THIS INDENTURE,made this �`�ti day of August, 2006, by and between Caivin
Presbyteria.n Church of C7rono, a Minnesota nonprofit corporation, hereinafter referred to as .
"Grantor", and the City of Orono, a municipal corporation,hereinafter referred to as "Grantee".
WITNESS, that Grantor, in consideration of the sum of One Dollar ($I.QO) and �
other good and valua.ble consideration given by Crrantee, the receipt of which is acknowledged by
Crrantor, does hereby grant, bargain, sell and convey to Grantee, its successors and assigns, a
*- perpetual easement for pubiic ingress, egress, and access for pedestrian trail purposes and uses,
including the right to construct and maintain the same, together with the right of the public for
access over, above, under and across the land loca.ted in the State of Minnesota, County of �
Hennepin, legally described as follows:
[See attached Exhibit A which is made part af this document]
including, but not by way of limitation, a full and free right and autharity to enter upon said land
to construct, install, maintain, operate and repair a gravel or paved trail and any and all
�ppurtenances, incidental and related tlaereto, (all of which are hereinafter refened to collectively
as the Improvements) at the cost of Grantee. The Grantee shall have the right to make use of said
land as is reasonably necessary and advisable to the construction, installation, rnaintenance,
operation and repair of the Izx�provements.
In addition to any other remedy the Grantee may have, the covenants and
restrictions contained herein may be enforced by injunction.
Grantor cavenants that it is in fee title to the above property, has a iawful right and
authority to convey and grant this easement, and that the land is free from all encumbrances.
Grrantee agrees that the improved surface of any trial within the easement will not exceed S
feet in width and agrees that any improved txail wi�Ehin the easement �will be constructed
contemporaneously with the installation of bollards and signage prohibiting non-pedestrian use of
the easement. Said signage, trail, easement area and lnollards to be maintaa.ned by the Cxrantee.
