The Orono City Council met on the above mentioned date with the following members present: Mayor
Lili Tod McMillan, and Council Members Cynthia Bremer, Doug Franchot, Aaron Printup, and David
Rahn. Representing Staff were City Administrator Jessica Loftus, City Clerk Lin Vee, Finance Director
Ron Olson, Assistant City Administrator of Long-Term Strategic Planning Michael Gaffron, Planning

PRESENTATION
4. WESTONKA SCHOOLS UPDATE – KEVIN BORG, SUPERINTENDENT
Kevin Borg addressed the City Council regarding the academic and financial progress they have made
over the past year at the Westonka School District. The Westonka School District this past year ranked
fourth in math and fifth in reading on the MN Comprehensive Assessment. Borg noted there are over 340
school districts in the state of Minnesota. In 2008, Shirley Hills Primary School was recognized as a Blue
Ribbon School and approximately one month ago Hilltop School was nominated for the Blue Ribbon
School award.
The Westonka School District's current focus is how a student's studies can be personalized and geared
towards the 21st Century. The school's efforts are focused on instruction relating to a student's ability and
interest as well as looking at 21st Century skills such as problem solving, critical thinking, creative
thinking, and communication skills.

This past year the Westonka School District received a clean audit and was presented with the Finance
Award from the State of Minnesota. In addition, Moody’s has assigned the District an AA2 rating, with
only two other school districts having a stronger rating in the state.
Borg stated their successful efforts at the District in large part are due to the support of the community.
This past year brought forward a renewal of the levy and two bond projects. The related projects include
deferred maintenance projects, such as roofs, parking, and mechanical systems, locker rooms, safety, and
improvements to the entrances of the buildings and technology infrastructure. This past week the Board
approved the sale of the bond, with the City receiving an extremely low interest rate at 2.1 percent. The
low interest rate means that the levy will be 3.7 million dollars less than what was being communicated to
the taxpayers in August, which is about a 17 percent reduction in the projected cost. The District’s credit
rating also assisted in obtaining that low interest rate.
Borg noted the School Board has interviewed construction managers and have hired Kraus-Anderson to
oversee the work. They expect the project to take three years, with construction likely commencing in
2013.
Borg indicated he is here to answer any questions the City Council would have.
Rahn noted on the school's website they have a facilities update tab, and asked whether they plan to have
updated information available to the residents on the various projects.
Borg indicated that the project study reports will be included on the website, which will allow the
taxpayers to see the items on the original project list and then the costs associated with those projects.
Rahn commented that would be a good financial aid to the residents. Rahn asked whether Superintendent
Bord has any insight into who the new varsity football coach will be.
Borg stated they will be interviewing this spring for a new head football coach.
McMillan noted the school's math scores drop off as the students get older, and asked what could be done
to help keep those scores up.
Borg noted Minnesota recently received a waiver in the No Child Left Behind requirements and
concurred that math tends to become more difficult as they progress through the grades. The test scores
in Grade 3 show that 91 percent of the students are proficient, which drops down to 70 percent in 11th
grade. As it relates to Westonka, Grade 3 ranks first in the state and Grade 11 ranks eighth in the state.
Borg noted the math and reading scores do drop off throughout the entire state since students are likely
not placing a high priority on math as they age. The Westonka School District is offering more advanced
classes this year and that he is hopeful more students will take advantage of those classes.
Borg indicated he would be happy to answer any questions the Council may have throughout the year and
thanked the City Council for their time this evening.
McMillan noted just under 50 percent of the Orono households are located in the Westonka School
District. McMillan thanked Superintendent Borg for his progress report.

5. HENNEPIN COUNTY NORTH ARM PUBLIC ACCESS AIS PREVENTION SIGNAGE
PILOT PROJECT – TONY BROUGH
Tony Brough stated he is with the Hennepin County Environmental Services, Lake Improvement
Program, which has the responsibility to handle navigational hazards. Last year they experienced plenty
of issues due to the high water levels. HCES has responsibility for all of the major channels on Lake
Minnetonka and they oversee dredging and rip-rapping, as well as monitoring numerous fishing areas
throughout Lake Minnetonka and two public accesses.
Approximately five years ago he started researching and applying for grants to help monitor the spread of
AIS. Those efforts have now paid off and HCES has been able to hire a community based social
researcher to assist in their efforts.
Community based social marketing is used in a lot of things but it has never really been used in
connection with public accesses before. Community based social marketing tends to look at people’s
behaviors, identify the barriers, and then develop strategies to deal with the issues. The group conducted
a significant amount of research on AIS, and as a result of those efforts, have developed some signage
they believe will help raise people's awareness on AIS.
Brough displayed the proposed signage for the accesses. Brough indicated he is open to suggestions and
feedback on the signage and that they are still in the design mode. At this time the signs have not yet
been ordered but they will be in the near future since they would like to have the signs erected by fishing
opener.
McMillan commented in her view this is a very smart approach.
Printup stated the new signage should be helpful.
Brough stated they will evaluate the results after the signs have been erected for a few months.
Bremer asked whether there will be any flyers available to distribute.
Brough stated to his knowledge there will not be flyers. Brough commented this program will only be
effective if they approach it with education at a community level. The HCES does have an education
outreach division, which will also have a part in this project. If the signage is effective, the HCES is
hoping the AIS situation will improve somewhat. Brough noted the signage will not be a 100 percent
solution since there are a number of different access points on Lake Minnetonka but that it is a start.
LMCD REPORT – ANDREW McDERMOTT, REPRESENTATIVE
McDermott reported that the Sheriff's Office has banned cars and SUVs out on Lake Minnetonka due to
the thin ice. Snowmobiles are still allowed. They are experiencing some difficulty keeping the snow
fences up due to the lake of snow and thin ice.
The LMCD has agreed to purchase a new harvester this year and it should be delivered sometime in early
to mid summer. The LMCD did hold a number of meetings regarding the harvester and concluded that it
is one part of the milfoil program. The LMCD did speak with a number of different states and
universities and most of them have a combination of chemicals and harvester program. They find that the

chemicals work well the first year but that the milfoil comes back in years two and three. McDermott
stated since the LMCD does not foresee funding the chemical treatments indefinitely, harvesting will
need to be part of the program to keep the lake free of milfoil.
McDermott reported the LMCD has hired an employment agency to provide AIS inspections during the
summer. The state also performs inspections. The majority of the inspections are done on the weekends.
The LMCD is also compiling an inventorying of car trailer stalls. They have gone out with GPS
coordinates to identify the stalls and arrived at 517. McDermott indicated the LMCD does not foresee
any new developments regarding access points on the lake.
McDermott stated one issue that has been raised by a number of people is the low water elevation of Lake
Minnetonka, which could be a problem this spring. The LMCD has put a chart together to show the
typical water elevations since 1902. In 1935, during the drought year, it was down to 923’ and last year it
was at 928’. It is currently around 928’. If there is no snow or spring rains, there will be a low water
emergency, which would mean that people could extend their docks out further into the lake. McDermott
noted the current water level is not as low as the low water elevation experienced in the 1980s during the
drought.
Rahn asked whether the dam could be opened to bring the water back in.
McDermott stated it is possible to open the dam back up if the creek elevation rises.

8. #12-3539 SURYA AND ANTHONY ROCHEL, 125 TURNHAM ROAD – VARIANCES
AND CONDITIONAL USE PERMIT
Planner Ben Gozola stated the subject property is located in the western portion of the community and
south of the Luce Line Trail and south of Turnham Road. There is a shared driveway off of Turnham
Road, parallel to the Luce Line, which services another property before it goes down to the subject
property.
Gozola displayed an aerial photo of the subject project and pointed out that there is a smaller home to the
north and some fairly substantially sized homes to the east and southeast. There is a small shed on the
property and a large clearing in front of the existing home. In addition, there is a large wetland in the
front.
Gozola stated the next slide shows the existing conditions on the lot. The dotted line indicates the
required setbacks on the property given the zoning classification of RR-1A. The two structures on the
property are nonconforming. The property is subdivided into two lots, which would be combined as a
component of the project. There is also some potential flooding associated with the wetland in the spring,
which has resulted in the conditional use permit request.
Gozola noted the applicant has updated his survey to show a revised driveway configuration. The
unrevised survey correctly depicts the trees and the proposed grading on the site.
As it relates to the 14 criteria code requirements, this request does meet those requirements. The area is
guided and zoned for single-family homes. The applicant is proposing to raze the existing house and
construct a new residence. The small size of the lot is a unique characteristic since this is a five acre
district. Staff is recommending approval of the lot area variance.
As it relates to the CUP, there is a code interpretation issue. Gozola stated in reviewing applications, he
typically uses the City's historic interpretation, but when the historic interpretation can put the City in a
bad position if challenged, he must address those issues in his report. He then examined the four sections
of the code that deal with land alteration. Section 966 is entitled prohibition, which basically says that a
person cannot move dirt in Orono without a CUP. If the ground is elevated, the existing grade is altered,
or the shoreline is modified, the City requires a CUP. Section 967 sets out an exemption to the CUP
requirement for land alteration activities in that normal and customary grading approved as part of a
building permit can be administratively approved by the building inspector. However, if a person is
doing normal grading on a lot without a building permit, they are required to get a CUP. If the applicant
is proposing unusual land alterations, the building inspector has the right to say that he/she cannot
approve the building permit and that the applicant must apply for a conditional use permit. And finally, if
the building inspector is in doubt of anything, it can be referred back for a CUP.
The final two sections governing land alteration relate to riprap and alterations near the shoreline. The
permit section requires that accurate documentation must be provided.

The usual interpretation based on the wording of the ordinance suggests the City's responsibility is to
judge the potential impacts of the proposed fill but not give consideration to "why" the fill is being
introduced. In other words, whether the fill is necessary or not should be of no concern to the City as the
landowner should be free to determine the need. The City's only responsibility is to fully review the
potential impacts of the desired fill and only approve the changes if no impacts are identified.
Gozola stated the historic reading of the code conducts that analysis but then it goes on to ask whether the
fill is really necessary. Absent the requested grading change, the question is asked as to whether the
applicant could choose a different building location or a different style residence. Gozola stated he did
not find within the code any indication that those questions be asked. The historic interpretation was
drawn from the definitions in the zoning code. Existing ground level is the existing grade of the property,
which folds into the definitions for building height and basement, each of which talks about specifically
ignoring grading changes when determining either.
The land alteration CUP sections do not require the landowner to show what they propose to construct
and by code the CUP is really just a mechanism to show where they will be moving dirt and how they
propose to do the land alteration. Gozola stated if the Council approves a land alteration CUP, by
definition they will be authorizing a new existing grade for the property.
Gozola stated as it relates to tonight's application, the review is strictly based on the CUP criteria and does
not question whether the fill is really necessary. Staff instead focused on all of the potential impacts that
could be created on the property.
The Planning Commission considered the historic interpretation and found that the recommended review
approach, based on the wording of code, is appropriate in this case. However, the Commission also
recommended that the City Council look at the land alteration provisions at some point in the future to
determine whether changes should be made to the language.
Gozola stated based upon that historic interpretation, Staff and the Planning Commission reviewed the
code requirements and found that all 14 criteria are met by the applicant. Staff has found that the land
alterations will not create any nuisances or negative impacts on traffic or lighting. Private well and septic
facilities will serve the site. Staff does not see this project as being a detriment to public health, safety
and welfare.
The application was reviewed by looking at compatibility, screening, character, and environmental
impact. As it relates to compatibility, Staff looked at whether the proposed grade is appropriate. Staff did
not find any evidence that the adjacent land will be impacted. Staff found that the resulting building
heights will be substantially similar to the existing conditions on the property and that the home needs to
be centrally located on the property. Gozola noted there will be 250 feet separation from other homes in
the area.
With regard to character, Staff needed to determine whether the change in grade would have a negative
impact. Staff has found that the proposed grading will not change the use on the site and will tie into the
existing contours on the adjacent lands so a large retaining wall is not required. The removal of trees is
not prohibited by code and screening is not required between single-family homes in Orono. The City
does not have any tree preservation requirements in this area. Staff does not view the tree removal as a

unique character change. While Staff does acknowledge that a number of trees will be removed, they did
not see it as a conflict since tree removal is permitted.
After reviewing all the criteria, both Staff and the Planning Commission have found that all the criteria
have been met and are recommending approval with conditions of the application.
Gozola noted a number of neighbors had expressed concerns at the Planning Commission meeting. The
neighbor directly to the north expressed concerns regarding the potential impacts to the shared driveway,
specifically as it relates to ruts and erosion, and requested that those be controlled and fixed. A currently
damaged culvert between the two properties will be fixed and designed better to handle runoff. Other
neighbors expressed similar concerns regarding the driveway. To address those concerns, it was
recommended that an escrow be required. The City Attorney, however, has expressed some concern
regarding the escrow and the City's ability to require it in this situation.
Mattick stated typically the City will require an escrow to ensure that certain public improvements are
completed. Mattick noted this is not a public street and is an easement on someone else's property.
Mattick indicated he has not seen other cities in the past get involved in private disputes.
Mattick stated in this case the City would be holding money to fix a problem that is not on City property
and that he has a concern about how that will be administered.
As it relates to Item Number 10, the language currently reads “the applicant is strongly encouraged to
provide protection to users of the Luce Line trail during all construction activities (obtain approval to
erect temporary signage on both sides of the shared driveway on the Luce Line to warn users of the
potential construction traffic).” Mattick indicated his position would be that the City either require the
signage or not, and that his recommendation would be to eliminate language stating “strongly
encouraged” as part of condition 10.
McMillan commented she is not sure whether any type of signage would be allowed by Three Rivers and
that they will have to be contacted if any signage is erected on the trail.
Gozola stated that was the discussion at the Planning Commission level and that is how they arrived at the
language “strongly encourage” as part of the condition.
Rahn asked how one party would protect themselves from the other with a shared driveway.
Mattick noted the applicant still gets to use the access, and that if the driveway is damaged, the neighbor
has the right to approach the applicant and ask for repairs. Mattick indicated he is not sure how the City
would make those determinations and then determine how much money is required.
Rahn concurred that it is outside the City’s scope, and that if the two parties cannot work it out, it would
become a legal situation between the two neighbors.
Mattick stated it is his assumption that the neighbors will monitor the situation and that he is not aware of
the quality of the access or the road at the present time.
Rahn asked whether primary and secondary septic sites can overlap.

Gaffron stated since the secondary site is outside the rock bed, it probably is not an issue. A typical
failure would be in the interface between the rock and the sand, and that in his view it is not an issue.
McMillan asked whether there should be a condition that once the new residence is constructed, that the
old residence be removed.
Gozola stated typically there is a code provision that only allows for one dwelling per parcel.
McMillan commented it would not hurt to include that as a condition. McMillan asked when the wetland
buffer would be triggered.
Gozola indicated the buffer requirement is being triggered given the amount of dirt being moved.
McMillan asked if the applicant simply grades the new building pad and does not construct a new
residence for a couple of years, whether that would be acceptable.
Gozola stated the CUP is not attached to their future actions. Given the way the applicant is proposing to
move the dirt, the existing house will need to be removed. If the house remains, they would have to meet
all the CUP conditions, which includes establishment of the buffer.
Gozola displayed the reconfiguration of the driveway on the overhead. Gozola noted the applicant would
like to add a turnaround in front of the house. Gozola noted hardcover is not regulated on this property
and the turnaround would not change the proposed grading.
Rahn asked whether conditions number nine and number ten would be eliminated.
Bremer stated number nine would be eliminated and then the condition requiring the existing home be
removed will be added.
McMillan commented she would also be okay with elimination of condition number ten.

VARIANCES AND CONDITIONAL USE PERMIT
Charles Truwit, Applicant, was present.
Curtis stated in 2009, the property owners applied for and received approval to redevelop the subject
property in order to make it more saleable. The property owners have received annual renewals of those
applications. The applicants have an interest in purchasing the property. With the exception of a few
cosmetic changes to the property, they wish to construct what was initially approved.
The applicants are proposing to slightly increase the size of the proposed footprint by 19 square feet over
the previous approval. The proposed home consists of 3,409 square feet of structural coverage. A second
floor continues to be proposed over a portion of the house, although the applicants are proposing to move
it further west for a more central location. The change results in less massing for the adjacent lot.
Also being requested is an increase in hardcover from 30.1 percent approved hardcover to 36 percent
within the 0-75 foot zone. The hardcover numbers were recently adjusted by the applicant. The increase
in hardcover being requested is primarily to allow a tear drop configuration of the driveway.
The Planning Commission voted in January to recommend approval of a CUP and to recommend denial
of the increase in hardcover. The Planning Commission had recommended approval of the hardcover
variances with the removal of the proposed tear drop driveway.
Curtis stated the colored overhead view reflects the Planning Commission’s recommendation relating to
the driveway. The Planning Commission recommended approval of the existing hardcover for the
driveway with the exception of the green and red areas as well as the addition of hardcover to provide
access to the front door. In addition, the Planning Commission recommended approval of the lot area and
lot width variances, approval of the requested side yard setback variance, approval of the requested 75-
foot lake setback variances, and approval of the CUP for grading within 75 feet of OHWL.
Staff recommends approval of hardcover totaling 8,028 square feet total. The Planning Commission’s
recommendation adds 563 square feet of additional hardcover for a total of 32.2 percent. The applicants
have agreed to plant additional shrubs or trees to screen the proposed lakeside deck. Staff continues to
recommend approval of the inclusion of a vegetative, shoreline buffer to infiltrate stormwater runoff
along the southwest lakeshore area in the place of the proposed sod as illustrated on the landscape plan.
The Council should discuss the various elements of the application and determine an appropriate level of
hardcover for the property. In addition, the applicant should be required to provide a revised plan and
revised survey prior to final Council approval.
Rahn asked when Staff recommends approval of the 32.2 percent hardcover, whether that is more or less
than what was approved in 2009 plus the 19 square feet. Rahn noted Staff's report states that 8,899 square
feet was approved by Resolution 5841, but noted there was some swapping with the driveway.
Curtis stated the front page of Staff’s report shows the levels approved originally. Those hardcover
numbers have since been adjusted to account for the removal of a piece of property belonging to the
adjacent lot. Curtis noted the revised hardcover numbers have been adjusted on the second page of Staff's
report, which is the 8,028 square feet. The Planning Commission is recommending approval of an
additional 553 square feet.

Curtis noted Staff did receive an e-mail today that has been distributed to the Council from an adjacent
property owner.
McMillan asked where that property owner is located.
Curtis illustrated on the overhead the location of that property.
Bremer noted the concern relates to headlights and privacy.
Rahn asked as it relates to the 5-foot setback, what the next level of distance is. Rahn asked if the 5-foot
conflict is only for the last 10 feet.
Curtis indicated it is and that it is closer to 12 feet. The lot line was adjusted in the past to reflect a
chimney on the adjacent home. Today there is a carport that goes to the property line on the subject
property.
Rahn asked whether 10 feet is required there or 30 feet.
Curtis indicated it is a 30-foot setback since it is a two acre zoning district. The proposed home is
consistent with the home’s current footprint.
Tom Owens, Attorney-at-Law, stated he would like to supplement Staff’s review with five additional
points. Before the Council tonight is an application seeking these variances because the plans in 2009 had
one key oversight; namely, the driveway near the house lacks two features to make the driveway safer and
more practically useable. The plans were drawn up in 2008 and modified several times in 2009. Those
plans were drawn up for a hypothetical buyer.
Owens stated his second point is that the findings made by the City Council in June 2009 all apply to this
application with one exception, which is that instead of a slight decrease in hardcover, there is a slight
increase from 31.5 percent to 36 percent.
The third point is that the only genuine issue before the City Council is whether the hardcover change is
reasonable and whether it will alter the essential character of the locality. The applicant urges the City
Council to find that the request is reasonable. The subject property is surrounded on three sides by water.
The property located at 1101 West Ferndale was granted hardcover of 52.6 percent in 1995 for a
replacement residence.
In addition, the dwelling and lot nonconformities and parcel configuration are truly unique to this lot,
which means that whatever the Council does tonight will not set a harmful legal precedent. It is
extremely unlikely that another homeowner will come before the Council and make a similar request.
Owens noted the legal landscape has changed recently and the bar for variance approval has been
considerably lowered by the MN Legislature. The practical difficulty standard allows the property owner
greater latitude.

Dr. Truwit stated what he is attempting to do is live within the spirit of what was already approved but
that there were a couple of items that were either deficiencies or oversights with the original approval.
Truwit noted the previously approved house has no door on the lake side of the house, which is
inconceivable that someone would construct a house on the lakeshore without a door to access that area.
Dr. Truwit noted the original proposed house and driveway were to be elevated as well as the garage floor
per the previous variances. Truwit stated the thing that caught his attention the most was the elevated
driveway. Due to the issues associated with the elevated driveway as previously approved, Truwit
indicated he is proposing the area in green. Given the current configuration of the driveway without the
extension, if someone is backing out in the winter and the driveway is icy, a vehicle could slide over the
retaining wall. The Planning Commission agreed with that premise since it is a safety issue.
The second issue before the City Council is one of practical difficulty. Currently you have to back out
into the neighbor’s driveway or back all the way out to the road. That situation is going to raise the risk
that someone is going to back up and go off the driveway. Truwit indicated he would like to have a
turnaround so that people can drive out facing forward.
Truwit stated he has only recently learned of the neighbor’s concern. With the current configuration of
the driveway, the headlights will hit the neighboring home when someone enters the driveway and when
someone leaves. With the tear drop, the neighbor would experience only one set of headlights.
Truwit displayed a picture of the lot showing the trees on the property. Given the substantial number of
trees, Truwit stated he is not sure what the neighbor will see. Truwit indicated they are not proposing to
remove the trees and are, in fact, proposing to plant more trees, which will increase the privacy. This
issue was not raised at the Planning Commission meeting.
Truwit stated they will be taking out the patio that was requested be removed, removing the carport, and
freeing up the space between the two properties the best they can, but that that they would like to use the
existing foundation. Truwit stated he has talked to the neighbors about the project and they have
indicated they would like to see the carport removed, which is being done. Truwit stated he is asking for
a slight increase in hardcover, but that in his view it is a reasonable request.
Truwit stated he initially attempted to point out to Staff that the neighbor has over 50 percent hardcover.
They are requesting 31.6 percent. Staff pointed out it is not an apples to apples comparison, which he
understands, but that he would request the City Council consider what the hardcover numbers would be if
that portion of the driveway is added to their property. Truwit stated according to his calculations, it
would be between 39.5 and 42.5 percent hardcover. Truwit pointed out their request is still well below
what the most immediate neighbor has for hardcover and that he is asking for something very reasonable
in order to address some safety concerns.
Franchot asked about the conservatory on the second floor.
Truwit indicated it is more of a four-season room. Concerns with the conservatory were also included in
the comments from the neighbor. Truwit stated there is no conceivable way the neighbors can see the
conservatory from their property.

Franchot commented his concern with the conservatory in general is that if it is used at night, it will be
quite brightly lit.
Truwit indicated if they do use it at night, it would be with the lights off and that it is not going to be a
center of activity during the nighttime. Truwit illustrated the line of view from the neighbor's house to the
conservatory.
Franchot asked whether there would be lights in the conservatory.
Truwit indicated there will be.
Franchot commented the residence is larger appearing with the second floor and high peak and that he has
a concern the glass structure will be lit and bright for the whole lake. Franchot stated the concern also
relates to future property owners.
Truwit stated the shades would be down at night and not lit up so people can see what they are doing.
The principal concern raised at the original City Council meeting was the proximity to the adjoining
property and the proximity to the lake, which is why their plans do not put the second story right up to the
corner and instead step it back.
Rahn asked if the existing home is a single story.
Truwit indicated it is.
McMillan asked if the driveway needs to be elevated due to the floodplain.
Curtis indicated it does.
McMillan commented the elevated driveway may be more as a result of the MCWD than the Orono City
Council.
Truwit indicated there was no MWCD approval applied for with the last application, which has been
taken care of with this application. The MWCD has reviewed this application and Staff has been
provided with their findings.
McMillan commented the Council would love to have a driveway without a retaining wall but that it may
not be possible in this case. McMillan asked if the driveway would be raised all the way out to Ferndale.
Truwit indicated the straight part is elevated approximately six or seven inches and that the portion near
the house has to be raised a foot and a half.
McMillan stated whenever there is a shared driveway arrangement, the City gives some credit for the
hardcover, and asked whether that has been done in this case.

Curtis indicated that is what the revised hardcover calculations show on the second page of Staff’s report.
Staff removed the portion of the driveway that only benefits the neighbor and everything that the subject
property needs to access the property is included in the hardcover numbers.
McMillan asked whether anyone has any issues with the patio being converted into a deck.
Bremer and Printup indicated they do not.
Rahn stated as it relates to the driveway, in his view the circular driveway is excessive and that he is not
in support of the turnaround. Rahn commented there might be more headlight issues with the tear drop.
Rahn stated he is not sure why the City Council would allow the blue driveway area since it appears the
applicants have a plenty wide turnaround without the blue area.
Truwit indicated the blue currently exists and that it would be removed with the addition of the
turnaround.
Rahn stated he would go with Staff’s recommendation and pointed out that it is a lot more house than
what was there before and that in his opinion it would have an impact on the character of the
neighborhood. Rahn commented that he has received complaints from other citizens about ramblers
being changed to two-story residences.
Rahn stated as it relates to driveways in general, the City Council gets very detailed on how wide
driveways can be, along with turnarounds. Rahn stated it appears that there would be plenty of room to
turn a car around and asked whether the engineer agrees with that assessment.
Curtis indicated he does.
Rahn stated if the applicant would like to rearrange the driveway and perhaps remove a third garage stall,
the application can be tabled for redesign.
Truwit indicated he did remove some of the existing hardcover and that he is not interested in redesigning
his plans. Truwit noted this is the last one-story house in the neighborhood and that the other homes have
already been converted or have been approved for redesign. Truwit stated the character of the
neighborhood has already changed and that the current house is not livable the way it is.
McMillan commented the applicant has a right to construct a second story but that it will have some
impact to the neighboring property. As it relates to the driveway, in an ideal world without the need to
limit hardcover, it would be elegant. McMillan stated in her view the applicant does have enough room to
back cars in and out of the driveway. McMillan stated she understands why the applicant would like that
amenity but that in her opinion there are already concessions being made with the location of the house.
Truwit stated the current house is an eyesore and that they are proposing a solution. Truwit stated he has
given the City Council his rationale for the turnaround and that he would like to proceed forward with the
rest of the house.

KC Chermak, applicant, was present.
Curtis stated the applicant is proposing to redevelop the subject property and construct a new residence.
They are requesting a lot width variance, a lot area variance, hardcover variances, as well as a side street
setback variance. Due to the topography and shape of the lot, the majority of the driveway for the
existing home is located in the right-of-way along with some other encroachments.
The applicants’ proposal includes a setback variance from the right-of-way to allow a 10-foot setback
where a 15-foot setback is required; an average lakeshore setback variance to allow a small portion of the
covered porch to partially encroach two to three feet; and a hardcover variance to allow 46 percent
hardcover. All of the encroaching improvements within the right-of-way are proposed to be removed and
the right-of-way will be restored with vegetation.
The Planning Commission voted 5-0 to recommend approval of the request. Staff also recommends
approval of the variances.
Curtis noted this application has received supporting comments from the neighbor to the north, who
would be affected by the average lakeshore setback variance. Public Works has also commented today on
the applicant’s right-of-way vegetation plan and they are satisfied with the proposed improvements. The

Public Works Department would like the plants near the culvert to be rearranged to allow for cleaning of
the culvert. Curtis indicated a 6-foot wide opening by 10-foot deep opening would allow for easier
cleaning.
The Council should review the request and adopt or amend the resolution granting the variances. In
addition, the Council should discuss the proposed landscaping plan.
Franchot asked whether there would be less structure with the new house as well as less hardcover on the
property under this proposal.
Curtis indicated there would be less structure and that the hardcover will also be reduced. The little shed
will be removed. The driveway will be located solely off of Ivy Place.
McMillan asked if the neighborhood uses that fire lane.
Curtis indicated it is utilized at the present time by the neighbors and for drainage. In the future that area
may need to be improved as it relates to the drainage.
KC Chermak, Pillar Homes, stated he does not have anything to add to staff’s report. Chermak indicated
he does not have an issue with moving the grasses. Chermak commented they worked hard on this
application and had good feedback from Staff.

Curtis indicated they met with Ben Gozola and went over the direction given at the last joint work
session. Planner Gozola will be bringing back some revisions in the near future. Staff is looking at
sometime in March to hold another joint work session.
Printup noted it is approximately one year since the videotaping of the City Council meetings has started
and that in his view it is going well. Printup thanked Staff for getting the council minutes on to the City's
website.
Printup noted in the news today they talked about the fire danger due to the dryness and encouraged the
residents to be careful with any burning they may be doing.
Printup thanked the LMCD Save the Lake Fund for their donation to the Long Lake Fire Department in
the amount of $4,168 to improve public safety on Lake Minnetonka by helping to fund ice water rescue
suits. Printup noted the Sheriff's Office is closing the public accesses on Hennepin County lakes and that
in his view that is a very good move by the sheriff given the thin ice.
Franchot noted a meeting has been scheduled with Long Lake regarding utilities on February 24th.
Franchot stated he will report back on that issue.
McMillan noted she met with Hennepin County Commissioner Jan Callison and some of the other local
mayors and that one issue that was raised was the new 911 dispatch center and whether the cities would
need to pay an additional service fee. Currently a couple of cities located in Hennepin County pay a fee
for 911, and the mayors in attendance at that meeting expressed their concern to the Commissioner that
they not be charged an additional fee.
CITY ADMINISTRATOR’S REPORT
12. APPOINTMENT OF PUBLIC WORKS DIRECTOR/CITY ENGINEER
Loftus noted the interviews have been completed for the position of public works director/city engineer
and that they are recommending Jesse Struve be hired. Loftus noted the recommendation was by
unanimous consensus.
Loftus noted in February of 2006, the Public Services Director position was removed from the salary
schedule and organizational chart. Following the approval of the creation of the public works/city
engineer position, the position was put back in the salary schedule but the organizational chart was not
amended. Loftus recommended the position be added to the organizational chart and to move the golf
course operations under Public Works.
Franchot commented the process in his view worked well and that there were a number of very well
qualified candidates. Franchot congratulated Jesse Struve on being chosen for the position.
Franchot moved, Rahn seconded, to appoint Jesse Struve to the position of Public Works
Director/City Engineer at the annual salary of $88,488, and accruing 3 weeks of vacation annually,
effective March 7, 2012, and to amend the organizational chart to show the position of Public

13. AUTHORIZATION TO PURCHASE 2012 SQUAD CARS
Chief Correy Farniok stated the Orono Police Department would like to purchase two new Dodge Police
Chargers in the next few months. Farniok stated in order to receive the discounted pricing, the order must
be placed by April 24th. Ford no longer manufactures the Crown Victoria.
Franchot commented the Chargers seem to be breaking down a lot sooner than the Fords based on the
mileage, and asked what cars are being replaced.
Farniok stated once the purchase is made and the cars are delivered, the vehicles would probably have
closer to 75,000 to 80,000 miles on them.
Rahn asked what the total cost is of replacing a squad car, including the transfer of the equipment from
one squad car to another.
Farniok indicated they set aside approximately $30,000 per vehicle. Money is typically saved by
transferring the equipment from vehicle to vehicle but when Dodge changed the style last year, they had
to purchase new push bumpers and interior roll cages. The Police Department is staying with the
Chargers so the equipment can be transferred. The total cost of a new vehicle will be under $30,000. The
squad setup is approximately $2,500 per vehicle.
Rahn stated some cities have 100,000 mile warranties and asked whether Dodge offers that.
Farniok stated that information is included in the memo and that they do have different packages. Farniok
indicated they have not seen a lot of major mechanical repairs to the Dodge Chargers.
Rahn stated he is in agreement with Council Member Franchot that the Police Department should not be
trading in cars at 75,000 miles and that it is surprising these cars are breaking down with so few miles.
Farniok pointed out that police squad cars are not your typical commuter car. It took Ford almost 20
years to develop a car that lasted a long time. Dodge has just entered into this market and they have been
making gradual improvements to the Charger.
Rahn asked what would happen if the cars were not replaced this year and they broke down, what impact
that would have on the service that is provided.
Farniok stated in the short-term there probably would not be an impact, but that it would become more
noticeable in the summer with the special events.

Farniok stated as it relates to the mileage, there is a fair amount of idle time with the vehicles. Ford uses
the equivalency of 33 miles per hour for idle time. The Police Department's current Ford has an idle time
of 5,326 hours on the idle meter, which is equivalent to 160,000 miles. Farniok noted that police squad

cars have a significant amount of idling time due to the amount of equipment that is in them and the
temperature that needs to be maintained. Due to that, the actual driven miles can be skewed. Farniok
noted the Dodge Chargers do not have idle meters installed in them.
Franchot commented that information is very helpful and noted the idle time would not change based on
the models.
Farniok stated the squad cars also go through tires on a much faster basis than your average car since they
have to make 180 degree turns to chase after speeding vehicles.
Rahn asked if the Police Department does the oil velocity checks periodically.
Farniok indicated they change the oil approximately once a month or every 3,000 miles. The issue with
increasing the oil changes to 4,000 to 5,000 miles is that if they can identify a problem during the oil
change, it will save money in the long run. The Tahoe and the new Charger use synthetic oil, which is
changed every 5,000 miles.
Rahn stated he is aware that some of the other local cities have a mandatory 100,000 mile replacement
policy, and that he is attempting to understand how other cities can go 100,000 miles with their police
squads and Orono only gets 75,000 miles.
Farniok noted Wayzata has a three-year replacement policy regardless of the miles. Medina and West
Hennepin's replacement policy is based on the mileage. Farniok indicates it also depends on the type of
miles that are on the vehicle. Orono has had Crown Victorias with 80,000 to 100,000 miles on them that
have had problems.
Farniok pointed out the existing squad cars will not be replaced until the new vehicles arrive, which will
be another six months or so. In order to get better pricing, the police cars need to be ordered at the
beginning or end of the year.
Rahn asked if it is closer to a three year cycle that the police cars are replaced.
Farnoik stated it is approximately three years at the present time and that they are attempting to push it
out to three and a half. There are two officers assigned per squad car so the vehicles are being used
approximately 16 hours a day. Farniok indicated they are also attempting to span the miles out evenly
among all the vehicles. The investigator cars are replaced every 6 years.
Farniok stated once the cars reach 75,000 to 80,000 miles, since the vehicles have been driven to the
extremes, the maneuverability decreases.
Rahn asked if the police department is reimbursed for the special events.
Farniok indicated they are reimbursed on some of the special events but the majority of them are
community events.
Rahn stated he does not want the public to get the impression that the City has a couple of extra cars just
to accommodate the special events.

Bremer noted the police department is replacing cars that are at 75,000 to 80,000 miles so they obviously
have not been used just for special events.
Rahn questioned whether the police department should only purchase one Dodge Charger now and then a
Ford Interceptor in the fall.
Farniok indicated the cost for a Ford is $27,000 to $28,000 and the Dodge is $22,500.
Rahn asked whether the City would have the extra $5,500 in the fall.
Olson indicated they have $60,000 budgeted for two police squads. Olson noted the Police Department
would not be paying the state contract prices if they wait until October.
Farniok indicated it would likely be a 2013 model if they wait until the fall and it would not be delivered
until the early part of the next year.
Printup noted in order to get the special pricing, the vehicles need to be ordered by April 24th, but that it
does allow for some leeway.
Farniok indicated that most cities have already ordered their vehicles. Farniok expressed a concern that
they may not be able to get all of the options that they want if they wait until right up to the deadline.
McMillan asked if there is any strong desire to continue with the Dodge Chargers.
Farniok indicated the officers are fine with continuing with the Dodge Chargers.
Rahn asked whether one Charger could be ordered now and then a Ford Interceptor in the fall, which
would allow the Police Chief some time to investigate how well the Ford Interceptors hold up since this is
the first year the Interceptors are in use.
Farniok indicated he would prefer to order one Charger and one Ford now in order to get the better
pricing and that he is not sure what type of information could be gained from the limited time the Ford
Interceptors would be used.
McMillan asked if there are any issues relating to storage of the police vehicles.
Farniok noted they did sustain $50,000 in hail damage to the vehicles, but to construct a new garage
facility they are looking at a million dollars.
Franchot asked what type of vehicles the Police Department would prefer to have.
Farniok indicated they would prefer to purchase the two Dodge Chargers.
Franchot moved, Bremer seconded, to approve the purchase of two 2012 Dodge Police Chargers for
$22,672.00 each, plus tax, registration and other miscellaneous fees from Dodge of Burnsville.

Farniok stated he attempts to be as fiscally responsible as possible, but that they had a car in 2009 that hit
a tree and was totaled out. It is difficult to determine when cars will break down and that this is the
replacement schedule the police department likes to follow.
VOTE: Ayes 3, Nays 2, Printup and Rahn Opposed.
Rahn stated he would have liked to have purchased one Dodge Charger now and then wait six months
before ordering another vehicle to see whether it is truly needed.
14. 2011 YEAR-END RECAP
Olson reported the budget numbers for 2011 have been finalized. It was necessary to make some
estimates for a couple of items where the bill has not yet been received. Revenues are currently at 102.3
percent of budget and expenditures are at 97.9 percent of budget. Current taxes collected are at 97.98
percent, which is better than in the past few years. Revenues for licenses and permits were at 155%, the
highest it’s been since 2006.
Olson noted two revenue categories finished the year under budget. Other Governmental Revenues ended
the year at 92.8 percent of budget due to lower reimbursements from the state. The other category was
the golf course. The poor weather this past year had a negative impact on the number of rounds played
during the season.
Olson reported property tax collections in 2001 and 2004 were at 99 percent, but as the economy
worsened, the City’s tax collections dropped down to under 97 percent. In 2010, they had flattened out
but are on the increase again, which is a positive sign that the economy is getting better.
McMillan asked if the taxes get paid when a house is foreclosed.
Olson indicated the City would eventually get the money once the house is resold.
Mattick stated the City could do a tax foreclosure, which takes five years, or wait for the bank to foreclose
on the property. Once the foreclosed property is ready to be sold, the County requires that all taxes are
brought current.
Olson stated the other revenue that increased this past year is building permit revenue, which in large part
was due to roof hail damage. Expenditures for 2011 came in at 98 percent, with four departments being
over budget at the end of the year. Olson stated in approximately two weeks he will be providing budget
adjustments to those line items. The City should be able to decrease the contingency line item and cover
the overages in the budget.
Franchot asked what was budgeted for contingency.
Olson indicated it was at $50,000.
McMillan asked what the special services fee is for.

that TH 12 is a two-lane, two direction roadway
Short Term :
► MnDOT installed additional two-way traffic signs in 201 1
Longer Term :
► Current project will install centerline rumble strips to provide
audible notification that TH 12 is a two-lane, two direction roadway.
FHWA study indicates that centerline rumble strips reduce head-on
and sideswipe injury crashes by 38-50% on rural two-lane roadways.
► Current project will restripe TH 12 with contrasting pavement
markings on each side of centerline rumble strip. Center yellow
skips and no-passing yellow striping will be placed over a wider,
black background. A 12 foot driving lane will be maintained.
► MnDOT will continue to monitor and evaluate TH 12 traffic for
project effectiveness.

To whom: I am unable to attend tonights meeting but my thoughts as follows..
I have recently received a copy of the minutes from the city council in regards to the
renting of dock slips in Orono, a long upstanding law that seems to work quite well. It is
interesting that invested stakeholders were never notified when you were looking at this.
Maybe that was not a big deal as the wording was just to clarify your position on dock
renting, but, someone has spoken up to say that maybe we should abolish the code. In
your application summary, you note that it is to preserve the character of residential
neighborhoods and prevent competition with licensed marinas. Perfectly stated! I have
been a lakeshore owner since 1978 and a marina owner since 1976 in Orono. I have
raised both of our kids in this Orono residential environment and I like knowing who my
neighbors are and who is in contact in our neighborhood with regards to our kids. If you
allow rental of dockslips, we start to see Tom, Dick and Harry driving through our
neighborhood, and who knows the background of Tom, Dick and Harry. Not what a
residential neighborhood is. We know our neighbors!! Not somebody trying to find a
cheap dockslip. We have constantly been aware of neighbors on Crystal Bay Road
renting out dockslips and we don't know who they are let alone the hassle of trying to get
through the road when they park on the side. Additionally, I am now in my fifth marina
in Orono and have improved everyone of them because we are able to rent them up. I do
not expect to be in competition with every lakeshore owner in Orono, that is changing the
rules after I have invested my life savings, blood sweat and tears to have a business in
Orono. The new wording included in the law(s) is the wording that allows Orono to do
the job of enforcing the regulation. That is the problem with the LMCD in that you have
to be of the highest payscale to interpret their rules and regulations. Additionally, they do
not have the manpower to enforce. When you call them about a situation, the response
will be "Well if they've had the dock there since "x" year then these rules apply and if
they've had it since "x" year these rules apply. Additionally, they are not moved by much
if the property owner next door is not complaining. I do not think we should put the
burden of dock enforcement on the neighbor. The neighbor could be frustrated with
people coming and going at all times of the day and not say anything do to the fact he has
to live by and get along with his neighbor. I think that would create hard feelings and all
you want to do is have a peaceful summer. Additionally, you do not a dock put on vacant
land! That is wisdom! I can think of a situation where a guy gets a hunk of land with a lot
of lakeshore, put up a dock and rent out three 40' boat slips and having numerous folks
you don't know coming and going through the residential areas where young kids are
growing up thereby putting them at risk.
I strongly suggest and support the verbage put through by staff and voted on 6-0 at the
planning commission. If you were to put this out to a vote a private residential Orono
lakeshore owners, and made this meeting published to those residents, it would
overwhelmingly, IMHO, be stated to go with the suggestions of staff and the planning
commission.
