REGULAR COUNCIL MEETING OF MAY 13, 2013 McMillan requested the minutes be corrected to read on Page 23, Paragraph 5, as follows: “The 1.3 percent increase in expenditures would increase it from 581,000 to 588,000,” and on Page 25, Paragraph 2, “McMillan stated she personally does not have much information about living with zebra mussels…” Levang moved, Printup seconded, to approve the minutes of the Orono City Council meeting of May 13, 2013, as revised. PUBLIC COMMENTS None PLANNING DEPARTMENT REPORT 3. #13-3596 CITY OF ORONO – ACCESSORY USES AND STRUCTURES – ZONING ORDINANCE AMENDMENT Gaffron noted the City Council reviewed this item at their May 13th meeting. Comments and suggestions from that review had been incorporated into the fifth draft, followed by additional input from the City Attorney, which has resulted in a number of refinements reflected in the sixth draft provided for City Council review this evening. Item #03 - CC Agenda - 06/10/2013 Approval of Council Minutes 05/28/2013 [Page 1 of 18] MINUTES OF THE ORONO CITY COUNCIL MEETING Tuesday, May 28, 2013 7:00 o’clock p.m. _____________________________________________________________________________________    Page 2 of 18   (3. #13-3596 CITY OF ORONO – ACCESSORY USES AND STRUCTURES – ZONING ORDINANCE AMENDMENT, Continued) Ordinance Sections 3 through 11 have been reworded to say: “Within any one family residential district, the only permitted accessory uses are the following…” The intent of the wording was to limit the potential list of accessory uses that are allowed to just what is on the list. The very last item in each of those lists talks about other uses that may be customarily incidental and subordinate to the principal use. Staff also looked at the listing of building and structures in terms of what was labeled detached garages and other detached buildings. That has been broken out into three separate line items for clarity. Staff is not totally happy about some of the ramifications of this language and would like the input of the City Council on this item. One of the concerns about using the terms detached accessory structures is that within the confines of something being customarily incidental and subordinate to the principal use is virtually everything that is not a use but is a structure, which can be from a dog house to the patio to any large building to a basketball hoop, would fall under that language. A structure is a term that is all- encompassing and just about anything is a structure that requires a location on the ground. The Planning Commission had recommended that the listings for “private recreational sporting facilities” and “private recreational play facilities be separated out. The definitions have been shortened by removing the examples of those uses and inserting the examples into a definition of each. The definitions attempt to make a distinction between those uses that require a building permit and those that do not, such as mobile equipment, although that distinction is not always clear. At the last City Council meeting, there was a question regarding roadside produce stands. The word temporary has been added to that definition, so if there are roadside produce stands, they would only be allowed for a limited period of time. Page 37 of 39 deals with a detached structure, such as stationary and recreational facilities that require building permits, which is a distinction, and trampolines and other mobile active recreational equipment that do not require a building permit. Similarly, Staff has taken all of the examples out of the list of accessory uses and placed them in the definition for structures or equipment such as hot tubs, barbecue pits, playhouses, etc., and other recreational facilities used for or by the residents. The difference is that many of those things may or may not require a building permit depending on how they are constructed and used. In both listings it is noted that the facilities are required to meet the pertinent accessory structure location and height requirements of the Zoning Chapter. This does not, however, address the fact that the City has historically allowed certain listed uses/structures to be located closer to the lot line than the required accessory structure setback. Gaffron indicated the other key element that shortens the code up significantly is elimination of the page and a half of standards for communication, reception, and transmission devices from each section. Those standards have been placed in a new listing towards the back of the ordinance under supplementary requirements and restrictions. Gaffron noted that set of standards has been in place for a number of years and contains the City’s standards for radio, television receiving antennas, satellite dishes, and amateur shortwave radio. The current definition for an accessory use is not changing under the current draft. Accessory use or structure in today’s existing definition is a use or a structure subordinate to and serving the principal use or structure of the same lot customarily incidental to the principal use or structure. While it has been removed from this section, it is already listed elsewhere in the code. Gaffron indicated when we talk about having a list of accessory uses, one of the reasons the City is attempting to create a list of accessory uses is to provide some clarity to what is intended by the code. Given the fact that Staff understands that the code as it exists today can be interpreted in ways different than what has been intended, Staff is attempting with the changes to make a code that is very clear for the public to understand. After much consideration, Staff has concluded that the existing combined definition of “accessory use or structure” is appropriate as opposed to separate definitions for “accessory use” and “accessory structure.” Because the current code has multiple definitions, Staff has deleted the existing definition of “accessory use,” not added a definition of “accessory structure,” retaining the existing definitions of “principal use” and “secondary use.” Also added are the definitions of private recreational sporting facilities and private recreational play facilities. Ordinance Section 27 has been added to revise Shoreland Ordinance Section 78-1281 (Water-Oriented Accessory Structures) to allow flagpoles and small pump houses (no greater than 20 square feet in area and no higher than 48 inches in height) within the lakeshore setback. As drafted, flagpoles would have to be set back from the ordinary high water level a distance that is yet to be determined as well as meet the required principal structure side setback for the zoning district. Setbacks would be no less than the principal structure setback. In a side yard in the one-half and one acre zones, it would be at least ten feet from the side lot line; in the 2-acre zone, it would be a 30-foot side setback; and in a 5-acre zone it would be a 50-foot side setback. Ordinance Section 28 has also been added to review Shoreland Ordinance Section 78-1279 (placement of structures on lots) to add flagpoles and pump houses to the short list of structures not required to meet the average lakeshore setback requirements. Gaffron noted there are a number of existing pump houses already in existence and the standards have been revised to match those of a lockbox. Bremer asked why that specification should be included in Section 2 and not in Sections 1 or 3. Gaffron indicated both a pump house and a lock box are typically at the shoreline or close to the water. A flagpole could be located close to the shore or elsewhere on the property. Gaffron asked if the Council would prefer a specific distance from the shore be required for a flagpole. Bremer stated she does not see the reason for a difference. Gaffron asked if she is suggesting that there not be a standard for flagpoles in the 0-75 foot zone. Bremer stated if they were going to do that, then it would not be necessary for Items 1, 2, and 3, and that she does not understand the philosophy for having a different distance for a flagpole. Bremer commented it would also depend on the topography of the lot. Anderson noted the City has regulations on flagpoles and that she is not as influenced by the proximity to the lake. McMillan stated in her view the side setbacks are more important than the closeness to the lake. McMillan noted there are currently a number of flagpoles located in the 0-75 and some smaller ones are located on people’s docks. Levang asked if it could become a visibility issue. Gaffron stated that could become a factor in certain situations. McMillan noted the side setbacks and height restrictions would help to some degree. Gaffron stated it could then read; one flagpole set back from a lot lines a distance of no less than and strike the language to be located X feet from the ordinary high water level. Section 28 should be changed to allow structures that are past the average lakeshore setback by specifically adding flagpoles and pump houses. Gaffron noted Ordinance Section 20 as reviewed on May 13th included five options for regulating “height of structures.” As a result of that review, it became clear that the City Council was interested in continuing to regulate excess structure heights via the conditional use permit and/or variance processes, based on whether the structure in question was attached or detached to the principal structure. The draft language now establishes that attached features of a building would need a variance for any height increase above the standard permitted building height for that district and that freestanding detached structures would need a conditional use permit to extend up to 50 percent above the permitted height, but a height increase greater than 50 percent would require a variance. McMillan asked if the advantage of requiring a variance versus a conditional use permit would be that variances are harder to obtain. Gaffron stated a conditional use permit, if the standards are met, will typically be granted. The City has not established any standards for increasing the height except for requiring a conditional use permit that allows an increase in height. The City has historic language that talks about the process for doing it but not the reasons why. Gaffron stated it currently is not spelled out in the code so it would be a variance by default. If the City Council would like to require a variance before the higher height is allowed for a flag pole or other accessory structure, Staff would suggest that language be included. Mattick stated if the City Council wants to limit it to a certain height, it should be spelled out, which would help the City create a standard that can be enforced. Mattick recommended the City not create a process where either a conditional use permit or a variance is required depending on different levels. Mattick recommended the Council just set it at a specific height for both. Gaffron stated the next question would be whether the City wants to list the things that a variance would be granted for. Mattick recommended the City not create a variance list. Gaffron noted Items A and B identify a list of items, and if you want to go higher than 30 feet, a person would need to go through the variance process. The intent is that everything has to meet the height restrictions, and anything higher than that would require a variance, including church spires. Mattick commented a lot of churches do not have the high spires anymore but there will be certain districts where they are more common as an allowed use. Mattick stated he understands parapet walls but that basically height is height. Bremer noted historically Item C has been included and asked if that would be removed as well. Gaffron stated the City Council probably should take a close look at the list, which includes things that are typically higher than your average structure, such as an elevator penthouse, HVAC or cooling towers, and if there is a 30-foot height restriction, anything above that would require a variance. Mattick stated you could either grant a variance or treat it as a non-encroachment within a specific zone. The City currently does that with side setbacks. Mattick stated you should not really need a conditional use permit for an elevator shaft. Gaffron stated Staff may want to draft something that allows those items at certain standards. Bremer stated it would not be in that section. Gaffron noted the title of that section is height of structures but that Staff will need to look at that closer. Gaffron stated as it relates to alternative energy systems, the draft ordinance adds “solar electric and solar thermal systems” and “geothermal systems” to the list of allowed accessory uses within each zoning district. As a complement to this, or as an alternative to including them in the list, the City Council may want to, at some point, establish standards for such systems. The best option for accomplishing this may be to establish a separate section under Article X – Supplementary Requirements and Restrictions; Division 1, entitled Alternative Energy Systems. This section would define the various types of alternate energy systems and incorporate a set of standards for each of the listed uses. Gaffron noted he has attached some language from other cities in his memorandum. Solar energy systems: a. Building integrated (system replaces a building component, such as photovoltaic or hot water systems being part of the roof, skylight, or awning system) b. Flush-mounted (system mounted on top of roof) c. Ground mounted (system is in the yard) 2. Geothermal energy systems: a. Closed loop (system circulates heat transfer fluid within closed loops of pipe) b. Open loop (system transfers heat directly from groundwater, then discharges groundwater back into the ground). This type of system is generally not allowed. 3. Wind turbine systems: a. Horizontal axis (propeller) b. Vertical axis (egg beater) 4. Outdoor wood boilers. Also known as hydronic furnaces. Many cities do not allow these. Staff is not aware of an outdoor wood boiler in existence at this time but there might have been one or two in the past. Staff is aware of a significant number of solar energy and geothermal energy systems existing within Orono. Most common are Items 1a, 1b, and 2a. Many cities have adopted standards for use of these systems as accessory to residential uses. The current draft list of accessory uses does not list “trash enclosures” as a permitted accessory use, but they certainly would be customarily incidental to the residential use. Orono Code deals with residential trash in two code sections. Other cities’ codes often contain a screening requirement. Fences used for screening should meet City fence location and height requirements. Establishment of a separate structure or screening fence far from the residential structure, such as at the street end of a very long driveway, has the potential to become problematic from a security standpoint, from a health and sanitation standpoint, and from an aesthetic standpoint. Gaffron requested the City Council discuss whether trash enclosures would be allowed near the road. Levang commented there could also be issues with raccoons and other creatures. McMillan suggested the City Council go through the list of questions outlined in Staff’s report. McMillan asked as it relates to Question No. 1 raised in Staff’s report, whether there should be different definitions for private recreational sporting facilities and private recreational play facilities. Mattick indicated he has been attempting to work with Staff to develop a way to make it a little more generic rather than spelling it out as a tennis court or a sport court. Mattick stated in his view it is workable as it is but that he is more inclined to combine the two and that he does not see a strong reason to distinguish between them. Mattick indicated he understands they are different to some degree but from a functional standpoint they are very much the same. Mattick stated he would probably combine them and perhaps refine what is listed a little bit more. Mattick noted the section on detached accessory buildings and detached accessory structures will need to be reworked. The reason that was included is buildings and structures are two defined terms and are rather broad. The proposed language does not accomplish what the City would like to accomplish and will need to be reworked. McMillan indicated she is in agreement that it is too broad. McMillan noted that the City Attorney had raised the point that it is redundant to say detached accessory buildings since all accessory buildings, by definition, are detached. Mattick stated accessory structures are supposed to be detached. McMillan stated she likes detached private garage since it differentiates between the one that is attached to a person’s house. Bremer asked why it says private. Gaffron stated historically in the code it talks about private simply to differentiate between someone who might put in a facility that is used for commercial purposes. Mattick indicated it is a defined term, and once you change it in this ordinance, you will have to change it elsewhere. McMillan indicated she is also fine with combining the two listings for private recreational sporting facilities and private recreational play facilities. Anderson asked if the detached accessory structure is more of a generic term than detached accessory building so you can put recreational sports and recreational play under that particular subheading. Mattick stated that was the idea but in his opinion it needs to be reworked since it is too broad. If you truly look at the definition of a structure, just about everything can be defined as a structure. Mattick stated in his view the language goes too far and will allow things that the City does not want. McMillan asked if everyone is okay with the word temporary for roadside stands. It was the consensus of the City Council that the word temporary is acceptable. McMillan stated she would like to see that in a separate section so the Council can approve the rest of the ordinance and work on that section later. Mattick stated there are a number of good examples out there already and that the Council can decide which ones they would like to allow and which ones should not be allowed. At the present time Orono allows solar but it needs to be attached to the residence. The Council should address whether it would be allowed detached from the house, which is becoming a little more popular depending on the topography of the yard. McMillan asked how everyone feels about trash enclosures. McMillan stated she is unsure whether the City wants to start regulating those. Mattick stated he has sat through this discussion before with other communities, and a number of people are okay with entrance monuments but they require an encroachment agreement since they are located in the City’s right-of-way. The idea behind that is no one really likes the big trash can sitting out by the road so wouldn’t it be better enclosed. The problem with that is the structures would all look different and would be a permanent structure in a high visibility area, which is one thing that should be considered. Bremer asked what would stop someone from placing one ten feet from the lot line or the road. Gaffron indicated on a lakeshore lot you would need to meet a principal structure setback if it is not a garage. Bremer stated it would depend on where the lot is. Gaffron stated at the present time the City does not allow any accessory structures between the house and the street. At its last meeting the Planning Commission reviewed an application where there is an existing shed about 20 feet off of the road and the house sits approximately 50 or 60 feet back from the road. There was a question of whether or not it should be allowed to stay. Bremer commented she can see that situation growing and that it becomes a slippery slope. Levang indicated she likes the Brooklyn Park code relating to the recycling. Gaffron stated the fully screened requirement is probably the biggest difference between their code and Orono’s. Levang noted they also have some instructions limiting when trash can be placed out for collection. Bremer commented the big green and yellow containers are also more obvious. Chapter 54 deals with solid waste management, which is unrelated to zoning, and those standards could be included in there. Bremer and McMillan concurred those standards could be included in Chapter 54. McMillan noted the City’s code also says that trash needs to be picked up every week, but with the addition of organics recycling, that has allowed some people to go every other week for pickup, which is something to consider when revising the code. Gaffron indicated Staff would like to bring back what hopefully is the final version at the next City Council meeting. The City Council took no formal action on this item. 4. #13-3601 CITY OF ORONO – WETLANDS – ZONING ORDINANCE AMENDMENT Gaffron noted this item was reviewed at the May 20th Planning Commission meeting, and on a vote of 6-0 the Planning Commission recommended approval of the ordinance as drafted. There were no public comments regarding this application at that time. Gaffron noted this is the first time the City Council will be seeing this ordinance amendment. Since the Planning Commission meeting, Staff has noted that the proposed 35-foot setback requirement as drafted does not prohibit hardcover within the wetland setback area; although, the preamble text before the table does contemplate this with the wording “separation between wetlands and buildings or other structures or surfaces. Staff believes that in order to provide the protection intended by the 35-foot setback requirement, it must apply to hardcover surfaces. The City’s wetland setback requirements in place prior to 2005 prohibited hardcover within the historically established 26-foot wetland setback area. Gaffron stated the City discovered with the Stonebay development that the developer was fine with constructing right up to the setback line and that the City wanted each home to have a yard around the home. In an effort to prevent that, the City required, in addition to the buffer requirements, a 20-foot setback from the buffer for any structures above the ground to provide for that walk-around area. Item #03 - CC Agenda - 06/10/2013 Approval of Council Minutes 05/28/2013 [Page 9 of 18] MINUTES OF THE ORONO CITY COUNCIL MEETING Tuesday, May 28, 2013 7:00 o’clock p.m. _____________________________________________________________________________________    Page 10 of 18   (4. #13-3601 CITY OF ORONO – WETLANDS – ZONING ORDINANCE AMENDMENT, Continued) Over the past several months, the City has discussed whether they should eliminate the City’s jurisdiction over buffers and turn that jurisdiction over to the Watershed District but continue to have wetland jurisdiction. Gaffron noted buffers have been a difficult issue for Staff and the residents to deal with. Staff has had good discussions with the Watershed District on how they currently and possibly in the future deal with buffers. The Watershed District has indicated that they will be bringing to their Board in the next month or two a request that instead of having their wetland buffers relate to the functional assessment and have different numbers for different wetlands for all residential single-family swelling, they would have a 25-foot buffer that would only be applied to new development. New development would obviously be a new subdivision or, for existing residences, a total rebuild or an increase in hardcover. The Watershed District expects that buffer to be 25 feet. For anything that is just an addition to a house, they would not require a buffer be established. Staff’s concern is if they were to re-establish a setback from the wetland, under the Watershed’s buffer current requirements, someone could construct right up to the wetland itself and the Watershed District would not necessarily be notified of that or have any control over that. Staff felt it would be better to have a 26-foot setback. In addition, Staff anticipates the Watershed District would require a 25-foot buffer in many cases and that the City should require an additional 9-foot buffer to come up with the 35- foot buffer setback to any structures. In cases where there is a question mark about how close someone is to a wetland, a wetland delineation would need to be done. People are more willing to have a delineation done rather than establish a buffer that limits the future use of their property. Gaffron noted the ordinance in front of the Council essentially removes the City’s jurisdiction over buffers. Following Staff’s discussions with the Watershed District, Staff is fairly satisfied that their commercial or nonresidential buffers are going to continue to be equal or more restrictive than what the City currently has in place. For any commercial, industrial or non-single-family development, Staff is expecting that the Watershed District will continue to use the functional assessment and the different tiers of buffer requirement. Staff is comfortable with that requirement and Staff anticipates the Watershed District will end up with a 25-foot requirement for all single-family homes. Based on the language contained in Subdivision 8, Staff would recommend that the setback table be revised to incorporate additional language as to the items/activities not allowed within the 35-foot setback area. As a minimum, hardcover should not be allowed within that setback. Additionally, septic systems, wells, and other construction should not be allowed. Filling, grading, and excavation within setback areas are activities which, in our experience, commonly accompany any construction project and have always been difficult to functionally prohibit. The Council may want to consider adding a sentence that merely states: “Areas within the required setback area subject to filling, grading or excavation as part of a construction project shall be re-vegetated immediately upon completion of such earthwork.” Gaffron indicated the draft ordinance has been revised to incorporate these changes. The City Attorney has reviewed the ordinance draft and is prepared to comment on it. Staff believes that the ordinance amendments will reduce the financial burdens, time delays and perceived property takings that property owners have expressed concern about. The amendments should simplify administration of the ordinance while providing sufficient levels of wetland protection. The last line of B reads, “If application of the MCWD is in conflict with City regulations, the more restrictive requirements shall apply. Gaffron stated an example would be if they require a 25-foot buffer and the City requires a 35-foot setback, they would need to meet the 35-foot setback. There may be cases where the Watershed District does not require a buffer at all but the City will still require a 35-foot setback. Mattick stated that would not be a subjective standard but it would be a matter of comparing the two codes, with the stricter regulation being applied. Levang noted Item C on Page 5 states that the delineation will be at the discretion of the Planning Director. Gaffron indicated that is the one area in determining when an in-house delineation needs to be done versus telling the property owner that a professional needs to define the actual edge of the wetland. The discretionary part is determining at what point that delineation needs to be completed at a higher level. Levang asked what the trigger for that requirement would be. Gaffron indicated if you look at the last line, the requirement for delineation shall be applied where the wetland exists within 150 feet of the proposed project. Levang asked if that would then be an objective standard. Gaffron indicated it would be an objective standard. Even if you reduce it down to 100 feet, it would still exceed the maximum buffer that the Watershed District might require. Unless it is a close call as to where the edge is and where the setback is, Gaffron indicates he does not feel the City wants to go down the road of requiring wetland delineations since it is difficult to get people to complete them. The City’s goal would be to require them only when they are absolutely necessary. McMillan commented a lot of times people will see cattails and will think that is the edge of the wetland when it actuality the wetland starts before that based on the soils. McMillan commented she is not sure where Staff came up with that number but that it does provide quite a bit of protection. Gaffron indicated it is the same number used by Minnetrista and their intent was to have an easier situation for its residents to deal with. McMillan stated in her view 150 feet is very conservative and provides a good amount of protection. Gaffron stated the requirement for delineation might require it be done in-house but it might not require the hiring of a professional. Gaffron indicated Staff will attempt to use that discretion in a way that only hits the cases where it is a close call. Gaffron commented it might be wise to wait and see what happens. Bremer asked when Staff expects a decision by the Watershed District. Gaffron indicated the Watershed District did not have an exact date but that they expect the Board to review it sometime in May or June. Gaffron indicated he could try to find out that information if it is available at this point. Bremer commented it would make sense to wait. McMillan asked if the City should write its code to mirror whatever the Watershed District requires. Gaffron stated if they pass a 30-foot setback, the City may want to reconsider their 35-foot setback. Bremer stated she understands where Staff is coming from but noted that the City may have to revisit this if they choose to go forward with the ordinance amendment at this point. Gaffron indicated part of the process when someone comes in the door is they need to talk with the Watershed District so they know where the boundaries are and where the setback needs to be since that will impact the application with the City. McMillan asked if the difference is that Level 1 does not requiring a delineation and Level 2 does. Gaffron indicated Level 1 is basically done in-house based on City maps. McMillan stated as it relates to Page 7, she would suggest removing the language regarding the four protection levels of the Watershed District, especially if they end up changing their requirement. McMillan commented it would give the City some flexibility. Gaffron noted they would still be using that standard for nonresidential development. Clearly it would not apply to residential but the Watershed District still plans on using the functional assessment for nonresidential development. Gaffron noted the City’s code mirrors what is in the Watershed District’s code. McMillan asked if there is a deadline for when a wetland delineation expires. Gaffron indicated it is not addressed in the City’s code but it is addressed by the state. Exhibit C talks about delineations and the levels of delineations. Gaffron noted Public Works Director Struve had spoken with someone at Bowser and they did not agree with the way the Watershed was using a 5-year versus a 3-year standard. Bowser was saying that the development on Willow View was a residential development and that they had set wetland boundaries when it was constructed. The Watershed District was saying that those wetland boundaries should be held forever even though they obviously have changed. The buffer is now in a wet area. Struve stated the question asked of Bowser was whether they agreed with the Watershed District and they indicated they did not. Struve stated in that situation, you would need to do a delineation because wetlands do change over the years. The Minnehaha Creek Watershed District stated they were really talking about the buffer area and not the wetland boundary. Struve indicated he was clarifying the Watershed District’s stance on where the wetland edges would be. Gaffron indicated it changed from three years to five years approximately two years ago. Struve noted it was changed in 2009. McMillan asked if that is in the City’s new code. Gaffron indicated it is part of the WACA rules. Gaffron noted the City of Orono would not accept a 10- year old delineation. Gaffron stated the City Council can either adopt the ordinance or table the application until a decision is made by the Minnehaha Creek Watershed District. McMillan indicated she does not want to go past the June 10th meeting. Anderson moved, Printup seconded, to adopt ORDINANCE NO. 103, Third Series, an Ordinance Amending Sections 78-1601, 78-1605, 78-1606, 78-1607, 78-1608, 78-1610, 78-1611, and 78-1612 of the Orono City Zoning Code Regarding Wetland Protection. McMillan noted the City Council did not really make any changes to the ordinance amendment tonight. Gaffron requested the motion also include adoption of the summary ordinance. Anderson amended her motion, Printup seconded, to adopt ORDINANCE NO. 103, Third Series, an Ordinance Amending Sections 78-1601, 78-1605, 78-1606, 78-1607, 78-1608, 78-1610, 78-1611, and 78-1612 of the Orono City Zoning Code Regarding Wetland Protection, and to adopt SUMMARY ORDINANCE NO. 104, Third Series. McMillan indicated she is in favor of the ordinance amendment and that it should hopefully clarify a lot of things for the applicants. Bremer stated if the City receives some feedback from the Minnehaha Creek Watershed District that they are imposing something other than what is anticipated by Staff, she would request Staff advise the City Council of that. VOTE: Ayes 5, Nays 0. PUBLIC WORKS DIRECTOR/CITY ENGINEER’S REPORT Struve reported that the Orono Golf Course did receive the update to their liquor license. The new door on the club house has been installed. The weather unfortunately has not been cooperating to allow golfers to be out there but once the course is fully opened, the golfers will have some new options. Struve reported Orono Orchard road is in the final phases of the project. The contractor is in the process of raising manholes and castings as well as conducting some repairs of settlement issues that occurred over the winter. The final asphalt layer will be completed in mid-June and the landscaping is being finalized, which will close out the project. As part of a requirement of the Minnesota Department of Health, the City needs to complete a consumer confidence report for the City’s water systems. A press release will be placed in the local newspaper so the residents can call City Hall to receive a copy of the report. The report will also be posted on the website for review as well. Levang commented she did visit the golf course yesterday and there were some people out there golfing. The new door looks good and allows more light into the facility. Levang commented she hopes the new liquor license will help improve business. Orono is continuing in its effort to work with Mediacom. McMillan stated they also talked a little bit about redoing the joint powers agreement but they did not discuss in depth anything regarding their negotiations with Media Com. Levang stated they also found out that the JPA committee is not really a committee so it will have little power to make any changes. Levang stated in her view it is a little late in the game to be looking at that and that she is not sure where it will all go. McMillan asked how the donation garden is going. Levang reported the garden has been cleaned and they hope to have it tilled sometime this week, with planting to begin on Saturday if the weather cooperates. McMillan reported the Community Drug Forum met last week and Congressman Jim Ramstad attended the meeting. Ramstad provided the group with some ideas for speakers. The group decided to work on something for this fall and hold another forum session. McMillan indicated she should have more details in about a month. McMillan noted former Mayor Crosby passed away last Sunday and that it is a huge loss for Medina. CITY ADMINISTRATOR’S REPORT Loftus reported the City is now operating under their summer city hours which will run until August 30. City Hall will be open from 7:00 until 5:00 Monday through Thursday and 7:30 to 11:30 on Friday. Loftus stated the second item is in regards to the Watershed District. Representatives will be attending the June 24 Council meeting and will be making a presentation on the Long Lake Creek corridor improvements consisting of stream stabilization. There is some information posted on the city’s website regarding that project. Loftus noted the City has started its budget process. Staff has started working internally this week on a draft budget. The 2012 audit will be presented to the City Council at its June 10 meeting and the June 24 worksession will also be a good opportunity to discuss budget priorities. At the July work session, Staff will have the first draft budget ready. Loftus commented that would be a good time for residents to start thinking about attending the budget work sessions and perhaps providing feedback on budget priorities. The City Council will then consider the preliminary budget in September. Levang asked if the city administrator normally sends a letter or puts something in the newspaper to let the residents know about the upcoming budget discussions. Loftus indicated that could be done. Printup commented the listserv would be a good start. McMillan suggested the summer hours also be placed on the City’s website. Loftus noted the hours have been posted on the door and are also on the City’s website. Bremer noted there was a notice sent out on the City’s listserv. McMillan asked if the residents are provided with information on who to call if they have an emergency on Friday afternoon or over the weekend. Loftus stated the call would go to the on-call staff in the Public Works Department, which is the same regardless of the summer hours. Struve noted the Public Works Department does not follow City Hall’s summer hours. McMillan suggested some sort of emergency number be provided on the City’s website for after hour emergencies. Struve stated if they call the Public Works Department, it would roll over to their cell phones. Loftus stated if it is an emergency, Hennepin County Dispatch has the public works contact information. McMillan asked if they call in on a Friday afternoon whether they are given a number to call. Bremer stated Hennepin County has the number. Struve stated on the Public Works website at the very top it says, for 24-hour service, please call after hours dispatch or emergency numbers listed. If they go on the Public Works site, they will be able to access that information. Olson stated on Friday afternoons there is also supposed to be a special message. Olson indicated his understanding is this past Friday it did not but that the City’s IT person will be looking into it to make sure it works. McMillan suggested the emergency numbers also be included in the next upcoming City newsletter. McMillan requested the new wetland ordinance be placed on the City’s website as well as the draft amendment of accessory uses and structures.
