The French Creek Homeowners Association has requested to install a 1,650 gallon holding tank
on a commonly owned private recreation lot that was created within the Plat of French Creek.
Installation of ho(ding tanks in the City requires Council approval. The recreation lot contains 2
tennis courts and an enclosed gazebo building. The gazebo was initially plumbed for installation
of a toilet and sink when the building was constructed in 1986.
The common lot is located at the south end of the French Creek neighborhood. The Committee
Chair, Mr. Miller, has stated he is the nearest neighbor to the building and on behalf of the
Homeowners Association recognizes the need to provide bathroom facilities on the property. The
lots located at the north end of French Creek are located about 1000' from the tennis court lot.
French Creek has proposed to install a holding tank rather than a septic system for several
reasons. A comp(ete septic system including tanks and a drainfield site may not be necessary to
handle the anticipated use of the building as it is only intended to be one toilet and one shower.
The building is not heated and the plumbing use of the lot would be from April 15 —October 15.
Locating a drainfield site may be difficult due to limited undisturbed land available on the site.
Matt Bolterman, On-Site Systems Manager for the City, has no objection to the use of a holding
tank based on the anticipated limited use of the gazebo building. Mr. Bolterman did recommend
the neighborhood have the tank monitored and pumped regularly.
COUNCIL ACTION REQUESTED
Motion to adopt the attached resolution approving installation of a 1,650 gallon holding tank on
Outlot A, French Creek for seasonal use with one toilet and one sink.

A RESOLUTION APPROVING INSTALLATION
OF A HOLDING TANK FOR OUTLOT A,
FRENCH CREEK
WHEREAS, the French Creek Homeowners Association has requested to install a
1,650 gallon holding tank on Outlot A, French Creek; and
�WHEREAS, Outlot A was created as common recreation lot containing two tennis
courts and an enclosed gazebo building; and
WHEREAS, Municipal Code Section 12.30,Subdivision E requires all new holding
tank installations to be reviewed by the City Council; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota that the request to install one 1,650 gallon holding tank on Outlot A,French Creek for use
with one toilet and one sink is hereby approved subject to the following conditions:
A. The holding tank is subject to all ISTS standards as specified in the Municipal Code.
B. The undersigned owners have read,understand and hereby agree to the terms of this
resolution and on behalf of the French Creek Homeowners Association, their heirs,
successors and assigns, hereby agree to the recording of this resolution in the Chain
of Title of the property.
Adopted by the City Council of the City of Orono, Minnesota at a regular meeting
held on the 13th day of May, 2002.

Dear Mr. Weinberger:
On behalf of the French Creek Homeowners Association (FCHOA), I am requesting the
city's approval to install a holding tank within the FCHOA commons which contains
two tennis courts and a tennis gazebo structure. The gazebo structure was designed and
is plumbed for a sink and toilet which were never installed. At our last FCHOA board
meeting we approved the completion of the sink and toilet installation and septic
hookup. It was always our intention to utilize a holding tank system which we h�ve
now planned out and are ready to install with the proper permit.
Please be aware that this is a seasonal toilet (April 15-October 15) and is only used
occasionally (10-15 times per season). Our consultants have recommended a 1,650
gallon tank which would be adequate for one or more seasons. Most likely, the tank
would be pumped out at the end of each season.
Your act�ntion to this matter is most appreciated, and we would hope to get this
approval as soon as practical. It is my understanding that the City Council meets on
May 13`t', which would be okay, but if this could be approved sooner "administratively,"
