MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, June 9, 2014 7:00 o’clock p.m. _____________________________________________________________________________________   Page 1 of 22    ROLL CALL The Orono City Council met on the above mentioned date with the following members present: Acting Mayor Aaron Printup, Council Members Cynthia Bremer, and Lizz Levang. Representing Staff were City Administrator Jessica Loftus, Senior Planner Michael Gaffron, Public Works Director/City Engineer Jesse Struve, City Attorney Soren Mattick, Consulting City Engineer David Martini, and Recorder Jackie Young. Acting Mayor Printup called the meeting to order at 7:00 p.m., followed by the Pledge of Allegiance. APPROVAL OF AGENDA Item Nos. 6, 9, 11, 12, 13, 14, 15, 18, 19, and 20 were added to the Consent Agenda. Levang moved, Bremer seconded, to approve the Consent Agenda as amended. VOTE: Ayes 3, Nays 0. *2. CITY COUNCIL WORK SESSION MINUTES OF MAY 27, 2014 Levang moved, Bremer seconded, to approve the minutes of the Orono City Council work session of May 27, 2014, as submitted. VOTE: Ayes 3, Nays 0. *3. REGULAR CITY COUNCIL MINUTES OF MAY 27, 2014 Levang moved, Bremer seconded, to approve the minutes of the Orono City Council meeting of May 27, 2014, as submitted. VOTE: Ayes 3, Nays 0. PRESENTATION 4. CITY OF MOUND, MAYOR MARK HANUS Mark Hanus, Mayor of Mound, stated he thought it was appropriate after the first year of contracting with Orono for police services that it would be good to provide a public statement and position from Mound’s perspective. Hanus stated a couple of complaints have been received by the City of Mound regarding the aggressive level of the patrolling and officers perhaps not understanding the circumstances of a particular situation. Hanus stated there typically is more to the story than what the person initially relates and once the full details of the situation is discovered, the complaints tend to be unfounded. Hanus indicated he did refer a couple of those complaints to Police Chief Farniok, who has done an excellent job at diffusing the situation. Hanus stated he attributes the majority of those types of complaints to the fact that every police department will have a slightly different culture and style and that it will take a little time for the residents to become accustomed to that. CITY OF MOUND, MAYOR MARK HANUS, Continued) Hanus stated as it relates to standards, he has monitored the response time and the numbers of patrol cars in Mound since both items were contractually covered and Mound citizens expressed concerns about those elements prior to entering into the contract. Hanus reported the emergency response times from 2011 to 2013 have continued to improve and are now better than what was provided by the Mound Police Department. The number of squad cars in Mound has also increased, which has resulted in some people complaining that they are too visible. Hanus stated Police Chief Correy Farniok is extremely talented in his ability to diffuse situations and is easy to approach by Mound City Staff and Mound residents. Police Chief Farniok has been very open and accessible, which is very important. Hanus indicated Mound is extremely pleased with the current situation and contract and that they have been receiving additional service at a lower cost. Hanus stated in his view the partnership is a good one and the transition has been very seamless. Hanus stated overall the contract has been a positive move for Mound and that he hopes it has been equally positive for Orono. Hanus stated he would also like to thank Orono City Staff for their efforts at making it a very smooth transition. Printup thanked Mayor Hanus for attending tonight’s meeting and for his kind words regarding the Orono Police Department. Printup stated it is nice to hear that the results have been beyond expectations and that Orono looks forward to building on the current relationship. Bremer commented the former Mound Police Department has also been very good to work with and that Police Chief Farniok has done a great job at bringing the two police departments together. 5. TOUR DE TONKA Tim Litfin, Minnetonka Community Education, addressed the City Council regarding the upcoming 2014 Tour de Tonka scheduled to take place August 2. Litfin stated something new will occur at this year’s event and that he would like Tammy Nelson to expound on that. Tammy Nelson, Plymouth, stated approximately a month and a half ago she got in touch with Mr. Litfin about the possibility of getting married in the parking lot of the Minnetonka High School at the 100-mile corral. Nelson indicated she met her fiancé` at the 100-mile corral and that the race has significance to a number of the riders. Nelson indicated Mr. Litfin has embraced this idea and that they owe him a great debt of thanks for allowing them to hold their wedding ceremony there. Litfin stated the Tour de Tonka has experienced a 336 percent increase in ridership since 2006, with last year’s event having 2,896 riders. The majority of the riders last year consisted of men aged 50 to 59, followed by men aged 40 to 49. The riders came from 211 different communities, 42 Minnesota counties, 24 states, and three countries, including two riders from Denmark. Legacy riders are the riders who come back every year, and in 2014 there will be 77 legacy riders. The majority of the riders come from Minnetonka, followed by Chanhassen and Minneapolis. Litfin noted participants from Orono come in at No. 22. TOUR DE TONKA, Continued) Litfin stated the Tour de Tonka helps raise money for the ICA Food Shelf and that they also have a kid ride every year, which has been fairly popular. Litfin thanked the various local police departments for their help in making the event a success. Litfin displayed a map of the different communities the riders go through. The rest stop for this area in 2014 will be at the Trinity Lutheran Church in Long Lake. Litfin noted the Tour de Tonka also has a number of great sponsors which contributes to the success of the event. Litfin displayed pictures from last year’s ride, noting that KARE 11 also covered the event last year. Lifton presented a short video covering highlights from the 2013 ride. Litfin thanked the City of Orono for being a part of the Tour de Tonka. Printup stated it is very impressive to see that the number of participants has continued to climb through the years. Printup thanked Litfin for his efforts at coordinating this event. LMCD REPORT – ANDREW MCDERMOTT, REPRESENTATIVE Andrew McDermott reported the LMCD has recently changed its marina ordinance. The process was started in September following a request by the marina owners. At the April 23 meeting, the new ordinance was adopted by the LMCD and there is now a code of qualified commercial marinas, which are essentially marinas that lease space to individuals and are not city docks or yacht clubs. The LMCD will be looking at those two items in the near future. McDermott stated marinas originally were only allowed to go out to 100 feet but are now legally allowed to go out to 200 feet. McDermott stated there were probably only a third that were at 100 feet, a third at 150 feet, and a third at 200 feet. The docks originally were at 300 feet but have gradually been pulled back over the years in an effort to get them at 100 feet. McDermott stated time has demonstrated that 100 feet was really not workable, which was one of the reasons for the change. McDermott stated the new ordinance also drops the amenity requirements, such as parking spaces, a meeting room, or a pay phone. The change in parking spaces will allow the marinas to increase their density slightly. McDermott stated most of the regulations were outdated and needed to be updated. McDermott noted the new ordinance does not mean that the docks can be extended immediately out to 200 feet and that the marinas will need to submit an application and comply with the setbacks and other requirements. If they currently have a setback variance, they will need to meet the new setbacks. If the docks are extended to 200 feet, the marinas would not be able to increase the number of boats but the slips could be made smaller or larger unless the amount of shoreline would allow the increase in the number of boats. McDermott noted the number of boats at the majority of the marinas would not change. In addition, very few marinas will qualify for an increase in boat storage. Item #02 - CC Agenda - 06/23/2014 Approval of Council Minutes 06/09/2014 [Page 3 of 22] MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, June 9, 2014 7:00 o’clock p.m. _____________________________________________________________________________________   Page 4 of 22    (LMCD REPORT – ANDREW MCDERMOTT, REPRESENTATIVE, Continued) McDermott stated overall there will not be a lot of change at the marinas but that the new ordinance will allow marinas to be a little more reactive to the economy. In addition, the marinas cannot block the channels, cannot go into emergent vegetation, and will be required to comply with other requirements. McDermott stated the biggest benefit will be the ease of making changes to the marinas. McDermott stated the other issue the LMCD has been reviewing is the different levels of high water. In the past the LMCD had ordinary high water and high water. Last Monday the LMCD passed an emergency high water ordinance. McDermott reported the water level on Lake Minnetonka had reached 930.66’, which is the highest level the lake has ever been at. The new ordinance goes from a regular high water ordinance with no wake out to 600 feet, with wakes being allowed after 600 feet from the shoreline, to an emergency high water ordinance, which does not allow any wake at all on the lake and will stay in effect until the water level reaches 930.3’. McDermott indicated the normal high water level is 929.40’. McDermott stated the dam is currently fully open and is sending out 300 cubic feet per second. The Minnehaha Creek Watershed District feels that if there is normal precipitation for the next six weeks, the water level will go back down to its normal level sometime in July. McDermott noted similar high water levels occurred in 2002 but those did not occur until mid-September and the LMCD did not take any action since it was near the end of the boating season. McDermott stated until the weather gets hotter and there is low humidity, the water level will not drop significantly. Printup asked if the LMCD is receiving positive feedback about the new emergency high water level. McDermott stated they are from the lakeshore owners given the damage they are experiencing to the shoreline. The LMCD was notified by a number of lakeshore owners that their docks were submerged. McDermott noted the new ordinance exempts emergency personnel from the emergency water level regulations and that it appears the majority of the people are following the ordinance. Levang asked if the Water Patrol has increased their monitoring of the situation. McDermott indicated they have and that the no-wake ordinance allows for easier enforcement. McDermott stated the final item relates to the LMCD budget. Orono’s share of the budget increased .5 percent or $278. The LMCD has kept a relatively flat budget and the majority of the increase will be going towards equipment replacement. Levang asked if the boat safety program will be done again this year. McDermott stated the program has been very popular, with two classes already being held and the third class already filled up. McDermott stated the biggest problem the LMCD has experienced with the classes if finding an ideal place to hold the event due to the fact that an Internet connection is required for a number of computers. PUBLIC COMMENTS Mark Jensen, 1520 Minnie Avenue, stated he has resided in Orono for approximately 30 years and that he is currently experiencing a situation on his street dealing with water. Jensen distributed some photographs showing the water. Jensen indicated the water flows from the left down Minnie Avenue from Cherry Avenue. There is a drain at the bottom of Cherry and his property is on the left. Jensen indicated the water stays in the street until it gets about 10 feet from his driveway and then goes left into his driveway. Jensen stated photo #5 is looking up Minnie Avenue. The new homes are located on the left of the photograph and his house is on the right. Jensen indicated photo #6 shows the logs that have been placed to help keep the water out of his driveway. Jensen stated his current driveway has deteriorated quite a bit and will need to be replaced, but given the current situation with the street and the water, he does not want to replace it since the water will wreck the new driveway. Jensen stated photo #8 shows his house and driveway. Jensen indicated he has had to build kind of a ramp for a car that is in the garage that is low to the ground so he can get the car out of the garage. Jensen stated photo #9 is another picture of the driveway with the new houses located down on the left. Photo #10 depicts the house located across the street. Jensen stated when the rain runs down the street and down his driveway; it then goes into his neighbor’s property. Jensen indicated they have dug a little channel to help divert the water to keep it away from the neighbor’s foundation but that his neighbor has experienced damage to his foundation. Jensen stated his neighbor has also hooked up a sump pump to try and keep the water out of his basement. The neighbors across the street also have sump pumps and that water goes out to the street. Jensen stated the last photo shows the logs. Jensen noted the curb is approximately six to eight inches higher than when he first moved out to the area. The street is also sloped to where the water comes off of Cherry and stays on his side of the street. Jensen stated the area has had an unusual amount of water this year, but since the road has been resurfaced five or six years ago, the water stays on Minnie Avenue until it hits his driveway. Jensen stated something has to be done about the situation and that he has spoken to Jesse Struve a couple of times about it. Jensen stated in his view the only way the situation can be remedied is where the majority of the water would stay on Cherry Avenue. Jensen indicated he is not asking the City to replace his driveway but that something needs to be done, such as the installation of a drain or drain tiles. Jensen indicated he is willing to work with the City to correct the problem. Struve stated the developer of the new homes on Maple Place and Minnie Avenue is also aware of the problem and that he is looking at possible solutions. Struve stated until he sees what the developer will be proposing; he would recommend the City hold off with any potential solutions. Struve indicated he did send an email earlier today asking for an update from the developer and that he will be pushing the issue as much as possible with the developer. Jensen stated Mr. Struve has been very helpful during this situation. PLANNING DEPARTMENT REPORT *6. LONG LAKE SLOW NO WAKE REGULATIONS – ORDINANCE NO. 123 Levang moved, Bremer seconded, to adopt ORDINANCE NO. 123, an Ordinance Amending Orono Municipal Code Chapter 94, Waterways, by Amending Section 94-136 and Adding Section 94-143 Regulating the Operation and Speed of Watercraft on Long Lake. Ayes 3, Nays 0. 7. #14-3654 JOHN BESSESEN ON BEHALF OF DAVID DELANEY – “2500 KELLY AVENUE – SKETCH PLAN Gaffron stated the applicants are requesting consideration and comments regarding the conceptual proposal for a 10-unit residential twin home development on the property located on Kelly Avenue. The property is located directly behind the Lund’s building on Kelly Avenue and is also close to the area that was re-guided to mixed use. The site is very wooded and has a steep slope down to a wetland adjacent to Kelly Avenue. The survey also shows a fairly flat area on the top of the parcel. Gaffron noted the survey also depicts a conservation easement that was created across the lower part of the property for drainage purposes. That easement has resulted in a minor change to the applicant’s proposal. The site consists of approximately four acres of dry land and six-tenths of an acre of wetland. Gaffron displayed some sketches of the unit the developer is proposing for the site. Gaffron noted the sketch plan has changed slightly based on the comments by the Planning Commission. The site would be accessed by a private driveway off of Kelly Avenue. The conceptual plan presented results in a net density of 2.5 units per dry buildable acre, or 2.2 units per gross acre. Development at the proposed density would require a rezoning and potentially an amendment of the Comprehensive Plan. General acceptance of the twin home concept for this site as a transition between commercial and single-family uses and is a plus for the Navarre area in providing more housing choices; 2. There was some desire expressed for reducing the number of buildings from five to four and creating greater separation between buildings to reduce the visual massing; 3. One Commissioner expressed concern about traffic impacts on Kelly Avenue and the neighborhood streets to the south and that the neighborhood likely would prefer single-family development of the site; 4. Commissioners generally indicated that slope management for erosion control and tree preservation for screening and maintaining the existing character of the neighborhood were key to the success of a development at this site; 5. Discussion regarding the access and road layout, T-turnaround versus cul-de-sac versus through road did not result in any conclusions. Gaffron stated based on the discussions with the Planning Commission, the developer has revised his sketch plan to have all the units facing to the south or southwest with a single private road off of Kelly Avenue and individual driveways that are easily accessed. In addition, there is a T-turnaround for emergency and other vehicles as opposed to a cul-de-sac, which would require significantly more hardcover, and some guest parking off to the side. The units overlook the wetland, leaving some area between the wetland and Kelly Avenue for some screening, which Staff feels is important in this situation. John Bessesen, the applicant is also proposing a rezoning of the site, which will likely require a PUD and a Comprehensive Plan Amendment. The developer is looking tonight for some direction from the City Council. Gaffron noted the sketch plan is similar in concept to the Stonebay development, with commons areas located next to the units. Gaffron stated the flowage and conservation easement may need to be redefined based on the location of the wetland and potentially there may be a dedication and rededication of the easement. Stormwater ponding may likely be required on the north end of the site. Gaffron stated Staff is aware of some drainage issues with Kelly Avenue and there will be concerns that this development does not add to those issues. Gaffron indicated there may or may not be a trail easement required and an additional park dedication fee may be required over what was previously paid a number of years ago. In addition, the applicants are proposing to create a walking environment with pedestrian access to Navarre. Gaffron stated since this is a sketch plan review, the City Council is not expected to formally act on the proposal but merely provide direction to the applicant. Bessesen noted there has been a wetland delineation done, which is significantly smaller than the easement that was created in 1981, particularly because the grocery store has installed a cistern to hold some of the water. Bessesen state he recently looked at the wetland and there is very little water sitting there and is very well contained. Bessesen stated the way the site sits and overlooks the meadow makes it nice for ten smaller units rather than four bigger sized homes. The goal of the development is to be able to provide housing for people who are 55 or older. Most of the neighbors are retired and this type of housing would have a smaller impact on the area. Bessesen indicated he would like to use the wetland as an amenity and that the units will be set back from the road quite a bit and will not be easily noticeable. Bessesen stated the area near the bluff would also not be heavily used by the residents with this type of development versus single- family homes. Printup stated his big concern, given his knowledge of the area, is the area across Kelly Avenue from the wetland. Printup stated when he was younger people used to call the wetland the bottomless pit and that his concern relates to the steep terrain and how unknown the wetland is. Bessesen noted they would not be allowed to change the wetland at all. Bessesen indicated the Minnehaha Watershed District has approved the new wetland delineation and the wetland is quite a bit smaller than the one completed in 1981. Printup asked if Kelly Avenue collects water or gets flooded over in the spring. Bessesen stated it does further down the street. Bessesen indicated in the area near the back of the church, the road is currently closed due to the water coming from the rest of the environment. Bessesen stated he could come off of County Road 19 in the back, which would not affect the wetland at all, and that he would ask the City Council provide direction on that. Bessesen stated he would like to see something more of a commercial use developed on the top of the hill at a later date. Levang stated she likes the concept of the twin homes, but that she has a concern about the need to rezone the site and change the City’s Comprehensive Plan, which raises a point about whether the concept is feasible. Levang stated she would also like to see some consideration given to reducing the number of buildings from five down to four. Levang asked what his opposition is to doing something that the current zoning would allow. Bessesen stated in his view if there are larger lots created on that site, there would be four larger sized homes, which would not allow much area for yards. It would also create a different environment in the neighborhood if those families had children. Bessesen stated he would like to have that view overlooking the wetland without creating a big impact. Printup asked what the zoning is across Kelly Avenue by the townhomes. Gaffron indicated it is one-acre zoning but it is a PUD development. Gaffron indicated it would be similar to what is across the street and it would also be similar to Stonebay. Gaffron stated it would likely be a PUD or an RPUD. Levang stated given the fact that there is similar type housing across the street, this development would tend to blend in more and would not be out of the ordinary. Bremer commented it is a good transition type of housing for the area. Bremer noted some of the properties have been on the market for the last few years, which makes her wonder whether there is a market for what is being proposed. Bessesen stated those were built earlier on and that he actually bought one of the properties a few years back and built a home on it. Bessesen noted those units are also a split-level home, which makes it difficult for older people, and that this type of housing would give Orono the opportunity to keep their senior citizens in the community. Bessesen stated a similar type of development in Mound is now selling for half a million dollars a lot. Bremer asked if his preference would be to come off of County Road 19 or Kelly Avenue. Bessesen indicated he is flexible on that. Printup stated he is comfortable with the concept and that he prefers access off of County Road 19. Levang stated it can be difficult to access Kelly Avenue and that it makes sense to come in off of County Road 19, particularly if he is planning something else on the upper portion. Levang asked if these units would have a view of the lake. Bessesen indicated they would not unless they constructed a walking path down to the public beach. Levang stated she would like to see the number of buildings reduced, with access off of County Road 19. Bessesen noted he did reduce the size of the footprint down to 1,800 square feet per unit in an effort to reduce the massing. Gaffron stated the applicant is also looking for direction on the rezoning. Gaffron stated he is hearing from the City Council that access should be off of County Road 19. Bessesen stated he is willing to have his architect proceed forward with designing the layout and having his engineers look at the site. Bessesen stated the wetland delineation has confirmed that he would be able to construct a road on that side of the wetland. The City Council took no formal action on this item. The property is accessed from a roadway or a driveway system that is within the Hennepin County Railroad Authority’s right-of-way. The driveway serves six to eight homes to the east of this property. In addition, the survey shows that the existing house is located into the Hennepin County | right-of-way. Gaffron stated the applicants are requesting variances in order to construct a new residence on the property 1.7 feet from the rear lot line where a 30-foot setback is required. Normally Hennepin County and Staff would prefer to see a greater setback, but seeing how the current house is located within the right-of-way, Staff is not opposed to the setback. As a result of the house being relocated, the applicants are proposing a setback of 57 feet from the OHWL where a 75-foot setback is required. Gaffron noted on addition, a hardcover variance is being requested to permit 36.57 percent hardcover where 25 percent is normally allowed. A conditional use permit is also requested in order to conduct grading which exceeds ten cubic yards within 75 feet of the OHWL and retaining walls in conjunction with removal of the existing home and an existing garage and construction of the new home. Lot area and width variances are also required because the proposed use of the existing lot of record will not meet the 25 percent hardcover limitation and will not meet the required LR-1C and Shoreland setback standards. Gaffron noted on the north end of the house, there is an existing garage that is partially underground and the applicants are proposing that be removed and retain part of the garage area and part of the existing apron as a spotting area, which will require some retaining walls along the east and west sides of that parking area. Those retaining walls are fairly close to the neighboring property but it does provide some parking space off of Crystal Bay Road, which has limited on-street parking. The applicants are proposing 10-foot setbacks on either side. Gaffron displayed photographs of the property and pointed out the location of the existing underground garage and an existing retaining wall. Staff has concluded that the retaining wall is necessary from an engineering standpoint. Gaffron noted there is also an existing drainage situation and the applicants will lift the elevation of the new house by a foot to a foot and a half to help alleviate that run-off. Gaffron noted at its May meeting, the Planning Commission recommended approval of a vote of 7-0 subject to Staff recommendations and the following conditions: 1. The shed must be relocated to a conforming location within the property or the shed must be removed but the attached garage may be increased in dimension to gain an amount of interior space equivalent to the removed shed. Expansion of the garage may not encroach closer than ten feet to the east side lot line if expanded eastward, nor closer than the proposed 1.7 feet to the rear lot line. 2. The mature oak next to the underground garage is anticipated to be disturbed by the proposed construction and plans to replace it should be included in the revised plans. The mature tree on the other side of the garage is proposed to remain. Gaffron stated the applicants have revised their plans to meet the recommendations of the Planning Commission and have decreased the hardcover slightly. Gaffron noted it is difficult to decrease the amount of hardcover on the property any further due to the size of the lot. Gaffron stated the variance request is similar in scope and character to other past variances granted for rebuilds on Crystal Bay Road. Staff recommends approval of the variances per the findings and conditions of the draft resolution. Levang asked how deep the underground garage is. Gaffron illustrated the existing garage on the overhead. Gaffron pointed out the existing garage is close in proximity to the current house. The portion of the garage that is underground will be removed and filled in. Levang asked if what is exposed today will remain. Gaffron indicated it will remain. Levang asked how that will be filled in. Gaffron stated it will likely be filled in with dirt from the site. Levang indicated she is concerned about erosion or the area collapsing. Dave Martini, Engineer stated to the extent they could, they would use materials from the site, compact the fill, and then restore it as quickly as possible to eliminate the erosion issues. Levang asked what the purpose of the retaining wall is. Gaffron stated the wall will be in the range of eight feet high and will require engineering. The exact type of retaining wall has not been determined at this point. Gaffron pointed out the areas on the overhead where retaining walls would be required. Martini stated the topography of the site limits what the applicants can do from an engineering standpoint. Given the minimal room to construct the wall, it will likely be a poured concrete wall. Levang asked if the depth of the garage will be sufficient for a car. Gaffron indicated it will be one car deep. Gaffron stated the lot is a 50-foot wide lot and that the garage will likely be no more than 20 feet deep. Gaffron indicated the parking area is for guest parking. The lot is very small, consisting of approximately 4,975 square feet and only 50 feet in width. The existing residence is a 20’ x 28’, one-story home with some attic space and no basement. Gaffron indicated there are a number of small lots in this area that were created 100 years ago and are backed up to the creek. The 929.4’ contour abuts the back of the property so it is technically a lakeshore lot with a setback even though it really does not have functional access to the lake. Gaffron noted the variances being requested are rear/street, lake, and side yard setback variance approvals in order to construct a second story over the existing home 13.9 feet from the east side and 15.7 feet from the west side lot lines where 30 feet setbacks are required; 52 feet from the OHWL where a 75-foot setback is required; and 19.8 feet from the street where a 50-foot setback is required. Gaffron stated in his view the proposal is similar to other projects in the neighborhood and will not change the character of the area. Gaffron stated the house has existed in this location for at least 30 years and it is yet to be determined whether the foundation will support a second story. Whether the foundation needs to be replaced does not affect the placement of the second story and it is Staff’s recommendation that in the event the foundation requires total replacement, it will not require further Council review as long as the building footprint, height and building envelope are not changed. Levang asked if the hardcover could be reduced by attaching the garage to the house. Levang asked if it would reduce hardcover. Gaffron indicated it would reduce it slightly. Bremer stated that is assuming it would be kept as a single car garage. Gaffron stated any changes made to the garage would likely have other impacts that Staff has not considered at this point. Gaffron stated if the garage is relocated, less of it would be in the floodplain but that the least impact to the property would be to add a second story. Gaffron noted that staff recommends approval of the variances subject to the applicants providing engineering certification of the existing foundation for suitability of adding a second story prior to issuance of a building permit. Bremer indicated she is fine with the application but that she is interested in knowing if the applicants would like to relocate the garage. Printup stated he is in favor of adding a second story, and that if they would like to have an attached garage that could be addressed in the future. Tammy Maddrey, Applicant, stated they did have an architect draw up a tandem garage with two stalls, which did reduce the hardcover somewhat, but the price of the project was significant and would likely result in the lot being overpriced and overbuilt for the area. Over the last several years, the City has been purchasing and installing permanent generators at high flow or problematic lift stations. The City began this program in an effort to reduce sanitary sewer backups and to prevent the discharge of raw sewage into Lake Minnetonka. PARK LANE GENERATOR UPDATE, Continued) Struve noted following installation of the generator, a local resident expressed concerns with the location and visual impacts of the generator. Staff did speak with one of the residents at the site prior to any work taking place and had the understanding that they had received a verbal okay to proceed with the project with the assumption the City would provide screening after the installation. The resident maintain they did not provide verbal approval prior to the start of the project. Struve noted staff has been working with the resident for the last eight months trying to come up with a mutually agreeable solution but have been unable to reach an agreement. The resident prefers the generator be moved approximately 300-400 feet to the City-owned lot by the intersection of Elm Street and Park Lane. Staff does not feel this is a reasonable request because of potential issues with having a generator located far away from the lift station. There is also the potential safety issue of having a power source far away. Struve stated to relocate the generator, it will cost an estimated $19,000 and the residents next to this relocation area may be opposed to the placement there also. Struve noted another option would be to locate the generator further southeast of the existing location. While this may reduce the visual impact to the one resident, it may still be visible from their property and impact other properties. There is also a good chance the generator would have to be placed in an existing pavement area which would reduce winter snow storage and would increase the chances of having an incident with a vehicle. Struve noted staff also had discussions with the resident about providing a 6-foot tall wood fence and then planting arborvitae to shield the fence. The resident would prefer to have the entire site fenced in while Staff would only recommend providing a fence around the generator and the new electrical panel in order to leave necessary access. Struve indicated no final solution has been arrived at with the resident and Staff is requesting the City Council provide guidance on how to proceed. Staff prefers the current location, with screening and potentially painting of the generator to reduce the visual impact. The residents have indicated they may pursue legal action if the generator remains in its current location. Struve displayed a photograph of the area depicting the new generator, transfer switch panel, and other existing equipment that was on the site prior to the installation of the new generator. Levang asked where the bollards would be located. Struve indicated they would be located as tight to the existing generator as possible and would be between the fence and the road. Levang asked if this area would be called an open drain. Struve stated it is an existing drainage swale. Levang asked how many bollards there would be. Levang stated it is important to note that there is a public landing in that area and that there are boats and trailers coming in and out, which is a good reason for having the bollards. Printup asked if the homeowner is present at tonight’s meeting. Struve indicated they are not. Printup noted the City’s standard procedure is fairly laid out in Staff’s memo and that he would be in favor of sticking with the City’s standard procedure. Struve stated in all other cases the City has worked with the surrounding landowners to come up with a screening plan. Levang noted the resident requested the color of the emergency generator be changed. Struve stated the Public Works Department could look at that and that the 6-foot fence would likely not hide the entire generator. Bremer commented the generator is pretty bright, which is probably intentional. Levang asked if the other generators in the City are either beige or green. Struve indicated they are. Struve noted this generator is not brand-new and was brought in from another site. Struve stated he will speak with the homeowner and see if they are okay with the proposed changes. Bremer stated the location of the generator, painting, and fence are fairly standard. Loftus stated Staff has presented at the various options, determined the cost of them, weighed the pros and cons of those options in the memo and the Engineer recommends the current location and screening. 17. HANLON AVENUE EXTENSION PETITION Struve stated Staff has received a request to extend Hanlon Avenue to provide access to 565 Hanlon Avenue. This property currently has access to the property from an alley located between Barrett Avenue and Hanlon Avenue. Toward the end of April, there was an incident where emergency vehicles had difficulty locating the property in question mainly because the property, while it has an address on Hanlon, does not actually have access off of Hanlon. Struve indicated access to the property is gained through an alley to the west of Hanlon Avenue. HANLON AVENUE EXTENSION PETITION, Continued) Bolton and Menk has provided a not-to-exceed fee of $2,500 to examine the feasibility of extending Hanlon Avenue or look at potential alternatives to help make the property more identifiable and easily located. Staff recommends accepting Bolton and Menk’s proposal. Hadassah Zohara, 565 Hanlon Avenue, indicated she has resided at this property for approximately 30 years and that she has always experienced difficulty with deliveries of gas, mail, and other products. In addition, people who visit the property require specific directions. Zohara indicated she had an elderly person visiting in April who became sick. Zohara stated she provided 911 with very specific directions but the squad car had a difficult time finding the house. The ambulance also went down Hanlon Avenue and could not figure out where the house was. Zohara stated in her view this is a serious situation and that there should be a fairly easy way to resolve it. Zohara indicated she is not sure if Hanlon Avenue has ever gone through to her property but that it is strange that she has a Hanlon Avenue address when the property cannot be accessed from Hanlon Avenue. Levang asked if the house is for sale. Zohara indicated the house is for sale. Printup asked why the road dead ends there. Gaffron indicated there is a fairly steep slope at the end of the road going down to the wetland and that it is his belief that approximately 30 to 40 years ago there was an informal driveway off of Hanlon Avenue. Zohara asked if the hill that goes down to the wetlands is City property. Gaffron stated there is a 50 or 60-foot right-of-way extending all the way down through the wetland to the railroad right-of-way. Gaffron stated he is sure the road was never extended further due to the topography. The property currently has access from the alley but there is no signage at the alley denoting directions to this property. Gaffron stated the solution may be as simple as erecting a sign. Zohara stated there is also a concern that the alley is not in very good shape and that it is also difficult to access the property in the wintertime. Gaffron stated the City does not have the option of coming in from the south and that there should be clear directions from either the alley or Hanlon Avenue on how to access this property. Levang stated her concern is that the property is now currently for sale and that the road extension may be contingent on the sale. Levang stated she would rather see the developer pick up the costs of extending Hanlon Avenue in the event the house is torn down and rebuilt. Levang stated in her view the City Council should table the request. Zohara stated the house is listed for sale but may be coming back off the market for two or three years. Levang asked if she would be willing to pay for the cost of the study. Zohara indicated she has been a taxpayer of Orono for 30 years and that she does not feel like that is her responsibility. Printup asked how many other neighbors are serviced by the alley. Zohara indicated none. Struve indicated the other residences have access off of Hanlon Avenue. Struve stated the Public Works Department could work with the resident on erecting some signage. Levang stated she is not opposed to signage but that she has a concern with approving the study since the property is for sale and may be redeveloped at some point in the future. Mattick stated the issue is locating the property. Mattick noted narrow roads and private roads are not new to Orono and that this is not the first home serviced by a private road. The question is whether the City would like to spend money to extend Hanlon Avenue or whether signage should be erected. Mattick indicated he is not sure whether the alley is controlled by the City. Bremer asked if the homeowner is amenable to signage. Zohara stated that is a viable solution but the problem that she has is that a number of people are now relying on their GPS and that she is not sure how erecting a sign would help those people. Zohara stated there would need to be a sign on the alley and then also a sign on Hanlon Avenue directing people to the alley. Zohara indicated she also is not sure how emergency response people find different addresses and that perhaps that should be checked as well. Struve stated it would involve two different signs, one at the alley and then one for the people traveling westbound on Dickenson directing people to the alley for 565 Hanlon. Struve stated the Public Works Department could create the signage and erect it in a very short period of time. Bremer stated in her view the signage should be done fairly quickly, with the property owner being given the opportunity to review the signage, and then the City could perhaps review this if there are still complaints. Levang noted this past Saturday there was a planting at the Navarre Park and recognition of Mrs. Englund who donated a number of lilac bushes. Levang stated the volunteers planted between 300 to 500 hostas and that the area looks magnificent. Levang noted City Administrator Loftus was in attendance along with Mayor McMillan and Council Member Printup. Levang stated Mrs. Englund is hoping that her donation will spur more donations to the City parks. In addition, a neighbor to the park allowed the group to transplant some hostas from her property. Levang stated in the future the City will be able to move a portion of those hostas into other parks. Levang reported the donation garden is approximately 90 percent planted at this point and that a number of new volunteers have offered to help. Bremer reported there was a Police Commission meeting this past week and that there was a good discussion on new trends and ongoing concerns in the area. Bremer stated in her view Police Chief Farniok has been doing a good job of getting out into the community but that there are always discussions at the meetings on how to increase the awareness of the police department and the various issues that the community is facing. Bremer stated the Committee also spoke about funding by the contract cities but at this time the contract cities are not interested in changing the funding formula. Printup noted the City has certificates of appreciation for Lois Hudlow for her donation of the plantings and DaVinci’s Pizza for donating pizzas to the volunteers. Printup stated even though Long Lake no longer contracts with Orono for their police service, Orono still provides help from time to time. Printup noted the City Administrator and himself met in Delano with some local officials from the Highway 12 area and Mn/DOT to look at ways to make the Highway 12 corridor safer. Loftus stated three state representatives were in attendance and that they indicated they would be willing to support a funding bill if definite solutions are arrived at. Loftus indicated the push at the meeting was the need to educate drivers. State Representative Joe McDonald advocated the creation of a community corridor coalition to carry forward the discussion, which was supported by the group. Loftus stated everybody at the meeting was united in ensuring that the local roadways are safe. Mn/DOT indicated that in their view the rumble strips are effective and that there are limited engineering solutions. Loftus stated the main thrust of the meeting was to get their concerns to Mn/DOT. Loftus stated to her understanding Delano will be setting up another meeting in the next month or two. Levang stated she has heard comments that people do not like to use that roadway but that in her view the rumble strips have helped somewhat. Levang stated any added improvement would be very welcome. Printup noted school is now officially out and that he would encourage everyone to drive safely over the summer. Printup noted Long Lake Days will be happening later this week. CITY ADMINISTRATOR’S REPORT Loftus stated the City received notice from Three Rivers that the Dakota Trail will be resurfaced in July and August. Three Rivers will have signs out the week before notifying the residents of what sections will be closed. Loftus stated the information will also be posted on the City’s website. Loftus noted she forwarded information she received from the City’s architect to the City Council on the City Hall/Police Station project. Loftus stated they hope to have the plans and specifications to the City Council by June 23. Loftus indicated one of the aspects of the project involves new signage for the City Hall/Police Station complex at the entrance points. The angled access point will be removed, with the other access point closest to the City Hall building remaining. Loftus displayed a sketch of the possible signage. Loftus indicated the signs meet the City’s residential sign code. Loftus stated the City’s current sign is approximately six feet high and approximately ten feet wide, but that it is erected at an angle that makes it difficult to see. Bremer commented she is not sure whether she likes the signs being offset. Printup stated the current sign is more representative of the other signs in the City. Levang stated she likes the offset of the sign since it draws people’s attention to it a little more. Loftus stated in her view the new signage will be more effective in directing people to either City Hall or the Public Works Department than what currently exists. Levang asked if there would be plantings around the sign. Loftus stated she believes the City’s sign regulation requires some plantings. Bremer stated her preference would be to align the signs up center with the monument and that the offset may appear to be outdated in a few years even though it may be architecturally trendy at the present time. Printup stated he also would prefer the signs to be centered. Loftus stated they are also attempting to find a good location for the sign to ensure the sign is not too close to the trail but yet still visible. Levang stated in her view the sign needs to be visible and does what it is supposed to do, which is direct people to the building. *21. LICENSES AND PERMITS Transient Merchant License 1.
