On April 20`h, John Smyth of Bonestroo and I inspected your property for compliance
with the City's Wetland Ordinance and approved plans on file. A memo was provided to
Mr. Rick Carlson and Mr. Ken Heyda of Water Street Homes LLC detailing the findings
of that inspection. I have attached this memo for your information.
Mr. Smyth and I will be conducting a re-inspection of your property for compliance with
the City's Wetland regulations and the approved plans on or about June 1, 2007. Please

Re: Wetland Ordinance Compliance
Remarks:
A compliance check at 3320 Fox Street was completed on April 20, 2007 to determine what progress had
been made, and to assess any remaining issues that may keep the site from being in compliance with the
city's ordinance.
The following is a summary of the issues that still exist with the construction, and the requirements
per the Wetland Protection Ordinance to be in compliance (per approved plan):
1. Buffer Vegetation and Drainage Improvements
❖ It appears that the buffer may not be to the extent shown on the approved plan and other
improvements that were part of the approved plan have not been completed or finalized. The
applicant should provide the City a CADD drawing (In County Coordinates) of proposed buffer
and plantings so a Global Position System can be used to verify the extent of the buffer and
locate other water quality improvements (see photos at end of inemo).
: A portion of a wetland swale that follows from north to south has been graded. This was
supposed to be left intact and is a potential wetland violation. The area of the historic wetland
will need to be re-established. At a minimal we will need the wetland area seeded with a
wetland seed mix and have blanket installed to protect the area from erosion during plant
establishment (see photos at end of inemo).

❖ Silt fence has been knocked down in an area adjacent to the wetland near the house on the
east side and should be re-established to protect the wetland from sedimentation (see Photos at
end of inemo).

Graded wetland area needs to be seeded and blanketed along with area of future buffer. No
temporary erosion control in place such as mulch or cover crop so area should be seeded in the
spring fo minimize sediment movement toward the lake.

Remarks:
A follow-up compliance check for 3320 Fox Street was completed on October 17,2007 to
determine if the CO can be granted to the property owner.
The buffer currently contains dense vegetation and is acceptable under the wetland ordinance.
The rainwater garden has been installed at the discharge point of the drainage swale. The
rainwater garden is currently functioning more like a wetland treatment system due to the clay
soils reducing infiltration rates. In this case it appears to be providing the water quality
treatment intended. Photo documentation of the buffer and rainwater garden is provided on
the following pages.
The CO can be granted for the property. The homeowner should be made aware that there are
some small spots of thistle that occur within the buffer that should be treated before they
become a nuisance. There are also a number of maintenance activities that could occur in the
buffer to support the development of native vegetation and enhance the appearance and
function of the buffer. The homeowner can contact me at(651)604-4708 for more details
regarding maintenance and enhancement opportunities.
