MINUTES FOR MAY 139 1996

The Orono Board of Review met on the above date with the following members present:
Mayor Edward Callahan, Jr., Council Members J. Diann Goetten, Gabriel Jabbour, and
Charles Kelley. JoEllen Hurr was absent. The following represented City Staff: City
Administrator Ron Moorse, City Assessors Rolf Erickson and David Wilde, and
Recorder Sherry Frost. The meeting was called to order by Mayor Callahan at 6:30 p.m.

Public response was gathered prior to Council action.
Curt Quady, 1223 Brown Road South, PID #10- 117 -23 31 0065, property listed on page
2 of the Assessor's report, was present and informed of no change in his property's
valuation. Quady said he received the form letter on this date, May 13. He had no
additional comments from those previously made regarding the improvements necessary
to bring his property up to the value stipulated by the Assessor to satisfy that amount.
Callahan moved, Jabbour seconded, to accept the 1997 assessed value of $104,000.
Vote: Ayes 4, Nays 0.
• Mr. Quady said he would take the next step and bring the issue up to the Hennepin
County Board of Appeals.
Katherine Kalweit, 4265 Forest Lake Drive, PID #07- 117 -23 12 0016, property listed on
page 15 of the Assessor's report, was present. Letters from Mr. & Mrs. Kalweit were
distributed prior to the start of the meeting in regards to their current assessment.
Goetten asked Kalweit if she has heard from Staff regarding the concerns brought
forward at the last Board of Review meeting. Kalweit said she had not. Moorse
responded that he had not contacted the Kalweit's but has discussed the matter with the
City Engineer and Public Works Director. No conclusion has been made on what action
to take, but Moorse said he will pursue the matter.
Kalweit asked the Council on what they based their evaluation regarding acceptance of
the Assessor's valuation of their property. Jabbour informed her that no decision has
been made. Callahan clarified that the letter received by Kalweit from the Assessor states
the Assessor stands by his original valuation. Goetten noted that Kalweit did deserve a
response to her questions.

Kalweit asked if the valuation included the tuck -under garage. She commented that the
woman who conducted the exterior assessment noted a "new" tuck -under garage, but
Kalweit explained that the garage was built 27 years ago. Erickson informed Kalweit
that they have never been charged for the garage in their property taxes, and the garage
was "new" to their records. He added that the value of the garage was only a small
portion of the valuation at about $1,200 to $1,400. Erickson reported that if the garage
was recently built, it would be noted as an improvement to the property on their
statement.
Jabbour commented on the limits of the substandard lot, the navigational problems, and
the less than pristine lakeshore, which brings the value of the property down from other
properties nearby.
Callahan asked Kalweit what she believed the property was worth. Kalweit said the
property's valuation should be the same as last year's value; though, she conceded that the
tuck -under garage not previously included should be taken into consideration. Kalweit
said it was not reasonable to increase the value of the property due to the condition of the
lakeshore and noted the probable difficulty in selling the property in its present condition.
Jabbour advised Kalweit that any known problems would have to be made known if the
property was being sold.
Jabbour moved, Goetten seconded, to recommend the value of the property remain at •
$240,000, which is the current valuation, due to the storm sewer problem.
Kelley noted that the proposed increase was $18,000. This followed a valuation of
$239,000 in 1995 and $240,000 in 1996. Kelley said he believed there should be some
increase in value shown in the lakeshore property even with the problems listed.
Jabbour said the storm sewer problem could possibly cause the loss of lakeshore with the
presence of the sediment. He noted the channel had been cleared by the DNR, but he
personally was unable to navigate it at last attempt.
Kelley said the back up of sewage from loss of electricity could happen elsewhere in
Orono.
Callahan agreed that it is likely that the property has appreciated somewhat and
recommended amending the valuation to $245,000 for 1997, which is a reduction from
the proposed valuation of $258,000. Kelley seconded the amended motion. Vote: Ayes
4, Nays 0.
Kelley informed Kalweit that if the City makes corrections to the storm water problem,
she would see a drastic increase in the value of her property. •

Jabbour commented that with the need to remove the sediment, the value should have
decreased. He informed Kalweit that she had the option to go to the Hennepin County
Board of Appeals.
Kalweit said it was her desire to call attention to the problems not being addressed.
Goetten said Moorse will address those problems.
Callahan asked for and received no additional public comments. He asked if the Board
had reviewed the final recommendations. All members agreed to the affirmative.
When asked for further comments, Goetten noted her appreciation of a reduction in value
of a Navarre property.
Callahan moved, Jabbour seconded, to deny the appeals and accept the recommendations
included in the Assessor's Report except as noted above regarding the Kalweit property.
Erickson said he has received three additional letters from property owners requesting to
go before the Board of Appeals. They are as follows: 1) Robert Owens, 1700 Bohns
Point Road, PID #16- 117 -23 22 0003; 2) Doug Johnson, 1355 Shoreline Drive, PID
#02- 117 -23 34 0012; and 3) Phillip Otto, 4116 Highwood Road, PID 907- 117 -23 44
0087. Erickson said he reviewed the properties and sent appropriate letters,
Jabbour commented on the valuation of the property owned by Mur Senn, listed on page
10 of the report. He noted the limitations to the lot. Erickson said in his opinion the
property is a bargain at that price. Erickson said at $137,000, the property is horribly
undervalued. He noted entry level lakeshore property is valued at least $100,000.
Jabbour said the increase was large, but Erickson said it was a fair price.
Vote: Ayes 4, Nays 0.
Jabbour asked if anything was being done with the problems occurring in the
neighborhood of the Lorence property. Moorse said he is meeting with the building
inspector and acting police chief to see what can be done. It was noted that a neighbor is
illegally renting boat slips. Callahan remarked that possibly legal action should be
pursued. Erickson noted that a property can be assessed by its use regardless of the
zoning district in which it is located. Jabbour said the neighboring property is being used
as a location for pArties, and the 4 boats are blocking the channel.
Jabbour asked Cheswick to consider the use of radar to track the speed in the area of
Forest Lake and North West Arm. Cheswick said he would check into the possibility.
