A RESOLUTION APPROVING THE
PRELIMINARY PLAT FOR PROPERTY LOCATED AT
3405 HIGH LANE
FILE NO. 07-3334
WHEREAS, Kevin M. Reilly and Denise D. Reilly, husband and wite
(l�ereinafter the "Developers") are the o��vners of the propei-ty witllin tl�e City of Orono
(l�ereinafter the "City") located at 340� Hi�h Lane and legally described as follows:
Tract B, RLS No. 843, Henoepin County, Minnesota
(hereinafter the "Property"); and
WHEREAS, on October 17, ��007, tl�e Developers filed a complete subdi��ision
application with the City for preliminary approval of a 2 lot residential plat of the Property; and
«'HEREAS, after due� published and n�ailed notice in accordance witl� Minnesota
Statutes 46?.3�5 et. seq. and the City of Orono Zouing a�1d Subdiaision Codes, on Nove;nber 19,
?007 the Oroi�o Planning Comnlission held a public hearing for the application at which time al]
persons desiring to be heard conceining the application were �iven the opportunity to speak
thereon; and
WHEREAS, on Novenlber 19, ?007, tl�e Planning Commission reviewed tl�e
application and recommended ou a vote of 6— 0 that the Council �rant preliminary plat ap��rova?;

WHEEZE.�,S, the City Council revie���ed tl�e proposal at a re�ular meetin� held on
December 10, 2007, ai�d directed staff to draft a resolution contai�ing �indin�Ts and conditions for

3. The Property is guided in the 2000-2020 Orono Community Managetnent Plan
(CMP) for single family residential use at a density of 1 unit per 2 acres. The
proposed layout contains 2 lots on 7.6 non-wetland acres, for an overall density of
1 unit per 3.8 dry acres.
4. The Property contiains a variety of natural features includin� wooded areas, open
fields, and some steep slopes.
5. Tlze proposed plat includes two lots. Lot 1 will be served via Graham Hill Road to
the east. Lot ? will continue to access Hi�h Lane �ia a newly created private road
Outlot.
6. As it will access via Gral�am Hill Road, proposed Lot 1 will become part of the
homeowner's association of Graham Hill Preseiti�e. Grahaln Hill Road is subject
to homeowner association ownership and maintenance, and subject to an
under?ying Road, DrainaQe and Utility Easement to be �anted to the City, as well
as a "Declaration of Covenants, Conditions, Restrictions aud Private Roadway
Easement" either as a separate docuinent or incorporated into the developinent
covenants.
7. All proposed lots will contain suitable area n�eeting all established setback
requirements to allow the collsti-uction of sin�le family residences. Each lot has a
proposed nuildii�g site meeting the RR-1B setbacl: standai-ds (�0' front and rear,
30' sides).
11. The Ci�y lias ��o e��rr�nt plans for trails or parks that specifically 1-ec�uire

CONCLUSIONS, ORDER AND CONDITIONS
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the
finding� noted above, the City Council of the City of Orono hereby grants Preliminary.Plat
Approval for Kevin and Denise Reilly, for a 2-lot plat per the Preliminary Plat surveyidrawing
by Mark S. Gronber� of Gronber� & Associates, v�c. dated 10/24/07 and attached hereto as
EYhibit A, subject to the following conditions:
l. Conservation Easements for the protection of steep slopes, woodlands, and open spaces �
shall be established over the rear portions of Lot 1 atld Lot 2 (extent to be determined) to
be shown on a Conservation/Preservation Plan drawing.
Developer sl�all submit proposed Conservation Easement lan�uage for Council review
and aceeptance, specifyinQ the proposed conditions and linlitations to be placed on tl�e
specific areas noted above. The easenlent sl�all incorporate as a minimum, the followin�
elements: no structures allowed, no fences, no domestic animals (i.e. no harses, sheep,
chickens, etc.), no tree or veQetation removal except by special pennit far maintenance or-
as part of an approved ve;etation management plan, no excavating or earth movelnent;
creation and maintenance of non-hardcover ��allcin; paths may be allowed. Pernzanezlt
ma1-lcers of a desi��n and inateria] acceptable to the P1aiuling and Zoning Coordinator shall
be placed at all points where the Consel-vation Easement intersects a ]ot boundary or
� where tl�e Easemel�t boundary line cl�an�es direction.

5. Lot 1 of Graham Hill Preserve 2"a Addition shall be included within the Graham Hill
Preserve homeowner's association and shall be subject to all covenants and conditions
imposed on Graham Hill Preserve.
6. Development Fees
A. Parl: Dedication Fee. T}�e developrnent is subject to the standard Parl� Dedication
Fee requirement. Because the value of each newly created lot will be in excess of
tl�e threshold value of $69,375.00 the 8% park fee cap of $5,550 per lot will
apply. Park dedication fee will be 1 lot x $5,5�0= $5,�50.
B. Storm Water and Drainaae Tiunk Fee. Tl�e development is subject to the standard
Storm Water and Drainage Trunk Fee of Lot 1 ( �3,050 per acre x 2.37 gross
acres = $7,228.50) + Lot 2 ($3,050 per acre x 4.0 adjusted �oss acres* _

7. City Engineer Approval. Approval is subject to the ongoing recommendations of the
City Engineer.
8. Plans and Specifications. The followin� plans and specifications shall be submitted for
review and approval by the City and other appropriate jurisdictioi�s prior to final plat
approval, to ensure t1�at the proposed plat will accomplisl� tl�e intended puiposes:
a) Final� overall lavout for all primary and alternate sewa�e treatment
svstem sites and proposed well locations.
b) Final grading, draina�e and erosion contl-ol plan showin� existing and
proposed cantours. anticipated buil�ing locations, e1e��ations, storn:��ater
facilities and caiculations, uti�ities and ��-osion control ineasures to be
used durin�� co��struc��3on. Final Plai approval will no� be ��ranted until
t?�e MirL�ei;aha Cl'e;.k �ratershed Distric� Las at�proved the stonl�w•ater
mana�e�nent plans.
c) Conselti�ation/P�eser��ation areas pian depictin� all areas subject to
protective covenants and easements.

d) Engineerin� details and desi�n for any proposed retaining walls.
e) Sufficient detail to meet the recominendations of the City Engineer.
9. Other Easements.
a) Draina�e and Utility Easements sl�all be dedicated to the public on the
final plat 10' along all exterior property lines, ai�d 5' either side of
interior property lines, except such easements shall be iilcreased to
accommodate drainage where required, subject to City staff approval.
b) A Road, Drainage and Utility Easement shall be �ranted to the City of
Orono over the private road Outlot.
c) A "Declaration of Covenants, Conditions, Restrictions and Private
Roadway Easement'° shall be eYecuted.
FINAL SLBMITTALS
The following list of final submittals inust be submitted to the Planning & Zoning Coordinator at
least 4 weeks prior to the re�ularly scheduled Council meeting on the second and fourth
Mondays of tt�e nlonth. These submittals are as follo«�s:

2. Legal documents required:
A. Title�opinion addressed to the City or a title insurance policy in favor of
the City. All owners, mort�a��e holders or others with property interest
indicated therein shall sign the plat and all other documents affected by
such interest.
B. The applicant must provide certified copies of all recorded easements
currentl_y affectin�the property.
C. Si�ned and e�ecuted Road, Drainage and Utility Easement and
Dec�laration of Private Covenants, Conditions, Restrictions and Pri��ate
Roadway Easement for maintenance of same over the private road Outlot.
D. Sig�led Conservation Easement to be granted over Outlot B and the other
areas noted herein.
