Dear Melanie:
We have reviewed the grading plan for 3Z35 Graham Hill Road dated 6-9-09. The plans
propose to build a single family home with an attached garage. We have the following
comments with regards to engineering matters:
• The proposed retaining wall is shown as 4.0 feet in height. If field changes
increase the height, engineering design and details must be submitted for review
and approval.
• The proposed grading plan is consistent with the overall development grading
plan and is acceptable from an engineering standpoint.
• This project will disturb more than 100 CY of material. Sediment and erosion
control information meeting the requirements of Orono's Ciry Code 79-7(c)(2)
must be submitted. The minimum $2000 sediment and erosion control financial
security should be required of the applicant for this permit.

The builder, Tom Bren has requested on behalf of the applicant, Courtney Kill, a refund of the
application escrow in the amount of$4,500.00.

I stopped in your office back in November to pick up the CO and also the escrow refund. I was told this process would
be under way at that time. it seems a bit odd that so many folks need to review a process as simple as refunding the
owner their deposit.

Recitals
1. A building permit application has been filed for a (circ/e one) new principal located at 3235
Graham Hill Road. the ("Subject Property"), as more fully shown and described on Exhibit"A" attached hereto.
2. Owner requests the City to review this application.

only if the Owner estabiishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneousiy with the execution of this Escrow
Aqreement, the Owner shall deqosit $4.500 with the City f$2,500 for the buildinq permit and pradinp review and
$2,000 for erosion controi). All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in
administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the

reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is compieted in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2009-00332. If compliance with the
approved buildinp permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owner. Owner shall be responsibfe for payment to the City within 30 days of the Owner's receipt
of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owner does not make

further approval of the Owner to reimburse the City for Eligible expenses the City has incurred. The City shall
notify the Owner the Owner of such draw and the nature of the expense for which the reimbursement is being
made. If the Escrow amount falls below 75% of the original escrow amount the Owner shall deposit additional
sums as directed by the City, or the City shall discontinue review and post a Stop Work Order.
4. CLOSING ESCROW. The Balance on deqosit in the escrow, if any, shall be returned to the
Owner when the review has been completed and written notification is received from the Owner requesting the
funds.
5. CERTIFY UNPAID CHARGES. If the project is abandoned by Owner, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

Tom,
Built into the City of Orono's application fee is a $500 credit used to cover the initial cost of any
engineering and/or legal review. Any engineering or legal fees over $500 are to be paid by the
applicant. I have attached a copy of the building permit application for your reference.
In July 2009, $164.00 was billed to the City for building permit application 2009-00332, 3235 Graham
Hill Road and in September 2010 the City was billed $246.00. To this point you have not received
any invoices, because those two invoices did not exceed the $500. In January 2011, Bonestroo
incurred another $164.00 for review of the final piece of information needed for the as-built review. In
February you will be receiving an invoice for $74.00.
You can either wait for the invoice to arrive and then pay the amount due. Once we receive the
check we will process the escrow refund at the next council meeting (all expenditures need council
approval). Or you can pay the $74.00 now and we will process the escrow refund request at the
February 14th council meeting.

Both the planning assistant and our account are out this afternoon and they have a better handle on the escrow refund
status. Without additional input from them I can't give you anything other than our standard answer. We don't typically
process an escrow refund without a CO but perhaps the refund process has been started. I'm sorry I don't have a solid
answer today. I'll have Chris follow up tomorrow.

I stopped in your office back in November to pick up the CO and also the escrow refund. i was told this process would
be under way at that time. It seems a bit odd that so many folks need to review a process as simple as refunding the
owner their deposit.
Nevertheless, will please let me if there is any problem with this project that would prevent them from immediately
approving a full refund.
