1. The new wetland ordinance was adopted Monday 8-22; it wiil be published and become effective as of
September 3. Complete applications submitted prior to September 3 will not be subject to the new
ordinance. The new ordinance will require buffer widths based on the Functional Assessment of
Wetlands based on data from the MCWD. The wetland mapped by MCWD at 3320 Fox is a "Preserve"
category, requiring a 50' buffer and a 20' building setback from the buffer. Your application for 3320 Fox
Street is incomplete; it was reviewed at our staff meeting this morning, and Janice Gundlach will be
sending you a letter shortly describing the areas in which it is incomplete. Briefly, however, the lack of a
grading plan and the lack of a wetland delineation report or indication of wetland boundaries in the
survey, are a key feature of its incompleteness.
2. As noted above, there is a timing gap at the moment, but until your application is complete, it is not a valid
application, so you need to get all required information to us ASAP to avoid being subject to the ordinance.
Additionally, given that this still falls under MCWD rules, we need to know how MCWD will treat the
wetland and what buffer they will require, before we can rule on the house location, etc.
3. You should deal directly with Public Services Director Greg Gappa (952-249-4621) on the Creekside
utilities issues.
I will be out of town from 3 pm today until Tuesday, September 6. Therefore, additional questions should be
directed to Janice or Melanie in my absence.

1. What is the impact of the 20' buffer ordinance passing relative to the 3320 Fox St permit?
2. Do we fall in any kind of gap to grandfather prior to the ordinance, etc?
3. Creekside: who is handling the joint utility maintenance agreement with Long Lake? Long Lake
won't allow me to start the work on Apple Glen Road, until the "city-wide" agreement(at least in
draft form) is agreed upon by the cities.
