WHEREAS,the City of Orono(hereinaftez the"City")is a municipal corpora.tion
orgaruzed and e�isti.ng under the laws of the State of Minnesota; and
WHEg,�AS, the City Council of the City of Orono (hereinafter "City Councii'�
has adopted land development regulations for the orderly, economic and safe development of
laud withi.�the City; and
WHE�tEAS, Bohland Development, Inc. (hereinafter the "Developer") has an
znterest in the properties at 190 Willow Drive North a.nd 177 Glendale Drive Iegally descxibed in
Exhfbit A attached hereto {hereinafter the"Property"); and
`VVHEYtEAS, the City Council has considered the application by the Develoger
for rezoni.z�zg of portions of the Fraperty to RPUD - Residential Plaxin:ed Unit Developrnent as
well as subdivision and developx�ent af the Property by the Planned TJnit Development (PUD}
process;and
'WHEREAS, on k'ebniary 13, 2006 the City Council adopted Resolutioa No.
5420 granting General Concept Plan Approval for the proposed development, which approval
includes the followi.ng elernents:
1. Subdivision platting of the Property to create eight developable single faxnzly residtntial
building lots to be served by a new public road, as well as two additional lots
encompassing the e�sring residence at 19Q Willow Drive North and the existing church
at l 77 Glendale Drive,to be designated as Lnts 1 through 10;
2, Rezoiung of Lot 1 and Lots 3 through 10 from RR-1B Single Family Rural Residential
District to RPUD Residential Planned Unit Developmerzt District;
3. PUD conditions for development o€single family residences oi1 Lots 3 thxough 10; and

`VVHEREAS,the Develaper has agzeed to execute the Planned Unit Development
No. 5 Agreen�ent providing for the in.stallation of certa.in improvements as a coi�dition of site
plan approval for the construction of certain public and private improvexz�e�ts on the Property,
aud which Agreement documents#he general a�.�,d detailed conditions for developznev.t and use of
tlle Property; and
WHEREAS, the Dev�Ioper has agreed to constxuct a public road and muuicipal
sewer and water facilities to be tarn.ed over to the City upon satisfactory conlpletion, and to grant
pu.blic easements to t�ie City over the proposed trails to be constructed by the developer or by the
City withiiY the Pxoperty; and
WHEREAS, the Developer has completed or has agreed to complete a11 other
r�uixements of the Zoning; Code, platting ardinan�es and related Ordinances of the City
includinb:
1. CoinpYetion of all platting requirements of Resolution No. 5420.
2. Dedicatian on the plat of Draivage�nd Utility Easements.
3. Submittal of Minnehaha Creek Watershed District(MCWD}permit approving the
grading and stormwater maxiagement facilities plan for the development of the
property as proposed per the approved Grading, Drainage azid SWPP Plan as
noted herein.
4, payment to the City of Stonnwater and Drainage Trw�lc Fees for the development
of the Property in the amoux�t of�23,940.00 as established in Genezal Concept
Plan Approvat Resolutirnn No. 5240.
5. Fayn�ent of a Park Dedicatioi� Fee in the amo�arlt of$44,400.00 as established in
General Concept Plan Approval Resolution No. 5420.
6, Payment to the City for the Iega1 review and filing of the plat agreemcnts,
easements and covenants in the amount of$250.00•
7,. Payme�7t of the final plat fee in the amount of$28Q.00.
8. Granting to the City of public easements over proposed trails within the Property;
and

WHERE.A.�, City staaFf and consultants have reviewed the plans for this PUD
application a.nd hereby specify appraval of each attached plan and identify them as part of the
official recozd for�lanned Unit Development Na. 5:
1. Approval af site plan and grading/drainage plans per the "Grading, Drainage and
Stormwater Pollution Prevention P3an" dated May 11, 2006 subject to any
additional requirements of the MCWD and subject ta tlie additional requirements
and conditions specified by the City Engineer in his letter dated June 12, 2006.
2. Approval of road a�,d storm sewer plans per tl�e "Raad & Stozzn Sewer Pian &
Prof le" dated May 11, 2006 subject to the additional requirements a��d conditians
speci�'ied by the City En.gineer in his letter dated 3une 12,2006.
3. Approval of municipal sewer and water plans per the "Water and Sauitary Sewer
Plan & Frofile" dated May 11, 2006 subject to the additional requirements and
conditions specified by the City Engineer in his letter dated June 12, 2006.
4. Approval of site landscaping per the "Landscaping Plaix" dated May 11, 2005
� �ubject ta incorporation of additional site preparation, plantings and maintenance
in complia.nce with the "Ecological Restoration & Managernent Program for
Glendale Cove"by ABS, Inc. dated May 26, 2006.
NUW, THEREFORE, BE TT RESOLVED that based on tlle findings of
Resolution No. 5424, the City Council of the City of Oxono does hereby approve the plat of
GLENDA.L.E COVE, Hennepin County, ?vlinnesota and does heraby g�ant General Developrnent
Plan Approval far Planned Unit Development No. 5, subject to fhe following conditions:
i. General Development Plan Approval is granted subject to conditions established
within Resolution No. 5420 and subject to the conditions established withizl the
Planned Unzt Development No. 5 Agreement and other pertinent documents.
2. Upon the finat approval and execution of this resolution and tki� Planned Unit
Development No. 5 Agreemex�t, the City Councii si�all formalty approve an
ordinance amending t�ie offieial zoning map of the City to rezone Lat 1 and Lots
3 through 10 from RR-1B Single Family Rural Residential District to ItPUD
Residential Planned Unit Development District, and amending the 4rono Zaning
Code by adding langua.ge establ'zshing Planned Unit Development No. 5 to
include the Property.

�'UT� No. 5 as set far�h in,the Planned Unit DeveXopment No. 5 Agreement, th.e
Ci.ty Council may declare t�ie approvals granted witlun this resolution and withz�z
said Agreemen�as null and void.
6. The aforesaid plat sllall be fzlad with the Hennepin Couniy on or b�fare December
2b, 2006 together with a certified oribinal copy af this resolutioz� and execuied
copies of the Aar��mezxts, easements, and coven.ants pertinent thereto. The plat
approval granted bsr this Resolution shall expize if the plat has not been filed b�r
the date specified above. In that event, zt 'c�'ill be necessax�' to f le a aew
application with the Czty of Orono for subdivision review.
7. The ap�rovals �ranted in this Resolu�ion shall z�ot become effective until sucb,
time that tkae Developer successfizlly completes purchase and provides suztable
evidence of o'wnership o�'the Properiy (wxth�Iie e�cept�on o�'Lots 1 and 2 which
will reznain in separate ownership).
