Thank you for meeting with Bruce Vang, Lyle Oman and me at the site on July l lth. This
letter is to follo�v-up our conversation regardin� resturation of the site.
You a?reed to have the grades restored to original elevations per the approved site plan, as soon
as possible and preferably this week. This will include:
l. Removal of sediments accumulated lakeward of the base of the slope.
2. Continued maintenance of the three rotivs of silt fence in place at the bottom of
the slope.
3. Placemen� of an additional ro�v ot silt fence at the crest of the slope
approximately 10' out from the house.
4. Stabilization of the bare slope with seed matting or mulch.
You agreed that your landscaper and architect would propose a planting schedule for
reforestation of the slope (indicate proposed numbers, types, sizes and locations of new
plantings). We agreed to allow you "a few weeks" to come up with such a plan, hence that plan
should be submitted by August lst for City approval. Once your plan is approved, plantings
should commence as soon as possible and must be completed this year. No certificate of
occupancy will be issued for the new home until vegetation restoration has be�n approved and
completed.

We acknowledge that there is disagreement regarding the number of trees Mr. Oman told you
could be removed. It is clear however, that the scope of tree removal, understory removal, and
total grading of the bluff greatly exceeds what he visualized he was approving, and in no way
conforms to the intent of the variance approval conditions to which the Vergeyles agreed. As
a result, City staff is requiring "inch for inch" replacement of those removed trees identified on
the site plan as being within the bluff and not within the roof overhang line of the house. (See
attached site plan). Since the intent of restoration is to provide both screenin� and slope
stabilit , up to 1/3 of the required 150 diameter inches should be in shrubs or understory
materials. Our intent is that this bluff area be restored to as near the original natural conditions
as possible.
I noted we have been contacted by the DNR regarding this project. Our codes and enforcement
procedures reflect DNR standards for shoreland management. Please refer to the attached
excerpts (6120.3300 Subp. 3D and Subp. A and B) from "Statewide Standards for Management
of Shoreland Areas".
You noted that there may be fill on the site in excess of the amounts needed to complete the
approved grading plan. That fill may be taken off the site, or as you suggested, you may wish
to amend your grading plan and construct a low berm in the street yard. Before doing so, please
provide an amended grading plan for approval.
If you have any questions on any of the above, please feel free to contact me at 473-7357. Also,
please advise us when your grading contractor will be restoring grades on the site.

J. Decks . Except as provided in item H, decks must
meet the structure setback standards. Decks �nat do not mee�
setback requirements trom public waters may be allowed without a
variance to be added to structures existing on the date tne
shoreland structure setbacks were established by ordinance , if
a11 oL tne following criteria and standards are met :
( 1 ) a thorough evaluation o� the prooerty and
st:ucture reveals no :easonable locat�on �or a deck meeting or
exceeding tne existing ordinary high water leve'_ se�back of �he
structure ;
( 2 ) the deck encroacnment toward tne ordinary
hign water �evel does not exceed 15 ..percent ot tre existing
shoreline setback of the structure �rom the ordinary high wa�er
leve? or does not encroach close� tnan 30 Leet , wnicnever is
more restrictive; and
( 3 ) the deck is cons�_uc�ec prima��'y e= wood ,
and is noc rooEed or screened .
SubD. 4 . Shoreland alterations . Vecetative al�eracions
and excavations or grading and fiiling necessary for tne
construction o� structures and sewage treatment sys�ems under
validly issued permits for these faci�ities are exempc �rom tne
vegetative alteration standards in this subpart and seoarate
permit requirements io� grading and `illing . Howeve� , ���e
grading and Lilling conditions oL th�s suboart mus� be met for
issuance oz permits for st:uctures ar.d sewage �reatment
systems . ��terations of vegetation and LODOQrapny mus� be
controlled by local governments to p:event erosion into public -
waters , rix nutrients , preserve shore'�and aes�net�cs , prese:ve
nistoric values , prevent bank slumoing, ar.d protec� 'ish and
wilalife habitat . Public roads and parking areas , as regulate�
by subpart 5 , are exempt from the provisions oL this oart .
A. Removal or alterations of vegecation, exceac �or
Eorest management or agricultural uses as orovided For in
subparts 7 and 8 , is ailowed according to tne following
standards :
( 1 ) Intensive vegetation clearing within t��e
shore and bluf� impact zones and on steep slopes is not
� allowed. Intensive vegetation clearing outside oF these areas
; is allowed if the activity is consistent with the forest
' management standards in suboart 8 .

( 2 ) Limited clearing o� trees and shrubs and �
� cutting, pruning , and trimming of trees to accommodate the ;
placement of stairways and landings , picnic areas , access patrs , �
livestock watering areas, beach and watercraft access areas , anci �
peTmitted water-oriented accessory structures or facilities, as i
well as providing a view to the water from the principal
dwelling site , in shore and bluff impact zones and on steep
slooes is allowed, provided that :
( a ) the screening of structures , vei:icles ,
or other facilities as viewed from the water , assuming su�rsner ,
1ea�-on conditions , is not substantially reduced;
(b) along rivers , existing shading o� water
suriaces is preserved; and
( c ) the above provisions are not aoolicab�e
to the removai of trees , limos , or brancnes that are dead,
diseased, or pose saFety hazards .
( 3 ) Use a� rer�.ilizer and oesticides in the
shoreland management district must be done in sucn a way as to
minimize runofi into the shore imoact zone or �ublic water by
the use or earth , vegetation, or both.
