'WHEREAS, on FebruarY 13, 2006 the City Council adopted Resalution No.
5420 grantiug C'reneral Concept Plan Approval for the proposed development, wbich approval
includes the following elements:
1. Subdivision platting of the Property to create eight developable single family residtntial
bui.lding lots to be served by a new public road, as well as two additional lots
encompassing the existing residence at 190 Willow Drive North and the existing church
at ]77 Cslendale Drive,to be designated as Lots 1 thxough 10;
2. Rezoiiing of Lot 1 and Lots 3 through 10 from RR-1B Single Family Rural Residential
District to RPUD Residential Planned Unit Development Distri.ct;
3. PUD conditions for development of single family residences oi�.Lots 3 through 10; and

No. 5 Agreement providing for the insta.Ilation of certain improvements as a coi�dition of site
plan approval for the construction of certain public and private impraveme�ts on the Property,
ax�,d which Agreement documents the general aiid detailed conditions for developineut axid u.se of
tlie Property; and
WHEREAS, the Developex has agreed to construct a public road and muuicipal
sewer and water facilities to be turned over ta the City upon satisfactory conlpletion, and to gant
public easements to the City over the proposed trails to be constructed by the developer or by the
City withn�the Property; and
WHEREAS, the Developer Yias completed or has agreed to complete all otller
requirements of the Zoning Code, plattin� ordinauces and related Ordinances of the City
zncluding:
I. Coinplation of a11 platting requirements of Resolution No. 542Q.
2. Dedication on the plat of Drainage and Utility Easexnents.
3. Submittal of Minnehaha Creek Watershed District(MCWD)permit approving the
grading and stormwater management facilities plan for the development of the
Property as proposed per the approved Grading, Draina.ge and SWPP Plan as
noted herein.
4, payment to the City of Stonnwater and Drainage Trw�lc Fees for the development
of the Property in the amount of$23,944.04 as established in General Concept
Plan Approva.t Resoiution No. 524Q.
5. Payment of a Park Dedicatioil Fee in the amo�znt of$44,400.00 a.s esta.blished in
General Coneept Plan Approval Resolution No. 5420.
6. Payment to the City far the legal review and filing of the plat agreemcnts,
easements and cavenants in the amount of$250.00.
7. Paymei2t of the final plat fee in the amount af$280.40.
8. Crranting to the City of public easements over proposed trails within the Property;

WHEREA55, City staff and consultants have reviewed the plans for this PUD
application and hereby specify approval of esch attached plan and identify th�m as part of the
official record for Pianned Unit Development No. 5:
1. Approva.l af site plan and grading/drainage plans per the "Grading, Drainage and
Stormwater Pollution Prevention Pian" dated May 11, 2006 subject to any
additional requirements of the MCWD and subject to the additional requirements
and aorid'ztions specified by the City Engineer in his lettear dated June 12, 2006.
2. Approval of road arid storm sewer plaas per tl�e "Road & Storm Sewer Plan &
Profile" dated May l 1,2046 subject to the additional requirements a�zd conditions
specified hy the City Engineer in his letter dated June 12,2006.
3. Approval of municipal sewar and water plans per the "Water and Sauitary Sewer
Plan & Pro�ile" dated May I1, 2006 subject to the additional requirements and
conditions specified by the City Engineer in his letter dated 3une I2,2006.
4. Ap�roval of site landscaping per the "Landscaping Plai�" dated Ma� 11, 2006

in compliance with the "Ecological Restoration & Management Program for
Giendale Cove"by ABS, Inc. dated May 26, 2006.
NOW, THEREFORE, BE YT RESOLVED that based on �11e findzngs of
Resolution No. 5420, the City Council of the City of Oxono does hereby approve the plat of
GLENDALE COVE, Hennepin County, Minnesota and does hereby grant General Development
Plan Approval fox Planned Unit Development Na. �, subject to the following conditions:
l. General Development Plan Approva.l is granted subject to conditions established
within Resolution No. 5420 and subject to the conditions established withi� tlze
Piannad Unit l�e�velopment No. 5 Agreement and other pertinent documents.
2, Upon the final approval and execution of this resolution and the Planned Unit
Development Na. 5 Agreement, the City Councii si2all formally appxove am
ordinance arnending the official zoning map af the City to rezone Lot 1 and Lots
3 through 10 from RR-1B Single Family Rural ResidentiaI District to RPUD

copies of�he Agr�emez�,ts, easements, and co��en.ants pertinent thereto. The plat
s.�proval granted bq this Resolution shall expize if the �plat has not been filed bsr
