Per our conversation today, the 3-10-15 survey had the FFE at 1008.6 and in performing our number of stories
calculation, it was a three-story house so we told them to revise the survey and/or the plans. They revised the survey
and lowered the home one foot. In Adam's absence, will you please review to make sure a walk-out home and the
grading still work?

It appears that the lower level of the home (not including the unexcavated garage area) is classified as a��story"and not
a��basement"as is needed; you have a 3-story home where 2�/z stories above a basement is the maximum permitted.
Based on my analysis the perimeter of the lower level is 188.6 linear feet. The first floor elevation is shown as 1008.6'
which results in the 1002.6' being the determining elevation 6 feet less (see below definitions). My calculation of the
portions of the lower level at 6'or more below the first/main floor is t82.1 linear feet or 43% where more than 50% is
required.
I believe if you lower the house and/or first floor elevation (FFE) at least 1 to 1 �/z feet the lowest level would meet our
definition of a basement and not be considered a story. Please modify the proposed house elevations and/or house plans
and resubmit two copies for our review. Attached is our information sheet on building height.
Definitions City Code 78-1
Basement means that portion of a building that is partiy or completely below the existing ground level. A basement shall be
considered as a story for purposes of determining the number of stories in a building, when the finished surface of the floor
above the basement is more than six feet above the existing ground level for more than 50 percent of the basement's perimeter.
The perimeter of the basement does not include portions of the house or garage that do not have a lower level but are merely
"unexcavated". Artificially raising the grade adjacent to the foundation of a structure (by filling or by a combination of filling
and retaining walls)above the surrounding natural terrain shall not be allowed as a method for converting a defined story to a
defined basement, regardless of any other benefits to the property of such action. Finished grade that increases more than one

such action merely restores a previously excavated site to its original natural grade may used as a method for converting a
defined story to a defined basement.
Building height means the vertical distance between the highest adjoining ground level at the building or ten feet above the
lowest ground level, whichever is lower, and the top of the cornice of a flat roof, or the deck line of a mansard roof, or the
uppermost point on a round or other arch-type roof, or the median height of the highest gable of a pitched or hipped roof.
Topographic changes which elevate the adjoining ground level above the existing terrain shall not be considered in determining
building height. For a pitched or hipped roof situation, regardless whether the highest living space in a building is a half-story or
full story,if the highest living space contains windows(excluding skylights)the upper measuring point far defining building
height shall be the median height of the top of the highest window and the highest peak of the roof.
Half story means the uppermost floor of a building in which(i)the intersection of the exterior wall and the roof is not mare than
three feet above the floor elevation, and(ii)not more than 60 percent of the floor area within the exterior walls of the uppermost
floor exceeds five feet in height as measured from the floor to the rafters. Floors exceeding these parameters shall be deemed a
full story.

On February 27, 2015 the City received a building permit application for a new single family home at 2335 Glendale
Cove Lane. Staff conducted a preliminary review based on the information provided and recommends the following
items be submitted or revised in order for your application to be considered complete and for the plan review to
continue:
1. Certificate of Survey. The City Engineer has reviewed the survey and made the following comments. Please
provide two copies of an updated,full size certificate of survey which meets all of the City's survey standards
(enclosed)addressing the comments below.
a. Proposed grading plans should be indicated with directional arrows of proposed surface drainage
(1' contours on lakeshore properties, 2' on all others). The source for all topography must be
indicated on the survey. Provide additional contour intervals as needed in flat areas to show
drainage patterns.
b. Existing topographic contours must extend 50' outside of lot lines on all lots.
c. As drawn the survey appears to depict proposed grading beyond the erosion control measures and
beyond the property boundaries.
d. It appears that existing topography is not depicted.
e. Please correctly label the 35'wetland buffer(incorrectly labeled euffer Impact Setback
Also a portion of the silt fence is located in the drainage and utility easement, please move the silt fence
location out of the drainage and utility easement. You should coordinate with the Minnehaha Creek
Watershed District to obtain Wetland Buffer signage, discuss signage placement and show it on the survey.
2. Floor Area Ratio (FAR) Calculation. The square footages shown on the survey don't match the square
footages shown on the building plans. Please correct and resubmit.
PLEASE NOTE, NEW 2015 PERMIT REQUIREMENT: Prior to the commencement of a� exterior/landscaping

Recitals
1. A building permit application has been filed for �'�''�'�`�`�`� �f�� `�`/�''~�dj^5<��-located at
the ("Subject Property"), legally described as

2. Owners request the City to review this application which requires City approval and may require
consultant legal and/or engineering review.
3. The City will commence its review of the application and incur costs associated with said review only if
the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement,
the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to reimburse the
City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all
out-of-pocket costs the City has incurred {including planning, engineering, in excess of $500, or legal consultant
review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be
responsible for under a building permit application. The escrow will also guarantee reimbursement to the City for all
out-of-pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater
Pollution Prevention Plan and the prov.isions of Orono City Code Chapter 79. The financial security may also be used
by the City to eliminate any hazardous conditions associated with the work and to repair any damage to public property
or infrastructure thaj,is� used b the work (including planning, engineering, or legal consultant review) associated with
building permit#��'� ����/ if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send
a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment to the
City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses invoiced
pursuant to#3. The City may draw from tbe escrow account without further approval of the Owners to reimburse the City for
eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners
when all requirements related to the project are complete. City Staff shall review the terms of this escrow agreement
two times per year to determine whether the requirements of the project have been successfully completed and
whether it is appropriate to return the funds. Owner may also request the release of the funds, and such funds shall be
released upon City Staff receiving the appropriate verification that all requirements of the project have been
successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible
expenses incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance
to the ec perty pursuant to Minn. Stat. §§ 415.01 and 366.012.
