We received the letter that was sent over for this project dated October 5t'', 2016, and after reviewing this we have a
couple of questions for you:
-Certificate of Survey: We submitted the new survey with our proposed improvements as well as an existing
conditions survey, do we have to have the surveyor physically sign the COS or is an electronic signature
accepted?An electronic signature is accepted if that is how the surveyor does it.
-Escrow& Escrow Agreement: is this section just clarifying that the escrow check will be mailed to the
client? Correct.
-MCWD: We have already applied and received the Erosion Control Permit from MCWD (please see attached)
Received.
-Zoning permit: We've submitted both a Zoning Permit and Building Permit Application on 9/26/16, was the
Zoning Permit Application Received? Please let us know if you need additional items for this. Both permit
applications were received. As noted in the letter, please submit 2 additional copies of the Landscape Plan or
Survey(meeting our requirements)in order to complete the remainder of the landscaping shown on the
proposed Landscape Plan. We cannot combine permit plan sets. The Zoning Permit will be reviewed and
approved once the MCWD has issued their Notice of Decision (NOD)on the wetland boundary.
Please note,the approved wetland boundary must be shown on a certificate of survey for the permit review.

We have discussed a project with you involving a new boulder retaining wall, a larger replacement deck, patio, and
replacement of existing timber retaining walls. Because the wetland delineation is still under review with the MCWD
the new elements of the plan cannot be permitted at this time. You have chosen to move forward with one of the in-
kind timber wall replacements. On September 26, 2016 the City received a Building Permit application for only the in-
kind replacement of a timber retaining wall. Staff conducted a preliminary review based on the information provided
and recommends the following items be submitted or revised in order for your application to be considered complete
and for the plan review to continue:
1. Certificate of Survey. Our engineer has reviewed the plans and survey: the Landscape Plan by Southview
Design submitted does not conform to the City's survey/site plan requirements because the plan must be
signed by a licensed professional; and a Lot Survey-Proposed Plan by E.G. Rud & Sons showing the proposed
project was submitted; however it is not signed by the surveyor. We require plans to be certified by a licensed
engineer,surveyor,or architect; one of these plans must be signed.
2. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal
of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City
for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee
conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow
amount for this project is $2,500. We acknowledge the receipt of$2,500 from Southview Design for the
escrow but be aware per the City's policy the money will be refunded to the property owner.
3. Minnehaha Creek Watershed District (MCWD). In addition to the wetland delineation please contact the
MCWD to see if your project may trigger any of their permitting requirements (i.e. erosion control). Please
note, the City of Orono will not issue a permit without a copy of the MCWD permit or documentation stating
the proposed project does not trigger any of their permitting requirements. Please advise them of your entire
project.
Regarding the remaining work (i.e. retaining walls under 4 feet, patios, stairs, sidewalks, etc), a Zoning Permit
application (copy enclosed) with 2 additional copies of the Landscape Plan or Survey will be required to be submitted

1. The plan does not conform to the cities survey/site plan standards--The plan is not signed by a licensed surveyor

This property needs to wait for the wetland delineation to be approved and an alternate septic site located prior to
issuing the entire zoning permit (stairs, patio, etc.) and building permit (for a rebuild and slight expansion of the
deck). Please review the lower retaining wall to be rebuilt in-kind (20') with boulders versus timbers (which is what is
shown on the photo, even though the survey calls them block walls). The additional retaining wall, curve and upper wall

Thank you for taking the time to meet with me today. I have attached a few images that show the current deck foot
print, the lower yard areas to the pond "wetland", and the current timber walls. I have a few comments that I would like
you to consider as you finalize your decision on what parts of the project I can start on prior to the 14th. i will list these
below and will look for your fol�ow up tomorrow per our conversation. Please feel free to call me on my mobile number
listed below if you have any questions and when you are ready to update me on the items in question.
• From our conversation today, I am of the understanding that I can begin the wall work prior to the 14t'' if I build
the new boulder wall in the same foot print as the lower timber wail. Please understand that my boulders will
be a little wider than the current timbers. Yes, I will get the permit ready to be issued for construction of the
lower wall to be rebuilt in-kind (20') with boulders. To clarify the pictures show timbers walls, but depicted as
block walls on the survey.The proposed extension of the lower wall and the upper wali cannot be constructed
until the wetland delineation has been completed and an alternate septic site has been identified.
• You are ok with me moving forward with the removal of the current deck. Yes,you can remove the deck, but
per City Code Section 58-47(d) no expansion is allowed without design and preservation of a future drainfield
site. Although we haven't received the building permit yet for the deck, the deck permit will not be issued until
a future drainfield site has been identified and approved by the Roger Peitso, the City's septic specialist.
• You mentioned that the only items at this time that could pause the project would be the septic system and if
there was a disagreement by the Watershed District on the wetland delineation line? Yes.
• I have spoken with the Steve Kennedy (Septic Designer) and he was going to come out to site Monday after his
locates were confirmed to review the site. He did recall his previous work and was going to connect with Roger
on any further questions. I am hoping he will be able to work out the Secondary location by mid to late next
week.
• Regarding the delineation line, I am still struggling with the fact that we cannot start the deck prior to the
14th? Per our measuring today, the new deck is only extended out about 1' further than the furthest location of
the current deck. The new decks footprint is no further out than the current patio that is under the current deck
and the patio area that is further out on the house side (see images). We are eliminating the side catwalk that

you see on the images and going with steps to the lower yard. I understand you go off of like in kind but the
patio under the deck today is out as far as the new deck? A deck permit reflecting an expansion cannot be
issued until the wetland delineation is approved and an alternate septic site has been located and approved.
• What is the difference if the current patio is out as far as the deck that we are building? i would like to think
that you would understand that the deck and patio are the same when coming to structures in the
position? The deck is structural and therefore an expansion.
• Do you really think the deck would be impacted by any change in the delineation line? The delineation line
would have to move a good 30'towards the home to have an impact. This is why I am hoping that you will allow
us to start on the deck sooner than the 14th? I agree, the deck most likely will not be impacted by the wetland
delineation; however, our code requires the delineation be verified for a proposed project within 150' of a
wetland. See City Code Section 78-1605.
• The building contractor will be stopping by again to resubmit his deck plans. He is hoping to be there by 10 am
tomorrow morning. To be clear, the deck pians were never submitted. The deck contractor talked to Roger and
I about the deck expansion and we told him at that time an alternate septic site would need to be de identified
and t�e then stated he would replace the deck in-kind to avoid having to locate an alternate site.
• Take a look at the pond and yard photos. The delineation line marked on site is about 12" off of the water's
edge.There is about a 8-9'grade change from this elevation to the patio. I don't think the wetland is any closer
to the home than it currently is marked. Citv Code Section 78-1605(c) states a potential wetland within 150' of a
proposed project requires a delineation, no flexibility is given for change in grade.

We received the building permit application for in-kind replacement of existing "timber walls" with new boulder
walls. Please reference the attached partial copy of existing survey, with the existing walls highlighted in blue. The
existing walls are listed as block retaining walls, not timber walls. Also attached is an annotated copy of the landscape
plan showing the walls in a different configuration. This does not appear to be an in-kind replacement.
If you want to proceed with the proposed walls as shown,you will need to wait for the MCWD to approve the wetland
delineation since the walls are not an in-kind replacement.

THIS WORK CONSISTS OF CONSTRUCTING BOULDER WALL STRUCTURES AT THE LOCATIONS INDICATED ON THE SITE GRADING PLAN, PREPARED BY SOUTHVIEW DESIGN, DATED 9/9/16 AND THE PROJECT SURVEY, PREPARED BY E.G. RUD &
SONS, INC., DATED 9/21/16. BOULDER WALLS ARE FORMED OF INTERLOCKING, DRY—STACKED ROCKS WITHOUT REINFORCING STEEL, MORTAR, OR CONCRETE.
CONSTRUCTION REQUIREMENTS
BOULDERS: BOULDERS SHALL CONSIST OF NATURAL STONE WITH VARYING HEIGHTS AND NOMINAL DEPTHS RANGING FROM 12 TO 48 INCHES (FRONT TO BACK).
GENERAL: THE FOLLOWING DEFINITIONS APPLY TO BOULDER WALL CONSTRUCTION:
(A) BASE ROCK: THE BASE ROCK IS THE LOWERMOST ROCK IN THE BOULDER WALL, AND BEARS DIRECTLY ON THE SOIL SUBGRADE.
(B) FACIN6 ROCK: THE FACING ROCKS COMPRISE THE BULK OF THE BOULDER WALL AND ARE STACKED ABOVE THE BASE ROCK.
(C) CAP ROCK: THE CAP ROCK IS THE UPPERMOST ROCK IN THE BOULDER WALL SECTION AND "CAPS" THE BOULDER WALL.
BOULDER WALL CONSTRUCTION:
(A) BOULDER WALL FOUNDATION EXCAVATION: EXCAVATE A FOUNDATION TRENCH AT LEAST (2 INCHES BELOW THE �iRADE AT THE BOTTOM OF THE WALL, RUNNING THE FULL LENGTH OF THE PROPOSED BOULDER WALL, OR TO THE
DEPTH SHOWN ON THE PLANS. EXCAVATE THE FOUNDATION TO A MINIMUM WIDTH EQUAL TO THE SPECIFIED BASE ROCK WIDTH PLUS 12 INCHES TO INCLUDE THE AGGREGATE BEHIND THE BOULDER WALL. EXERCISE CARE DURING
EXCAVATION OF THE BACK CUT. STABILITY OF TEMPORARY CUT SLOPES IS THE RESPONSIBILITY OF THE CONTRACTOR.
(B) BOULDER PLACEMENT: PLACE THE FIRST COURSE OF ROCK (BASE ROCK) ON FIRM, UNYIELDING SOIL WITH FULL COrITACT BETWEEN THE ROCK AND THE SUBGRADE. EXCAVATE ANY LOOSE, SOFT OR OTHERWISE UNSUITABLE MATERIAL
PRESENT AT FOUNDATION GRADE AND REPLACE WITH SUITABLE FOUNDATION FiLL. COMPACT THE FOUNDATION FILL AS NEEDED. AS THE BOULDER WALL IS CONSTRUCTED, PLACE THE ROCKS SO THAT THERE ARE NO CONTINUOUS JOINTS
IN EITHER THE VERTICAL OR LATERAL DIRECTION. STOCKPILE A SUFFICIENT NUMBER OF ROCKS TO PROVIDE A GOOD SELECTION FOR PLACEMENT. TO OBTAIN A BETTER FIT, PLACE ROCKS WHICH DO NOT MATCH THE SPACES OFFERED BY
THE PREVIOUS COURSE IN A DIFFERENT LOCATION. AVOID PLACING ROCKS WHICH HAVE SHAPES THAT CREATE VOIDS VdITH A LINEAR DIMENSION GREATER THAN 8 INCHES. EXCEPT IN ISOLATED CASES, PLACE EACH ROCK SO THAT IT
BEARS ON AT LEAST TWO ROCKS BELOW IT. LOCATE AT LEAST ONE BEARING POINT A DISTANCE NO GREATER THAN � INCHES FROM THE AVERAGE FACE OF THE BOULDER WALL. THE ALLOWABLE TOLERANCE FOR BASE ROCK WIDTHS IS
3 INCHES; HOWEVER, DO NOT PLACE TWO OR MORE CONSECUTIVE BASE ROCKS WITH A WIDTH LESS THAN SPECIFIED ON THE PLANS. SLOPE THE TOP SURFACE OF EACH ROCK TOWARDS THE BACK OF THE BOULDER WALL AT AN
INCLINATION OF AT LEAST 5 PERCENT. THE MINIMUM BOULDER WALL THICKNESS IS BASED ON MINIMUM BASE ROCK WIUTH, AS SPECIFIED ON THE PLANS, AND ALLOWABLE FACE BATTER. THE REQUIRED MINIMUM FACE BATTER IS 10
DEGREES. SECURELY PLACE FACING ROCKS SO THAT THE ROCKS ARE UNABLE TO BE MOVED WITH A PRY BAR AFTER THE BOULDER WALL IS COMPLETE.
(C) VOIDS: WHERE VOIDS WITH A MINIMUM DIMENSION OF 6 INCHES OR GREATER EXIST IN THE FACE OF THE BOULDER WALL, CHINK THE VOIDS WITH SMALLER ROCK.
(I) IF THERE IS NO ROCK CONTACT WITHIN THE BOULDER WALL THICKNESS, CHINK THE VOID WITH A SMALLER PIECE OF ROCK.
(2) CHINKING ROCKS SHOULD NOT PROVIDE PRIMARY STRUCTURAL SUPPORT FOR THE OVERLYING ROCK.
(3) CHINKING ROCKS SHOULD NOT BE ABLE TO BE MOVED OR REMOVED BY HAND AFTER BOULDER WALL IS COMPLETE. RESET LOOSE CHINKING ROCKS UNTIL SECURELY PLACED OR GROUTED IN PLACE. DO NOT ALLOW GROUT TO BE
READILY VISIBLE FROM THE FACE OF THE BOULDER WALL.
(D) BOULDER WALL AGGREGATE: INSTALL AGGREGATE, CONSISTING OF 3/4� TO I I/2" CLEAR CRUSHED A6GREGATE (NO PEA GRAVEL), BETWEEN THE BOULDER WALL AND THE BACK CUT FACE BEING SUPPORTED. THE AGGREGATE
LAYER SHALL 8E TO THE DIMENSIONS SHOWN ON THE PLANS, WITH A MINUMUM DEPTH OF 12 INCHES. PLACE AGGREG��TE CONCURRENT WITH BOULDER WALL SO THAT AT NO TIME IS EITHER MORE THAN 12 INCHES HIGHER THAN THE
