A RESOLUTION GRANTING A VARIANCE
TO MUNICIPAL ZONING CODE
SECTION 10.56, SUBDIVISION 16 (C)(1),
SECTION 10.56, SUBDIVISION 16 (C)(6),
SECTION 10.56, SUBDIVISION 16 (L)(1);
FILE NO. O1-2709
WHEREAS,Richard R. Shull and Anne M. Shull (hereinafter"the applicants")are
the owners of the property located at 228� French Lake Road within the City of Orono(hereinafter
"the City") and legally described as follows:
Lot 4, Block 1, and Outlot C, Johnston's French Lake Second Addition, Hennepin
County, Minnesota (hereinafter"the property"); and
VVHEREAS, the applicants have applied to the City for a variance to Municipal
Zoning Code Section 10.56, Subdivision 16 (C)(1) to permit structure within 150' of a Natural
Environment Lake, Section 10.56, Subdivision 16(L)(1)to permit 3,622 s.f. (22.25%)of hardcover
in 0-75' setback area where 4,381 s.£ (26.9%) exists and 0 s.£ (0%) is allowed and Section 10.56,
Subdivision 16(C)(6)to permit the encroachment of 50' and 75' into the average lakeshore setback
for construction of a t�vo stall garage to the east end of the residence and a new entryway over
existing steps.
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Ciry of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on September 17, 2001,at which time all persons desiring to be
heard concerning this application were given the opportunity to speak thereon.
1�TOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#01-2709.

2. The property is located in the RR-1B, Single Family Rural Residential Zoning
District, where 2 acres is the minimum lot area. The property consists of
approximately 1.5 acres.
3. The Orono Planning Commission revie�ved this application on September 17, 2001
and recommended approval by a vote of 7 to 0.
4. The Planning Commission made the following findin�s of fact:
A. The 150'Natural Environment lake setback was adopted after the residence
was built.
B. Hardcover in the 0-75 setback zone�vill decrease to 3,622 s.f.(22.2�%)from
4,381 s.f. (26.9%). .
C. The structural coveraae on the property will be 4.9%, belo�v the allowed
15%. y
D. Encroachment into the avera�e lakeshore setback will not adversely affect
the neighboring property views.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zonina district; that granting
the variance will not adversely affect traffic conditions, light, air, nor pose a fire
hazard or other danger to neighboring property; would not merel�� serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable hardship
or difficulty; is necessary to preserve a substantial property right of the applicant;
and would be in keepin� with the spirit and intent of the Zonin� Code and
Comprehensive Plan of the City.
6. The City Council has considered this application includin� the findings and
recommendations of the Plannin�Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variance on the health, safety and
welfare of the community.

CONCLUSIONS, ORDER, AlrrD CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
variance to Municipal Zonin?Code Section 10.56, Subdivision 16(C)(1)to permit structure within
1�0' of a Natural Environment Lake, Section 10.56, Subdivision 16(L)(1) to permit 3,622 s.f.
(2?2�%) of hardcover in 0-75' setback area where 4,381 s.f. (26.9%) eYists and 0 s.£ (0%) is
allowed and Section 10.56, Subdivision 16(C)(6)to permit the encroachment of 50' and 7S into the
avera�e lakeshore setback for construction of a two stall gara�e to the east end of the residence and
a new entryway over existina steps. Approval is subject to the followin� conditions:
1. Council approval is based on the site plan submitted by the applicants attached to this
resolution as Exhibit A. Any amendments to the site plan may require further
Planning Commission and City Council review.
2. Authorities granted by this variance run �vith the property not �vith the applicants,
but are permissive only and must be exercised by application for a building permit
«-ithin one year of the date of Council approval, or this variance will expire on that
date (September 24, 2002).
;. Violation of or non-compliance with any of the terms and conditions of this
variance shall constitute a violation of the zoning code,shall automatically terminate
any authority granted herein, and shall be punishable as a misdemeanor.
�. The undersi�ned applicants have read, understood and hereby a�ree to the terms of
this resolution and on behalf of themselves, their heirs, successors and assians,
hereby a�rees to the recording of this resolution in the Chain of Title of the property.
Adopted by the City Council of the City or Orono, 1�linnesota at a regular meetino held on
the 2=4th day of September, 2001.
