Hi Melanie,
I just wanted to let you know that we will be moving the deck as soon as the ground thaws out and the can dig
new footings. I appologize for this taking so long, but where in the process of talking with an attorney to see if
we could take legal action on who the liable party was for this mistake. In the end, it would cost us more to go
that route than to just move the deck.
Pll keep you posted as I hear more from the deck contractor.

The deck encroaches into the setback. I do not have the ability to approve/accept an as-built plan that does not conform
to the setbacks without the Council's approval of a setback variance.
The City asked for but did not require an updated survey for just the deck construction part of the project as the survey
for the home construction was very recent. Your permit application contained a sketch of the proposed deck on a reduced
copy of the approved home permit survey. You could have chosen to re-survey and stake the proposed deck as is always
recommended, however this deck was permitted based on the best information (existing survey and deck plans) to save
you the cost of additional survey work. As part of the construction project the setbacks should have been staked on site
prior to construction to assure no encroachments.
I'm happy to work toward a solution on this issue with you.

Attached is a revised as-built survey that I wanted to show you that has the correct deck measurement of 12
feet from the back of the house. The builder will be submitting the official as-built with some other small
revisions later. But I wanted to discuss the deck with you again. The previous survey showed 12.6 feet which
you explained was the issue before because it did not match the as-builtsurvey. The deck plans that were
submitted (also attached) indicated 12 feet from the back of the house which now matches the attached
revised survey. With this update, the deck is 14 inches in the setback. Please call me at 651-253-7911 at your

Hello,
An as-built survey was submitted and a site visit was performed. The inspector has the following comments:
• The approved plan and the as-built plan show a swale between the garage and the east property line. There
is no swale on the east side and the grade and down spout drain to the neighboring property.
• The as-built does not indicate the existing swale to the west of the home. The swale is acceptable, but needs
to be shown on the as-built. The down spout on the west side should be directed to the swale.
• The retaining wall is over 4' tall and must be approved by a registered professional engineer.
• The deck corner is encroaching in the wetland setback.
Please have the above corrected and re-submit an as-built survey for our review and approval.

Attached is a revised as-built survey that I wanted to show you that has the correct deck measurement of 12
feet from the back of the house. The builder will be submitting the official as-built with some other small
revisions later. But I wanted to discuss the deck with you again. The previous survey showed 12.6 feet which
you explained was the issue before because it did not match the as-builtsurvey. The deck plans that were
submitted (also attached) indicated 12 feet from the back of the house which now matches the attached
revised survey. With this update, the deck is 14 inches in the setback. Please call me at 651-253-7911 at your

The permit for this deck was applied for in June, 2013. The plans were reviewed and approved by the
city and the permit was issued on June 21 st. The deck was built and inspected and passed final
inspection on July 1st. This email is just being received right now???? I am not sure why this email is
being sent right now after the deck has already been approved, built and passed inspection.
