Representing Staff were City Administrator Jessica Loftus, Finance Director Ron Olson, Assistant City Administrator of Long-Term Strategic Planning Michael Gaffron, Planning Coordinator Melanie Curtis, Public Works Director/City Engineer Jesse Struve, and Recorder Jackie Young. Mayor McMillan called the meeting to order at 7:00 p.m., followed by the Pledge of Allegiance. APPROVAL OF AGENDA Item Nos. 6, 7, 8, and 10 were added to the Consent Agenda. Bremer moved, Printup seconded, to approve the Consent Agenda as amended. VOTE: Ayes 4, Nays 0. APPROVAL OF MINUTES *2. REGULAR CITY COUNCIL MINUTES OF APRIL 28, 2014 Bremer moved, Printup seconded, to approve the minutes of the Orono City Council meeting of April 28, 2014, as submitted. VOTE: Ayes 4, Nays 0. PUBLIC HEARING – 7:00 P.M. 3. ANNUAL PUBLIC HEARING FOR NPDES PHASE II STORM WATER PERMIT Struve stated every year the City is required to hold a public hearing to provide input on the NPDES permit. The goal of the hearing is to help educate interested citizens and receive comments from the public, which will be documented and responded to in the City’s final submittal. Struve indicated NPDES stands for National Pollutant Discharge Elimination System and is a stormwater pollution prevention program. The City’s NPDES permit was initially created in 2006 and has been updated a few times since. Best management practices covered under the permit include street sweeping, public education, maintenance of the system and how best to move forward with any improvements. The permit also involves annual reports, periodic revisions of the City’s ordinances, and a mapping of the City’s stormwater system. The six basic control measures include public education, public participation, illicit discharge, construction site stormwater runoff controls, post-construction water management, and pollution prevention. Struve stated local decisions on stormwater management can have global impacts and include decline in aquatic biodiversity, habitat loss, increased flooding, aesthetics, and human health. Various pollutant sources include painting near body waters, grass clippings, and leaves that enter into storm drains and discharge into water bodies. Struve stated there are multiple solutions to these issues but it basically starts with homeowners and the use of rain gardens and other preventative measures. ANNUAL PUBLIC HEARING FOR NPDES PHASE II STORM WATER PERMIT, Continued) The goals for 2013 included articles in the City’s spring and fall newsletters regarding lawn maintenance, cleaning up after animals, and other topics related to stormwater management. Struve noted this information is also available on the City’s website. The City also offers a grass and leave disposal program with drop-off at the Public Works facility. In addition, methods for handing construction debris and collection are reviewed, with inspections by both City Staff and the Minnehaha Watershed Creek District being conducted. Struve stated the City’s streets get swept at least twice a year along with various culvert improvements, and stormwater treatment devices are inspected and cleaned out twice a year. The City has approximately 25 devices currently to trap the debris. Struve stated some of the 2014 implementation activities include a pond maintenance review, a review of impaired waters, ravine stabilization, and a review of the Public Works maintenance operations. Another item to consider as part of the NPDES permit includes MPCA audits. Struve noted no fines have been levied to date against the City and that care is taken to make sure that residents’ questions are documented and included in the submittal. Struve stated future rules revisions will likely result in changes in what the City is required to do and that the work is funded through the stormwater enterprise funds which are collected through the residents’ water bills. Struve stated the next step in this process is to record any comments from the residents, prepare a response, and then submit the permit documentation. Mayor McMillan opened the public hearing at 7:12 p.m. There were no public comments regarding this item. Mayor McMillan closed the public hearing at 7:12 p.m. Levang asked what type of pond is denoted under the maintenance section. Struve indicated it would cover ponds specifically created for stormwater management and that there are approximately 30 such ponds in Orono. Struve noted it would not cover low areas that rain water is directed to. McMillan asked what is done with the debris that is collected during the street sweeping. Struve indicated the debris is usually taken to the landfill. Struve stated the debris can be screened and some sand can be reused but that the amount is very limited. Struve indicated the amount of sand put down in the winter varies from year to year, which may necessitate additional sweepings in a particular year, but that the Public Works Department has not really quantified the amount of sand used. Printup asked whether any stenciling as depicted in the pictures has been done in Orono. ANNUAL PUBLIC HEARING FOR NPDES PHASE II STORM WATER PERMIT, Continued) Struve stated not to his knowledge and noted the City’s stormwater system is fairly limited compared to other cities. The City Council took no formal action on this item. LMCD REPORT – ANDREW McDERMOTT, REPRESENTATIVE None PLANNING COMMISSION COMMENTS – KEVIN LANDGRAVER, REPRESENTATIVE Landgraver noted the joint session with the City Council and Planning Commission occurred last week and that it was a productive meeting. Landgraver indicated he would be available for questions. PUBLIC COMMENTS None PLANNING DEPARTMENT REPORT 4. NEW JOINT USE DOCK LICENSE – PIRATES COVE (850-860 WINDJAMMER LANE) Gaffron stated this is a request for a new joint use dock license and that typically the City only receives renewals. The dock is proposed to be located on either side of the shared lot line between 850 and 860 Windjammer Lane and will serve four off-lake lots within the Pirates Cove subdivision. Gaffron displayed the existing and proposed dock layouts for the area. Gaffron noted the inland four lots have easements on either side of the lot lines between two riparian lots. In the past they have had a joint dock situation that has not risen to the level of being obvious to Staff and a license was never applied for. Gaffron stated the dock situation likely existed since the 1960s to some degree. Gaffron stated there are two potential dock layouts to serve one slip for each of the off-lake lots. One dock has a side opening and the other opens to the lake. The second dock option meets the 100-foot limit that the LMCD would place on the dock system. Gaffron stated the City began regulating joint use docks in 1963. The original plat layout was created in 1965 and showed two outlots. Neither of those outlots was ever created. A few years later an easement was created between Lots 6 and 7. Lot 6 had a 10-foot walking easement for the off-lake lots that widens out to 20 feet and the easement for Lot 7 also widens out to 20 feet. Staff believes the easement situation was created in 1967, two years after the plat, and was long before the City required any approvals for granting easements to the lakeshore. In 1971, a separate easement was granted that changed the easement for Lot 6 so it was only 10 feet wide at the lake. Gaffron noted that easement is still in effect as well as the easement that granted the 20 feet. NEW JOINT USE DOCK LICENSE – PIRATES COVE [850-860 WINDJAMMER LANE], Continued) Gaffron indicated the LMCD, in looking at existing situations, will look at the entire length of Lots 6 and 7, which consists of approximately 344 feet. Based on the LMCD’s review of the six lots, the property owners would be allowed up to seven slips and Lots 6 and 7 would be limited to three slips. Gaffron noted the aerial photos from the 1970s, 1989, and 2009 show that there has been a dock at this location but that it has increased in size through the years. There have also been different layouts of the dock throughout the years. From Staff’s perspective, there are no real issues with a joint use dock at this location but that it would be looked at as a legal nonconforming situation. The City Council should consider the following issues: 1. The proposed joint use dock appears to fall under the definition of “joint use” in that it appears to be an association of more than two non-riparian landowners within a subdivision adjacent to the lake sharing a dock or dock system providing permanent boat slips for the members. Based on the aerial photos, it is entirely possible that past use of the shared dock system did not rise to the level of obviously needing a joint use license. 2. If the owners of riparian Lots 6 and 7 each agree to be limited to one slip, it would be reasonable to allow credit for their entire lakeshore length toward the total of six slips serving six lots. On the other hand, if either owner does not agree to such a limitation, then the “one slip per 50 feet” standard of Section 94-38 would not be satisfied. 3. The easements granted in 1967 and 1971 would appear to predate the 1984 Orono code and might be considered as creating a legal nonconforming situation. 4. In addition to the 2012 survey, the applicant has submitted two proposed dock layouts, each containing four slips. Layout A extends approximately 115 feet into the lake, likely requiring an LMCD length variance, while Layout B meets LMCD’s 100-foot length limit. 5. If the joint use dock license is approved, it would be reasonable to add a stipulation that each boat stored at the site must be registered to one of the non-riparian lot owners. Gaffron stated the City Council has the option of calling for a public hearing on this matter if is so desires. Staff’s memo with the attachments was mailed to all six involved property owners. Pending confirmation that the owners of Lots 6 and 7 will agree to being limited to a total of three slips for their use at their own property, Staff would recommend approval of a 2014 Joint Use Dock License for the Pirates Cove Dock Owners; to be renewed annually, subject to the following conditions: 1. Either dock layout A or B is acceptable, subject to gaining appropriate approvals for the dock system from the LMCD. 2. No more than four slips shall be allowed, one for each of the four off-lake lots, to be installed as a single four-slip dock system. The owners of Lots 6 and 7 shall additionally be limited to no more than three total slips combined, but are not required to have those slips be part of the joint dock structure. NEW JOINT USE DOCK LICENSE – PIRATES COVE [850-860 WINDJAMMER LANE], Continued) 3. Each boat stored at the shared dock must be registered to one of the four non-riparian lot owners. 4. Rental of slips is not allowed per City Code. Gaffron stated the City Council should review the proposed joint use with the applicants, determine whether a public hearing is necessary, and either set a date for a hearing or direct Staff to issue a 2014 Joint Use Dock License to the Pirates Cove Dock Owners subject to the conditions noted above. If the City Council does not feel a public hearing is necessary, Staff could bring back a draft resolution at the May 27 meeting. McMillan asked if the dock exceeds beyond 100 feet currently. Gaffron indicated he is not sure and that the LMCD typically determines that. Bremer asked if there is an extra slip on one of the options. Gaffron stated the survey from 2004 shows two docks with two slips and two additional slips for the riparian lots. McMillan noted the side slip would not be allowed given the configuration because a boat cannot access it. Gaffron stated the LMCD will look at the extended lot lines from the outside of the two riparian lots rather than the easements and that it will come down to what is functional. McMillan commented that may be a way to obtain a variance but that the water depth will also need to be considered. McMillan noted the major issue is the fact that the owners of Lots 6 and 7 would be limited to three dock slips. Levang asked if anyone from the City has talked to the property owners. Gaffron indicated they have not, which is one of the purposes of tonight’s meeting. Printup asked if this is private property. Gaffron indicated that is correct. Mayor McMillan opened the meeting up for public comment at 7:26 p.m. Scott Harris, Attorney-at-Law with Stinson, Leonard & Street; stated he represents the riparian property owners. Harris indicated there has been a dispute regarding the docks but that the parties reached a conditional agreement shortly before tonight’s meeting. The agreement will resolve all litigation between them and it is dependent and conditioned upon approval by the City Council and the LMCD of the second option. NEW JOINT USE DOCK LICENSE – PIRATES COVE [850-860 WINDJAMMER LANE], Continued) Harris indicated the parties have been in very detailed settlement discussions about the exact configuration and the parties recognize that the continuation of the easement would be a permitted nonconforming use. Harris noted the parties will adhere to the existing easement but will restate some of its terms to eliminate any issues of further dispute. The parties intend to proceed with the easement but simply detail those disputed items, which will not affect the configuration or location. Harris stated the parties are in support of an approval by the City Council. Gaffron asked if there are any conditions that are being proposed to be placed on the Joint Use Dock License by Staff that would conflict with the parties’ agreement. Gaffron asked if there is an issue with the limitation of the three docks serving the two riparian property owners. Harris stated the riparian owners recognize they will have a total of three docks available. McMillan asked if that settlement information could be passed on to Staff in the next couple of weeks. Harris indicated they will provide that and that it will be the same easement except for more specificity on some items to eliminate any risk of future disagreement. Gaffron stated he is not sure what type of stair system is necessary or what exists and asked if there are any plans for a walking system down to the lake. Harris stated there is and that steps will be taken to enhance and safeguard the drainage and erosion issues as well as protection against contamination of the lake by reason of the drainage. Harris indicated they have been dealing with Staff and part of the settlement is that the City separately approves some plans that have been submitted for drainage and configuration. Harris indicated there have been some issues regarding erosion that has been caused by the existing walkway, which would be eradicated under this plan. McMillan asked if a conditional use permit would be required for grading in the 0-75 foot zone. Curtis indicated it would depend on the extent of the disturbance and that Staff has not seen a formal plan at this point. Gaffron stated if it is a single stairway that meets the City’s standards; it may not need to come before the City Council. Harris noted there is a long-time existing drainage system there and the new plan would eliminate some erosion issues. Harris stated the plan will be submitted jointly by the parties. McMillan stated the City Council should determine whether a public hearing is necessary. Gaffron stated the public hearing could be held in two weeks and that Staff would notify the affected property owners. Gaffron noted the notice would not be published. Gaffron stated if the Council deems a public hearing is not necessary, Staff would simply bring back a resolution at the May 27 meeting. Gaffron stated if a public hearing is held, since it is not specifically required, he would recommend that notice be given to any property owners 150 feet out from the two riparian properties, which would likely result in two additional property owners being notified. A person in the audience noted the LMCD would also be holding a public hearing. Printup asked if the public hearing would delay anything since this matter would still need to come back before the City Council in two weeks. Gaffron indicated the issue is what type of notice should be given. Staff would likely send out the notices at the end of the week, which would allow for a 10-day notice. Gaffron noted the six property owners are in attendance tonight. John Biglow, Attorney-at-Law, stated he represents the Broghammers, who are easement owners and that the other easement owners are also present as well as their counsel. Biglow stated the issue of a public hearing is a little more unique in this situation in that all the parties that are directly affected by the easement are either present or represented by counsel. Biglow indicated the negotiated settlement between the parties is that the necessity of a public hearing is up to the discretion of the Council and noted that there will be additional steps that they will have to go through with the LMCD. McMillan noted joint dock uses are fairly unique in Orono and a new one has not been added in quite some time. McMillan stated the City Council needs to take the entire neighborhood into consideration before making a decision. McMillan stated oftentimes the Council will hold the public hearing and then also vote on the resolution. Bremer asked if there is sufficient time to issue public notice. Gaffron stated a 10-day notice is required and that notice will be mailed to the affected property owners by the end of the week. Gaffron stated the notice will not be published but simply mailed. Levang indicated she would prefer to hold a public hearing and then vote on the resolution. Bremer stated if one of the affected homeowners is watching the meeting tonight, that also provides notice, and that she is fine with holding the public hearing at the next City Council meeting. Bremer moved, Printup seconded, to direct Staff to draft a resolution approving Dock Layout Option B, consistent with the conditions outlined in Staff’s report, with the understanding that the owners of Lots 6 and 7 will be limited to three dock slips, and to direct Staff to provide notice of a public hearing to the affected property owners. This section of the development was originally platted for six lots and has been reduced to five lots for a number of reasons. Gaffron stated at the present time they are vacant parcels. Gaffron noted the master plan layout also depicts a shared driveway situation. Under the current proposal, each unit will have its own driveway. Gaffron noted the shared driveway situations have been challenging in Stonebay since they are difficult to maneuver and parking is an issue. Gaffron stated one of the benefits of going to five lots is that the units that would have been built up to the wetland buffer are now given additional room between the back of the structure and the wetland buffer. Gaffron displayed a color rendition of a typical unit that would be constructed on the lots. Gaffron noted the homeowners association has been very active in finding developers to finish off the units. Gaffron noted that at the north end of Boulder Drive, Units 28 and 29 originally had a side-loading garage on 28 and a shared driveway for 26, 27, and 28 as well as a retaining wall system, which left Unit 28 almost impossible to use. The developer is now proposing a single unit on that lot rather than two units and would be a combination of those two lots, which does not require approval by the City. The property owners for the existing buildings have been concerned about how that duplex would get built and this proposal solves that issue. Gaffron noted the City Council will also need to vacate an existing drainage easement. Staff has received comments from three of the four utility companies serving Stonebay. None oppose the easement vacation/rededication. It is anticipated that a similar response will be received from the other utility company, Mediacom, as there are no apparent existing utilities or planned future utility needs in the small triangle being vacated. Gaffron noted that Staff recommends approval of the re-plat and easement vacation, subject to rededication of the drainage and utility easement over newly created Lot 6. McMillan commented it appears to be a better design and that she appreciates the efforts the homeowners association have spent finding a developer to finish the lots. McMillan asked how much of the development remains to be built. Gaffron indicated approximately 45 rambler units have been constructed out of 100. Levang asked where those units are located. Gaffron displayed a color layout of the development. Gaffron noted there are six additions total within the development and that the seventh addition is merely a re-plat of the fourth addition. Gaffron indicated all of the additions were platted approximately five years ago and that this would not be a new plat or new addition except for the fact that the easement is being vacated. Printup asked how the process would go with the Watershed District. Printup stated given the wetlands, he has a concern with the neighborhoods to the north. Gaffron stated two different sets of engineers have concluded that the stormwater will not impact those properties and that Staff does not believe it is an issue. Staff has also not received any comments from any neighbors regarding any runoff this year even in light of the above average rainfall. Another neighborhood meeting will be held prior to the plans and specifications being brought before the City Council. Struve reported over the last week and a half the Public Works Department has been dealing with a roadway failure at Olive Avenue. Struve indicated there was significant settlement to the point where the Public Works Department had to act in an emergency manner to address the situation. McMillan noted she did receive an email from a resident on West Lafayette expressing a desire to have a neighborhood meeting following the feasibility study. McMillan asked how long the feasibility study will take. Struve stated Staff is in the process of obtaining bids for the soil borings and that it is likely the Council will see something later this summer on that project. Struve indicated the Council can choose at that time whether to move forward with the project in 2015 or 2016 but that Staff still needs to complete the feasibility study. *8. DONATION FROM JEANNE ENGLUND – RESOLUTION NO. 6403 Bremer moved, Printup seconded, to adopt RESOLUTION NO. 6403, a Resolution Accepting a Donation from Jeanne Englund. VOTE: Ayes 4, Nays 0. MAYOR/COUNCIL REPORT Levang stated the Mayor and herself will be attending a special meeting on water quality later this week. Levang stated Staff is working on the June newsletter and that it should be delivered to the residents by the first week of June. Printup noted there will be a donation by the Sons of the American Revolution recognizing Chief Joseph Orono. Printup stated he would encourage people to attend the event on Tuesday, May 27. Printup stated he has already received some positive responses regarding the event. McMillan noted there was a fire department advisory meeting approximately a week ago. The Fire Department is slightly over budget at this point but has been under budget for the last two years. McMillan indicated the City Council will be receiving a report on the Fire Department at the next City Council meeting. McMillan thanked Jeanne Englund for her donation to Navarre Park and the residents who have made donations to the Orono Golf Course. McMillan noted the City does have an anonymous donor who will match any donation up to $50 for the golf course. SPECIAL EVENT PERMIT – LONG LAKE ROWING CLUB Gaffron stated the City received a letter requesting permission from Orono for a special event permit for use of Long Lake for regular rowing practice during the boating season. The applicant is part of an organization sponsored by Minneapolis Springs Rowing, LLC, represented by Todd Wilson. The letter of request indicates they do not have a name yet but Mr. Wilson references it as the Long Lake Rowing Club. The Hennepin County Water Patrol’s standard procedure requires written approval by the affected local government bodies prior to issuing such permits. At its February 24, 2014 meeting, the Orono City Council voted 4-0 to approve issuance by the Water Patrol of a 2014 Special Event Permit for the Long Lake Rowing Crew. The approval was subject to two conditions: One, no organized practice on Sundays; and two, the Crew’s use of the lake shall not impede the use of Orono’s Summit Park Beach facilities and access by the public. The application by Mr. Wilson for the Rowing Crew raises the following concerns: 1. The proposed overlap in times of operation, between the Rowing Crew and the Rowing Club may cause problems of congestion on the lake. Even without overlapping use periods, the amount of hours devoted to this single use may be problematic for other users of the lake. 2. The application materials suggest that while the applicant currently has five students, the estimated number of students could be as many as 15 for 2014, and as many as 20 participants total. This potentially places a significant demand on daily lake use as well as parking needs. 3. While no specific event location is noted in the Water Patrol application, the request for storage racks suggests they want to use Summit Beach as a base of operation as well as for equipment storage. 4. The event parking location is listed as private in the Water Patrol application, with no location listed, which seems to conflict with the request for use of a public park/beach as a base of operation. 5. The City generally does not grant exclusive use of City park property for private activities or enterprises for-profit, non-profit or otherwise. Gaffron stated the Rowing Club is proposing to hold practices in the early morning and mid-late afternoon on Monday through Saturday. In addition, the applicant has requested the ability to create a rack for rowing shell storage at Orono’s Summit Park Beach at the southeast end of Long Lake. The use of Summit Park Beach for the proposed level of Rowing Club use would not necessarily rise to the level of a City special event permit but could have impacts on other public use of the park and beach. The potential level of 20 participants suggests the need for parking for up to 20 vehicles, which would potentially create problems for other beach and park users due to the limited available parking. Summit Park Beach has parking currently for approximately 10 to 15 vehicles. SPECIAL EVENT PERMIT – LONG LAKE ROWING CLUB, Continued) Gaffron noted Orono has never established a system of park use permits and generally has not honored requested for exclusive use of park properties by individuals or groups. The exception is the Orono Baseball Association which has long-standing agreements for use of the ball fields at Bederwood and Hackberry Parks. Allowing the Rowing Club exclusive use of Summit Beach either as a base of operation or for storage of rowing shells would be inconsistent with past City practice. Staff has a question as to whether two such rowing organizations operating on the lake will have a negative impact on public use of the lake. Whether the two organizations use the lake at concurrent times or at different times, the potential impact on other lake users is not known, and it would be prudent to see what impacts the approved use has during 2014 before approving a second such use. In addition, the request for use of Summit Park Beach for storage of rowing shells is inconsistent with past City practice regarding exclusive use of city park properties. The request for lake use approval given to the Rowing Crew in February was specifically conditioned on not impeding the use of Summit Park Beach facilities and access by the public. It would be inconsistent with that action to now allow a similar applicant to use Summit Park Beach for equipment storage parking, and as a base of operation. Staff would recommend denial of the current application. Printup noted the City of Orono has never allowed special events or reservations of a particular area, and asked if the City can deny something that is not allowed or whether it would be best to leave it alone. Gaffron stated it is something that has not been allowed and that the City Council could simply say they do not approve it. McMillan noted the City does not generally allow private organizations to reserve city-owned parks and that the City currently does not have a permit process for the parks and beaches. McMillan stated the proposed use of Summit Beach is not an option since the City does not allow it. McMillan stated if it will not occur at Summit Beach, the City Council will need to know what other proposed location the applicant has in mind. Bremer stated that is consistent with her understanding and her thoughts on the application. Todd Wilson, 130 Manor Circle, Orono, stated he would like to have his application considered as two separate requests. Wilson indicated they currently have permanent boat storage with private parking behind the dentist’s office near the Red Rooster as well as a space where rowers are able to train indoors. Wilson stated the idea of going to Summit Beach was something that was simply being considered and is not essential to their operations. Wilson stated he currently has a small group of kids and that he would respect any restrictions the Council may place on the group’s growth. Wilson stated they also typically attempt to row when there is not a lot of other lake traffic and that he has spent a lot of money to purchase a wakeless launch to prevent shore erosion. McMillan stated if he is not interested in Summit Beach, it would be helpful to know where he would be launching the boats. McMillan asked if Long Lake has signed off on the special event permit. Wilson stated he was not able to get on the Long Lake City Council’s agenda until later in the month. McMillan stated given the fact that they will be launching in Long Lake, she would like them to comment on the application first. Wilson asked whether Orono would approve the application if Long Lake does. McMillan stated she would like Long Lake to make that decision first. McMillan noted the Summit Beach request would not be allowed. Levang stated she also would defer out of respect to Long Lake at this point. McMillan stated the launching point needs to be addressed first. Printup indicated he is in agreement with Mayor McMillan and that the Orono City Council cannot comment on that if it is going to occur in Long Lake. Wilson indicated the Water Patrol has asked that Orono also approve the request. McMillan stated she would prefer to let Long Lake make that determination. Wilson stated last Sunday, although no organized activities are allowed per the Long Lake ordinances, the Long Lake Rowing Crew was conducting an organized practice with approximately eight boats. Wilson stated not one of the boats had a life jacket in it and the rowers were also very rude to him and said that he was not allowed on the lake. Wilson stated another violation of their permit is that they have not been using a wakeless launch, which is in violation of state and local law. McMillan noted the Council is only here to discuss Mr. Wilson’s situation. McMillan asked if Mr. Wilson would like to come back to the Council once he hears from Long Lake. Wilson indicated he would. Levang asked whether the application should be formally tabled. McMillan noted it is not Orono’s permit application. Gaffron suggested direction be provided to the applicant that he come back to the Orono City Council once he hears from Long Lake and that the application can be formally tabled if the Council so chooses. Gaffron noted the only action that would be required at some point is a motion approving or denying the application. SPECIAL EVENT PERMIT – LONG LAKE ROWING CLUB, Continued) Loftus requested the applicant submit a new Water Patrol permit application that has an updated location for a new storage facility, a parking plan, and proposed access point. Loftus stated to her knowledge the current application does not reflect that. Casey Rasmussen, Orono, stated her daughter has been rowing with Mr. Wilson for the last few months, and that she would ask the City Council to grant them the ability to row on Long Lake. Currently the group goes out rowing twice a day at 5 a.m. The girls are working very hard so they can attend Division 1 schools and be on the rowing teams. Rasmussen stated while the community rowing program is admirable and a lot of good kids are involved in it, it is not a good fit for her daughter since she would like to attend a Division 1 school. Rasmussen stated competitive rowing takes a different type of training, which is the type of training Mr. Wilson provides, and that it would be nice if it can be done in their home town. Rasmussen stated she would ask if the City Council could possibly put something on the table so they do not waste even more time. Rasmussen noted the girls are currently training for regionals and fly to Ohio on Friday. After that they hope to attend nationals in California in three weeks. Rasmussen stated every week that they have to wait in this process is difficult. Rasmussen stated they are not an organized club and that they are basically hiring Mr. Wilson as a private coach. The group did not understand that they would have to go through the same process as a private club. Rasmussen requested the City Council’s support on their application. Carrie Shoyer stated she resides in Chaska but that her daughter also trains with Mr. Wilson. Shoyer stated she heard the Orono City Council indicate they would like to defer to Long Lake, and asked if defer means that if Long Lake approves it, they would not have to come back to Orono. Shoyer stated she wants to understand exactly what the Council is saying. McMillan stated the Council is asking that Long Lake give permission first especially if the boats will be launched in their city. McMillan noted the City of Long Lake has had issues with boat launches in the past and that she would like them to comment on it first. McMillan stated after Long Lake comments on it or grants permission, the Orono City Council will act on it. Shoyer stated she is asking whether a decision can be made that if Long Lake is okay with it, that Orono is okay with it, which would save them time. McMillan stated she does not want to put any pressure on the City of Long Lake. McMillan indicated she was more concerned about the use of Summit Beach and that she wanted to make sure that was communicated tonight. McMillan noted the City Council just found out tonight that the boats will be launched out of Nelson Beach and that Staff will need to discuss it with Long Lake first. Shoyer asked if there is any potential that by the time this goes before the Long Lake City Council that the Orono Staff will have discussed things with them. CITY ADMINISTRATOR’S REPORT, CONTINUED Loftus stated a group of volunteers have organized a golf scramble for Saturday, July 19, as well as a full day of activities to celebrate the 90-year anniversary of the golf course and to raise funds. Loftus indicated there will be some information regarding the event on the City’s website. Loftus reported the review scheduled for next Monday by the Metropolitan Council of the Lakeview Comprehensive Plan Amendment has been suspended at the City’s request so Staff can review the EAW worksheet, which is expected to be completed later in May. Loftus stated that review process will begin again once Staff has had a chance to review that. Loftus stated last week the police officers who were involved in the November officer-involved shooting appeared before the grand jury. The officers provided testimony and the City was informed that the grand jury took action in the City’s favor, there will be no changes brought against the police officers. Loftus stated the City had its bond rating call with Moody’s regarding the May 27 bond sale. Loftus commended Finance Director Ron Olson on the excellent job he has done with the City’s upcoming bond sale. Loftus noted road restrictions were lifted last Friday. Bremer asked if the signs had been removed. Struve indicated they all should be. *10.
