A RESOLUTION
GRANTING A VARIANCE TO
MUNICIPAL ZONING CODE
SECTION 78-1279(6)
FILE NO. 11-3522
WHEREAS, Nancy R. Bigos, a single person (hereinafter "the Applicant") is the
owner of the property located at 3350 Fox Street within the City of Orono (hereinafter the
"City") and legally described as follows: Lot 4, Block 1, Fullerton Estates, Hennepin County,
Minnesota (hereinafter the "Property"); and
WHEREAS, the Applicant has made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction of an
addition to the existing home partially ahead of the average lakeshore setback; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held
a public hearing on August 15, 2011 at which times all persons desiring to be heard concerning
this application were given the opportunity to speak thereon.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File ll-3522.
2. The property is located in the LR-lA One Family Lakeshore Residential Zoning
District which requires a minimum lot area of 2.0 acres and a minimum lot width
of 200'.
3. The Planning Commission reviewed this application at a public hearing held on
August 15, 2011 and recommended approval of the variance based on the
following findings:
a. The property contains 312,361 square feet in area and has �600-feet in width.

b. The Applicant's home was constructed in approximately 1920 and priar to the
construction of the homes on the adjacent lots.
c. The Applicant's request will not alter the essential character of the
neighborhood and will result in minimal ne�ative impact on adjacent
properties.
d. The proposed addition to the east - :�rtion of the Applicant's home is
completely screened by the existin� home from the property to the west.
Ample ve`etative screenina exists betv✓e�n the Applicant's property and the
property to the east makinQ the addition ciifficult to see.
e. The Applicant's proposed addition will not adversely impact views of the lake
currently enjoyed by the adjacent properties.
f. The expansion of the existin� home will result in minimal additional massing
of the house.
g. The Applicant's request is in harmony with the purpose and intent of the
ordinan�e.
h. The Applicant has demonstrated that enforcin� the averaae lalceshore setback
provision of the Zoninj Ordinance deprives the Applicant of the reasonable
use of.their property.
4. The City Council has considered this application including the findin�s and
recommendation oi the Planninb Commission, reports by City stafi, comments by
the applicant and the public, and the effect of the proposed variance on the health,
safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that �rantin�
the variance would not adversel_y affect traffic conditions, Iignt, air nar pose a fire
hazard or other danyer to nei�hboring property; would not merelv serve as a
convenience to the Applicant, but is necessary to alleviate a practical difficulty; is
necessary to preserve a substantial property right of the Applicant; and would be
in keepin� with the spirit and intent of the Zonin� Code and Comprehensive Plan
of the Citv.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findin�s, the Orono City Council hereby �rants a
variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction of an
addition to the existing home 11 feet ahead of the average lakeshore setback line, subject to the
following conditions:
l. Council approval is based on the survey and building plans submitted by the Applicant
and annotated by City staff, attached to this Resolution as Exhibits A R. B. Anv
amendments to the site plan which are not in conformity with City codes will requir�
further Plannin� Commission and City Council review.
2. Proposed hardcover levels are conforming and no hardcover variances are �ranted.
3. The building plans submitted for building permit will be reviewed to ensure compliance
with the City's buildin�hei�ht and number of stories re�ulations.
4. Authorities granted by this resolution run with the property not with the Applicant, but
are permissive only and must be exercised by obtaining a building permit for the new
construction and commencing consh-uction of said project. A framin� inspection must be
completed within one year of the date of Council approval, or the variance will expire on
that date (Au�ust 22, 2012).
�. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
6. The undersigned Applicant has read, understands and hereby agrees to the terms of this
resolution and on behalf of the Applicant and the Applicant's heirs, successors and
assin s, hereby agrees to the recording of this resolution in the chain of title of the
Property.
