BUILDING PERMIT ESCROW AGREEMENT
Orono Building Permit#2011-00075
�
AGREEMENT made this�day of �6������-P , 20 // , by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Keith &Amy Korsi ("Owners").
Recitals
1. A building permit application has been filed for a new residence located at 3215 Graham Hill
Road, the ("Subject Propert�'), legally described as Lot 2, Block 1, Graham Hill Preserve, Hennepin County
Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2011-00075 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bilis for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject pro�perty pursuant to Minn. Stat. §§415.01 and 366.012.

Dear Melanie:
We have reviewed the plans for the proposed house and associated grading to be constructed at
3215 Graham Hill Road. The plans are dated 1-26-11. We have the following comments with
regards to engineering matters:
• The grading plan generally follows the overall development grading plan and is
acceptable from an engineering standpoint.
• The proposed retaining wall on the side of the house is 6 feet high. Engineered design
and details should be submitted for review and approval for all retaining walls over four
in height, and for all tiered walls with a separation of less than two times the wall height.
• This project will disturb more than 100 CY of material. Sediment and erosion control
information meeting the requirements of Orono's City Code 79-7(c)(2) must be
submitted. The minimum $2000 sediment and erosion control financial securiry should
be required of the owner for this permit.

Review Summary:
The retaining wall plan was prepared by an Engineer and the content appears
appropriate to direct construction of boulder retaining walls at this site. Calculations
for the wall design were not submitted for review. Plans should state the design
complies with safety factor and building code requirements.
Plans indicate wall design only addresses internal stability. External stability including
but not limited to foundation settlement, global/slope stability is not addressed by the
wall design Engineer. It is recommended the Owner review the proposed design with
the Owners Engineer and determine whether or not external stability analysis is
appropriate. The Owner/Contractor shall be aware of and follow the suggested
general notes and quality assurance provisions noted on the wall design Engineer's
plan.
A site plan showing the wall layout relative to boundaries, buildings and other site
features were provided. Wall layout, notes and details of construction were submitted.
Plans indicate the design was prepared by a professional engineer and content
appears to meet industry standards for this type of work.

Road, Review notes include:
• Plans were prepared by an Engineering Consultant and the plan content
appears appropriate to direct retaining wall construction.
• Design calculations for the wall were not provided. Calculations should
indicate whether or not the design satisfies Minnesota State Building Code
factor of safety requirements. Plans should state the design complies with
code requirements.
• Plans contain ��General Notes". We recommend the Owner and Contractor
follow by these provisions to satisfy the wall designer's intent and quality

The area above the walls is assumed to be level. A traffic parking area is assumed to be above the lower wall, a uniform loading of 100 psf was used for design.
3)The foundation soils shall be inspected to confirm an ailowable bearing capacity of 2,000 psf or greater against shear failure or excessive settlement.
II. INSPECTION AND TESTING:
1)7he Owner or Owner's Engineer shall be responsibfe for site inspection and testing. Site inspection shall include, but not be limited to the following:
a. Verifying the soil parameters stated above are consistent with backfill and foundation soils being used for retaining wall construction.
b. Verify groundwater conditions at the site and insure adequate surtace water control is provided to direct water away from the wall area _
c. Inspect and verify the foundation soils are firm and capable of supporting the {oad stated Section 1.3 without excessive settlement or shear failure. �+heet �n deX

BUILDING PERMIT ESCROW AGREEMENT

AGREEMENT made this �'� day of �6'�t��-f , 20 // , by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Keith &Amy Korsi ("Owners").
Recitals
1. A building permit application has been filed for a new residence located at 3215 Graham Hill
Road, the ("Subject Property"), legaliy described as Lot 2, Block 1, Graham Hill Preserve, Hennepin County
Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $2,500 with the City. Atl accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may aiso be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2011-00075 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject pro�erty pursuant to Minn. Stat. §§415.01 and 366.012.
