Exhfbit A atta.ched hereto (hereinafter the"PropertY")� a�'d
WHEREAS, the City Council has considerec� the application by the Develoger
for rezoz�i�g af portions of the Froperty to RPUD - Residential Planned Unit Development as
well as subdivision and development of the Property by the Planned t.7nit Development (PUD}
proaess;and
WHEREAS, on Februaz'y i 3, 2006 the City Council adopted Resolution No.
5420 granting General Concept Plan Approval for the proposed development, wbich approval
includes the following elernents:
1. Subdivision platting of the Property to create eight developable single family residential
building lots to be served by a new public road, as well as two additional lots
encompassing the existing residence at 190 Willow Drive North and the existing church
at 177 Glendale Drive,to be designated as Lots 1 thxough 10;
2. Rezoiung of Lot 1 and Lots 3 through 10 from RR-1 B Single Family Rural Residential
District to RPUD Residential Planned Unut Development District;

W$EREAS,the Develaper has a.greed to execute the Planned Unit Development
No. 5 Agreement pravzding for the instatlation of certain improvements as a coi�ditian of site
plan approval for the construction of certain public and private improvemeuts on the Property,
aa�d which Agreement documents the general a�id detailed conditions for develop�neut and use of
tlie Property; and
WHEREAS, the Dev�Ioper has agreed to construct a public road and muuicipal
sewer and water facilities to be turned over to the City upon satisfactory conlpletion, and to grant
public easenients to the City over the proposed trails to be constructed by the developer or by the
City withul the Property; and
WHEREAS, the Developer has completed or has agreed to complete all otlier
requisements of the Zoning Code, platting ardi.nan�es and related Ordinances of the City
including:
1. Coinpletion of�.1 platting requirements of Resolution No, 5420.
2. Dedication on the plat of Draiilage and Utility Easements.
3. Submiital of Minnehaha Cr�ek Watershed Distric#(MCWD}per�it approving the
grading and stormwater management facilities plan for the develapment of the
Property a.s proposed per the approved Grading, Drainage a�ad SWPP Plan as
noted herein.
4. Payment to the City of Stonnwater and Draanage Tru��lc Fees for the development
of the Property in the amount of�23,944.00 as established in Genezal Concept
Plan Appxoval Resolutiozi No. 524Q.
5. Payment of a Park Dedication Ree in the amo�znt of$44,400.00 as esta.blished in
General Concept Plan Approval Resolution No. 542Q.
6. Payment to the City for the Iegal review an,d filing af tb.e plat agreements,
easexnents and covenants in the amount of�250.00.
7'. Payznent of the final plat fee in the amount of$280.00.
8. Granting to the City of public easements over praposed trails within t3ae Property;

WHEREA�S, City sta�Ef and consultants have revi�wed the plans for this PUD
application and hereby speci�y appraval of each attached plan and identify them as �art af#he
offici�I recozd for Planned Unit Develapment No. 5:
1. Approval of site plan and grading/drainage plans per the "Grading, Drainage and
Stormwater Pollution Preven�ion Pian" dated May 11, 2006 subject to any
a.dditional requirements of the MCWD ancl subject ta the additional requirements
and conditions specified by the City Engineer in his lettex dated June 12, 2�06.
2. Approval of road and storm sewer plaas per tlae "Road & Storm Sewer Plan &
Profile" dated May 11, 2006 subject to the additional requirements aiid conditions
speci�ied by the City Engineer in his letter dated June 12, 2006.
3. Approval of municipal sewer and water plans per the "DJater and Sau:itary Sewer
Plan & Frofile" dated May I l, 2006 subject to the additional requirements and
conditions specified by the City Engineer in his letter dated 3une I2,2006.
4. Approval of site landscaping per the "Landscaping Plai�" dated Ma� 11, 2006
� �ubject ta incorporation of additional site preparation, plantings and rnaintenance
in compliance with the "Ecological Restoration & Management Prograrn for
Glendale Cave"by AES, Inc. dated May 26, 2006.
N�W, THEREFORE, BE IT RESOLVED that based on �1ie findings of
Resolution No. 5420, the City Council of the City of Orono does hereby approve the plat of
GLENDALE COVE, Hennepin County, Minneso�a and does hereby grant General Development
Plan Approval for Planned Unit Development Na 5; subject to the followusg conditions:
4. General Development Plan Approva.l is granted subject to conditions established
within Resolution No. 5420 and subject to t}ze conditions established withi� the
Planned Unit I)e�velopznent No. 5 Agreement and other pertinent documents.
2, Upon the finaJ. approval and execution of this resolution and th� Planned Unit
Development No. 5 Agreem,ex�t, the City Council shall formatly approve an
ordinance asnending the official zoning map of the City to rezone Lot 1 and Lots
3 through 10 from RR-1B Single Pamily Rural Residential District to RPUD
Residential Flanned Unit Development District, and amending the �rono Zoning
Code by adding language establzshing Planned Uzut Development No. 5 to
include the Property.

couf'ormity with the Plaz�i,ed Unit DevelopmEnt No. 5 A.�reement. Any proposed

said Agr�emerzt ma� be made only afier a public hearing cozaducted by the
Council. Ax�y cb.anges shall be recorded as azz�.endments io the zecorded copy of
the fu1a1 develop�nent plan.
5. If substantial development has not occurred within o�ie year a�fter approval of
P�JD No. 5 as set farth in. the Planned Unit ;Development No. 5 Agreement, t.he
City Council may declare t�ie approvals grazlted witlun this reso�utzon and withzr�
said Agreement as null and void.
6. The aforesaid plat slzall be�led with the Hennepin Cot�xiiy on or befoxe December
26, 20d6 together with a cextified original copy of this resolu�ioz� aud execuied
copies of the Agr�emez�,ts, easements, and coven,ants pertinent thereto. The plat
a�provai granted by this Resalution shall expize if the �plat has not been filed b�r
the daie specified abo�e. In that event, it 'c�ill be necessax�' to f le a new
application witk tise City of Orono for subdiv'ision review.
7. The ap�rovals granteci in this Resolu�ion shall zzot become effect�ve ttntil sucb.
