Recitals �. A building permit application has been filed for a swimming pool located at 1300 French Cre� rive the("Subject Property"),Iegally described as Lot 7. Block 2, French Creek,City of Orono, Nennepin Cour linnesota. 2. Owners request the City to review this application. 3. The City wiil commence its review of the application and incur costs associated with said reviE �ly if the Owner establishes an escrow to ensure reimbursement to the City of its costs. OW THEREFORE,THE PARTIES AGREE AS FOLLOWS: 7. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of ihis Escrc greement, the�wners shall deposit�2,500 with the City. Ail accrued interest, if any,shall be paid to the City �imburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW.The purpose of the escrow is to guarantee reimbursement to the C �r all out-of-pocket costs the City has incurred (nciuding planning, engineering, in excess of 5500, or lec �nsultant review} or will incur i� reviewing the plan. Eligible expenses shall be consistent with expenses ti �wners would be responsible for under' a building permit appiicatian. The escrow wii� also guarant� �imbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed �cordance with the Stormwater Poliution Prevention Pian and the provisions of Orono City Code Chapter i he financial security may also be used by the City to eliminate any hazardous conditions associated with tl ork and to repair any damage to public property or infrastructure that is caused by the work(inciuding plannir ngineering, or legal consuitant review) associated with buiiding permit #2012-00303 if compliance with tl pproved buiiding permit is not accomp{ished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City witi in tu �nd a bili to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owne �ceipt of bili. 4. DISBURSEMENT FROM ESCROW ACGOUNT. In the event thai the Owners do not make payme �the City within the timeframe outlined in#3 above,shail issue a Stop Work Order until the Owners pay ali expens voiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners �imburse the City for eligible expenses the City has incurred. 5. CLOSING ESCROW. The Baiance on deposit in the escrow, if any, shall be returned to t! �wners when the�eview has been compieted and written notification is received from the Owners requesting tl inds. 6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners.or if the eligible expens curred by the City exceed the amount i�escrow,the City shall have the right to certify the unpaid balance to ti abject property pursuant to Minn.Stat.§§415.01 and 356.012.
