Recitais
1. Building permit applications have been filed for an in-ground pool and patio located at 3285
Graham Hill Road the ("Subject Property"), as more fully shown and described on Exhibit"A" attached hereto.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owner shali deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owner would be responsible for under a building permit appiication. The escrow will aiso guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financiai security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit#2009-00427 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owner. Owner shall be responsible for payment to the City within 30 days of the Owner's receipt
of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owner does not make
payment to the City within the timeframe outlined in #3 above, the City may draw from the escrow account without
further approval of the Owner to reimburse the City for Eligible expenses the City has incurred. The City shall
notify the Owner the Owner of such draw and the nature of the expense for which the reimbursement is being
made. If the Escrow amount falls below 75% of the original escrow amount the Owner shall deposit additional
sums as directed by the City, or the City shall discontinue review and post a Stop Work Order.
4. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owner when the review has been completed and written notification is received from the Owner requesting the
funds.
5. CERTIFY UNPAID CHARGES. If the project is abandoned by Owner, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

vary between types of construction projects.
(b) Surveys required:
(1) Initial survey. Any building or general permit application for construction of a new structure or expansion of
an existing structure shall be accompanied by a certificate of survey prepared by a Minnesota Registered Land
Surveyor unless the building official determines the construction project is exempt from this section. The certificate
of survey shall conform to the standards on file in the office of the buiiding official.
(2) Foundation survey. A foundation survey shall be submitted to the city for review and approval, unless
exempted by the building official, upon completion of the foundation work for all buildings and all additions to
buildings. The foundation survey, prepared by a Minnesota Registered Land Surveyor, shall certify the lot
dimensions; front, side, rear, lakeshore, and wetland setbacks; and foundation elevation. A foundation survey must
be submitted before proceeding with framing or further construction. In lieu of a survey a letter prepared by a
Minnesota Registered Land Surveyor containing the same information as a foundation survey may be submitted.

by the building official. The as-built survey shall certify the final topography of the site; verify drainage patterns;
and provide hardcover calculations for lots in the Shoreland Overlay District. An as-built survey must be approved
before the issuance of a certificate of occupancy. In the event that weather or other conditions prevent the
completion of an as-built survey at the time the Certificate of Occupancy is requested, applicant shall provide a
sufficient financial guarantee and establish an escrow agreement to ensure completion of the as-built survey.

Our records indicate we continue to hold an escrow of $2,500 pertaining to permits 2009-00047
and 2009-00427 regarding the new home and swimming pool on the above property. Before we
can refund the escrow, an as-built survey for the property must be submitted. Our engineer will
review the as-built survey to determine if the property conforms to the approved building permit
plans, approved grading plan, etc. if so, your escrow will be refunded. If anything is identified on
the as-built survey which is out of conformance with the permits or city codes corrections will be

To follow up my letter to you dated March 30, 2011, we have not received an as-built survey for
the construction of the new home and pool at 3285 Graham Hill Road.
We continue to hold an escrow of $2,500 pertaining to the construction of a new home and
installation of an in-ground pool. In order to begin the process for the release of the escrow,
submittal of an as-built survey is required so we may verify conformance with approved permit
plans. Once our engineer determines the property conforms to the approved building permit
plans, approved grading plan, etc. your escrow can be refunded.

Sec. 86-68. Permit application; information required.
(a) The application for a construction permit shall include such information as may be
required by the city, which may vary between types of construction projects.
(b) Surveys required:
(1) Initial survey. Any building or general permit application for construction of a new
structure or expansion of an existing structure shall be accompanied by a
certificate of survey prepared by a Minnesota Registered Land Surveyor unless
the building official determines the construction project is exempt from this
section. The certificate of survey shall conform to the standards on file in the
office of the building official.
(2) Foundation survey. A foundation survey shall be submitted to the city for review
and approval, unless exempted by the building official, upon completion of the
foundation work for all buildings and all additions to buildings. The foundation
survey, prepared by a Minnesota Registered Land Surveyor, shall certify the lot
dimensions; front, side, rear, lakeshore, and wetland setbacks; and foundation
elevation. A foundation survey must be submitted before proceeding with framing
or further construction. In lieu of a survey a letter prepared by a Minnesota
Registered Land Surveyor containing the same information as a foundation
survey may be submitted.
(3) As-built survey. An as-built survey, prepared by a Minnesota Registered Land
Surveyor, shall be submitted to the city for review and approval upon the
completion of all buildings and all additions to buildings, unless exempted by the
building official. The as-built survey shall certify the final topography of the site;
verify drainage patterns; and provide hardcover calculations for lots in the
Shoreland Overlay District. An as-built survey must be approved before the
issuance of a certificate of occupancy. In the event that weather or other
conditions prevent the completion of an as-built survey at the time the Certificate
of Occupancy is requested, applicant shall provide a sufficient financial
guarantee and establish an escrow agreement to ensure completion of the as-
built survey.
