A RESOLUTION GRA.NTTNG VARIANCES
TO MUNICIPAL ZONING CODE
SECTION 78-350(B), SECTION 78-1288
FILE NO. 06-3172
WHEREAS, Timothy R. Brady and Lyi1n A. Brady, husband and wife
(hereinafter "t11e applicauts") are the owners of the property located at 3555 Frederick
Street within the City of Orono (hereinafter the "City") and legally described as follows:
Lot 12, Blocic 2,Navan�e, Heiulepin County, Minnesota
(hereinafter the"property"); and
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-350 (b) to allow tlle
construction of au attached garage aiid a half stoiy over the existing l�ome 5.5' from the
side lot line where 10' is required and 5.5' currently exists; and
WHEREAS, the applicants have made application to the City of Oroilo
for a variance to Orono Municipal Zoning Code Section 78-1288 (b) to allow 2,816 s.f. or
35% hardcover within the 75'-250' setbacic zone where 25% is normally allowed and
2,485 s.f. or 30.9% currently exists, in conjunction with the addition of an attached
garage and half story addition.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Miiulesota:
FINDINGS
1. This application was reviewed as Zoning File #06-3172.
2. The property is located in the LR-1C One Family Lakeshore Residential
Zoning District which requires a minimum of 0.5 acre in area and a
minimtun lot width of 100'.
3. The Plaiu�ing Commission reviewed this application at a public hearing
held on February ?l, 2006 and Nlarch 20, 2006 and recommended

approval of 75'-250' zone hardcover and side setback variances based on
the follo�ving findings:
a. The property is 11,955 s.f. or 0.27 acre ii� area and has 50' in width at
the OHWL and at the 75' setback.
U. No additional land is available for acquisition by the applicanis to
inake the property confonning witli respect to the westem side
setbacic.
c. The property currently 11as a garage and driveway�accessing off of the
undeveloped Cannan St�eet right-of-way. It is in the interest of the
City to have the existing driveway abandoned and the right-of-way
restored. In order to do so the garage must be relocated off of
Frederick Street and an increase in hardcover is the necessary result.
d. The applicants have redesigned from a full story addition to a half
story addition to offset the impact of light and open space reduction
caused by the substandard setback of the existing home and new %a
stoiy addition,
e. "Shed donners" have been proposed for the west side of the home on
the '/z story to further minimize the mass of the building.
£ Due to the location of the home any additions or alterations to the west
side of the house require variances.
g. The applicants are proposing to remove portions of nonconfoi-ming
hardcover and structure and an illegally constructed boulder retaining
�vall within 75'of the OHWL in conjunction witlZ setback and
hardcover variance approvals.
h. The applicants have proposed to remove the existing gravel drive�vay
from Carn7an Street and will re-grade and re-vegetate the area with
grass.
4. The City Council has considered this application including the findin�s
and recommendation of the Plaruiing Commission, reports by City staff,

conunents by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the conununity.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic
conditions, light, air nor pose a fire hazard or other danger to neighboring
property; would not merely serve as a convenience to the applicants, bllt l5
necessary to alleviate a demonstrable hardsl�ip or difficulty; is necessary to
preserve a substantial property i-ight of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon oile or more of the above findings, the Orono City Council hereby
grants variances to Orono Mtmicipal Zoning Code Sections 78-350(b), and 78-1288(b) to
allow construction of an attached garage addition and a half story addition 5.5' from the
west side lot line, subject to the following conditions:
1. Council approval is based oil the site plan and house plans subinitted by the
applicants and annotated by City staff, attached to this Resolution as Exhibits A
and B. Any amendments to the site plan or home plans which are not in
confonnity witl� City codes will rec�uire fiu�ther Planning Commission and City
Council review.
2. Hardcover in the 0-75' zone shall not increase above the level or 0%. Hardcover
in the 75-25U' zone shall be limited to 2,816 s.f. or 35% per the proposed plan and
hardcover allowance summary as depicted on Exhibit A. Applicants are advised
that any future requests to inerease hardcover or change the nature of
existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concunent reduction in existing
hardcover.
3. Required removal of the retaining wall �vithin the 0-75' zone shall be completed
in COIl)llI1Ct1011 with the removal of the retaining wal]s and re-grading and
restoration of the Camzan Street right-of-way to grass and prior to the f rst
inspection for the home additions.

4. Authorities granted by this resolution nin with the property not witlz ihe
applicauts, but are gernzissive only and must be eYercised by obtaining a building
permit for the new constnictioiz within one year of the date of Council approval,
or the variance will expire on that date (March 27, 2007).
5. Violation of or non-compliance with any of the teilns and conditions of this
resolution shall constitute a violation of the zoning code, shall autoinatically
ternlinate any authority granted herein, aud sl�all be punishable as a misdemeanor.
6. The undersigned applicants have read, understand and hereby agree to the tenns
of this resolution and on Uehalf of the applicants and the applicants' heirs,
successors and assigns, hereby agree to the recording of this resolution in the
chain of title of the property.
