� Sec.13.04 RIGHTS OF SUBJEC'I'S OF DATA
Subd.1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. [nformation required to be given individual.An individual asked to supply private or confidential data concerning himself shall be
informed of. (a)the purpose and intended use ofthe requested data within the collecting state agency,political subdivision,or statewide system;(b)
whether he may refuse or is legaliy required to supply the requested data;(c)any known consequence arising from his suppiying or refusing to supply
private or confidential data;and(d)the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall
not apply when an individual is asked to supply investigative data,pursuant to section 13.82,subdivision 5,to a law enforcement officer.
The commissioner of revenue maYplace the notice required under this subdivision in the individual income taac or propertv tas refund
instructions instead of on those forms.
Subd.3. Access to data by individuaL Upon request to a responsible authority,an individual shal I be informed whether he is the subject of
stored data on individuals,and whether it is classified as public,pnvate or confidential. Upon his further request,an individual who is the subject of
stored private or public data on individuals shall be shown the data without any charge to him and,if he desires,shall be informed of the content a�d
meaning of that data. After an individual has been shown the private data and informed of its meaning the data need not be disclosed to him for six
months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The
responsible authoriry shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority
may require the requesting person to pay the actual costs of making,certifying,and compiling the copies.
The responsible authority shall comply immediately,if possible,with any request made pwsuant to this subdivision,or within five days of
the date of the request,excluding Saturdays,Sundays and Iegal holidays,if immediate compliance is not possible. If he cannot comply with the request
within that time,he shall so inform the individual,and may have an additional five days within which to comply with the request,excluding Saturdays,
Sundays and legal holidays.
Subd.4. Procedure when data is not accurate or complete.M individual may contest the accuracy or completeness of public or private data
conceming himself. To exercise this right,an individual shall notify in wnting the responsible authoriry describing the nature of the disageement.The
responsible authority shall within 30 days either (a)correct the data found to be inaccurate or incomplete and attempt to notify past recipients of
inaccurate or incomplete data,including recipients named by the individual;or(b)notify the individual that he believes the data to be correct. Data in
dispute shall be disclosed onty if the individual's statement of disagreement is included with the disclosed data.
The determination of the responsible authoriry may be appealed pursuant to the provisions of the administrative procedure act relating to
contested cases.

The City is in receipt of a building permit application for the above noted address. At
this time the City is not able to complete a review until the following materials are
submitted:
• A grading plan showing existing and pro�osed contours in 2' intervals for the
entire property and 50' beyond all property boundaries. The submitted plan only
shows existing grades.
� City maps show "preserve" wetland on the property requiring completion of a
wetland delineation. This information must be submitted for City review and the
delineated boundary should be shown on the survey, so that appropriate setback
requirements and conformance with applicable codes can be confinned.
Submittal of a watershed district pernlit is also required to verify the
buffer/setback requirements that they will impose.
• Septic plans for primary and alternate 5-bedroom sites must be submitted for
review by the City's Septic Inspector.
• The pool sho�vn on the submitted plan does not ineet the average lakeshore
setbacic requirement of Section 78-1279 (6). In order for the pool to be approved
with this permit application, it must be revised to meet the average lalceshore
setback standard or removed froin this application and pursued at a later date with
a revised location and/or approval of a variance.
� Review of the house plans, absent a arading plan, indicates that the building
height exceeds 30' per Section 78-1 defifiitzon of ba�ildirig height, and associated

location appears to be 954' with the top of foundation proposed at 956.5. When
measuring from existing grade, 954', to the midpoint between the top of window
of top of peak of the highest gable, the total height is 34'. The grading plan
and/or the house plans should be revised so as not to exceed 30' is total defined
height.
• Hardcover calculation worksheets must be submitted for the entire property to
ensure hardcover standards of Section 78-1288 are in compliance.
• The International Residential Building Code, Section R-310-1, requires
emergency escape and rescue windows in basements with habitable space. The
sport court is considered a habitable space and must be provided with an egress
window. Please revise the building plans accordingly.
As of today's date the building permit application for 3320 Fox Street is incomplete. The
City Council has recently adopted a new Wetland Ordinance which will become effective
following a September 3rd publication in the local newspapers, which potentially impacts
the development of this lot. In order to not be subject to new wetland regulations a
complete building permit application must be submitted prior to the publication of the

Sec. 78-1.Definitions.
Building height means the vertical distance between the highest adjoii�ing ground level at
the building or ten feet above the lowest ground level, whichever is lower, and the top of the
cornice of a flat roof, or the deck line of a mansard roof, or the uppermost point on a round or
other arch-type roof, or the median height of the highest gable of a pitched or hipped roof.
Topographic changes which elevate the adjoining ground level above the eaisting terrain shall not
be considered in determining buildin�heigllt. For a pitclled or hipped roof situation, regardless
whether the highest living space in a building is a half-story or full story, if the highest living
space contains windows(excluding skylights)the upper measurinb point for defining building
height shall be the median height of the top of the highest window and the highest peak of the
roof.
Sec. 78-30�. Area, height,lot width and yard requirements.
(a) Height. No structure or building in the LR-lA district shall exceed 2 1/2 stories
and shall not e�ceed 30 feet in height except as provided in section 78-1366.

(6) Average lakeshore setback. No principal or accessory structure shall be located closer to
the lakeshore than the average distance from the shoreline of existing residence
buildings on adjacent lots; except that this does not apply to stairways, lifts,
landings and IockboYes. Further,the average lakeshore setback shall apply only
to classified lakes and shall not apply to tributaries. The avera�e lakeshore
setback line shall be a strai�ht line connectin�the most lakeward protrusions of
the residence buildin�s on the immediately adjacent lakeshore lots.
a. In instances where the averaae lakeshore setback can not be met,
administrative approval may be granted at the discretion of the planning
director provided no lake views of an adjacent lakeshore lot are
obstructed and adjacent neighbors provide written approval.
Sec. 7�-1288. Hard cover limitations.
(a) No hard cover or impervious surface shall be placed, located or constructed
�vithin 75 feet of the ordinary high water level of any lake or tributary, eYcept for stairways, lifts,
landings and lockboYes as regulated elsewhere in this Code.
(b} Betwee�: 75 feet and 250 feet of the OHWL, there shall be no �reater than 2�
percent hard cover. Between 250 feet and 500 feet of the OHWL there shall be no greater than 30
percent hardcover. Between �00 feet and 1,000 feet of the OHWL there shall be no greater than
35 percent hardcover.
