services of a consultant planner and less police overtime.
According to City policy, the amount in excess of 50 percent is to be transferred into another fund. The
total amount to be transferred is $631,044. Any inter-fund transfer requires approval of the City Council.
The Council does have the authority to transfer excess fund balance to funds other than the Community
Investment Fund.
The Community Investment Construction Fund allows the greatest latitude in the use of the funds. The
funds can be used to fund city-wide projects that have no other funding source such as a road project, a
sidewalk/trail, park acquisition, or allocated to City facilities. This fund is currently funding an annual
transfer in the amount of $130,000 for debt support of the 2010 fire hall refunding bonds. The fund
balance as of December 31, 2012, is $1,793,299.
Olson stated he would recommend the money be transferred to the Community Investment Construction
Fund since it allows the City greater flexibility in how the money will be spent. Other possible funds for
receiving a transfer include the Pavement Management Fund, Debt Service Funds, Improvement &
Equipment Outlay Construction Fund, or the Permanent Improvement Revolving Fund.
Franchot stated he has had some difficulty with cutting what he considers minor but important things out
of the City's budget. Franchot asked if there is a way that some of this money could be reserved and
allocated to those items that the City elected not to increase last year, such as an increased payment on the

Olson stated the City Council could direct that, but that he would not be comfortable with allocating the
funds towards an ongoing expense.
Franchot asked where the money is located right now.
Olson indicated it is in the General Fund.
Franchot stated he does not see an accounting problem since it is already in the General Fund.
Olson stated it is not an accounting problem per se but that the levy did not increase due to the fact the
City used fund balances to offset those expenses.
Franchot noted the City has chosen not to do some things because they did not think they would have the
money and there was a reluctance to increase taxes, but due to good management, the City now has a
surplus. Franchot asked if that money could somehow be available to address some of these items.

Bremer stated from a budgeting perspective, if there is typically a surplus at the end of the year, it is a
lesson to be learned going forward. Bremer stated in her view it is a front-end problem with how the
budget is created.
Franchot indicated he is in agreement with that but that he is attempting to identify some resources to
supplement those items that were not increased or cut.
Bremer stated the City prepares its budget based on what it anticipates for revenues and expenses and that
in her view she does not feel the City can reinstate something knowing that the budget is not as tight as
what they originally thought. Bremer stated they can reinstate items in future budgets if there is typically
a surplus at the end of the year.
Loftus noted the Debt Service Funds could perhaps fit that objective raised by Council Member Franchot
without increasing the City's total levy. Loftus commented it is difficult to get it exactly right on
expenses and revenues and that the City tries to be more conservative in budgeting, but that they are
generally pretty accurate with their budget projections.
McMillan pointed out the building permit revenue is variable and difficult to predict. McMillan stated
given the fact that the City has received some favorable bids on a number of projects, perhaps the City
could go forward with a couple of additional projects and that it might be worthwhile to take $100,000 of
this money and attempt to obtain bids on other road projects throughout the City. McMillan noted the
City's 2011 CIP identifies a number of roads for mill and overlay that this money could perhaps be
allocated to this year.
Struve stated he can put that money to good use on street projects and that they are in the process of
looking at roadways for seal coating. The City does have some money in the budget for the next two
years to prep those streets for seal coating, and if some of the money is allocated towards those projects,
that would allow the City to get a step ahead in that process.
Printup stated he would be in favor of allocating some of the money towards road improvements. Printup
stated he is also comfortable with the $39,000 allocation to the PIR fund for capital purchases.
Printup moved to transfer $39,000 to the PIR Fund for future police capital purchases.
McMillan asked if a specific amount needs to be identified now that would be transferred.
Olson indicated it is not necessary to identify a specific amount at this time.
Franchot stated he would like Staff to spend some time researching various road projects. Franchot
indicated he has a concern that if all of the money is allocated towards road projects, that once the City's
budgeting cycle starts, they will not have the money available for other things. Franchot stated he would
be opposed to the majority of it going towards roads and that he would like to see Staff’s
recommendations.
McMillan stated she would like Council Member Printup to finish his motion.

Printup stated the way he reads the recommendation, if it is transferred to the Community Investment
Construction Fund, it can be allocated for roads or other projects at a later time.
Bremer asked if there is any deadline for the transfers.
Olson indicated it would have to happen in the 2012 budget year.
Printup moved, McMillan seconded, that $39,000 be transferred to the PIR fund for future police
capital purchases and to transfer $592,044 to the Community Investment Fund.
Mattick stated the Council could direct Staff to come up with their recommendations for future road
projects.
Franchot asked if it can also be directed to debt service if it is transferred to the Community Investment
Fund.
Olson indicated it can be.
McMillan noted the City’s debt service starts to decrease next year.
Bremer stated that would be another question to look at, which is how that money would impact the
City’s debt service.
Olson indicated it would be spread out over the life of the bonds and that it would amount to
approximately $50,000 per year that the debt service levy would be decreased.
McMillan asked why the City would want to be paying that off early if the City has received a low
interest rate on the money.
Olson noted the money would just be set aside to pay off the debt service. The sole reason to do that
would be to decrease the tax levy or to free up money from the levy to pay other obligations.
McMillan commented she does not see any additional debt being added next year and that perhaps the
City could look at adding another project once the debt service gets down to half a million dollars.
Franchot stated he would like to see some future discussion on this.

Loftus reported she will be attending the first Technical Advisory Committee meeting for the turnback of
County Road 112 and that she will be providing them with the list of the other individuals on the Project
Advisory Committee as reviewed by the City Council. She also noted the installation of the new Voice
over Internet Protocol (VoIP) phone system went smoothly with the help of Finance, IT and the City Clerk.
Loftus noted June marks the start of the official budget cycle for the City and that she will be attending a
budget meeting at the LMCD on June 7. The LMCD has proposed an overall budget increase of 2.6
percent, which amounts to 0.9 percent increase for Orono based on market values. Loftus stated she
would welcome the City Council's comments on that proposed increase and that she would relay those
comments to the LMCD on June 7.
