Box 66 Crystal Bay, MN 55323 Re: Proposed replat of Lot 2, Block 1, Hallson Estates Dear Sir or Madam: At the request of Michael Hilbelink, I have been requested to issue to you the following opinion relative to the above matter. I hereby certify that I have examined the Abstract of Title to the real properry described below. The Abstract contains 107 entries and was certified to November 30, 1997, at 7:00 a.m., by Edina Realty Title. Description (This real property is located in Hennepin County): Lot 2, Block 1, Hallson Estates (referred to in this letter as the "Property"). As a result of my examination, it is my opinion that as of November 30, 1997, at 7:00 a.m., title to the Property was marketable and was vested in John Hallson, now married to Linda I. Hallson, subject to the following: l. A mortgage dated May 9, 1988, and filed May 18, 1988, as Document No. 5409708 in the Hennepin Counry Recorder's office running in favor of FBS Mortgage Corporation, a Nevada corporation, to secure an original debt of $95,000.00. , Real Propeny Law Specialist, certified by the Minnesota State Bar Association This mortgage was assigned by FBS Mortgage Corporation to Rothschild Financial Corporation, a Minnesota corporation, by a document dated August 1, 1988, and filed September 20, 1988, as Document No. 5455794 in the Hennepin County Recorder's office. This mortgage was further assigned to Bank of America, fsb, a federal savings bank, by a document dated June 15, 1996, and filed June 27, 1996, as Document No. 6598402 in the Hennepin Counry Recorder's office. 2. A mortgage dated May 7, 1993, and filed August 26, 1993, as Document No. 6140257 in the Hennepin County Recorder's office running in favor of Norwest Bank Minnesota, National Association, to secure an original debt of $35,000.00. 3. A mortgage dated April 12, 1996, and filed July 23, 1996, as Document No. 6610033 in the Hennepin Counry Recorder's office running in favor of American Family Financial Services, Inc., a Wisconsin corporation, to secure an original debt of $5,512.88. 4. A mortgage dated August 22, 1996, and filed September 25, 1996, as Document No. 6638176 in the Hennepin Counry Recorder's office running in favor of American Family Financial Services, Inc., a Wisconsin corporation, to secure an original debt of $15,034.73. 5. A Declaration of Private Road Easement and Declaration of Covenants for Maintenance of Same dated November 4, 1986, and filed January 22, 1987, as Document No. 5216205 in the Hennepin County Recorder's office. This Declaration is for the benefit of the future development of the Property (described therein as "Lot 2 Hallson Estates Addition"). 6. A Resolution of the Orono Ciry Council, No. 3390, dated March 14, 1994, and filed April 14, 1994, as Document No. 6269521 in the Hennepin County Recorder's oftice. This Resoiution grants a condiiionai use permit fc,r trie Property for a temporary greenhouse. 7. Real estate taxes due and payable in 1997 and prior years have been paid in full. Homestead real estate taxes due and payable in 1997 were in the amount of $3,715.02 (Base tax amount: $3,679.08, P.I.D. No. 33-118-23 43 0005). 8. Public zoning or building ordinances, municipal regulations and unpaid installments of special assessments. The Abstract does not contain any information as to whether there are outstanding or pending assessments affecting the Property. 9. Drainage and utiliry easements as shown on the plat of Hallson Estates. 10. Any questions of survey or encroachment which may be determined by an inspection of the Property or an accurate survey of the Property. 11. Any liens for labor or materials furnished to the Property in the last 120 days for which payment has not been made. 12. The rights of anyone in possession other than the above-named fee owners. 13.
