In an April 3, 2013 letter to you, I indicated we believe there are many projects started and/or
completed without proper permits at this property. A copy of this letter is enclosed. Please complete
the enclosed Zoning Permit Application listing each land alteration and/or hardcover change which has
been started and/or been completed since the time of the original permit in 2011. The Zoning Permit
fee is $50; however, as work has been done without a permit an after-the-fact or double fee will be
imposed.

For future reference, when working in Orono a permit is required for any amount of earth movement
on, off or around a property. Outside of the 75-foot setback from Lake Minnetonka a property owner
can apply for and get a staff-issued permit to move 0 to 500 cubic yards. More than 500 cubic yards
requires a Conditional Use Permit which must be approved by the City Council. Within 75 feet of the
lake a property owner may get a staff-issued permit to disturb, move, fill, etc up to 10 cubic yards; more
than that requires a CUP from the City Council. There should always be erosion control materials
(fencing, bio-logs, etc) protecting the site if there is potential for storm water to run sediment off site.
Lastly, after further review of the approved variance, since a pool permit was issued and work has
begun, a building permit for the cabana can be applied for without renewing the variance. However, if
only the foundation is being constructed this year, a new permit will need to be issued next year for the
construction of the building of the cabana.

As you are aware, on March 11, 2013 the Orono City Council approved a variance to allow the proposed pool to
encroach into the average lakeshore setback as well as granted a CUP to permit fuli bathroom facilities in the
proposed pool cabana. At this time I am preparing to issue two permits: in-ground swimming pool and pool
cabana. The property owner, Nancy Bigos, must sign the approval resolution which is on file at City Hall prior to
issuance of permits. Before I issue the permit for the pool cabana, I require some clarification. The building
permit application submitted notes that the permit request is for the foundation only. Is this still the intent? Or
are you planning on constructing the pool cabana structure also at this time?
Additionally, the survey dated 10/11/12 submitted with the permit application for the entrance monuments
(permit #2012-00976) reflected a number of "proposed changes", i.e. driveway modifications, retaining walls,
etc. For this reason, Staff noted on the survey that the approval granted by this permit was for the entrance
monuments ONLY. In preparation for issuing the currently requested permits, I reviewed the most recent
survey (1/23/2013) and it again appears that there are a number of patios, driveway, sidewalks, stairs and other
landscape features which do not appear on the previous surveys; are labeled "proposed" or have been modified
in some way from previous surveys on file. All landscape work including minor grading (0 to 500 cubic yards) or
new/replacement hardcover installation requires approval by the City via a Zoning Permit. While I do not
believe hardcover limitations have been exceeded, the City must have record of and approve these types of
activities. Attached is a Zoning Permit application form. Please comp►ete the application and note all of the
land alterations and hardcover changes which have been completed and are proposed since the time of the
original permit for the home addition in 2011 so the City's records can be updated. The Zoning Permit fee is
$50; as work has been done without a permit an after-the-fact fee or double fee will be imposed.

Sorry for the delay in response... We received the as-built survey for 3350 Fox Street, dated 10-11-12. Since
the pool and cabana permits have not been issued, those projects should be removed from the as-built survey.
We would prefer the as-built survey reflect the site as it currently exists; please remove the future stuff.
Do you know the timing for making their variance application for the pool? The deadline for January was today
at noon. Also, we were told the existing pool shown as "to be removed" was going to be removed. Is this still
their intent?
