This is a foflow-up ta our conversation at your affica yesierday regarding the surveys
far 4415 Forest Lake Landing. The original survey provided to us by Mr. Bybuth was
a boundary survey, 2�s indicated on the survay. Coffin $� Gronberg surveyed the 5
separate fand parceis and established their common boundaries and th� baundaries
between adjacent properties. No additional information w�s requested by us or Mr.
Kearing at that time. Prior to the purchase of 4415 Forest Lake Landing th� Lines
requested, upon their �ttorr�ey's advice, that we have Coffin and �ranberg pravide
more detailed information. I asked Mark ta clsarly stake the 931.5 floodline contour,
to clearly stake the 75' setbacks and sideyard and entry setbacks, and to locate the
soil test borings that Braun Testing had done. I asked Mark Gronberg to have his
crew take as many readings as necessary to accurateEy stake the property.
Mark had the same field crew perform the work that had done the original work. The
Lines reviewed the site staking, were satisfied and purchased the lot.
Just prior to submitting our proposal for a Variance Request I asked Mark Gronberg
to calculate the lot area, the are� within the 75' ta 250' zone, and the hardcover far
the project, This is when we discovered that we now had more area than previously
thought. I foliowed up with a phane call to Mark Gronberg and he stated that the
929. 4 countour lies within a fairly flat area and by taking more readings this time
they were 8ble to more �ccurately determine its location. I brought this finding ta
yaur attention when ! submitted the variance request to your office.
Pursuant to our conversation yesterday at your office and to my conversatian
yesterday morning with Bruce at the site, I once again called Mark Gronberg He
stated that he had talked with you and faxed your office the field notes upon your
request.

A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 10.22, SUBDIVISION 2 AND 10.24, SUBDIVISION S (A)

WHEREAS, Bruce Kehring (hereinafter "the applicant") has an interest in the
property located at 4-415 Forest Lake Landing within the City of Orono and legally described
as follows:
Lots 13 through 17, inclusive, Tonkaview Gardens, Hennepin County, Minnesota
(hereinafter "the property"); and
WHEREAS, per Municipal Zoning Code Section 10.22, Subdivision 2 and
Section 10.24, Subdivision 5 (A), the applicant seeks approval of a height variance for a portion
of a new residence that will be at three stories where the code allows only 2'/z stories and a
hardcover variance within the 75-250' setback area where the new construction will result in
4,462 s.f. or 32.5% hardcover where only 3,425 s.f. or 25%o is allowed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #1892.
2. The property is located in the LR-1B Single Family Lakeshore Residential Zoning
District requiring one acre in area. The property consists of 55,500 s.f. or 1.27
acres.
' 3. The Orono Planning Commission reviewed this application on November 15,
1993 and recommended approval of the variances as proposed based upon the
following unique findings and hardships:
A. Total lot area is 55,500 s.f. where only 13,700 s.f. lies within the 75-250'
setback area.

B. A standard lakeshore lot with 55,500 s.f. in area would have yielded much
higher hardcover allowances within the 75-250' setback zone.
C. The property is located on a peninsula.
D. The property contains unique topographical constraints.
E. The house has been specifically designed to limit the need for horizontal
expansion beyond building footprint to provide additional outdoor
recreational space.
F. Surface runoff from 25.2% of the total 32.5% of hardcover improvements
will be treated within a drainfield area and will not run directly into lake.
G. A small wing of the new residence will be at a three-story height.
4. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial property
right of the applicant; and would be in keeping with the spirit and intent of the
Zoning Code and Comprehensive Plan of the City.
5. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicant and the effect of the proposed variance on the health, safety and
welfare of the community.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Municipal Zoning Code Sections 10.22, Subdivision 2 granting a hardcover
variance within the 75-250' setback area of 1,037 s.f. or 7.5% and per Section 10.24,
Subdivision 5 (A) grants a height variance for a small portion of the residence that will be at a
three-story height instead of at 2'/z stories, subject to the following conditions:

1. Prior to the filina of an application for new construction, applicant must apply for
the legal combination of the five separate parcels that make up the building site.
2. Upon application for a permit, applicant will make payment for a sewer
connection charge at $11,331 per 1993 fee schedule and a SAC payment of$750
based on MWCC's 1993 fee schedule.
3. The City shall require permits for the installation of the drainfield and extension
of municipal sewer to residence. Applicant's consultant/contractor shall provide
all design and spec information for the review of the City Engineer.
4. Authorities granted by this resolution run with the property not with the applicant,
but are permissive only and must be exercised by application for a building
permit within one year of the date of Council approval, or this variance will
expire on that date (December 13, 1994).
5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
6. The undersigned applicant has read, understood and hereby agrees to the terms
of this .resolution and on behalf of himself, his heirs, successors and assigns,
hereby agrees to the recording of this resolution in the Chain of Title of the
property.

The subject property consists of five separate tax parcels totaling over an acre in area.
Applicant proposes construction of a single family residence with a footprint area of
approximately 3,460 s.f. All required setbacks will be met. Review Exhibit J, the flat roof
structure will meet the 30' height limit. The only variance sought by applicant is for excess
hardcover within the 75-250' setback area.

Special design considerations have been employed to minimize horizontal expansion and
limit hardcover. The architect's addendum, Exhibit B, notes space has been utilized below and
above the grade level garage as living space. A lower level patio lies under a portion of the
main level greatroom, review Exhibit K. The roof deck eliminates need for additional decks and
patio.
The most unique solution to the excess hardcover is the proposal to install a drainfield
to treat runoff collected from the flat roof. 7.3% of hardcover from the walk and drive would
be treated by surrounding ground area. 25% of the runoff from the hardcover would be
disbursed and absorbed in the drainfield.
The applicant also notes if City would consider vacating 5' on either side of the 60' right-
of-way of Forest Lake Landing that the area within the 75-250' zone would be increased by 740
s.f. also reducing intensity of hardcover excesses.
The property has never been assessed for sewer. Review E�ibit L, the sewer is
approximately 120' away from property boundary. It will be the applicant's responsibility to
extend sewer to the property. Sewer connection charge will consist of the following charges:

Lift Station 10 by-pass charge $ 2,188.00

The fee schedule provides no direction for properties where the sewer line does not abut
the boundaries of the property but where the owner must assume responsibility for extending the
sewer. The question is whether it is fair to charge applicant the front footage charge at this
time. Applicant may wish to appeal to the Council at the time of the Council's review to
determine if the $4,807.00 fee could be removed from total sewer unit charge.

Brief Review of Application
For more detail of this review, please refer to the Planning Commission minutes of the
November 15, 1993 meeting and the enclosed staff inemo dated November 12, 1993. Applicant
seeks approval of a hardcover variance within the 75-250' setback area and a height variance
for a cylindrical-shaped addition to the west side of the structure shown at three stories where
the code only allows for a 2'/z-story structure. Refer to Exhibit J. Note that no portion of the
structure exceeds a 30' height. The three-story structure provides access to an upper story roof
level deck.
The property meets both area and width standards (43,560 s.f. required - 55,500 s.f.
existing). The property is located at the end of Forest Lake Landing at the east end of the
peninsula. The property is surrounded by lakeshore at the north, east and south. Although the
property well exceeds the area allowance of the zoning district, the building envelope consists
of 13,700. Hardcover within the 75-250' setback area is proposed as follows:
Allowed = 3,425 s.f. or 25%
Proposed = 4,462 s.f. or 32.5%
Variance = 1,037 s.f. or 7.5%

Planning Commission Discussion
Planning Commission members questioned the design of the house noting that it was
"inconsistent" with surrounding neighborhood. Applicant advised that the design and shape of
the house resulted from the unique shaped building envelope and need to conserve horizontal
hardcover improvements. The property is surrounded by lakeshore on three sides. The issue
of the impact on the neighbor to the immediate north was noted but staff advised that because
of the platted roadway dividing properties that owner to north had no ordinance based claim on
lakeshore view.
Applicant noted that if 55,500 s.f. lot was of a normal, standard shape lakeshore lot,
hardcover allowance would be much higher. The house has been designed so that there is no
need to extend beyond building footprint for additional outdoor recreational space as a lower
level patio has been placed beneath the main level grade room and a roofed deck above the
upper level.
The applicant has proposed a drainfield to maintain runoff from roofs of structure to
offset 7.5% excess of hardcover. In fact, applicant notes that 7.3% of driveway and walkway
improvements' runoff would drain out onto existing surface but that the remainder of hardcover
would be treated through the drainfield. Applicant will be responsible for providing detailed
spec and design information for drainfield. A separate permit will be required to be reviewed
and inspected by the City Engineer. Review Exhibit M, the drainfield is located entirely within
the 75-250' setback area.
Planning Commission Recommendation
Planning Commission members voted unanimous approval of the proposed variances
based on the hardships set forth by applicant subject to the condition that applicant apply for the
legal combination of the five separate parcels upon application for a building permit.

for the property is maintained at 8%.
4. Does the installation of the drainfield influence your recommendation? (25% of
the 32.7% hardcover to be treated within drainfield.)
Any condition of approval must include the condition that the five separate tax parcels
must be legally combined prior to the City issuing a building permit for the new construction.
Applicant may also wish to present an appeal to the Council concerning payment of a front
footage charge as part of the sewer connection fee.

2. For each iteiu of hardcover within that zone, enter the length and
width, and multiply to get square footage (s.f.).
3 . Add up all the square footages to get total square footage of
hardcover.
4 . Divide by the total area of property within the zone and multiply by
100 to get percentage of hardcover in the zone.
5 . If changes in hardcover are proposed, you should do a "before"

HARDCOVBR ORDINANC$ - In 1975 , the Orono City Council adopted an
ordinance limiting the percentage of lot area that can be covered with
impervious surfaces ("hardcover") such as roofs, driveways, sidewalks,
etc. on properties located within 1,000 feet of a lake. Studies have
shown that sediments, oils, and debris carried into the lake from
highly urbanized areas have a detrimental impact on the quality of
water in the lake. The intent of Orono's ordinance is to ensure that
rainfall run-off will be cleansed by filtering through grassed or
vegetated yard areas before entering the lake.

CITY OF ORONO - NOTICE
The Planning Commission will hold public hearings in the Council Chambers at 2780 Kelley
Parkway at 7:00 p.m. on Monday, November 15, 1993 for the purpose of reviewing the
following land use applications:
1. #1886 Robert L. Melamed requests �a conditional use permit for land alterations,
including filling and grading in excess of 100 cubic yards, to accommodate construction
of a residence structure on the property located at 1000 South Old Crystal Bay Road.
2. #1887 Robert L. Melamed requests a conditional use permit for construction and use of
a guest house on the property located at 1000 South Old Crystal Bay Road.
3. #1888 Paul and VeNita Schnebele, 835 Forest Arms Lane, request an average lakeshore
setback variance for a room addition to the existing residence.
4. #1889 Rodney J. Batzlaff, 1115 Brown Road South, requests renewal of front and side
setback variances to allow construction of a detached garage to be located between the
existing residence and the street.
5. #1890 Craig Hertzenberg, 115 Smith Avenue, requests side and rear setback variances
for construction of an addition to the existing residence.
6. #1891 Brian and Barbara Ehalt of 140 Leaf Street, owners, and Don and Glee Jarnes,

8. #1893 Christine A. Freeman, 2240 Shadywood Road, requests a side setback variance

Hardship
Although the total lot area is 55 , 500 sq . ft . only 13 , 700 sq . ft .
lies within the 75 ' to 250 ' zone due to the lots topography and
unique peninsular shape . Twenty five percent of the area within the
75 ' to 250' zone yields only 3425 sq . ft . allowable hardcover. This
is inadequate for house, walk & drive . A standard shaped lakeshore
lot would yield a much higher allowable hardcover for this large of a
1 ot .
Proqosed Solution
A) Limit amount of hardcover generated by utilizing space above and
below garage as living space.
B) Lower level patio lies under cover of main level great room.
C) Roof deck eliminates need for additional decks and patios
D) Flat roof design allows for the collection and control of all
precipitation falling on the structure. Large heated roof drains
collect water and bring it down through the house structure and
into dispersion tanks. Our 4000 gallons of runoff can be held
within the tanks (the equivalent of 2" of rain falling in one
hour ) . The runoff is then dispersed and absorbed by the soil in a
manor similar to a septic field . Only the runoff from the walk and
drive would need to be shed onto the surface of the surrounding
landscape . This area would only be 7 . 3% of the 75 ' to 250 ' zone.
E) The site will be left in its existing heavily vegitated condition
where possible.
Additional Finding
Orono currently has a 60' street right-a-way, but only requires 50' .
If 5 ' were vacated on each side and deeded back to the property
owners , this would increase the 75 ' to 250 ' zane by 740 sq. ft .
