You are correct,we do have the signed escrow agreement and money and I just received a copy of the signed building
permit application,thank you.
Also, according to IRC R311.4.3 a landing is required outside the patio door, minimum of 3'x 3' unless the door opening
is wider. I will note this on the building permit application and it must be installed and shown on the as-built survey.

Building Permit Application. Please have the property owner sign the building permit application. A copy of the

signage is required. Please purchase and install a minimum of two (2) City of Orono wetland signs from the City and post
on the edge of the wetland buffer impact area.
Escrow & Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of an
escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-
pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City
Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is$2,500. The
escrow agreement is enclosed. The property owner must sign the escrow agreement and submit a check for$2,500.
Your project may trigger the Minnehaha Creek Watershed District's (MCWD) permitting requirements; please contact
the MCWD directly at 952-471-0590 regarding your project. Please note, the City of Orono will not issue a building

ORONO, a Minnesota municipal corporation ("City')and L.�r� D w,oZr��,�.S ("Owners").
Recitals
1. Construction of the new residence located at 2385 Glendale Cove Ln, the ("Subject
Property"), legally described as: Lot 10, Block 1, Glendale Cove, in Orono, Hennepin
County Minnesota, is the subject of building permit number #2014-00112 has been
completed.
2. Winter conditions currently prohibit completion of exterior improvements, final grading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners request the City issue a temporary certificate of occupancy ("TCO") to the
Owners so that the Owners may occupy the new residence.
4. The City will issue a TCO only if the Owners establish an escrow to ensure completion of
exterior improvements, continuation of erosion control and submittaf of an as-built survey
to the City.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $10,000 with the City. All accrued interest, if any, shall be paid to
the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to assure completion of any
exterior improvements, final grading, establishment of vegetation as well as guarantee reimbursement to
the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of
$500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners would be responsible for under a building permit application. The escrow will
also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that
the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of
Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any
hazardous conditions associated with the work and to repair any dfimage to public property or
infrastructure that is caused by the work (including planning, engineering, or legal consultant review)
associated with building permit #2014-00112 if compliance with the approved building permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will
in turn send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of
the Owners'receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners
pay all expenses invoiced pursuant to#3. The City may draw from the escrow account without further approval
of the Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to
the Owners when all requirements related to the project are complete. City Staff shall review the terms of
this escrow agreement two times per year to determine whether the requirements of the project have
been successfully completed and whether it is appropriate to return the funds. Owner may also request
the release of the funds, and such funds shall be released upon City Staff receiving the appropriate
verification that all requirements of the project have been successfully completed.

6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the
unpaid balance to the subject property pursuant to Minn. Stat. §§415.01 and 366.012.
7. ACCESS TO SUBJECT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contractors, the right to enter upon the subject property for the specific purpose
of inspecting and completing any exterior improvements, final grading, estabiishment of vegetation and
the restoration of the subject property should the Owners not complete the work by the specified dates.

2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:

Per our telephone conversation attached is the zoning permit application needed for a proposed patio
project on your property.
Also per our discussion, a temporary certificate of occupancy (TCO) was issued for your home (copy
attached), but not a final certificate of occupancy. An as-built survey was submitted and it was noted at

' � that time the a swale on the east side of the property was not graded as proposed, therefore a final
certificate of occupancy could not be issued due to this unresolved issue. City staff will be meeting with
Matt from LDK on site on tomorrow(Wednesday,April 22"d) to discuss the swale requirement. Please
note, according to the TCO, all exterior improvements must be completed by June 1, 2015.
The City engineer's initial review of the survey noted the pink hashed area was wetland buffer, which
was incorrect. Attached is a colored copy of Glendale Cove subdivision which shows the area in pink in
wetland buffer. This pink area should shown on the survey as wetland buffer. The red hashed area on
your survey may be lawn. The Minnehaha Creek Watershed District (MCWD) is copied on this email and
may inspect the property and may notify you where the wetland buffer signage is to be located. Contact
them directiy at 952-471-0590 to resolve the sign location issue. Once the signs are installed per the
MCWD's requirement, please have the survey updated to show the correct wetland buffer area, signage
location and swale once installed.

An updated as-built survey was submitted and approved, thank you. In the process of issuing the final certificate of
occupancy and refunding the escrow money I found the following permits need inspections:

Per our telephone conversation attached is the zoning permit application needed for a proposed patio project on your
p ro pe rty.
Also per our discussion, a temporary certificate of occupancy (TCO) was issued for your home (copy attached), but not a
final certificate of occupancy. An as-built survey was submitted and it was noted at that time the a swale on the east
side of the property was not graded as proposed,therefore a final certificate of occupancy could not be issued due to
this unresolved issue. City staff will be meeting with Matt from LDK on site on tomorrow (Wednesday,April 22"d)to
discuss the swale requirement. Please note, according to the TCO, all exterior improvements must be completed by
June 1, 2015.
The City engineer's initial review of the survey noted the pink hashed area was wetland buffer,which was incorrect.
Attached is a colored copy of Glendale Cove subdivision which shows the area in pink in wetland buffer. This pink area
should shown on the survey as wetland buffer. The red hashed area on your survey may be lawn. The Minnehaha Creek
Watershed District (MCWD) is copied on this email and may inspect the property and may notify you where the wetland
buffer signage is to be located. Contact them directly at 952-471-0590 to resolve the sign location issue. Once the signs
are installed per the MCWD's requirement, please have the survey updated to show the correct wetland buffer area,
signage location and swale once installed.
