The Orono City Council adopted Munic:ipal Code revisions to compiy witt� the Stete regiilations on May 13, 1996. Al�hough mandetory septic system regulations are new to the State, th� new c��des will not incltide s latge number of chang�s fur Orono. Changes that will effecl Orano residents are as follows: � The State regulat'tuns now ree�uire that all septic system inspcctions performed by licen9ed �ers�nnel must identify the system's compliance. This means that nll septic system inspections petformed by�licensed c�ntractor or the City mu9t inc:lude either soil horing infoimEition or perform a new soii boring to confirm �omplinnce with current codes. Compliance inspections sl�all be conducted by a qualified employce who is independent of tlie home owner or installer. 3. Certificate of Compliance or Notice of Noncompliance signed by the inspector must be submitted to the City wi[hin 30 da�-s of tfie compliance inspection and H�ill be kept on file with the City. 4. Any on-site treatrnent system located on real property lying wiU�in tl�e City of Minnetrista si�all be brought into compliancc�vit}�the requirements of the current individual sewage treatment systems (ISTS) standards promulgated by the Minnesota Pollution Control Agency(MPCA) in Minn. Rules Ctiapter 7080, hereafter known as"Chapter 7080",of d�e City of Minnetrista [ndividual Sewage Tr�eatment System Ordinance, hereafter la�own as U�e Ordinance, whichever is most restrictive, upon die sale or conveyance of said rea) property. 5. Prior to the convtwance of any real propertv, d�e seller must disclose in writing to the buyer information about die status and location of all known ISTS on the property by delivering to the . buyer eitt�er a sw-orn affidavit by the seller that no ISTS e�cists on the property to the best of their knowledge after diligent investigation or a certificate of compliance or a notice of non-compliance mecting all the provisions of Chapter 7080 being die result of a compliance inspection conducted by a Minnesota state registered inspector holding a Designer I or Inspector certification. A certification of compliance(ccrtificate of compliance)or notice of noncompliance(notice of noncompliance) mceting all provisions of Ctiapter 7080 must be submitted to the City of Minnetrista and the seller within 30 days after die compliance inspection. If an individual sewage treatment system is found to be in noncompliance,a site evaluation meeting all provisions of Cltapter 7080 must be submitted witli d�e�iotice of noncompliance 6. If the seller fails to provide a Certificate of Compliance, d�e seller shall provide ilie buyer suft3cient security in tl�e form of an escrow agreement to assure thc installation of a complying ISTS. The � security s}iall be placed in an escrow�vith a licensed real estate closer, licensed attorney-at-law, or federal or state ciiarteral financial institution. Tl�e amouni escrowed shal(equal to 150%of a written esticnate to install a complying.ISTS provided a licenses and certified installer, or il�e amount escro�•ed shall be equal to 110%of the written contract price for d�e installation of a complying ISTS provided b�•a licensed and certified installer. After a complying ISTS has been installed and a certificate of compliance issued, tl�e City of Minnetrista sl�all provide tl�e escrow agent a cop��of the certificate of compliance. 7. Do avoid unnecessary foot traffic over the mound, mow it and stay off of it. This is especially true in the winter time. Even human foot traffic can cause frost to penetrate the mound resulting in potential freezing problems. Do inspect your mound system annually for winter kill, (reseed if necessary) animal damage, (burrowing}or signs of potential failure, Do not plant trees or shrubs on the mound system, smaller trees and shrubs may be planted at the edges. Remember, that sunshine is the key to a hea�thy mound system.
