WHEREAS, JerryNelson (hereinafter "theapplicant") isowner •3
of the prooerty located at E565 Dunwoody Avenue within the City of Orona �
(hereinafter "City") and legally described as follows: �
� Lot 11, Block 8, Townsite of Langdon Park, and that part of Lot �i
12, Block 8, Townsite of Langdon Park lying nozthwesterly of a
line described as beginning at a point in the northeasterly
line of Lot 12 distant 39.5 feet southeast from the most
northerly corner of said Lot 12; thence southwesterly
parallel with the northwesterly line of Lot 12 a distance of
lP8 feet; thence deflect right 6 degrees 35 minutes a distance
of i�77 feet more or less to the shore line and said line thezeby
terminating; and ..
WHEREAS, the applicant has applied to the City for a variance
to Municipal 2oning Code Section 10.22, Subdivision 2 to permit the
construction of a deck which will increase the hardcover in the 75-250' �
setback zone from 6,898 square feet (or 248) to 8,044 s�uare feet !or
29$) where only 7,018 square feet (or 258) is allowed.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:

on September 17. 1984, and recommended approval of the
proposed variance based upon the fol2owing findings: `

4. The City Cou,�cil has considered this application
including the findings and recommendations of the Planning
Commission, reports by City staff, comments by the applicant
and the effect of the proposed variance on the health, safety
and welfare of the community. '='

5. The City Council finds that the conditions existing on �
�his proYerty arQ pecnliar ta�t and do not apply general3y to
other property in this zoning distzict; that grantir.c; the
variance would not adversely affect traffic conditions,
light, air nor pose a fire hazard or other danger to �
j neighboring property; would not merely serve as a �
convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicant; and
would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby
grants a variance to the Municipal Zoning Code Section I0.22,
t Subdivision 2 to permit the constzuction of a deck which will increase
hardcover in the 75-250' setback zone from 6,898 square feet (or 248) to
8,044 square feet or (298) whe��: only 7,018 square feet t258) is
allowed, subject to the following conditions:
1. The hardcover allowed by this variance is in excess of
�� '=# D� �;,�; the 25 percent allowed in the 75-250' foot setback zone. The
�-�r.-; ,�'� ';.,;, apolicant is hereby advised that the City will not apptove
�'� -� iu�`�r any f uture improvements that result in ac'ditional

2. Authorities granted �y this variance run with the
property not with the applicant, but are permissive only and
must be exercised by 3pplication for a building permit within
one year of the date of Council approval, or this variance
