The building plans show the proposed grade at the door would be just inches below the door threshold, requiring only a minimal landing and no stairway. The survey suggests the final grade at that door would be approximately 1.5 feet below the threshold,which would have required a landing and a few steps. The photo you sent shows that the final grade will be at least three feet below the threshold, requiring a landing and more steps.These are significant discrepancies considering the impact on your hardcover of adding a landing and stairway where none was originally proposed. A stairway for a service door is considered as a non-encroachment in a side yard (zoning code Section 78-1405) if it doesn't extend above the main floor level.This stairway would have to be tucked in alongside the garage, steps heading toward the lake, at the minimum size allowed by Building Code. The landing and stairway system would have to be counted in your hardcover; based on the 79 s.f. excess hardcover,you would have 21 s.f. to play with and it would also have to be permeable below it. An option is to eliminate the garage service door altogether. You should discuss the footing requirements with Building Official Roger Peitso. The height of the window well as shown in the picture was a bit disconcerting given how high it was compared to the neighbor's yard only 6 feet away. It is his understanding and our understanding that the proposed rain garden design/plan eliminates the need for us to have a permeable paver patio. Can you please verify that this is correct? Would a solid patio with a rain garden eliminate the solid patio from our hardcover calculations? Also, during his meeting with you, he mentioned to me this evening that he discussed our garage service door stairs. We need a set of exterior steps to get down to grade. Our conclusions are as follows: 1. As of Monday (March 13) the Council revised the lot coverage ordinance to allow 20%structural coverage and eliminate open decks from the calculation. Therefore your structural coverage as calculated at 17.8% (with the deck) last year, is no longer an issue. 2. Based on your lot area of 11,780 s.f. your standard hardcover allotment is 25% or 2,945 s.f. Then, per Code Section 78-1684(5), "the first 100 square feet of pervious paver patios/walkways or the first 100 square feet of deck with a minimum one-fourth inch spacing between boards and a pervious surface below" is excluded (see the attached code section and definitions). We have been interpreting and enforcing this to mean that you get your 25% hardcover plus 100 square feet of deck/patio that meets the required permeability criteria. 3. Based on your statement that currently without the deck your hardcover is at 2784 s.f. (or 161 s.f. below the 25% limit) you could add a 240 s.f. deck which would put your hardcover at 3024 s.f., but because you are functionally allowed 3045 s.f. (2945 +100), you would still be below the maximum and no variance would be required. 4. Your building permit application for the deck would have to specify the %" or greater spacing of boards, and we would require an engineered paver system design that meets City Engineer approval to be considered as a legitimate long-term pervious surface. It's more complicated than simply laying down paver blocks with spaces between them. Let me know if you have further questions.
