NO. � � � C� �kESH�g'� A RESOLUTION APPROVING TH� PLAT OF GRAHAM HILL PRESERVE 2ND ADDITION FILE#12-3�50 W�-IEREAS, the City of Orono is a municipal corporation or�anized and existing under the Iaws of the State of IVfinnesota; and WHERE�S, the City Council of the City of Orono (hereinafter "Ciry Council") has adopted subdivision and land development regulations for the orderl��, economic and safe development of land within�he City; and WHEREAS, on May 14, 2012 the City Council considered the application by Kevin M. Reiliy and Denise D. Reilly, husband and wife (hereinafter the `'Owners") for subdivision of property lo:;ated at 340� High Lane in the County of Hennepin, State of Minnesota and le�ally described as follows: Tra�t B, ReQistered Land Survey No. 843 and Outiot B, GRAHAM HILL PRESERVE (hereinafter the "Properiy"); and �WHEREAS, on January� 14, 2008, the Cit�r Council adopted Resolution Na �716 �rantin� Preliminarv Plat Approval for the proposed subdivision of the Propem� into two single family residential lots; and WHEREAS,the City Council has extended the effective period of preliminary plat approval granted by Resolution No. �716 at the Owners' request on four occasions via Resolutions No. �787 on November 10, 2008;No. 5878 on November 9, 20Q9; No. 6017 on 3anuan� 10. 201 l; and No. 6107 on January 9, 20L, the most recent e�tension bein,to 3anuary 14; 2013; and WHEREAS, the Owners have completed or have agreed to complete all other requirements of the platting regulations of the Cin�includin�: 1. Completion of all platting requirements of Preliminary Plat Resolution No. �716. Dedication on the plat of perimeter Drainage and Utility Easements as required in Resolution No. �716. 3. Platting of a private road outlot 50 feet in width designated on the plat as Outlot A for the existing road known as High Lane, and granting to the City of a Road, Drainage and utility Easement as well as establishing covenants for maintenance of said private road. 4. Establishment of a Conservation Easement for protection of existing woods and steep slopes at the southwestern corner of the Property. 5. Provision to the City of evidence that Lot 1 shall be subject to the provisions of the Graham Hill Homeowners Association with respect to use and maintenance of Graham Hill Road for access. 6. Provision to the City of a title opinion for the Property and certified copies of all recorded easements currently affecting the Property. 7. Payment of Park Dedication Fee far Lot 1 in the amount of$5,�50.00. 8. Payment of Storm Water and Drainage Trunk Fee in the amount of$8,674.20. NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution No. 5716, the City Council of the City of Orono does hereby approve the plat of GRAHAM HILL PRESERVE 2ND ADDITION, Hennepin County, Minnesota (a copy of which is attached as Exhibit A) subject to the following conditions: l. Development within GRAHAM HILL PRESERVE 2ND ADDITION is subject to the Conclusions, Orders and Conditions enumerated within Preliminary Plat Resolution No. 5716. 2. The approvals granted in this Resolution shall become effective only when all conditions of approval requiring actions by the Owners have been satisfied. 3. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, Planning & Zoning Coordinator and City Engineer that all requirements of the platting regulations have been satisfied. The approval o-ranted by this Resolution shall expire if the conditions of this Resolution have not been met or the plat has not been filed by the date specified above. Reilly and Denise D. Reilly, husband and wife ("Declarants"). � �_ RECITALS: A. Declarants are fee owners of that certain real property located in Hennepin County, Minnesota legally described as Lot 2, Block 1, Graham Hill Preserve 2d Addition and Outlot A (the "Property"). B. Declarants desire to provide for the benefit of the CITY OF ORONO an easement for roadway purposes (the "Roadway") over, across and upon Outlot A, and to further provide for the maintenance relating to the Roadway and the easement herein granted. NOW, THEREFORE, in consideration of the foregoing, the Declarants hereby declare that Outlot A is and shall be held, transferred, sold, conveyed and occupied subject to the covenants and easements hereafter set forth, which shall run with the Property and be binding on all parties, now or hereafter having any right, title, or interest in the Property and any part thereof, their heirs, successors, and assigns. 1. Roadway Easement. Declarants hereby declare and create a permanent easement for public roadway purposes over, on, across, under, and through Outlot A of the Property, including the rights of the City, its contractors, agents, servants, and assigns, to enter upon the permanent easement premises at all reasonable times to construct, reconstruct, inspect, repair, and maintain said public roadway system over, across, on, under, and through the permanent easement premises, together with the right to grade, level, fill, drain, excavate and pave the permanent easement premises, and the further right to remove trees, bushes, undergrowth, and other obstructions interfering with the location, construction, and maintenance of said public roadway system. This Roadway Easement for the benefit of the City is in addition to the Drive and Roadway Easements contained in Doc. Nos. 678959 and 2764174. 2. Maintenance of Roadway. Declarants shall pay an equal, proportionate share for any costs for the maintenance or repair of the Roadway. Maintenance shall include reconstruction, snow removal, sanding or salting, as necessary. 3. Violation and Enforcement. In the event the Declarants fail to conduct maintenance, it is agreed that the City, may undertake such maintenance and assess to Declarants an equal, proportionate share of the maintenance conducted 16470�v2 by the City. Any such maintenance conducted by the City will not result in the Roadway becoming a public roadway. 4. Bindin E� ffect. This covenant shall run with the land and shall be binding on and inure to the benefit of the Declaratns, their heirs, representatives, successors and assigns. 5. Warranties of Title. Declarant represents and warrants that they are the lawful owners of the Roadway and have full right, title and authority to enter into this Declaration. Any mortgage lender shall consent to this Declaration, which consent shall be attached and made a part of this Declaration.
