Please see the attached information. I was planning to have Jesse handle this but since he's leaving I thought it would
be best if you picked up this one...
I sent a violation letter to the property owner (&contractor) on April 29`h. Walls were constructed and potentially
vegetation was removed without proper permits. The contractor has submitted a permit application and a survey of the
site. I would like you to contact him (Greg Perl — 763-478-6919 —greggperl@yahoo.com ) to set up a meeting on site.
If you and I can discuss this beforehand I'm not sure I need to be at the meeting.
I'm tossing this into your court. Let me know how you'd like to proceed...

Bluff ineans a topographic feature, such as a hill, cliff or embankment, having the
following characteristics (An area with an average slope of less than 18 percent over a
distance of 50 feet or more shall not be considered part of the bluf�:
(1)
Part or all of the feature is located in a shoreland area;
�2)
The slope rises at least 25 feet above the ordinary high water level of the
water body;
(3)
The grade of the slope from the toe of the bluff to a point 25 feet or more
above the ordinary high water level averages 30 percent or greater; and
(4)
The slope must drain toward the water body.
Bluff impact zone means a bluff and land located within 20 feet from the top of a
bluff.
Bluff, toe of the, means the lower point of a 50-foot segment with an average slope
exceeding 18 percent.
Bluff, top of the, means that point on the cross section of a bluff below which the
slope becomes more than 18 percent and above which the average slope for a distance of
50 feet or more is 18 percent or less.

During routine inspections by the Minnehaha Creek Watershed District (MCWD) staff on April
30th, 2014 at the above mentioned location, work requiring a MCWD may have taken place:

To avoid formal enforcement action, please complete the actions below by Noon,Wednesday,
May 7th,2014.
o Complete and submit the Joint Water Resources Application
o A $10 application fee is required for each permit application
o Submit a site plan(11"x17"or smaller)that shows the following:
■ Site property lines.
■ Existing and proposed elevation contours sufficient to show drainage on and
adjacent to the site.
■ The site location in relation to surrounding roads, steep slopes, significant
geographic features, buildings and other structures.
■ Identification and location of all water features and facilities on-site and within
1000 feet of the area to be disturbed including any lake, stream or wetland; any
natural or artificial water diversion or detention area; any surface or subsurface
drainage facility or stormwater conveyance; and any storm sewer catch basin
within 100 feet and down-gradient of the area to be disturbed.
■ Identification of all receiving waterbodies and/or stormwater conveyance systems
to which the site discharges.
■ Location of trees and vegetation to be retained, and method of protection.
■ Existing 100 year flood elevation,if applicable.
■ Location of proposed grading or other land-disturbing activity and location of
stockpiles.
■ Quantities of soil or earth material to be removed, or stored on site,and area of
land to be disturbed.
■ Locations of concrete washout areas.

■ A written plan showing locations and methods of dewatering(the District is to be
made aware of any dewatering at least 24 hours prior to proposed dewatering).
■ Locations of proposed runoff control,erosion prevention, sediment control and
temporary and permanent soil stabilization measures, including:
• Perimeter control along all roads and trails.
• Perimeter control at the bottom of all slopes leading off site or toward
water resources.
• Perimeter control and/or cover around/on all large stockpiles.
• Crushed rock or existing paved construction entrance.
NOTE:
➢ All erosion and sediinent control measures must be in place before any land disturbing activity begins
➢ Silt fence must be trenched in six inches and installed correctly(see figure).
o A permanent stabilization plan that states the following:
■ Addition of at least 6"of topsoil to all disturbed areas.
■ Method for establishing permanent vegetative cover.
o A detailed schedule indicating dates and sequence of land-alteration activities:
implementation,maintenance and removal of erosion and sedimentation-control
measures, and permanent site-stabilization measures.
o A list of names, addresses,telephone numbers and responsibilities of all contractors,
subcontractors and other persons who will engage in the land-disturbing activities.
o An erosion control inspection plan(required for projects disturbing greater than '/4 acre).
Include the Erosion Control Inspection Plan Acknowledgment form(found on our
website)with your application.
o A financial assurance is required for project disturbing greater than one acre.
Working without a permit where one is required is in violation of MCWD rules. The MCWD
would like to remind the applicant that construction is not to begin on site until a permit has been

On April 25, 2014, City Staff observed that trees and brush were removed, the slope was altered and
retaining walls were constructed on the bluff within 75 feet of the ordinary high water level (OHWL) of
Lake Minnetonka. This letter is to notify you a Stop Work Order is being issued which means no
further work can occur on this property. Because the work was done on the property without City review
or issuance of proper Ciry permits, the property is in violation of the following Ciry Code Sections:
✓ City Code Sections 78-966 &78-667 — regarding permit requirements for land alterations.
✓ City Code Section 78-1279 — regarding placement of structures within bluff areas.
✓ City Code Section 78-1285 — regarding the clear cutting of vegetation on bluffs and steep slopes.
✓ City Code Section 78-1286 — regarding topographic alterations.
✓ City Code Section 78-1680 — regarding placement of hardcover.
This letter is your official notification that your property is in violation of the above listed City Codes. In
order to resolve the violations you are required to take immediate corrective actions as follows:
1. Immediately (within 24 hours of receipt of this letter) install silt fencing which must remain
until vegetation is established.
2. Within 7 days, remove sediment that may have accumulated lakeward of the land
alterations/disturbance.
3. Within 14 days, Submit a slope restoration plan signed by a licensed professional engineer
which reflects removal of the illegal walls and restoration of the slope on the lakeside of the
residence to its original grade as shown the attached site/grading plan. Also, submit a
vegetation restoration planting schedule prepared by a registered landscape architect. The
plan must include vegetative materials to restore a slope stabilizing root structure, re-
establishment of understory and replacement of trees.
4. Tree and vegetation restoration shall occur this growing season.
Staff will be conducting periodic site inspections to verify compliance with this order. Please be advised, if
you fail to correct the violations as noted above this matter will be forwarded to the City Attorney for
review and may result in criminal prosecution. I have attached a copy of the appropriate City Codes for
your reference.

Sec. 78-966. Prohibition.
(a) It is unlawful for any person to perform or have performed the following land alteration activities
without a conditional use permit issued by the council:
(1) Remove, fill, use for fill, dredge, store or excavate rock, sand, gravel, dirt or similar earth material
within the limits of the city.
(2) Fill or reclaim any land by depositing such material or by grading of existing land to elevate or alter
the existing natural grade.
(3) Build, alter or repair any seawall or retaining wall, or otherwise change the grade or shore of
lakeshore property.
(b) All land alterations involving filling and grading shall be performed only with clean fill as defined in
section 78-1. Granting of such permits is subject to other regulations and prohibitions of this Code and
other applicable statutes or ordinances of other governmental bodies.

Sec. 78-967. Exception.
(a)The requirements of section 78-966 are not intended to govern the following land alteration activities:
(1) Normal and customary grading in the area of an existing or a newly constructed building, or the
grading of the driveway serving such building,
(2) Any earth movement under 500 cubic yards which does not adversely impact the existing drainage.
(3) Grading, filling or excavating of ten cubic yards or less within the shore setback zone of all lakes
enumerated in article IX of this chapter.
(b) Such grading and earth movement shall be subject to approval by the building inspector at the time
of issuance of a building permit, provided that a plan showing proper drainage and protection of
adjoining property has been submitted. Where such earth movement is not being performed in
conjunction with a building permit, a separate land alteration permit shall be required. Any unusual land
alterations, including earth filling, removal or grading, proposed by a builder shall be subject to a
conditional use permit as provided for in this chapter. The following land afterations shall be considered
as unusual land alterations:
(1) All excavations for foundations in excess of 12 feet average depth if any amount of the excess
material removed below 12 feet depth is to be stockpiled on the site.
(2) Any additional fill brought on site in excess of 500 cubic yards, except for fill required to raise grade
for adequate frost footing protection, the intent being that structures shall not be artificially raised above
the preexisting surrounding topography.
(3) Grading or alterations that would propose any changes in elevations within five feet of adjacent
residential lot lines except for drainage swales and ditches.
(c)The building inspector shall have the authority to refer any requests for land alteration permits to the
city council for review and approval in instances where the land alteration appears to potentially create
negative impacts or be not in keeping with the goals and policies of the community management plan.

Sec. 78-968. Permit.
An application for a conditional use permit shall be accompanied by a drawing made by a registered
surveyor or other competent person showing the location of the proposed excavation or storage and shall
state the amount of material which is to be removed, excavated or stored, filled or graded, and such
other information as the council may require. Applications shall be filed with the city administrator and
shall be accompanied by a deposit to be determined by the city, which will be used to offset the cost of
processing the application. Any unused portion will be refunded to the applicant.

Sec. 78-1279. Placement of structures on lots.
When more than one setback applies to a site, structures and facilities must be located to meet all
setbacks. Structures shall be located as follows:

must not be placed within bluff impact zones.
(4)Uses without water-oriented needs. Uses without water-oriented needs must be located on lots or
parcels without public waters frontage, or, if located on lots or parcels with public waters frontage, must
either be set back double the normal ordinary high water level setback or be substantially screened from
view from the water by vegetation or topography, assuming summer, leaf-on conditions.
(5) Fences, docks, �etaining walls. No fence shall be placed within the shore setback zone. Portions of
dock located landward of the OHWL shall be considered as a landing, subject to the regulations for
landings per section 78-128Z. Retaining walls shall not be placed within the shore setback zone.
(6) Average lakeshore setback No principal or accessory structure shall be located closer to the lakeshore
than the average distance from the shoreline of existing residence buildings on adjacent lots; except that
this does not apply to stairways, lifts, landings, lockboxes, flagpoles and pump houses. Further, the
average lakeshore setback shall apply only to classified lakes and shall not apply to tributaries. The
average lakeshore setback line shall be a straight line connecting the most lakeward protrusions of the
residence buildings on the immediately adjacent lakeshore lots.
a. In instances where the average lakeshore setback can not be met, administrative approval may be
granted at the discretion of the planning director provided no lake views of an adjacent lakeshore lot are
obstructed and adjacent neighbors provide written approval.

Sec. 78-1285. Vegetation alterations.
(a) No live tree within 75 feet of the shoreline or within the bluff impact zone with a diameter of six
inches or more (or 19 inches in circumference or greater) measured three feet above the ground may be
removed without first obtaining a permit from the city staff, provided that at least the equivalent number
of replacement trees of a size and nature found acceptable to the stafF are planted at the same setback
from the shoreline as those removed. Appeals of staff determinations as to type, size and quality of the
trees to be replaced will be to the council. Removal of trees that are dead shall not require a permit, but
such trees must be inspected by city staff prior to their removal.

(b) Intensive vegetation clearing within 75 feet of the shoreline, on steep slopes or within the bluff
impact zone within the Shoreland Overlay District is prohibited. Limited clearing of shrubs and trees less
than six inches in diameter and cutting, pruning and trimming of trees of any size is allowed to provide a
view to the water from the principal dwelling site and to accommodate the placement of permitted
stairways and landings, picnic areas, access paths, beach and watercraft access areas, and permitted
lockboxes, provided that the screening of structures, vehicles or other facilities as viewed from the water,
assuming summer, leaf-on conditions, is not substantially reduced.

Sec. 78-1286. Topographic alterations/grading and filling.
(a) Grading and filling and excavations necessary for the construction of structures, sewage treatment
systems, and driveways under validly issued construction permits for these facilities do not require the
issuance of a separate grading and filling permit. However, all grading and filling activity approved
permits for construction of structures, sewage treatment systems, and driveways shall adhere to the
grading and filling standards of this article.
(b) Grading, filling or excavating of more than ten cubic yards is prohibited within 75 feet of the ordinary
high water level of the public waters enumerated in section 78-1217. Grading, filling or excavating of ten
cubic yards or less shall require city staff review and permit and be subject to other pertinent sections of
this chapter.
(c) Public and private roads, driveways, parking areas, and public or private watercraft access ramps shall
not be constructed within 75 feet of the ordinary high water level of the public waters enumerated in
section 78-1217. If no alternatives exist, such improvements shall be subject to the standard zoning
variance review procedure, and such review shall take into account the following considerations:
(1) Such improvements shall be designed to take advantage of natural vegetation and topography to
achieve maximum screening from view from public waters.
(2) All roads and parking areas shall be designed and constructed to minimize and control erosion to
public waters consistent with the requirements of all agencies with jurisdiction.
(d) Except for those projects requiring permits for c:onstruction of structures, sewage treatment systems
and driveways, a land alteration permit will be required as follows:
(1) For movement of one through 500 cubic yards of material anywhere within the Shoreland Overlay
District, a staff-issued land alteration permit shall be required.
(2) For movement of more than 500 cubic yards of material within the Shoreland Overlay District,
conditional use permit approval by the city council is required in addition to the required land alteration
permit.
(e)The following considerations and conditions must be adhered to during the issuance of construction
permits, grading and filling permits, conditional use permits, variances and subdivision approvals:
(1) Grading or filling in any type 1, 2, 3, 4, 5, 6, 7 or 8 wetland must be evaluated to determine how
extensively the proposed activity would affect the following functional qualities of the wetland:
a. Sediment and pollutant trapping and retention;
b. Storage of surface runoff to prevent or reduce flood damage;
c. Fish and wildlife habitat;
d. Recreational use;
e. Shoreline or bank stabilization; and
f. Noteworthiness, including special qualities, such as historic significance, critical habitat for endangered
plants and animals, or others.
This evaluation must also include a determination of whether the wetland alteration being proposed
requires permits, reviews or approvals by other sections of city ordinances or by other local, state or
federal agencies including but not limited to watershed districts, state department of natural resources, or
the United States Army Corps of Engineers.
(2) Alterations must be designed and conducted in a manner that ensures only the smallest amount of
bare ground is exposed for the shortest time possible.
(3) Mulches or similar materials must be used, where necessary, for temporary bare soil coverage, and a
permanent vegetation cover must be established as soon as possible.

(4) Methods to minimize soil erosion and to trap sediments before they reach any surface water feature
must be used.
(5) Aitered areas must be stabilized to acceptable erosion control standards consistent with the field
ofFice technical guides of the local soil and water conservation districts and the United States Soil
Conservation Service.
(6) Fill or excavated material must not be placed in a manner that creates an unstable slope.
(7) Plans to place fill or excavated material on steep siopes must be reviewed by the city engineer for
continued slope stability and must not create finished slopes of 30 percent or greater.
(8) Fill or excavated material must not be placed in bluff impact zones.
(9) Any alterations below the ordinary high water level of public waters must first be authorized by the
commissioner of the department of natural resources under Minn. Stat. § 103G.245.
(10) Alterations of topography must only be allowed if they are accessory to permitted or conditional uses
and do not adversely affect adjacent or nearby property.
(11) Placement of natural rock riprap, inciuding associated grading of the shoreline and placement of a
filter blanket, is permitted if the finished slope does not exceed three feet horizontal to one foot vertical,
the landward extent of the riprap is within ten feet of the ordinary high water level, and the height of the
riprap above the ordinary high water level does not exceed three feet. A riprap permit shall be obtained
per the requirements of section 78-969
(f� Excavations where the intended purpose is connection to a public water, such as boat slips, canals,
lagoons and harbors, are prohibited above the ordinary high water level. Such excavations below the
elevation or the ordinary high water level are subject to approval of the department of natural resources
and other agencies with concurrent jurisdiction.

Within 75 feet of the ordinary high water level (OHWL) of any lake or tributary, and within any bluff or
shore impact zone, no hardcover shall be placed, located or constructed, except for driveways, stairways,
lifts, landings and lockboxes as regulated by the shoreland overlay district.

RE: 1485 Green Trees Road Zoning Violations
Dear Mr. and. Mrs. Vergeyle:
On June 27, 1994, an inspection was conducted at the above subject property which revealed
the following Zoning Code violation:
Violation of the conditions of Resolution No. 3406:
1. Failure to adhere to the approved grading plan per Condition l.
2. Destruction and removal of trees and vegetation within the steep slopes
and bluff impact zone, which trees were not necessary to be removed for
construction of the residence per Condition 2.
3. Filling on the lakeside of the residence «�here no fill is allowed per
Condition 4.
Our site inspection confirms that at least 5 and as many as 8 - 10 mature trees located on steep
slopes (and on the bluft) lakeward of the house have been removed. At least five of said trees
were locateci more than 10 feet from any footprint or projected roofline of the existing house and
were not necessary to r�move for construction of the residence.
Further, fill placed lakeward of the house is extensive and is undergoing severe erosion, having
already breached the single line of silt fence at the base of the slope, and causing a significant
sedimentation problem at the base of the bluff. The existence and placement of this fill is a.
direct violation of Condition 4 of Resolution No. 3406 and appears to be similar in character to
the originally proposed filling of the bluff which the City specifically disallowed.
As a consequence of the above noted activity, a violation citation has been issued to you and is
included with this letter.

You are required to take corrective action as follows:
1, Immediately (within 24 hours of your receipt of this letter) re-establish the silt
fencing at its current location and a second barrier 20 feet lakeward of the first.
2. Within 7 days, restore the slope on the lakeside of the residence to its original
location and grade as shown on the approved site/grading plan. Remove sediment
that has accumulated lakeward of the silt fence. Upon completion of grade
restoration, immediately establish measures to prevent further erosion and
sed'unentation.
3. Within 14 days, submit a vegetation restoration schedule prepared by a registered
landscape architect, which plan shall include vegetative materials to restore a
slope stabilizing root structure, re-establishment of understory, and replacement
of trees on an inch for inch replacement (approximately 150" total diameter of
replacement trees).
4. Tree and vegetation restoration shall occur this growing season. A Certificate of
Occupancy shall not be issued until vegetation restoration is completed.
Failure to adhere to the above schedule shall result in all home construction work at the site
being immediately stopped.
A copy of Resolution No. 3406, the approved site and �rading plan, and copies of the pertinent
ordinances are enclosed.

Subd. 5. Compliance. The use of any shoreland of public
waters ;� the size and shape of lots ; the use, size, type and
location of structures on lots; the instal lation and maintenance of
water supply and waste treatment systems, the grading and filling
of any shoreland areas ; the cutting of shoreland vegetation; and
the subdivision of land shall be in full compliance with the terms
of this section and other applicable regulations . �
Subd. 6. Enforcement. The Zoning Administrator is
responsible for - the administration and enforcement of this
ordinance. Any violation of the provisions of this ordinance or
failure to comply with any of its requirements ( including

WHEREAS, David and Margaret Vergeyle (hereinafter "the applicants") are
owners of the property located at 1485 Green Trees Road within the City of Orono (hereinafter
"City") and legally described as follows:
L,ot 1, Block 1, Green Trees on Tanager Lake, Hennepin County, Minnesota
(hereinafter "the property"); and
WHEREAS, the applicants have applied to the City for variances to Municipal
Zoning Code Section 10.56, Subdivision 16 (C) (2 & 3) to allow placement of a residence
structure at a setback of Iess than the required 30' from the defined "top of bluff", and to allow
placement of said structure within the bluff impact zone where structures and accessory facilities
are not allowed; and for a variance to Section 10.56, Subdivision 16 (I) to allow intensive
vegetation clearing on steep slopes to accommodate the proposed residence; and for a variance
to Section 10.56, Subdivision 16 (n (5) (h) to allow fill placement in a bluff unpact zone; and
for a variance to Section 10.23, Subdivision 6 (B) to allow a front yard setback of 39.4' where
a 50' front yard setback is normally required.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,

FINDINGS
1. This application was reviewed as Zoning File #1909.

3. The Orono Planning Commission reviewed this application on March 21, 1994
and recommended on a vote of 4 ayes, 2 nays and 1 abstention, conditional
approval of the proposed variances per the following findings and recommended
conditions:
�,. This lot was platted in September of 1980 and was approved by the City
at 1.69 acres in area.
B. The property is not sewered, therefore an on-site sewage treatment system
is required.
C. The dry buildable portion of the lot that is not within the 100' lakeshore
setback nor within the bluff impact zone, is surrounded by private
roadway on three sides and a 50' street setback is required in the LR-lA
zone.
D. Once the lakeshore setback, setback from top of bluff, front and side yard
setbacks and setback from septic system are accounted for, the remaining
buildable area of the property is approximately 15' x 65', not large
enough for construction of a residence on the property. Therefore,
without approval of variances, the lot would be unbuildable.
E, The proposed location of the residence requires variances to both the 30'
bluff setback and the prohibition on structures within the bluff impact
zone. The proposed dwelling location in addition to proposed filling and
retaining walls approximately 30' lakeward of the foundation would result
in the removal of a substantial number of mature trees and other
vegetation within the bluff and on steep slopes, require a variance to the
prohibition on intensive vegetation clearing on steep slopes.
F. No hardship or need has been justified for granting of the variances
necessitated by the fill and retaining walls.

G. The filling and grading necessary to merely accommodate construction of
a residence on the property is reasonable as long as the impacts of such
grading are minunized to the greatest degree possible, both by house
placement as well as by using appropriate erosion control methods.
H. The removal of just those trees necessary to accommodate construction of
a residence is fair and reasonable.
I. Planning Commission recommends that the Council look favorably on any
revised proposal which might result in up to a 10' encroachment into the
street setback zone but which therefore reduces the impacts on the steep
slope and bluff impact zone by moving the proposed residence nearer the
street.
J, Planning Commission recommends that the fill and retaining walls on the
lakeside of the proposed residence be omitted, that the proposed deck be
allowed, and that any patio area on the lakeside of the residence be
constructed as a deck to eliminate the need for filling.
K. Planning Commission recommends that the applicants preserve existing
vegetation to the greatest extent possible to preserve the existing degree
of screening from Tanager Lake.
L. Planning Commission recommends that the tile drain system incorporate
an underground percolation system to minimize erosion potential.
IVi, The Minnesota DNR has submitted a letter of non-objection to the
variance subject to the following conditions:
1) The design of the structure and bluff alterations must be reviewed
and approved by a registered structural or soils engineer. This
review must consider the stability of the structure and appropriate
design to minimize erosion in the altered area during and after
construction.

2) Vegetation and appropriate coloring shall be used to blend in the
alterations with the natural character of the bluff area.
4, Pursuant to the Planning Commission recommendation, the applicants have
revised their proposal to eluninate grading or filling on the lakeside of the
proposed residence, and have relocated/reconfigured the proposed structure in a
manner such that the following variances are required:
�,. 10'.6' setback encroachment into the 50' street yard requirement.
B. 30' encroachment of the 30' top of bluff setback.
C. 44' structural encroachment lakeward of the defined top of bluff.
D. A portion of the bluff impact zone will be filled to accommodate said
residence.
E. Intensive vegetation clearing on steep slopes will occur to accommodate
construction of the house.
5, The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicant and the effect of the proposed variance on the health, safety and
welfare of the community.
6, The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial property
right of the applicant; and would be in keeping with the spirit and intent of the
Zoning Code and Comprehensive Plan of the City.

39.6' where a 50' front yard setback is normally required; and a variance to Section 10.56,
Subdivision 16 (C) to allow encroachment into the 30' required setback from the top of bluff,
and to allow structure in the bluff impact zone where structure is normally not allowed; and a
variance to Section 10.56, Subdivision 16 (I) to allow intensive vegetation clearing on steep
slopes; and a variance to Section 10.56, Subdivision 16 (� to allow fill within the bluff impact
zone, subject to the following conditions:
1. All construction on and improvements to the property shall be per the approved
site and grading plans attached to this resolution as Exhibit A.
2. Applicants shall take extreme precautions to prevent the destruction of trees and
vegetation within the steep slopes and bluff impact zone which are not necessary
to be removed for construction of the residence.
3. Applicants shall take extreme precautions to protect the primary and altemate
drainfield sites from an construction traffic, by fencing said drainfield areas with
a sturdy fence and placing warning signs. Applicants are advised that the
proposed drainfields are located in an area extremely winerable to inadvertent
traffic which may render said drainfield areas unusable and would make the lot
unbuildable.
4. No filling is allowed on the lakeside of the residence. The proposed decks as
shown on the site plan shall be constructed so as not to require the placement of
fill.
5. The surface water drainage systems on the property shall incorporate underground
percolation systems wherever feasible.
6. Authorities granted by this resolution run with the property not with the
applicants, but are permissive only and must be exercised by application for a
building permit within one year of the date of Council approval, or this variance
will expire on that date (March 28, 1995).

'7. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
g. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the
property.
