WHEREAS,the City of 4rono(hereinaftez the"CitY"}is a municipal corporatioil
o���eci and e�isting under the laws of the State of Minn.esota; and
yVTiEgEAS, the City Council of the City of�rono (hexeinafter "City Counci,l")
has adopted lanr� development regulations for the orderly, economic and safe development of
1at�d withi�the City; and
WHEREAS, Bohland Development, Inc. (hereinafter the "Developer") has an
interest in the properties at i90 Willow Drive North a.nd 177 Glendale Drive Iegally desoribed in
Exhi.bit A�ttached hereto (hereinafter the"Property"); and
WHEREAS, the City Council has considered the application by the Develoger
for rezozv.i�zg af portions of the Property to RPUD - Residential Planned Unit Developrnent as
well as subdivision and development of the Property by the Planned Unit Development (PUD}
process; and
i�VIiEREAS, on February 13, 2006 the City Coun.cil adopted Resolution No.
5420 granting General Concept Plan Approval for the proposed development, which approv�l
includes the following elements:
1. Subdivision platting of the Property to create eight developable single fami�y residential
building lots to be servec3 by a new public road, as well as two additional lots
encompassing the existing residence at 190 Wil.low Dxive North and the existing church
at l77 Glendale Drive,to be designated as Lots 1 thxough 10;
2. Rezoiung af Lot 1 and Lots 3 through 10 from RR-1B Single Famiiy Rural Residential
District to RPUD Residential Planned Unit Developznent Distri.ct;
3. PUD conditions for development o€single family residences oi1 Lots 3 throngh 10; and

W�EREA5, the Develaper has a.greed to execute the Planned Unit Developmeut
No. 5 Agreement providing for the instatlation of certain im�rovenzents as a coi�dition of site
plan approval for the construction of certain public and private improveme�ts on the ProperCy,
axad which Agreement documents the general a�id detailed conditions for development and use of
tlie Property; and
WHEREAS, the Dev�Ioper has agreed to construct a public road and muuicipal
sewer and water faciJities to be turned over to the City upon satisfactory conlpletion, and to grant
public easements to the City over the proposed trails to be constructed by the developer or by the
City withu�the Property; and
WHEREAS, the Developer has completed or kas agreed to complete all otller
requirements of the Zoning Code, platting ordi.nances and reiated Ordinances of the City
including:
1. Coinpletion of all platting requirements of Resolution No. 5420.
2. Dedicatian on the plat of Draiilage and Utiiity Easemeats.
3. Submittal of Minnehaha Creek Watexshed District(MCWD)permit approving the
grading and stormwater manageznent facilities plan for the development of the
Property as proposed per the approved Grading, Draina.ge and SWPP Plan as
noted herein.
4, payment to the City of Stonnwater and Drainage Tru�alc Fees for the devetopment
of the Property in the amount of$23,944.00 as established in General Concept
Plan Approval Resolution No. 5240.
5. Payn�ent of a Park Dedicatioil Fee in the amo�.u�.t of$44,400.00 as esta.blished in
General Conce�rt Plan Approval Resotution No. 5420.
6. payment to the City fax the legal review and filing af the plat agreemcnts,
easements and covenants in.the amount of$250.00.
�'. Payme�2t of the final plat fee in the amount of$280.OU.
8. Granting to the Ci#y of public easements aver praposed trails within the Property;

WI�EREAS, City staff and conslzltants have reviewed the plans for this PUD
application and hereby spe�ify ap�roval of esch attached plan and identify them as part of the
official record for Plazmed Unit Development No. 5:
1. Approva.l of site plan and grading/drainage plans per the "Grading, Drainage and
Stormwater Pollution Prevention Pian" dated May 11, 2006 subject to any
additional requirements of the MCWD aru2 subject to the additional requirements
and aonditions specified by the City Engineer in his letter dated June 12, 2�06.
2. Approval of road a�d storm sewer plans per tlie "Road & Storm Sewer Plan 8z
Profile" dated May 11, 2046 subject to the additaonal requirements aizd conditions
specified hy the City Engineer in his letter dated June i2,2006.
3. Approval of municipal sewer and water plans per the "Water and Sauitary Sewer
Pian & Profile" dated May I l, 2006 subject to the additional requirements and
conditions specif ed by the City Engineer in his lettex dazed 3une I2,2006.
4. Ap�roval of site landscaping per the "Landscaping Plaii" dated May 11, 200b
� §ubject tQ incorporation of addifiianal site preparation, plantings and maintenance
in complia.nce with the "Ecological Restoration & Managernent Program for
Giendale Cove"by AES, Inc. dated May 26, 200b.
N4W, THEREFORE, BE TT RESOLVED that based on �11e findings of
Resolution No. 5424, the City Counci.l of the City of Orono does hereby approve the plat of
GLENDALE COVE, Heru�epin County, Minnesota and does hereby grant General Development
Plan Appxovar far Planned Unit Development Na. 5, subject to the following conditions:
l. Genaral Development Plan Approva.l is granted subject to conditions established
within Resolution No. 5420 and subject to the condifiaons established withiii the
Planned Unit I�e�velapment TIo. 5 Agreement and other pertinent docurnents.
2. Upon the fina� approval and execution of this resolution and th� Planned Unit
Development No. S Agreem.ent, the City Councii shall formally approve an
ordinance amendi.ng the official Zoning map of the City to rezone Lot 1 and Lots
3 through 10 from RR-1B Single Pamily Rural ResidentiaI District to RPUD
Residential Flanned Unit Development District, and amending the Orono Zoning
Coda by adding language establzshing Planned Unit Development No. � to
include the Property.

said Agreemant as nu11 and void.
6. The aforesaid plat sTza].I be�led with th.e He�nnepin Couniy on or befoze Decernber
2b, 2006 toeether with a cextified oribinal copy of this resolu,tioz� aud executec�
copies of the AprEemezx�s, easements, and coven,anrs pertinent thereto. The plat
approval granted by this Resolution sha]1 expzze if the plat has not been filed b�r
the date specified abo�e. In that event, it will be aecessax�' to f le a �aew
applxcation with tlie Czty of 4rono for subdivision review.
